    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La&amp;nbsp; Junta de&amp;nbsp; Gobierno de&amp;nbsp; Palma en sesión que tuvo lugar en fecha 21 de febrero de 2013 adoptó el siguiente acuerdo: &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“En fecha 9/11/2011 la&amp;nbsp; Junta de Gobierno aprobó inicialmente el Proyecto de Estatutos de&amp;nbsp; la&amp;nbsp; Entidad Urbanística de Conservación del SUP 51-02 LA FEMU, del vigente PGOU, presentado el 30/03/2011 por el Sr. Andrés Moreno Aguilar, como Presidente de la Junta de&amp;nbsp; Compensación del SUP, vista la última versión entregada el 23/05/2011 con las modificaciones incluidas en la documentación aportada el 9/09/2011 que incorpora el Anexo &amp;nbsp;I&amp;nbsp; relación de&amp;nbsp; propietarios y&amp;nbsp; cuotas. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Ese acuerdo fue notificado a los afectados y se publicó al BOIB núm. 179, de fecha 29.11.2011, junto con el texto íntegro de los Estatutos de la Entidad Urbanística de&amp;nbsp; Conservación, durante el plazo de QUINCE DÍAS, sin que se hayan presentado alegaciones al respecto.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 3pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por todo esto, en conformidad con los arts. 24 al 30, y 67 al 70, del Reglamento de Gestión Urbanística, el art. 127.1.d) de la Ley 7/1985, de 2 de abril, Reguladora de&amp;nbsp; las Bases de Régimen Local, y los arts. 172 y 175 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, el TAG que subscribe considera que puede elevar se a la Junta de Gobierno de Palma la siguiente propuesta de resolución para que adopte el siguiente &lt;strong&gt;ACUERDO&lt;/strong&gt;:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1r.- &lt;strong&gt;Aprobar definitivamente&lt;/strong&gt; el Proyecto de Estatutos de la Entidad Urbanística de&amp;nbsp; Conservación del SUP 51-02 LA&amp;nbsp; FEMU, del vigente PGOU, presentado el 30/03/2011 por el Sr. Andrés Moreno Aguilar, como presidente de la Junta de Compensación del SUP, vista la documentación entregada el 23/05/2011 con las modificaciones incluidas en la&amp;nbsp; documentación aportada el 9/09/2011 que incorpora el Anexo I relación de&amp;nbsp; propietarios y&amp;nbsp; cuotas.&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2n.- &lt;strong&gt;Poner en conocimiento &lt;/strong&gt;de los promotores que el representante en el órgano rector de la&amp;nbsp; Entidad Urbanística de Conservación que se constituya será el Gerente de Urbanismo o&amp;nbsp; persona en quien delegue.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3r.- &lt;strong&gt;Publicar&lt;/strong&gt; el presente acuerdo en el Boletín Oficial de&amp;nbsp; las Islas Baleares.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4t.- &lt;strong&gt;Notificar&lt;/strong&gt; el presente acuerdo a todos los propietarios que han de integrarse en la Entidad Urbanística de Conservación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5t.- &lt;strong&gt;Comunicar&lt;/strong&gt; el presente acuerdo a la Sección que tramita los proyectos de urbanización.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6è.- &lt;strong&gt;Requerir&lt;/strong&gt; a la Entidad Conservadora, cuando se constituya, para que comunique al Ayuntamiento la empresa y el técnico responsable de las labores de conservación y&amp;nbsp; mantenimiento.---&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Lo que se publica para su conocimiento y a los efectos de que sirva de notificación por edictos a los interesados más abajo mencionados, en caso que no se les pueda llevar a cabo la notificación individualizada, de conformidad con los artículos 161.3, 162 y 163 del Reglamento de Gestión Urbanística, aprobado por el RD 3288/78 de 25 de agosto. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra esta resolución, que pone fin a la vía administrativa, podéis interponer, con carácter potestativo, RECURSO DE REPOSICIÓN ante el mismo órgano que la dictó, de acuerdo con lo que dispone el art. 116 de la Ley 30/92, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, según la redacción dada por la Ley 4/99, de 13 de enero. El plazo para interponerlo es de UN MES a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto el de reposición.&lt;br /&gt; El RECURSO DE REPOSICIÓN potestativo se tendrá que presentar en el Registro General de este Ayuntamiento o en las dependencias a las cuales hace mención el art. 38.4, de la Ley 30/92, de 26 de noviembre, antes mencionada, y se entenderá desestimado cuando no se haya resuelto y notificada la resolución, en el plazo de UN MES, a contar a partir del día siguiente a su interposición, quedando en este caso expedita la vía contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;De no utilizar el recurso potestativo de reposición, se puede interponer directamente RECURSO CONTENCIOSO ADMINISTRATIVO, de conformidad a lo establecido en el artículo antes mencionado y en los arts. 45 y siguientes de la Ley 29/98, de 13 de julio, Reguladora de la Jurisdicción Contenciosa Administrativa, ante el Juzgado Contencioso Administrativo, de conformidad con el art. 8 de la Ley Orgánica 19/2003, de 23 de diciembre, que reforma la Ley Orgánica 6/1985, de 1 de julio, en el plazo de DOS MESES, a contar desde el día siguiente al de la recepción de la presente notificación. Todo esto, sin perjuicio de cualquier otro recurso o acción que estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
