    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Puesto que no ha podido ser notificado en el domicilio que aparece en el expediente, por el presente Anuncio se notifica a las personas que se relacionan en el siguiente Decreto, de conformidad con lo que dispone el art. 59.5 de la Ley 30/1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Vistas las denuncias formuladas por la Policía Local y las actas de abandono de vehículos en la vía pública.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Vista la Ley 11/99 que modifica el RD Leg. 339/90, de 2 de marzo, modificado por la Ley 5/97, de 24 de marzo, referente a la determinación del estado de abandono de los vehículos, que establece que se presumirá racionalmente su abandono:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“a) Cuando transcurran más de dos meses desde que el vehículo haya sido depositado después de que la autoridad competente lo haya retirado de la vía pública.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Cuando permanezca estacionado por un período superior a un mes en el mismo lugar y presente desperfectos que hagan imposible el desplazamiento por sus propios medios o le falten las placas de matriculación”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto el artículo 3.b) de la Ley 22/2011, de 28 de julio, de residuos, que establece que el vehículo abandonado es un residuo sólido urbano, otorgando el artículo 12.5 de la misma Ley, competencias a las entidades locales para su gestión.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto que los vehículos relacionados se encuentran en este supuesto.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En virtud de las atribuciones que me otorga la normativa vigente&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Resuelvo:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Primero.- Tratar como residuo sólido urbano los vehículos que a continuación se relacionan. Se procederá a la retirada de la vía pública cuando sea estrictamente necesario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Segundo.- Notificar esta resolución a los titulares de los vehículos con datos conocidos, otorgando, de conformidad con el artículo 53.3 de la Ley 22/2011 de residuos, un plazo de 15 días desde la recepción de la notificación para aportar las alegaciones oportunas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En este plazo, el interesado deberá proceder a la retirada del vehículo, con la advertencia de la posible incoación del correspondiente procedimiento sancionador de acuerdo con lo establecido en el art. 2 de la Ley 11/99 de 21 de abril, de modificación de la Ley reguladora de las bases de régimen local y otras medidas para el desarrollo local en materia de tráfico, circulación de vehículos a motor y seguridad vial y el art. 46.3 C de la Ley 22/2011 de residuos. Así mismo, en estos 15 días, el interesado podrá renunciar expresamente a la titularidad del vehículo previo abono de las deudas con la Administración Pública, si es el caso.&lt;/span&gt;&lt;/p&gt;
