&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;EXPOSICIÓN DE MOTIVOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El impacto ambiental derivado de las actividades en las vías y espacios públicos municipales, hace necesaria la aprobación de una Ordenanza que regule este ámbito de competencia municipal. Estas normas pretenden regular el ejercicio de la actividad de promoción y publicidad, desde una doble óptica:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1. - Considerar los efectos negativos que concurren en el ejercicio de la actividad que se regula: molestias a los ciudadanos / as y efectos negativos para el ambiente (residuos, impacto visual, contaminación acústica, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2. - Este medio de promoción, considerado en abstracto, es una vía legítima para hacer llegar a los potenciales consumidores / as la oferta de sus servicios y / o productos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Por otra parte, también se pretenden defender los derechos de los ciudadanos / as: a no recibir este tipo de publicidad en su casa, si no quieren, y evitar las afecciones a su descanso que puede generar esta actividad. Así como que el coste ambiental ocasionado por estas actividades lo paguen las empresas responsables de la publicidad y no los ciudadanos / as en general.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Todos estos aspectos hacen necesario la adopción de medidas preventivas, correctoras y sancionadoras ante las infracciones cometidas, asegurando que prevalece el interés general sobre los intereses particulares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Capítulo 1. DISPOSICIONES GENERALES. -&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 1. Publicidad dinámica. Definición y medios de publicidad.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La Ley 5/1997 de 8 de julio, reguladora de la publicidad dinámica de las Islas Baleares, define la publicidad dinámica como aquella forma de comunicación llevada a cabo por personas físicas o jurídicas, ya sean públicas o privadas, en el ejercicio de una actividad comercial, industrial, artesanal, social o profesional, encaminada a la finalidad de promover la contratación de bienes o servicios de toda clase, o en la difusión de mensajes de naturaleza social, cultural, política o de cualquier otra naturaleza; realizada por medio del contacto directo de los / las agentes publicitarios / as con los posibles usuarios / as o clientes / clientes y con la utilización preferente, para su práctica, de zonas de dominio público, vías y espacios libres públicos y zonas privadas de concurrencia pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Constituyen medios de publicidad dinámica, a efectos de esta ordenanza:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a. Propaganda manual&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b. Reparto domiciliario de publicidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c. Publicidad mediante el uso de vehículos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;d. Publicidad oral. Se entiende como publicidad oral aquella que transmite sus mensajes de viva voz, con ayuda de megafonía o sin, o de otros medios auditivos auxiliares, mediante el contacto directo entre los / las agentes publicitarios / as y los / las posibles usuarios / as, y con la utilización, para su ejercicio, de las zonas de dominio público, vías y espacio libres y zonas privadas de concurrencia pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 2. Objetivos y ámbito de aplicación de esta norma.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La presente ordenanza tiene por objeto regular y controlar la distribución o difusión de la publicidad comercial directa a propietarios / as de viviendas, establecimientos, oficinas y despachos o entre vecinos / vecinas y personas peatones, así como su depósito en los buzones, porterías , patios, entradas y espacios similares de los inmuebles del término municipal de Santa Maria del Camí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Los objetivos principales que se pretenden alcanzar son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&lt;span style="color: rgb(51, 51, 51)"&gt; Regular la publicidad comercial directa en diferentes lugares, con el fin de reducir al máximo la producción de residuos que genera esta actividad y sufragar los costes de su eliminación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&lt;span style="color: rgb(51, 51, 51)"&gt; Introducir las medidas necesarias para disminuir los perjuicios y molestias que esta actividad provoca en la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&lt;span style="color: rgb(51, 51, 51)"&gt; Mejorar la limpieza, la imagen del pueblo y su sostenibilidad ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;No se podrán difundir mensajes o utilizar cualquier material destinado a propaganda o promoción publicitaria, que atenten contra la dignidad de la persona o vulnere los valores y derechos reconocidos en la Constitución, especialmente los relativos a la infancia, la juventud y la mujer; tampoco publicidad que resulte engañosa, desleal o subliminal o que infrinja la normativa sectorial reguladora de la publicidad de determinados productos, bienes, actividades y servicios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Quedan excluidas de la aplicación de esta ordenanza, las siguientes actividades:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a. - La publicidad electoral, en los aspectos regulados por la legislación electoral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b. - Mensajes y comunicados de las Administraciones Públicas en materias de interés general, aunque su distribución o comunicación se realice por agentes publicitarios / as independientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c. - Aquellos mensajes y comunicaciones relativos a materia de seguridad o emergencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;d. - Aquellas comunicaciones que vayan dirigidas, única y exclusivamente, a la materialización del ejercicio de algunos derechos fundamentales y libertades públicas incluidos en la sección 1 ª, del Capítulo II, del Título I de la Constitución Española que, en su caso, se regirán por la normativa de aplicación a estos derechos y libertades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;e. - Las informaciones y comunicaciones de las entidades vecinales inscritas en el registro municipal de asociaciones del Ayuntamiento de Santa Maria del Camí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 3. Responsabilidad de la publicidad comercial directa.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Son responsables del cumplimiento de esta Ordenanza las personas físicas y&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;jurídicas titulares de la actividad de publicidad comercial directa y las personas repartidoras o difusoras de la misma, que podrán ser objeto de las sanciones administrativas municipales, en su caso, mediante un previo procedimiento sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 4. Normas y obligaciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1) Las actividades de publicidad dinámica están sujetas a la presentación de una declaración responsable por la instalación inicial, suscrita por el interesado en la que manifieste, bajo su responsabilidad, que cumple con los requisitos establecidos en la normativa vigente, que dispone de la documentación que así lo acredita y que se compromete a mantener durante el periodo de tiempo inherente a la actividad. En caso de publicidad mediante el uso de vehículos será de aplicación lo dispuesto en el párrafo anterior, siempre y cuando no se alteren las condiciones normales del tráfico de vehículos, en caso contrario, será necesaria la obtención de la correspondiente licencia municipal .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2) La publicidad se depositará en el interior de los buzones particulares y / o en aquellos espacios establecidos al efecto. Se prohíbe dejar la publicidad en los inmuebles cerrados y también fuera de los vestíbulos y portales de las fincas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;3) Es obligatorio respetar la voluntad de no recibir publicidad, cuando ésta es expresa, absteniéndose en este caso, de entrar en las fincas o de depositarla en los buzones o lugares del inmueble correspondiente. Por no querer publicidad basta dejar un papel visible en el portal, buzón o lugar correspondiente que así lo indique.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;4) Todo el material impreso utilizado en la publicidad será preferentemente reciclado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;5) Todo el material publicitario, al que hace referencia esta Ordenanza, deberá llevar en lugar visible una identificación de la empresa anunciante. En esta debe constar como mínimo: nombre de la empresa, su NIF, la dirección del domicilio y teléfono.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;6) Es de obligado cumplimiento abonar la cuota tributaria para iniciar la tramitación de la solicitud de licencia de ejercicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;7) Los / las agentes publicitarios / as deberán llevar enganchado en un lugar visible de la vestimenta, durante el ejercicio de la actividad de publicidad comercial directa, un identificador con el nombre de la persona que reparte y la empresa para la que reparte la publicidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;8) Las empresas o personas titulares que ejercen la actividad de publicidad dinámica y los / las sedes / sus agentes están obligados a adoptar las medidas correctoras para evitar la suciedad en la zona de actuación publicitaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;9) Las empresas anunciadas serán responsables del cumplimiento de esta Ordenanza. En caso de incumplimiento se aplicará el procedimiento sancionador correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;10) Sólo se podrá repartir o difundir mediante publicidad manual, domiciliaria, oral y de vehículos a motor de lunes a viernes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 5.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La distribución o difusión de publicidad comercial directa en las modalidades manual, domiciliaria, oral y de vehículos a motor, queda limitada al casco urbano, quedando prohibida&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;en zona rústica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;CAPÍTULO II. EJERCICIO DE LA ACTIVIDAD.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 6. - De la documentación preceptiva. -&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Las personas y empresas que desarrollen actividades de publicidad dinámica en el municipio de Santa María del camí deben disponer y, a requerimiento del ayuntamiento, acreditar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1. DNI o NIF del / de la solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2. Alta, en su caso, del Impuesto de actividades económicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;3. Empresas y / o personas que proponen como agentes de publicidad dinámica, con indicación de su DNI o NIF y domicilio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;4. En los supuestos de entidades, agrupaciones, asociaciones sin ánimo de lucro de interés general o los col ectivos, será suficiente la acreditación de la documentación a que se refieren el apartado 1 y 3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;5. Liquidación de la tasa correspondiente para la concesión de la licencia para el ejercicio de la actividad publicitaria comercial directa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;6. Comprobante del pago de la cuota tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;De acuerdo con lo dispuesto en el artículo 35, f) de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, en los supuestos de reiteración de las solicitudes de licencia, no será necesario presentar aquellos documentos que ya se encuentren en poder de la Administración municipal, siempre que no hayan cambiado las circunstancias fácticas o jurídicas de la persona o entidad solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 7.-Cuota tributaria. -&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Para obtener la licencia de actividad para publicidad dinámica y por un plazo máximo de tres días, necesariamente tendrán que abonar con antelación las tasas previstas en la Ordenanza Fiscal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&amp;nbsp;Esta tasa implica la autorización para distribuir publicidad dinámica dentro del casco urbano, quedando prohibido repartir en zona rústica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 8.-Prohibiciones. -&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Queda prohibido:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) Situar o fijar cualquier tipo de material impreso o grafiado, de cualquier naturaleza, en el mobiliario urbano (arbolado, semáforos, señalización vial, postes de alumbrado y bienes similares), en las fachadas, entradas o elementos externos, como carátulas de porteros automáticos, exterior de los buzones, puertas, cerrados y paredes de cerramiento de fincas, solares y terrenos, excepto en aquellos lugares expresamente reservados al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) Situar material de propaganda en parabrisas u otros elementos de los vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c) La colocación o fijación mediante soportes autoadhesivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;CAPÍTULO III. INFRACCIONES Y SANCIONES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 9. Consideraciones generales&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1. Constituyen infracciones administrativas las acciones u omisiones que se describen en la Ley 5/1997 de 8 de julio, reguladora de la publicidad dinámica de las Islas Baleares, y las que, en desarrollo de la misma, se establecen en la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2. Las infracciones a que se refiere el apartado anterior se clasifican en leves, graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 10. Infracciones leves&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Son infracciones leves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) El incumplimiento de las normas sobre el material publicitario de los apartados 6 y 7 del artículo 4.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 11. Infracciones graves&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Son infracciones graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) El ejercicio de las actividades publicitarias reguladas en esta Ordenanza sin previa presentación de declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) La contravención de las obligaciones establecidas en los apartados 3, 8 y 10 del artículo 4.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c) La falta de adopción de las medidas correctoras a que se refiere el apartado 2 del artículo 4.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;d) La comisión de una infracción leve cuando concurra la circunstancia de reincidencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 12. Infracciones muy graves&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1. Son infracciones muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) La distribución de material publicitario o la difusión de mensajes publicitarios que atenten contra la dignidad de la persona o vulneren los valores y derechos reconocidos en la Constitución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) La falsedad o la ocultación de los documentos o de los datos declarados en la declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c) La comisión de una infracción grave cuando concurra la circunstancia de reincidencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;d) El uso de animales como reclamo o complemento de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2. A los efectos del presente artículo y del anterior, hay reincidencia cuando la persona responsable haya sido sancionado / a por la comisión de más de una infracción leve, grave o muy grave de la misma naturaleza (publicidad dinámica) en el plazo de un año y las sanciones correspondientes sean firmes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 13. Cuantificación de las sanciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1. Las infracciones reguladas en este capítulo se castigarán con las siguientes sanciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) Infracciones leves: multa de 100 hasta 250 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) Infracciones graves: multa hasta de 251 a 500 euros. Cuando la sanción sea por haber repartido material sin pagar la tasa preceptiva, la sanción será como mínimo del doble de lo que se ha dejado de pagar, mal supere el importe estipulado como máximo en este apartado, hasta un límite de 1.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c) Infracciones muy graves: multa de 501 a 1.500 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 14. Procedimiento sancionador&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Los expedientes sancionadores se someterán a los principios de la potestad sancionadora establecidos por la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El procedimiento sancionador se regirá por lo establecido en el Decreto 14/1994, de 10 de febrero, por el que se aprueba el Reglamento del procedimiento a seguir por la Administración de la Comunidad Autónoma de las Islas Baleares en el ejercicio de la potestad sancionadora y, supletoriamente, por lo previsto en el Real Decreto 1398/1993, de 4 de agosto, por el que se aprueba el Reglamento del procedimiento para el ejercicio de la potestad sancionadora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Antes de incoar un expediente sancionador, se podrá adoptar por la Alcaldía una medida cautelar, amparada por la Ley Balear de referencia, y consistente en el comiso del material de promoción publicidad, si se trata de una actividad no permitida o de la que no se ha presentado declaración responsable en el Ayuntamiento, o si se considera que esta medida resulta necesaria, con el fin de impedir el ejercicio o la continuación de la actividad, en caso de que se haya detectado una infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La presente ordenanza entrará en vigor el día siguiente de la fecha de publicación del texto íntegro en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
