    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Comisión de Gobierno del Consell Insular de Formentera, en sesión de 22 de febrer de 2013, aprobó las bases que seguidamente se transcriben&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;BASES QUE DEBE DE REGIR LA CONCESIÓN DE LAS AYUDAS POR DESPLAZAMIENTO A ESTUDIANTES QUE CURSEN ESTUDIOS UNIVERSITARIOS, CICLOS FORMATIVOS O DE EDUCACIÓN POSTOBLIGATORIA REGLADA O ENSEÑANZAS ARTÍSTICAS FUERA DE LA ISLA DE FORMENTERA CURSO 2012–2013&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Consell Insular de Formentera tiene la voluntad de iniciar una política de ayudas económicas para los estudiantes que cursen estudios fuera de esta isla, consciente que se tiene que establecer medidas para compensar el hecho de la insularidad en materia educativa y, así, corregir las desigualdades o los desequilibrios entre los estudiantes de la isla de Formentera con el resto de la Comunidad y del Estado español, tiene la voluntad de compensar el coste económico que supone el desplazamiento de los estudiantes de Formentera, teniendo en cuenta que en nuestra isla aún no hay una oferta formativa amplia al alcance de todas las inquietudes estudiantiles y que, además, este hecho insular conlleva un mayor coste para las personas que tienen que vivir fuera de su lugar habitual de residencia y efectuar desplazamientos periódicamente durante el curso académico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.- Objeto de la convocatoria.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El objeto de esta convocatoria es compensar parte del coste del desplazamiento, de los alumnos de la Isla de Formentera por el curso académico 2011–2012, que se desplace y resida fuera de su domicilio familiar para realizar estudios universitarios, ciclos formativos, educación postobligatoria reglada o enseñanzas artísticas que no se imparten en Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.- Importe y crédito presupuestario.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El importe que se destina a esta convocatoria es de treinta mil euros, con cargo a la partida presupuestaria 334.48000 de los presupuestos correspondientes al ejercicio 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La cuantía individual de la ayuda por desplazamiento será de:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-&lt;/span&gt; Ciento cincuenta euros (150 euros), para&lt;span style="color: black"&gt; los estudiantes que cursen sus estudios en Ibiza, siempre que lo disponible en la partida presupuestaria prevista a tal efecto lo permita. En caso contrario, el importe mínimo se obtendrá haciendo un prorrateo a partes iguales, en función del número de solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-&lt;/span&gt; Cuatrocientos cincuenta euros (450 euros),&lt;span style="color: black"&gt; para los estudiantes que cursen sus estudios fuera de las islas Pitiusas, siempre que el disponible en la partida presupuestaria prevista al efecto lo permitan. En caso contrario, el importe mínimo se obtendrá haciendo un prorrateo a partes iguales, en función del número de solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.- Personas beneficiarias.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Pueden beneficiarse de las ayudas previstas en esta convocatoria, para el curso académico 2011–2012 las personas que se encuentren en alguna de las circunstancias siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Aquel alumnado con domicilio familiar en la isla de Formentera que curse estudios universitarios en centros propios de universidades públicas o privadas o en centros adscritos a ellas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Aquel alumnado con domicilio familiar en la isla de Formentera que curse Ciclos Formativos o Educación postobligatoria reglada fuera de la isla siempre que éstos no se puedan cursar en Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Aquel alumnado con domicilio familiar en la isla de Formentera que cursen enseñanzas artísticas: estudios de música, danza, arte dramático y estudios superiores de artes plásticas y de diseño.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No podrán obtener la condición de persona beneficiaria las personas en las cuales concurra alguna de las circunstancias previstas en el artículo 10 del Decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la ley de subvenciones de las Illes Balears, y el articulo 13.2) de la Ley 38/2003, de 17 de noviembre, general de subvenciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;4.- Requisitos y documentación a presentar.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los estudiantes que estén interesados deben solicitar la ayuda mediante la presentación en el Registro General de Entrada del Consell Insular de Formentera (plaza de la Constitución 1, 07860 San Francisco Javier), de la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Impreso de solicitud específica para esta convocatoria debidamente rellenada. Este impreso se encuentra en el Consell Insular de Formentera o en la página web &lt;/span&gt;www.consellinsulardeformentera.cat.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Impreso de solicitud de transferencia bancaria del cual el alumno/a sea titular o cotitular. (Anexo IV)&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Fotocopia del DNI. En el caso de alumno extranjero: fotocopia del pasaporte juntamente con el NIE, o tarjeta de residencia. En el caso que el DNI no figure con localidad del domicilio del municipio de Formentera, certificado de convivencia que acredite la vecindad administrativa de la persona solicitante y el número de personas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Impreso de matriculación del curso 2012–2013 donde conste el número de créditos matriculados y el nombre de las asignaturas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las personas que quieran acogerse a esta convocatoria de ayudas deberán justificar que tienen como mínimo un año de antigüedad de residencia, bien con la presentación del documento nacional de identidad, siempre que tenga una fecha de expedición superior al año, o bien mediante un certificado de empadronamiento.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Es requisito indispensable para ser beneficiario/a haber aprobado, como mínimo, un 50 % de los créditos mínimos exigidos del último curso realizado. En este sentido, las personas solicitantes deberán aportar un documento acreditativo de las notas obtenidas correspondientes al curso anterior.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Plan de estudios, programación completa.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Así mismo, se deberá justificar que para el curso 2012–2013 la persona solicitante se ha matriculado, como mínimo, del 50 % del total de créditos previstos para el curso.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Modelo de declaración responsable (Anexo II)&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En caso de haberse matriculado de un número inferior al 50% del total de créditos previstos para el curso, se debe aportar la acreditación (original o copia compulsada) del centro universitario que justifique que se ha formalizado la matrícula por el número máximo de créditos posible de acuerdo con la organización administrativa del centro o del expediente académico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Así mismo, se podrá utilizar cualquiera de los medios previstos en el art. 38.4 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común (LRJPAC).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;5.- Corrección y mejora de la solicitud.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el plazo de 30 días, contados desde la finalización del plazo de presentación de solicitudes el Consell dará a conocer, mediante la publicación en el tablón de anuncios del Consell, una lista donde se requerirán las personas interesadas para que en el plazo de 10 días, si la solicitud y/o la documentación tiene algún defecto, la enmienden de acuerdo con lo que dispone el art. 71.1 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común (LRJPAC), y se les advertirá que, en el caso de no hacerlo, se considerara desestimada su petición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se hará publicidad de estos requerimientos en la pagina web &lt;/span&gt;www.consellinsulardeformentera.cat&lt;span style="color: black"&gt;, del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;6.- Plazo de presentación de solicitudes.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El plazo de presentación de solicitudes se inicia al día siguiente de la publicación de esta convocatoria en el BOIB, hasta el 30 de abril de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.- Casos especiales.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las solicitudes de casos especiales o excepcionales no previstos en estas bases serán objeto de resolución puntual por la Comisión de Gobierno, previo informe de los servicios jurídicos de este Consell Insular de Formentera (CIF).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.- Instrucción, resolución y publicidad.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez realizados los actos de instrucción que resulten oportunos, se redactaran las correspondientes propuestas de concesión de las ayudas de desplazamiento que se elevaran a la Comisión de Gobierno, como órgano competente para su concesión. En las propuestas se expresará el nombre de las personas beneficiarias para las cuales se proponen la subvención y la cuantía, así como de las solicitudes excluidas, con la indicación de la causa de exclusión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las ayudas por desplazamiento se harán públicas en el tablón de anuncios de esta corporación, a efectos previstos en el art. 59,6b de la Ley 30/92, de 26 de noviembre, y de conformidad con el art. 34, 2c del Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones. También se hará publicidad de las ayudas por desplazamiento en la pagina web &lt;/span&gt;www.consellinsulardeformentera.cat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.- Recursos.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La resolución de concesión de las ayudas agota la vía administrativa y delante de la misma se puede interponer, o bien, recurso potestativo de reposición delante del mismo órgano que lo ha dictado, es decir, delante de la Comisión de Gobierno del Consell Insular de Formentera, en el plazo de un mes desde la notificación, o bien, recurso contencioso-administrativo delante de los juzgados de lo contencioso-administrativo de Palma de Mallorca, en el plazo de dos meses desde la notificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10.- Pago.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las ayudas que otorgue el Consell Insular se harán efectivas mediante transferencia bancaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.- Compatibilidad.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estas ayudas serán compatibles con otras que se puedan recibir de otras administraciones o entidades, públicas o privadas, pero no por el mismo concepto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;12.- Verificación y control.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las personas beneficiarias de las ayudas quedarán en general sometidas al régimen de obligaciones, intervenciones y sanciones que establece el Decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la ley de subvenciones de las Illes Balears, la Ley estatal 38/2003, de 17 de noviembre, general de subvenciones, el Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el reglamento de la Ley 38/2003, y otra normativa que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;13.- Obligaciones.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Son obligaciones de las personas beneficiarias:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Someterse a las actuaciones de comprobación de la entidad que concede la ayuda y las de control financiero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Acreditar la realización de la actividad al Consell Insular así como el cumplimento de los requisitos y las condiciones que determinen la concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Cualquier alteración de las condiciones tenidas en cuenta para conceder la ayuda podrá dar lugar a la modificación de la resolución de la concesión. El importe de la ayuda otorgada por el Consell en ningún caso no podrá ser de tal cuantía que, aisladamente o en concurrencia con otras subvenciones o ayudas procedentes de cualquier administración o ente publico o privado, supere el coste de la actividad a realizar por la persona beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;14.- Reintegro de las ayudas concedidas.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El incumplimiento de estas obligaciones por parte de las personas beneficiarias, o la alteración sustancial de las condiciones determinantes del otorgamiento de la ayuda o la concurrencia de las causas de reintegro previstas en el articulo 11 del Decreto Legislativo 2/2005, de 28 de diciembre, y el articulo 37 de la ley 38/2003, podrá dar lugar al reintegro de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;15.- Publicación.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estas bases se publicarán en el BOIB y entrarán en vigor al día siguiente de su publicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
