&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Que en el procedimiento PROCEDIMIENTO ORDINARIO 0000122 /2011 de este Juzgado de lo Social, seguidos a instancia de D/Dª SHI LEI contra la empresa&amp;nbsp; HOLDING LILLE 2005 SL,&amp;nbsp; CONSTRUCCIONES Y PROMOCIONES MANCOR 2007 SL, sobre ORDINARIO, se ha dictado la siguiente resolución, cuya parte dispositiva se adjunta:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;u&gt;A U T O&lt;/u&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Magistrado/a-Juez&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sr/Sra. D/Dª.&amp;nbsp; ELENA LILLO PASTOR&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En PALMA DE MALLORCA, a catorce de Diciembre de dos mil doce.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ANTECEDENTES DE HECHO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt; SHI LEI ha interpuesto demanda frente a&amp;nbsp; HOLDING LILLE 2005 SL,&amp;nbsp; CONSTRUCCIONES Y PROMOCIONES MANCOR 2007 SL , que fué admitida a trámite, señalándose para la celebración de los actos de conciliación y juicio, por resolución de 05/10/12.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;Al acto de conciliación/juicio la parte demandante ha manifestando que desiste de la acción entablada contra CONSTRUCCIONES Y PROMOCIONES MANCOR 2007 SL.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp; En el día y hora señalados, se procede a llamar a las partes, una vez comprobada la constancia en autos de haberse realizado su citación en forma.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FUNDAMENTOS DE DERECHO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ÚNICO.- &lt;/strong&gt;Declarada por el actor su voluntad de abandonar el proceso contra CONSTRUCCIONES Y PROMOCIONES MANCOR 2007 SL y al no solicitar el demandado la continuación del procedimiento, procede tener al demandante por desistido de su demanda.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dispone el artículo 83.2 de la LJS, que si el actor citado en forma no compareciese ni alegase justa causa que motive la suspensión del acto de conciliación, o del juicio, el secretario judicial en el primer caso y el juez o tribunal en el segundo, le tendrán por desistido de su demanda.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Vistos los preceptos legales citados y demás de general y pertinente aplicación,&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;PARTE DISPOSITIVA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Dispongo:&lt;/strong&gt; Tener por desistido a SHI LEI de su demanda frente a&amp;nbsp; CONSTRUCCIONES Y PROMOCIONES MANCOR 2007 SL, de cantidad.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Archivar las actuaciones una vez que sea firme esta resolución.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Incorpórese el original al Libro de Autos, dejando certificación del mismo en el procedimiento de su razón.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Notifíquese a las partes, haciéndoles saber que en aplicación del mandato contenido en el artículo 53.2 de la LJS, en el primer escrito o comparecencia ante el órgano judicial, las partes o interesados, y en su caso los profesionales designados, señalarán un domicilio y datos completos para la práctica de actos de comunicación. El domicilio y los datos de localización facilitados con tal fin, &lt;strong&gt;&lt;u&gt;surtirán plenos efectos y las notificaciones en ellos intentadas sin efecto serán válidas&lt;/u&gt;&lt;/strong&gt; hasta tanto no sean facilitados otros datos alternativos, siendo &lt;strong&gt;carga procesal de las partes&lt;/strong&gt; y de sus representantes &lt;strong&gt;mantenerlos actualizados&lt;/strong&gt;. Asimismo deberán comunicar los cambios relativos a su número de teléfono, fax, dirección electrónica o similares, siempre que estos últimos estén siendo utilizados como instrumentos de comunicación con el Tribunal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;MODO DE IMPUGNACIÓN:&lt;/strong&gt; Mediante recurso de reposición a interponer en el plazo de los &lt;strong&gt;TRES DÍAS&lt;/strong&gt; hábiles siguientes a su notificación con expresión de la infracción cometida en la resolución a juicio del recurrente, sin que la interposición del recurso tenga efectos suspensivos con respecto a la resolución recurrida.(ART. 186 Y 187 LPL)&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así lo acuerda y firma SSª. Doy fe.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se advierte al destinatario que las siguientes comunicaciones se harán fijando copia de la resolución o de la cédula en el tablón de anuncios de la Oficina judicial, salvo el supuesto de la comunicación de las resoluciones que deban revestir forma de auto o sentencia, o cuando se trate de emplazamiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En PALMA DE MALLORCA, a siete de Febrero de dos mil trece.&lt;/span&gt;&lt;/p&gt;
