&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ORDENANZA MUNICIPAL REGULADORA DEL COMERCIO AMBULANTE EN EL MUNICIPIO DE ALCUDIA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;EXPOSICION DE MOTIVOS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El objetivo de esta Ordenanza es dotar de un marco a los profesionales de esta actividad, protegiendo a la vez a los consumidores y usuarios dentro del ámbito de competencias de las entidades locales.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Presente Ordenanza es de aplicación en el marco de la Ley 7/1996, de 15 de enero, de Ordenación del Comercio Minorista; del Real Decreto 199/2010, de 26 de febrero, por el que se regula el ejercicio de la venta ambulante o no sedentaria; y de las normas reguladoras de la venta ambulante de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;CAPÍTULO 1:&lt;br /&gt; DISPOSICIONES GENERALES&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 1.-&lt;br /&gt; Objeto.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&lt;span style="color: black"&gt;a presente ordenanza tiene por objeto regular con carácter general el ejercicio de la venta ambulante o no sedentaria que se realiza por comerciantes fuera del establecimiento comercial permanente con instalaciones desmontables, transportables o móviles en lugares y fechas previamente autorizados en el término municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 2.-&lt;br /&gt; Modalidades de venta.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El comercio no sedentario o ambulante podrá ejercitarse en alguna de las siguientes modalidades:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Mercadillos periódicos u ocasionales en puestos o instalaciones desmontables, móviles o semi-móviles, con las condiciones o requisitos establecidos en los artículos siguientes de la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Comercio en vía pública en puestos aislados y desmontables de carácter ocasional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Excepcional y puntualmente, venta en recintos o espacios reservados para la celebración de las fiestas y ferias populares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Quedan excluidos de la presente ordenanza los puestos autorizados en la vía pública de carácter fijo y estable que se regirán por su normativa específica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 3.-&lt;br /&gt; Emplazamiento.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Corresponde al Ayuntamiento de Alcudia la determinación del número y superficie de los puestos para el ejercicio de la venta ambulante. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los puestos de venta ambulante o no sedentaria no podrán situarse en los accesos a edificios de uso público, establecimientos comerciales e industriales, ni en lugares que dificulten el acceso y la circulación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 4.-&lt;br /&gt; Sujetos.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El comercio ambulante podrá ejercerse por toda persona física o jurídica que se dedique a la actividad del comercio al por menor y reúna los requisitos exigidos en la presente ordenanza y otros que según la normativa les fuera de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 5.-&lt;br /&gt; Régimen Económico.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento podrá fijar las tasas correspondientes por la utilización privativa o aprovechamiento especial del suelo público en las distintas modalidades de venta ambulante, actualizando anualmente la cuantía. A estos efectos se tendrá en cuenta los gastos de &lt;/span&gt;conservación y mantenimiento de las infraestructuras afectadas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Serán a cargo de los adjudicatarios de los puestos la totalidad de las exacciones que figuren en las Ordenanzas Fiscales de aplicación, así como los impuestos, contribuciones y resto de arbitrios exigidos por el Estado, Comunidad Autónoma o Municipio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No queda sujeto a tasa por ocupación de la vía pública el espacio que ocupe, en su caso, el vehículo utilizado para el ejercicio de la actividad comercial, siempre y cuando se limite a transportar la mercancía y la estructura del puesto, sin que pueda servir también como espacio para ejercer la venta. En todo caso deberá facilitarse al Ayuntamiento el número de matrícula con el cual se accederá al mercado, debiendo comunicar cualquier cambio de vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 6.-&lt;br /&gt; Personal del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento determinará el personal que, conforme a las necesidades del servicio, prestará sus funciones en los mercados municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El personal encargado estará a disposición de los usuarios y clientes de los mercados en todo aquello que concierna al servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este personal comunicará al Ayuntamiento, las novedades, incidencias y anomalías que se produzcan en los mercados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;CAPÍTULO 2:&lt;br /&gt; RÉGIMEN DE AUTORIZACIÓN DE COMERCIO AMBULANTE&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 7.-&lt;br /&gt; Autorización.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El ejercicio de las actividades del comercio ambulante requerirá la previa obtención de la correspondiente autorización municipal conforme al procedimiento de otorgamiento recogido &lt;/span&gt;en la presente ordenanza. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para cada emplazamiento concreto y por cada una de las modalidades de venta ambulante o no sedentaria que el comerciante se proponga ejercer, deberá solicitar una autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 8.-&lt;br /&gt; Tipo y duración de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La autorización que se conceda será transmisible entre parientes hasta el primer grado por consanguinidad o afinidad, previa comunicación al Ayuntamiento, sin que esta circunstancia afecte al período de vigencia de la misma. Dicha comunicación deberá contener una declaración responsable en la que se manifieste el cumplimiento de los requisitos previstos en el artículo 8 de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Podrá ejercer la actividad comercial ambulante en nombre del titular de la autorización el cónyuge o persona unida a éste en análoga relación de afectividad, hijos y empleados con contrato de trabajo y dados de alta en la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cuando el ejercicio corresponda a una persona jurídica, si bajo una misma titularidad opera más de una persona física, deberá existir una relación contractual, o bien una relación de servicios documentalmente justificable entre el titular y la persona que lleve a tal efecto la actividad comercial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La duración de las autorizaciones será limitada y, en todo caso, no superior a un año. Únicamente podrá prorrogarse para permitir al titular la amortización de las inversiones directamente relacionadas con la actividad y una remuneración equitativa de los capitales invertidos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En los casos en que se autorice el comercio en espacios de celebración de fiestas populares la autorización se limitará al periodo de duración de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la autorización y las personas que trabajen en el puesto en relación con la actividad comercial, estarán obligados al cumplimiento de los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Estar dado de alta en el epígrafe y al corriente en el pago del impuesto de actividades económicas o, en caso de estar exentos, estar dado de alta en el censo de obligados tributarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Estar al corriente en el pago de las cotizaciones de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Estar al corriente en el pago de las tasas municipales correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Disponer de autorización de residencia y trabajo, en caso de nacionales de terceros países.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Haber contratado un seguro de responsabilidad civil con cobertura de los riesgos de la actividad comercial desempeñada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) Disponer, en caso de comercializar productos alimenticios, de un carné de manipulador de alimentos, que el titular deberá llevar consigo durante el ejercicio de su actividad comercial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 9.-&lt;br /&gt; Procedimiento de autorización.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El procedimiento de concesión de la autorización municipal para el ejercicio de la venta ambulante ha de ser, en todo caso, público y su tramitación deberá desarrollarse conforme a criterios claros, sencillos, objetivos y predecibles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La convocatoria se realizará mediante resolución de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El plazo de resolución del procedimiento será de seis meses a contar desde el día siguiente al término del plazo para la presentación de solicitudes, transcurrido el cual los interesados podrán entender desestimada su solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 10.-&lt;br /&gt; Criterios para optimizar las valoraciones de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En atención a una mayor profesionalización del comercio ambulante, protección de los consumidores, así como en consideración a factores de política social, para el otorgamiento de la autorización podrán tenerse en cuenta, entre otros, los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) La experiencia demostrada en el ejercicio de la profesión que asegure la correcta prestación de la actividad comercial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) La disponibilidad de instalaciones desmontables adecuadas y proporcionales al desarrollo de la actividad comercial ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) En su caso, estar en posesión del carné de profesional de comerciante ambulante expedido por la Comunidad de las Illes Balears o haber solicitado la inscripción en el Registro de comerciantes ambulantes de la Comunidad de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Las dificultades para el acceso al mercado laboral del solicitante, con prioridad de las personas con minusvalía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Número de personas dependientes económicamente del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) Estar en posesión de algún distintivo de calidad reconocido en el ámbito del comercio ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) No&amp;nbsp; haber&amp;nbsp; incurrido&amp;nbsp; en&amp;nbsp; sanción&amp;nbsp; administrativa&amp;nbsp; firme&amp;nbsp; por&amp;nbsp; la&amp;nbsp; comisión&amp;nbsp; de&amp;nbsp; alguna infracción de las normas de comercio ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h) La tipología de los productos y servicios que se pretenden comercializar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i) Antigüedad en el puesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;j) En caso de igualdad de circunstancias entre los solicitantes, la prioridad irá en función de la antigüedad de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 11.-&lt;br /&gt; Solicitudes y plazo de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las personas físicas o jurídicas que vayan a ejercer la venta ambulante han de presentar su solicitud en los plazos señalados en la convocatoria que hará la Alcaldía mediante resolución, conforme a los modelos previstos en los anexos de la presente ordenanza, en la que se aporte fotocopia del DNI o NIE; dos fotografías; una declaración responsable en la que se manifieste el cumplimiento de los requisitos previstos en el artículo 8 de ésta ordenanza y, si procede, la documentación acreditativa de la concurrencia de cualquier circunstancia prevista en el artículo anterior a efectos de valorar las solicitudes presentadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez concedida la autorización municipal el Ayuntamiento podrá ejercitar las oportunas facultades de comprobación, control e inspección sobre el adjudicatario solicitando, entre otros, los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Documentos acreditativos de la identidad del solicitante. En caso de personas jurídicas, documentación acreditativa de la personalidad y poderes del representante legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Documentos acreditativos de estar dado de alta en el régimen de la Seguridad Social que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Documento acreditativo de estar dado de alta en el epígrafe fiscal del IAE correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Copias de los contratos de trabajo que acrediten la relación laboral de las personas que vayan a desarrollar la actividad en nombre del titular, sea éste persona física o jurídica. Las sociedades cooperativas entregarán certificado de incorporación como socio trabajador expedida por el Secretario de la misma o persona con poderes en la entidad y copia del TC 1 y 2 del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Justificación de estar en posesión del carné de manipulador de alimentos, expedido por la Consejería competente, conforme a la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) Documentación acreditativa de la suscripción del seguro de responsabilidad civil, que cubra cualquier clase de riesgo derivado del ejercicio de la actividad comercial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) Justificación de tener a disposición del consumidor las correspondientes hojas de reclamación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 12.-&lt;br /&gt; Revocación de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las autorizaciones podrán ser revocadas unilateralmente por el Ayuntamiento en caso de incumplimiento de los preceptos contenidos en la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 13.-&lt;br /&gt; Contenido de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En las autorizaciones expedidas por el Ayuntamiento se hará constar la siguiente información:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Identificación del titular y en su caso de la/s persona/s autorizadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Modalidad del comercio ambulante para la que se habilita la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Ubicación precisa del puesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Producto/s autorizado/s para el comercio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Días y horas en los que se podrá llevar a cabo la actividad comercial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) Plazo de duración de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) En su caso, condiciones particulares a las que se sujeta el titular de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento entregará al titular de la autorización un cartón identificativo en el que se incluirá: una fotografía del titular; su nombre y apellidos y, en su caso, el de las personas autorizadas; modalidad del comercio ambulante para la que se habilita la autorización; productos autorizados para el comercio; días y horas en los que se podrá llevar a cabo la actividad comercial; plazo de duración de la autorización; un domicilio para recibir las reclamaciones de los consumidores; y año en curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 14.-&lt;br /&gt; Obligaciones generales de los vendedores.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sin perjuicio de las obligaciones especiales que correspondan por razón del tipo de venta ambulante y objeto de la misma, los adjudicatarios de los puestos están obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Cumplir todas las disposiciones legales aplicables en materia de abastos, sanidad, policía, alimentación, comercio y cualesquiera otras dimanantes de los organismos y autoridades competentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Ocupar personalmente el puesto, sin perjuicio de que la actividad comercial sea realizada por las personas a que se refiere el artículo 8.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Usar un buen lenguaje y tener un buen comportamiento entre ellos, el público y los representantes del Ayuntamiento. Si algún vendedor o ciudadano se sintiere ofendido por algún hecho relacionado con una de las disposiciones mencionadas podrá hacer la correspondiente queja ante la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Poner a la vista del público el cartón identificativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Tener en todo momento a disposición de los representantes del Ayuntamiento la documentación acreditativa de la titularidad del puesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) Presentar en el plazo de los cinco días siguientes a su requerimiento los justificantes de estar al corriente de sus obligaciones laborales, fiscales y sanitarias, y las de carácter económico con la entidad concesionaria de la explotación del mercado; albaranes, facturas o similares, acreditativos del origen de las mercaderías y el precio de adquisición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) Facilitar una segunda pesada, siempre que sea requerida por los representantes del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h) Tener a disposición de los representantes del Ayuntamiento los justificantes de haber satisfecho los derechos municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i) Depositar y verter las basuras en la forma que determine el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;j) Avenirse siempre a la clasificación otorgada respecto a la actividad económica reconocida y declarada, en función de lo establecido en los reglamentos de régimen interior y/o pliegos concesionales de cada mercado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;k) Mostrar permanentemente y de forma visible el precio de los productos y su origen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;l) Estacionar los vehículos en los lugares que determine la autoridad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;CAPÍTULO 3:&lt;br /&gt; RÉGIMEN DE LAS CONDICIONES HIGIÉNICO-SANITARIAS Y DEFENSA DE LOS CONSUMIDORES&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 15.-&lt;br /&gt; Vestuario y limpieza personal.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los vendedores deberán cuidar su limpieza personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los vendedores de frutas, verduras, frutos secos y derivados deberán emplear ropa de trabajo y, en caso de vender productos hortofrutícolas, llevar bata blanca o azul.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 16.-&lt;br /&gt; Venta de productos alimenticios.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sólo se permitirá la venta de productos alimenticios cuando se realice en mercadillos, o en las otras modalidades de comercio ambulante que estén autorizadas, siempre que reúnan las condiciones higiénico-sanitarias previstas en las disposiciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Salvo que, a juicio de las autoridades competentes, se disponga de las instalaciones adecuadas y estén debidamente envasados, queda prohibida la venta de los siguientes productos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Carne, aves y caza, sea fresca, refrigerada o congelada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Pescado y marisco, sea fresco, refrigerado o congelado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Leche certificada y pasteurizada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Queso fresco, requesón, nata, mantequilla, yogures y otros productos lácteos frescos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Pastelería rellena y adornada y productos del horno. Pastas alimenticias frescas y rellenas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) Anchoas, ahumados y otros semi-congelados o productos que necesiten refrigeración.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) Otros productos que por sus especiales características, y a juicio de las autoridades competentes, comporten un riesgo sanitario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En ningún caso se autorizará la venta de productos de imitación de cualquier tipo de marca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las autoridades sanitarias competentes, en casos excepcionales y por motivos de salud pública que lo aconsejen, podrán prohibir la venta de determinados productos alimenticios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 17.-&lt;br /&gt; Facturas y comprobantes de la compra de productos.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El comerciante tendrá a disposición de los servicios de inspección las facturas y comprobantes acreditativos de las mercancías y productos objeto de comercio ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 18.-&amp;nbsp;&lt;br /&gt; Exposición de precios.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El comerciante tendrá expuesto al público, en lugar visible, los precios de venta de las mercancías ofertadas. Los precios serán finales y completos, impuestos incluidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 19.-&lt;br /&gt; Deber de información.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los comerciantes deberán informar, a través de un cartel visible, de la dirección donde se atenderán, en su caso, las reclamaciones de los consumidores. En el caso de que el titular de la autorización sea una persona física, esta dirección podrá ser la correspondiente a la oficina del consumidor de Alcúdia, debiendo el titular registrar en dicha oficina el domicilio que señale a efectos de recibir las reclamaciones presentadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La dirección deberá figurar, en todo caso, en la factura o en el comprobante de la venta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 20.-&lt;br /&gt; Medición de los productos.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los puestos que expendan productos al peso o medida deberán disponer de cuantos instrumentos homologados sean necesarios para su medición o pesada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El comprador que no esté conforme con el peso o medida de las mercaderías, antes de abandonar el puesto donde las haya comprado, deberá dar aviso a un representante o personal del Ayuntamiento, para que le acompañen a hacer una segunda pesada, o repeso municipal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 21.-&lt;br /&gt; Garantía de los productos.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los productos comercializados en régimen de venta ambulante deberán cumplir lo establecido en materia de sanidad e higiene, normalización y etiquetado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La autoridad municipal y los inspectores de sanidad y de consumo podrán decomisar los productos que no cumplieren tales condiciones, pudiendo incoar, en su caso, el oportuno expediente sancionador. Se podrá acordar la intervención cautelar de los productos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el Mercado de Alcudia y en el Mercado del Puerto de Alcúdia queda absolutamente prohibido a los compradores tocar o palpar las mercaderías expuestas susceptibles de fácil contaminación. También queda prohibido en estos mercados el acceso o circulación de captadores o vendedores no autorizados, así como de animales de cualquier clase.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 22.-&lt;br /&gt; Justificante de las transacciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Será obligatorio, por parte del comerciante, proceder a la entrega de factura, ticket o recibo justificativo de la compra, siempre que así viniese demandado por el comprador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Los medios o elementos de recogida serán facilitados por el ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 24.-&lt;br /&gt; Infraestructuras sanitarias.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;SECCION 1ª: DEL COMERCIO EN MERCADILLOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 25.-&lt;br /&gt; Definición.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La modalidad de comercio en mercadillos periódicos u ocasionales es aquella que se realiza mediante la agrupación de puestos ubicados en suelo calificado como urbano, en los que se ejerce el comercio al por menor de productos con oferta comercial variada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento podrá autorizar la celebración de mercadillos extraordinarios de comercio ambulante en otras ubicaciones, días y fechas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 26.-&lt;br /&gt; Características del mercadillo&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El número de mercadillos, su emplazamiento, número de puestos, tamaño, composición y distribución será determinado por el Ayuntamiento de acuerdo con la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento podrá acordar, por razones de interés público y mediante acuerdo motivado, el traslado provisional del emplazamiento habitual del mercadillo, previa comunicación al titular de la autorización, sin generar en ningún caso indemnización ni derecho económico alguno por razón del traslado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En todo caso, la nueva ubicación deberá reunir las condiciones que la normativa vigente exige para la celebración de los mercadillos periódicos, tanto en espacio, toma de luz y agua, como en condiciones higiénico-sanitarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento podrá acordar, por razones de interés público y mediante un acuerdo motivado, la suspensión de la apertura de los mercados hasta dos días al año, avisando el día de mercado inmediatamente anterior, sin generar en ningún caso indemnización ni ningún derecho económico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 27.-&lt;br /&gt; Características de los puestos.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La venta se efectuará a través de puestos desmontables o camiones-tienda debidamente acondicionados, que se instalarán en los lugares señalados y reservados a tal efecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los puestos tendrán, con carácter general, una superficie mínima de 2.5 metros de longitud y un máximo de 10 metros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si se utilizaren toldos o parasoles, estos se elevarán dos metros, como mínimo, por encima de la rasante de la calzada. No se podrán colgar artículos fuera de la perpendicular de la superficie del puesto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El depósito y vertido de basuras se hará en la forma que determine el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los vendedores de frutas, verduras, frutos secos y derivados deberán exponer los productos a una altura mínima de 40 cm respecto del suelo, o bien en cajones de plástico limpios y desinfectados o desechables y de un solo uso. Los embutidos, frutos secos, productos salados y demás que, por sus características, sean especialmente susceptibles a la incidencia del sol y el paso de la gente, deberán estar separados del público a través de vitrinas y debidamente protegidos del sol. Los embutidos y quesos deberán, además, estar envasados al vacío. Cuando se usen cubos para pesar a medida, éstos deberán estar limpios y desinfectados para cada mercado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 28.-&lt;br /&gt; Ubicación, días y horas de celebración.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el municipio de Alcúdia se celebrarán los siguientes mercados:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Mercado de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este mercado se ubicará en los paseos Pere Ventayol i&amp;nbsp; Mare de Deu de la Victòria, así como en la plaça Carles V. En los meses de junio a octubre esta ubicación quedará ampliada a las calles Major, des Moll y Ronda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El mercado tendrá dos zonas, una dedicada a los productos de campo y la otra al resto de mercaderías.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El mercado se celebrará los martes y domingos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El horario de instalación y recogida y funcionamiento será el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) De mayo a octubre, la instalación se hará de las 6:30 horas a las 20:30 horas; y la recogida desde las 13:30 hasta a les 15:30 horas. El funcionamiento será desde las 8:30 hasta las 13:30 horas. En las calles Major, des Moll y Camí de Ronda, la instalación se hará desde las 8:00 hasta las 9:00 horas y la recogida desde las 13:30 hasta las 15:00 horas. El funcionamiento será desde las 9:00 hasta las 13:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) De noviembre a abril, la instalación se hará desde las 7:00 hasta las 9:00 horas y la recogida desde las 13:00 hasta las 14:30 horas. El funcionamiento será desde las 9:00 horas hasta las 13:00 horas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Mercado del Puerto de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este mercado se ubicará en la plaza des Vicari. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El mercado se celebrará los viernes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El horario de instalación y recogida y funcionamiento será el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) De mayo a octubre, la instalación se hará desde las 6:30 hasta las 8:30 horas y la recogida desde las 13:30 horas a las 15:30 horas. El funcionamiento será desde las 8:30 horas hasta las 13:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) De noviembre a abril, la instalación se hará desde las 7:00 hasta las 9:00 horas y la recogida desde las 13:00 hasta las 14:30 horas. El funcionamiento será desde las 9:00 horas hasta las 13:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Mercadillo de verano (mercado nocturno).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este mercadillo se ubicará en el Paseo Marítimo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El mercadillo se celebrará de junio a septiembre, de jueves a sábado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El horario de instalación será de las 17:30 a las 18:00 horas y la recogida será desde las 22:30 a las 23:00 horas. El funcionamiento será desde las 18:00 hasta las 22:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El puesto que no hubiese sido ocupado por su titular al término del período de instalación quedará vacante, no pudiendo ser ocupado por ninguna otra persona ajena al mismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento, por razones de interés público, mediante acuerdo motivado, podrá modificar la fecha y horario, previa comunicación al titular de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;SECCION 2ª:&amp;nbsp;&lt;br /&gt; DEL COMERCIO AMBULANTE EN VÍA PÚBLICA.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 29.-&lt;br /&gt; Concepto. &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se incluye bajo la presente modalidad el comercio ambulante, realizado con ocupación de la vía pública en puestos no fijos de carácter aislados ya sea de manera ocasional o habitual, y cuyo objeto sea la venta de retratos, caricaturas o manualidades que se realicen delante del propio cliente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 30.-&lt;br /&gt; Ubicación, fechas y horario.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este tipo de comercio deberá realizarse en la calle Pere Mas i Reus y en la carretera de Artà, así como en cualesquiera otras zonas que habilite el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El comercio en vía pública se podrá ejercer todos los días durante los meses de mayo a septiembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El horario de apertura de los puestos será de las 17:00 horas a las 23:00 horas.&lt;/span&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 31.-&lt;br /&gt; Limitaciones de instalación.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Solo se podrá autorizar la instalación de enclaves o puestos aislados en la vía pública, cuando éstos no dificulten el tráfico rodado o la circulación de peatones o generen cualquier otro riesgo para la seguridad ciudadana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;SECCION 3ª:&lt;br /&gt; OTROS TIPOS DE COMERCIO AMBULANTE&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 32.-&lt;br /&gt; Comercio ambulante con motivo de festejos o fiestas populares.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Excepcional y puntualmente, el Ayuntamiento podrá autorizar la venta en recintos o espacios reservados para la celebración y las fiestas y ferias populares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;CAPÍTULO 5:&lt;br /&gt; FUNCIÓN INSPECTORA Y RÉGIMEN SANCIONADOR&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 33.-&lt;br /&gt; Competencia.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sin perjuicio de las competencias atribuidas por la Ley 11/2001, de 15 de junio, de Ordenación de la Actividad Comercial en las Illes Balears, al Gobierno de las Illes Balears, al Director General que tenga atribuidas las competencias en materia de comercio, al Consejero Competente en materia de comercio y al Consejo de Gobierno de las Illes Balears, corresponde al Ayuntamiento de Alcúdia la inspección y sanción de las infracciones, previa instrucción del correspondiente expediente, derivado del ejercicio de la actividad comercial ambulante según la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cuando se detecten infracciones de índole sanitaria, el Ayuntamiento dará cuenta inmediata a la autoridad que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 34.-&lt;br /&gt; Infracciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las infracciones se clasifican en:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Infracciones leves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Incumplir el horario autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) El empleo de todo tipo de dispositivo sonoro con fines de propaganda, reclamo, aviso o distracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) No tener expuesta al público, en lugar visible, la autorización municipal de mercancías.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) No exhibir los precios de venta al público de las mercancías.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) No tener a disposición de los servicios de inspección las facturas y comprobantes de compra de los productos objeto de comercio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) No tener a disposición de los consumidores y usuarios las hojas de reclamación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) No proceder a la limpieza del puesto, una vez finalizada la jornada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h) La venta de productos distintos a los autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i) La venta de productos falsificados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;j) Cualquier otra sanción u omisión que constituya incumplimiento de los preceptos de esta ordenanza y que no esté tipificada como infracción grave o muy grave.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Infracciones graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) La instalación del puesto en lugar no autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Incumplir cualquiera de las condiciones impuestas en la autorización para el ejercicio del comercio ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) El ejercicio de la actividad por persona distinta de la autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) No estar al corriente del pago de las tasas municipales para la instalación del puesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Incumplimiento de las normas higiénico-sanitarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) La negativa a suministrar información a la autoridad municipal, funcionarios y agentes en cumplimiento de sus funciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) Injuriar a los clientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Infracciones muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) La reincidencia en infracciones graves. Se entiende que existe reincidencia por la comisión en el término de un año de más de una infracción grave, cuando así haya sido declarado por resolución firme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) La resistencia, coacción o amenaza a la autoridad municipal, funcionarios y agentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Agredir físicamente a los clientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 35.-&lt;br /&gt; Sanciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.&amp;nbsp; Las sanciones aplicables serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Por infracciones leves, admonición o multa de hasta 150 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Por infracciones graves, multa de 150 hasta 1.200 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Por infracciones muy graves, multa de 1.200 euros hasta 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Las sanciones se graduarán en función de los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Volumen de facturación al que afecte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Cuantía del beneficio obtenido. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Grado de intencionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Plazo de tiempo durante el que se haya venido cometiendo la infracción. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Naturaleza de los perjuicios causados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Será compatible con la sanción el decomiso de la mercancía no autorizada, así como el decomiso de la mercancía falsificada, fraudulenta o no identificada que pudiera entrañar riesgo para el consumidor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;DISPOSICIÓN DEROGATORIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Quedan derogados el Reglamento del Mercado Municipal de Alcudia (BOIB nº 42, d’1 d’abril de 2000) y cualesquiera otras disposiciones municipales que se opongan a lo establecido en&amp;nbsp; la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente Ordenanza entrará en vigor cuando se haya publicado íntegramente en el Boletín Oficial de la Comunidad Autónoma y haya transcurrido el plazo señalado en el artículo 113 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;br /&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Por todo ello,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
