&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aplicación Presupuestaria 310.08&amp;nbsp; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;TASA POR PRESTACION DEL SERVICIO MUNICIPAL DE AGUAS&amp;nbsp; POTABLES, NUEVOS SUMINISTROS Y EXPANSIÓN DE LAS REDES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FUNDAMENTO LEGAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 1. De acuerdo con lo que disponen los artículos 15 a 27 del Texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real decreto legislativo 2/2004, de 5 de marzo, se establece la presente tasa por la prestación de los servicios municipales de agua potable, nuevos suministros y expansión de las redes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;MOTIVO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 2. Los servicios a que se refiere la presente Ordenanza son:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) suministro de agua potable&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) realización de acometidas a la red&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) suministro de contadores&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) contratación consumos en las instalaciones contra incendios&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 3. La obligación de contribuir por el servicio de suministro de agua potable nacerá en el momento en que sea efectiva la acometida, y tendrá carácter continuado aunque no se utilice por motivos ajenos al propio servicio. Con esta finalidad se establecen en esta Ordenanza unas cuotas mínimas de servicio para cada caso en que, teniendo acometida a la red general, no exista consumo de agua.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SUJETO PASIVO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 4. 1. Es sujeto pasivo la persona natural o jurídica, nacional o extranjera, que haya solicitado y obtenido la prestación de cualquier de los servicios regulados en esta Ordenanza.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Tendrán la consideración de sujeto pasivo las herencias yacentes, comunidades de bienes y otras entidades que, con falta de personalidad jurídica, constituyan una unidad económica o un patrimonio separado susceptible de imposición.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Las empresas, entidades o particulares beneficiados de los&amp;nbsp; servicios.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 5. Si el sujeto pasivo o contribuyente no fuese, al mismo tiempo, propietario del inmueble afectado por los servicios, el propietario responderá como substituto de las obligaciones tributarias del contribuyente.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 6. Los sujetos pasivos, tanto principal como substituto, podrán actuar mediante un representante, con el cual se entenderán las sucesivas actuaciones administrativas, si no se hace manifestación formal en contrario.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;BASE IMPONIBLE, TARIFAS Y TIPOS DE GRAVAMEN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 7. Las tarifas por el servicio de suministro de agua, que se facturará por tramos, incluyen el mantenimiento del servicio y los contadores y serán las siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D) ESPECIALES&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. &amp;nbsp;Usuarios que formen parte de un núcleo familiar que sea beneficiario de ayudas económicas individuales, temporales y de emergencia social gestionadas por la Comunitat Autònoma de les Illes Balears, el Consell Insular de Menorca o que acrediten reunir las condiciones objetivas para ello, según informe&amp;nbsp; del&amp;nbsp; Servei d’Atenció Primària del Àrea de Serveis a les Persones de este Ayuntamiento: 25% de la tarifa doméstica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Usuarios con domicilio en el cual pernocten habitualmente más de cuatro personas: 70% de la tarifa doméstica (esta tarifa no se aplicará en el caso de segundas residencias).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Conjunto de viviendas que por razones urbanísticas o legales no tengan contador individualizado: 50% de la tarifa doméstica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Institutos de Educación secundaria y centros educativos concertados: 50% de la tarifa doméstica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. En caso de exceso de consumo por fuga de agua, se aplicará como&amp;nbsp; tarifa, para todos los m3 consumidos, el precio medio que resulte de la facturación inmediatamente anterior a la que puso de manifiesto la fuga.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;NORMAS DE GESTIÓN, LIQUIDACIÓN Y COBRANZA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 9. Normas de aplicación de las tarifas anteriores:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Para las tarifas reflejadas en el artículo 7:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Les liquidaciones se efectuaran trimestralmente. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Si como consecuencia de la planificación de las lecturas se produjese un defecto de menos de 86 días, o un exceso de más de 95, en los incluidos en el período de facturación, se procederá al prorrateo de de los tramos previstos en esta Ordenanza.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Los servicios de mantenimiento no comprenden el valor de las piezas a sustituir, pero sí la rectificación ante el Ministerio de Industria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Las liquidaciones por los servicios de aguas se devengaran trimestralmente, y el período de cobranza comenzará el primer día del mes siguiente al vencimiento de cada uno de los períodos impositivos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Tarifas especiales:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La aplicación de tarifas especiales podrá ser solicitada en cualquier momento y, si es concedida, tendrá vigencia a partir del trimestre natural siguiente al cual se haya producido la resolución positiva:&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Durante un año natural para las tarifas D1 y D2&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Mientras se mantenga la situación que ha dado lugar a la aplicación de las tarifas especiales D3 y D4.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La documentación a presentar con la solicitud será la siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.1.: Copia de la resolución por la cual la CAIB o el CIME ha otorgado al interesado ayudas económicas de carácter social. En el caso de las otorgadas por el Ayuntamiento, la aplicación de la tarifa se tramitará de oficio, previa comunicación de los servicios municipales que la hayan tramitado a los Servicios de Gestión Tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.2.: La pernoctación habitual de las personas que residen en el domicilio o loca se comprobará directamente. Por el propio Ayuntamiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.3: Informe de la empresa concesionaria del Servicio que confirme la existencia de contador colectivo&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.4: Acreditación del régimen que tenga el centro escolar.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.5.: Informe de la empresa concesionaria del Servicio que confirme la fuga como motivo del exceso de consumo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. Liquidación en caso de imposibilidad de lectura del consumo:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En estos casos figurará como consumo el correspondiente al mismo trimestre del ejercicio anterior, y, si esto no es posible, se hará una estimación haciendo la media de los consumos de un máximo de tres trimestres anteriores o, en defecto de lo anterior, aplicando la media de consumos del tipo de contrato de que se trate.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. Tarifa de uso industrial y de servicios&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Al consumo de agua exigido por la actividad ganadera y al producido en los locales en que la actividad ejercida sea fundamentalmente de las encuadradas en las divisiones 1 a 5 (ambas incluidas), a efectos del IAE, se les aplicará la tarifa de uso industrial.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La tarifa de servicios se aplicará al consumo de agua en locales con actividades fundamentalmente encuadradas en las divisiones 6 a 9 de la sección 1ª (sector servicios), sección 2ª (profesionales liberales) y 3ª (artistas), a efectos del IAE.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En su caso, la acreditación de la actividad se hará con la correspondiente alta del IAE&amp;nbsp; o del Censo de obligados tributarios correspondiente y cualquier otro documento que considere conveniente el Ayuntamiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Para las tarifas reflejadas en el artículo 8:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Las tarifas 1, 2 y 3 a) se liquidarán por cada petición de servicio formulada y se harán efectivas al solicitar la prestación del mismo por el sistema de liquidación provisional.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La liquidación provisional podrá revisarse según informe de los servicios realmente prestados.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El resto de las cuotas de la tarifa 3 b) se liquidarán anualmente por padrón.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 10&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Las entidades o particulares interesados en la utilización de los servicios regulados por la presente ordenanza presentarán solicitud detallada de los servicios requeridos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. También habrán de presentar la oportuna declaración en caso de alteración o baja en el aprovechamiento de los servicios ya concedidos en el momento en que se produzca la misma o se desee proceder a la baja.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DISPOSICIÓN ADICIONAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Todo lo que no este previsto en esta Ordenanza se regirá por el Texto Refundido de la Ley Reguladora de las Haciendas Locales y la ley general tributaria&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La presente Ordenanza, tendrá vigencia a partir del día siguiente a su publicación definitiva en el BOIB, hasta su modificación o derogación expresa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
