&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. El 13 de noviembre de 2012, el Ayuntamiento de Capdepera presentó a la Vicepresidencia Económica, de Promoción Empresarial y de Empleo una solicitud de autorización para la implantación de las tarifas del servicio de transporte urbano de viajeros con taxis, de Capdepera.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La Comisión de Precios de las Illes Balears, que se reunió el día 26 de noviembre de 2012, acordó requerir al Ayuntamiento de Capdepera que presentara la documentación justificativa de determinadas partidas de gastos.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El 11 de enero de 2013, el Ayuntamiento de Capdepera presentó documentación justificativa en respuesta a este requerimiento.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. El 6 de febrero de 2013, la Dirección General de Transportes emitió un informe técnico que observa algunas diferencias en el estudio económico presentado para la justificación de las tarifas que se solicitan en comparación con el modelo de estudio económico aprobado por l&lt;span style="color: black"&gt;a Comisión de Precios de las Illes Balears el 24 de mayo de 2006:&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Las cuantías de las partidas de costes que se consignan en el estudio presentado se ajustan a las del modelo excepto las partidas de aceites y filtros y de neumáticos, que tienen un valor superior pero que se justifican con las correspondientes facturas que ha presentado el Ayuntamiento de Capdepera y que&lt;span style="color: black"&gt;, por lo tanto, se aceptan.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- En la estructura de ingresos del estudio presentado, la distribución de kilómetros recorridos urbanos e interurbanos presenta una proporción más alta de kilómetros urbanos y, por lo tanto, más baja de interurbanos. Este hecho puede tener explicación si tenemos en cuenta que los kilómetros por carrera urbana son superiores a los de otros municipios de la isla, vistas las distancias que existen entre los núcleos de población principales del municipio -Capdepera, Canyamel, Cala Rajada y Font de sa Cala.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- En la estructura de ingresos, el porcentaje de horas muertas del estudio (45%) es muy superior al del modelo (15%). Se entiende que, en este caso, el porcentaje tiene que ser superior al del modelo porque la separación de los principales núcleos de población del municipio provoca que el taxista tenga que hacer más kilómetros en vacío. No&lt;span style="color: black"&gt; obstante, se considera que el porcentaje propuesto es demasiado alto y, por lo tanto, se acepta hasta un máximo de un 35%.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Los ingresos que se derivan de las tarifas urbanas propuestas por el Consistorio y las tarifas interurbanas actualmente vigentes superan sobradamente el coste total que se consigna en el estudio. Por lo tanto, las tarifas se tienen que ajustar para conseguir el equilibrio entre ingresos y gastos del servicio.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Dirección General de Transportes propone ajustar la propuesta del Ayuntamiento de Capdepera para mantener el equilibrio financiero entre ingresos y gastos y rebajar la tarifa del kilómetro de día a 0,95 €; la del kilómetro de noche o en festivo, a 1,10 €; el suplemento de radio-taxi, a&lt;span style="color: black"&gt; 1,13 € y la bajada de bandera, a 2,35 €.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. La Comisión de Precios de las Illes Balears, que se reunió el día 7 de febrero de 2013, examinó el expediente y, de acuerdo con el informe técnico y la propuesta de la Dirección General de Transportes, dictaminó favorablemente sobre la modificación de tarifas que resultaba de reajustar los cálculos a la aplicación de las observaciones hechas en el Informe.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. El Real Decreto 2226/1977, de 27 de agosto, sobre autorizaciones de aumento de tarifas de servicios de competencia local (BOE nº. 207, de 30 de agosto).&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El Real Decreto 2695/1977, de 28 de octubre, sobre normativa en materia de precios (BOE nº. 260, de 31 de octubre).&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. El Real Decreto Ley 7/1996, de 7 de junio, sobre medidas urgentes de carácter fiscal y de fomento y liberalización de la actividad económica (BOE nº. 139, de 8 de junio).&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. La Resolución del vicepresidente económico, de Promoción Empresarial y de Empleo de 3 de octubre de 2011 de delegación de competencias y de delegación de firma en determinados órganos de la Vicepresidencia Económica, de Promoción Empresarial y de Empleo, de otras consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, de la Agencia Tributaria de las Illes Balears y del Servicio de Salud de las Illes Balears, y de suplencia de los órganos directivos de la Vicepresidencia (BOIB nº. 153, de 8 de octubre).&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante del vicepresidente económico, de Promoción Empresarial y de Empleo en el plazo de un mes contador desde el día siguiente al de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente al de haber recibido la notificación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contenciosa Administrativa.&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
