&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el presente procedimiento ORDINARIO 641/11&amp;nbsp; seguido a instancia de&amp;nbsp; ESTACION DE SERVICIO JENA, S.L. frente a&amp;nbsp; CONSTRUCCIONES PITIUSAS FONT, S.L. se ha dictado sentencia, cuyo ENCABEZAMIENTO Y FALLO SON del tenor literal siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ENCABEZAMIENTO:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En Ibiza, a uno de febrero de dos mil trece&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Vistos por mí, Doña Montserrat Molina Pla, Juez del Juzgado de Primera Instancia nº 2 de Ibiza, los presentes autos sobre juicio ordinario nº 641/2011, seguidos a instancia de la Estación de Servicio Jena, S.L., representada por la Procuradora D.ª Buenaventura Cucó Josa y asistida por el Letrado D. José Esteban Villarroya, contra Construcciones Pitiusas Font, S.L., en situación de rebeldía,&amp;nbsp; sobre reclamación de cantidad&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;FALLO&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Que estimando la demanda&lt;/strong&gt; interpuesta por la representación procesal de la Estación de Servicio Jena, S.L., contra Construcciones Pitiusas Font, S.L., &lt;strong&gt;debo condenar y condeno&lt;/strong&gt; a la parte demandada a abonar a la parte actora la cantidad de 3.044,35 euros, más los respectivos intereses legales, con imposición de las costas causadas en este procedimiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la presente resolución cabe interponer recurso de apelación en el plazo de veinte días desde su notificación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así por esta mi sentencia, lo pronuncio, mando y firmo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PUBLICACION.-La anterior sentencia ha sido publicada en legal forma, de lo que doy fe.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y encontrándose dicho demandado,&amp;nbsp; CONSTRUCCIONES PITIUSAS FONT, S.L., en paradero desconocido, se expide el presente a fin de que sirva de notificación en forma al mismo.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;IBIZA/EIVISSA a quince de Febrero de dos mil trece.&lt;/span&gt;&lt;/p&gt;
