El 5 de febrero&lt;/span&gt;&lt;span style="color: rgb(51, 51, 51)"&gt; de 2013 &lt;/span&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;entró en el Registro de la Consejería de Administraciones Públicas (con nº. de registro de entrada&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;646&lt;/span&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;/2013)&lt;/span&gt;&lt;span style="color: rgb(51, 51, 51)"&gt; un oficio de la Secretaria General de la Consejería de Presidencia en el que se adjuntaba la documentación&lt;/span&gt; relativa al expediente de cesión gratuita y temporal de cuatro obras de Joan Miró, con la finalidad de que la Dirección General de Patrimonio lo tramitara.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2. El 9 de enero de 2013&lt;/span&gt; la Directora de la Fundació Pilar i Joan Miró a Mallorca dirigió al Presidente de las Illes Balears un escrito (con nº de registro de entrada 1501/2013) en el que solicitaba la autorización del Gobierno de las Illes Balears para poder ceder en préstamo temporal al Moscow Museum of Modern Art (MMOMA) en Moscú (Rusia), para la exposición &amp;quot;Joan Miró. Imagery&amp;quot;, que tendrá lugar desde el 25 de abril al 9 de junio de 2013, las siguientes obras que pertenecen al Patrimonio de la Comunidad Autónoma&lt;span style="color: rgb(51, 51, 51)"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;em&gt;- Personnage, &lt;/em&gt;1963 (nº de Inventario 100000002845)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;em&gt;- Personnage&lt;/em&gt;, 1977 (nº de Inventario 100000002848)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;em&gt;- Femme à la chevelure défaite par un oiseau au lever du soleil&lt;/em&gt;, 1976 (nº de Inventario 100000002839)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;em&gt;- Oiseau dans un paysage&lt;/em&gt;, 1974 (nº de Inventario 100000002841)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;3. La Comunidad Autónoma de las Illes Baleares es propietaria de estas obras de Joan Miró (Barcelona, 1893 - Palma, 1983), que fueron entregadas el 21 de abril de 2007 por los herederos de Doña Maria Dolors Miró Juncosa, junto con el escultura en bronce &lt;em&gt;Maternité&lt;/em&gt;, 1973, edición nº 4/4, y la obra del pintor francés Fernand Léger (Argentan, 1881 - Gif-sur-Yvette, 1955) &lt;em&gt;Esquisse pour las plongeur&lt;/em&gt;, 1941, en pago de parte de la deuda tributaria, por concepto del impuesto sobre sucesiones y donaciones. Estas cuatro obras están adscritas a la Consejería de Presidencia y depositadas en la Fundació Pilar i Joan Miró a Mallorca, ya que fueron entregadas en concepto de préstamo a la Fundación para que las expusiera en sus dependencias mediante contrato de comodato de 14 de noviembre de 2007, con vigencia de cinco años prorrogable de manera tácita por anualidades sucesivas hasta un máximo de 20 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;4. El Moscow Museum of Modern Art (MMOMA) es el primer museo de arte contemporáneo de Rusia y fue inaugurado el 15 de diciembre de 1999. Concentra sus actividades exclusivamente en el arte de los siglos XX y XXI y, aunque la mayoría de obras expuestas son de artistas rusos, también incluye obras de grandes artistas internacionales, como piezas gráficas de Pablo Picasso, Joan Miró, Fernand Léger y Giorgio de Chirico, esculturas de Salvador Dalí, Armand y Arnaldo Pomodoro, pinturas de Henri Rousseau e instalaciones de Yukinori Yanaga. Por su dinamismo, se configura como uno de los lugares más activos en la vida cultural de Moscú.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;5. La exposición temporal que acogerá, &amp;quot;Joan Miró. Imagery&amp;quot;, se inscribe en el marco del Festival Internacional de las Artes&amp;quot;El bosque de los cerezos&amp;quot;, que se celebra anualmente desde el año 2000 y pretende examinar el repertorio iconográfico del artista mediante pinturas, esculturas y dibujos creados en su etapa de madurez, e incluirá la recreación del Taller Sert y fotos de Son Boter, lo que permitirá dar a conocer los estudios de Miró en Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;6. Esta iniciativa, por otra parte, está avalada por la participación de la Embajada de España en Moscú, a través de la Consejería para Asuntos Culturales. Hay que recordar que en el año 2011 fue declarado Año Dual de Rusia en España y de España en Rusia, para fortalecer y acercar las relaciones hispanorusas en los ámbitos político, económico, cultural, humanitario y educativo. Uno de los componentes clave del programa de actos fueron los eventos culturales y, entre éstos, el Moscow Museum of Modern Art (MMOMA) acogió exposiciones de colecciones españolas y el Museo Estatal de Bellas Artes A. Pushkin cedió a principios de 2012 sus salas para artistas españoles del siglo XX, entre ellos Joan Miró. Por este motivo, la exposición dedicada a Joan Miró que se quiere llevar a cabo entre los meses de abril a junio de 2013 se puede entender como una continuidad de estas relaciones bilaterales hispanorusas, con el objetivo de continuar fortaleciendo los lazos culturales entre ambos países.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;7. El 25 de enero de 2013, la Secretaria General de la Consejería de Presidencia, para poder dar respuesta a esta petición, envió un escrito a la Directora General de Cultura en el que le solicitaba una nueva tasación de los cuadros, a fin de disponer de su valor real con vistas a la póliza de seguro que debe cubrir ante eventuales siniestros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;8. La Directora del Museo de Mallorca, mediante escrito de 8 de febrero de 2013, informó que las cuatro obras a que se ha hecho referencia están en buen estado de conservación y de acuerdo con los precios de subastas públicas de obras de Joan Miró de los últimos años, estima que la valoración actual, a efectos del seguro para la exposición temporal, es la siguiente:&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;9. Una de las obras, &lt;em&gt;Femme à la chevelure défaite par un oiseau au lever du soleil &lt;/em&gt;(1976), fue declarada Bien Catalogado por Resolución de 5 de noviembre de 2001 del Consejo Insular de Mallorca, por la que se declaran Bien de Interés Cultural diversas obras pictóricas,(BOE nº. 296, de 11 de noviembre), lo que implica, de acuerdo con el artículo 44 de la Ley 12/1.998, de 21 de diciembre, de Patrimonio Histórico de las Illes Balears, que el préstamo temporal debe ser comunicado a la Comisión Insular de Patrimonio Histórico del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;10. El 12 de febrero de 2013 la Secretaria General de la Consejería de Presidencia firmó un informe explicativo sobre la oportunidad y el interés en relación con la solicitud de préstamo de las cuatro obras de arte de Joan Miró y en el que muestra una predisposición favorable a este préstamo, dado que la exposición será importante para la difusión internacional de la obra del artista y a la vez de la isla de Mallorca. Así, consta en el informe que teniendo en cuenta que la exposición está organizada por la Fundació Pilar i Joan Miró a Mallorca y quiere dar a conocer los estudios de Miró en la isla, puede suponer una publicidad adicional a su actividad y&amp;nbsp; por extensión, al Patrimonio Cultural de Mallorca, lo que se puede traducir en un factor de atracción de visitantes rusos a la isla, un mercado turístico de gran importancia, por su dinamismo y previsiones de crecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;11. El 12 de febrero de 2013, el Consejero de Presidencia propuso al Consejero de Administraciones Públicas que ordenara el inicio del expediente para la cesión gratuita y temporal de las cuatro obras pictóricas mencionadas -desde el 1 de abril, fecha aproximada de salida de las obras desde Palma, hasta el 31 de julio de 2013, fecha estimada de regreso-, a favor del Moscow Museum of Modern Art (MMOMA).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;12. El 5 de marzo de 2013, el Consejero de Administraciones Públicas, a propuesta de la Directora General de Patrimonio, Contratos y Obras Públicas, dictó una resolución de inicio del expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;13. El 15 de marzo de 2013, la Secretaria General de la Consejería de Presidencia firmó un oficio, en el que adjunta la documentación preceptiva aportada por la Fundació Pilar i Joan Miró a Mallorca, para autorizar la cesión gratuita. En concreto, se ha aportado la documentación que se indica a continuación:&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Informe explicativo de la exposición, en la que se destaca, entre otros aspectos, que la exposición se inaugurará el día 25 de abril en el&amp;nbsp; Moscow Museum of Modern Art (MMOMA) y se clausurará el 9 de junio de 2.013, condiciones del edificio, medidas de seguridad, conservación y seguros contratados, así como condiciones de recogida, embalaje y transporte de las obras mencionadas por la empresa SIT GRUPO EMPRESARIAL, S.L. (CIF: B-28139780), siempre con la supervisión de la Fundació Pilar i Joan Miró a Mallorca, siguiendo las condiciones de conservación requeridas para obras de arte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Póliza de seguro (nº. 0621370711330), suscrita con la entidad MAPFRE (CIF: A-28141935). Se destaca que el periodo de cobertura del seguro es del 14 de marzo hasta el 14 de agosto de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Permiso de exportación temporal de la obra, emitido por el Director General de Bellas Artes y Bienes Culturales del Ministerio de Cultura con fecha de 14 de marzo de 2013. Cabe destacar que se hace constar que la fecha máxima de validez del permiso es hasta el 31 de julio de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Borrador del contrato de préstamo temporal concertado entre la Fundación Pilar i Joan Miró a Mallorca y el Moscow Museum of Modern Art (MMOMA).&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt;

&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;3.&lt;/span&gt;&lt;span style="color: rgb(51, 51, 51)"&gt; Notificar esta Resolución al&lt;/span&gt; Moscow Museum of Modern Art (MMOMA), a la Fundació Pilar i Joan Miró a Mallorca, a la Consejería de Presidencia, a la Consejería de Educación, Cultura y Universidades y a la Comisión Insular de Patrimonio Histórico del Consejo Insular de Mallorca, para su conocimiento y efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;4.&lt;/span&gt;&lt;span style="color: rgb(51, 51, 51)"&gt; Anotar esta cesión&lt;/span&gt; en el Inventario General de Bienes y Derechos de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
