&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el presente procedimiento Ordinario, Rollo de Apelación nº 287/2012 seguido a instancia de SOLEDAD CONRADO DE VILLALONGA, JOSE FRANCISCO CONRADO DE VILLALONGA, MARIA ISABEL CONRADO DE VILLALONGA&amp;nbsp; frente a RAFAEL PERERA MESQUIDA, JOSE LUIS CONRADO DE VILLALONGA, MARÍA JOSEFA CONRADO DE VILLALONGA , MARÍA DEL PILAR CONRADO&amp;nbsp; DE VILLALONGA, MARÍA VICTORIA CONRADO DE VILLALONGA, CARMEN ZAFORTEZA ROSSIÑOL, JOSÉ MARÍA CONRADO ZAFORTEZA, LUIS CONRADO ZAFORTEZA, MARÍA VICTORIA CONRADO ZAFORTEZA, SANTIAGO CONRADO ZAFORTEZA, ANTONIO RIBAS ZAFORTEZA, SANTIAGO CONRADO DE VILLALONGA, JOSÉ MARÍA RIBAS CONRADO, JOAQUÍN RIBAS CONRADO, IÑIGO-LUIS RIBAS CONRADO, JOSÉ FRANCISCO RIBAS CONRADO, MAGDALENA RIBAS CONRADO, FRANCISCO DE BORJA RIBAS CONRADO, ROSARIO RIBAS CONRADO&amp;nbsp; se ha dictado Sentencia nº 539/12, cuyo encabezamiento y fallo es del tenor literal siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“&lt;strong&gt;SENTENCIA Nº 539 &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ILMOS. SRES.:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PRESIDENTE: D. MATEO RAMÓN HOMAR&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En Palma de Mallorca a,&amp;nbsp; veintisiete&amp;nbsp; de diciembre de dos mil doce.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VISTO en grado de apelación ante esta Sección Quinta, de la Audiencia Provincial de PALMA DE MALLORCA, los Autos de PROCEDIMIENTO ORDINARIO 671/2005, procedentes del JDO. PRIMERA INSTANCIA N. 4 de PALMA DE MALLORCA, a los que ha correspondido el Rollo RECURSO DE APELACION (LECN) 287/2012, en los que aparece como parte actora apelante, Dª SOLEDAD CONRADO DE VILLALONGA, D. JOSE FRANCISCO CONRADO DE VILLALONGA&amp;nbsp; y Dª MARIA ISABEL CONRADO DE VILLALONGA, representados por el Procurador de los tribunales, Sr. JOSE ANTONIO CABOT LLAMBIAS y asistidos por el Letrado D. FRANCISCO RAMALLO MASSANET; y como parte demandada apelada, D. RAFAEL PERERA MEZQUIDA, representado por el Procurador de los Tribunales Sr. MIGUEL ARBONA SERRA y asistido por el Letrado D. RAFAEL PERERA MEZQUIDA; y otra como parte demandada apelada D. JOSE LUIS CONRADO DE VILLALONGA, Dª MARÍA JOSEFA CONRADO DE VILLALONGA, Dª MARÍA DEL PILAR CONRADO&amp;nbsp; DE VILLALONGA, Dª MARÍA VICTORIA CONRADO DE VILLALONGA, Dª CARMEN ZAFORTEZA ROSSIÑOL, D. JOSÉ FRANCISCO RIBAS CONRADO, Dª MAGDALENA RIBAS CONRADO, D. FRANCISCO DE BORJA RIBAS CONRADO y Dª ROSARIO RIBAS CONRADO. ANTECEDENTES DE HECHO. FUNDAMENTOS DE DERECHO.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FALLAMOS:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;1º)&lt;/strong&gt; &lt;strong&gt;Desestimar&lt;/strong&gt; el recurso de Apelación interpuesto por el Procurador de los Tribunales D. José Antonio Cabot Llambias, en representación de D. José Francisco, Dª Soledad y Dª Mª Isabel Conrado de Villalonga, contra la Sentencia de fecha 17-junio-2010, dictada por el Juzgado de Primera Instancia nº 4 de esta Capital, en los autos de Juicio Ordinario nº 671/2005, de que dimana el presente Rollo de Sala; y en su virtud,&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2º)&lt;/strong&gt;&amp;nbsp; Confirmar los pronunciamientos que la resolución impugnada contiene.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3º)&lt;/strong&gt; Se imponen a los demandantes-apelantes las costas procesales devengadas en esta alzada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así, por esta nuestra Sentencia, de la que se llevará certificación al rollo de sala, definitivamente juzgando, la pronunciamos, mandamos y firmamos’.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y encontrándose dicho demandado, SANTIAGO CONRADO DE VILLALONGA, JOSÉ MARÍA RIBAS CONRADO, JOAQUÍN RIBAS CONRADO, IÑIGO-LUIS RIBAS CONRADO, JOSÉ FRANCISCO RIBAS CONRADO, MAGDALENA RIBAS CONRADO, FRANCISCO DE BORJA RIBAS CONRADO, ROSARIO RIBAS CONRADO, en paradero desconocido, se expide el presente a fin que sirva de notificación en forma al mismo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
