    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el BOIB nº 165 de fecha 6.11.2012, se publicó el acuerdo del Pleno del Ayuntamiento de Ferreries de fecha 27 de septiembre de 2012, de la aprobación provisional de la modificación de la ordenanza reguladora de la tasa por suministro de agua.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Una vez finalizado el plazo de exposición pública sin que se hayan presentado reclamaciones, el mencionado acuerdo ha resultado elevado a definitivo y se transcribe el texto íntegro de la ordenanza:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“&lt;b&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR SUMINISTRO DE AGUA&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;b&gt;Artículo 1.-&lt;/b&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt; Concepto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En conformidad con lo previsto en el artículo 58 de la Ley 39/1998, de 28 de diciembre, reguladora de las haciendas locales, este Ayuntamiento establece el precio público para el suministro de agua, que se regirá por la presente ordenanza.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Artículo 2.- &lt;/b&gt;Obligados/das al pago.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Están obligadas a pagar el precio previsto en esta ordenanza las personas que se beneficien de los servicios o actividades, prestados o realizados por este Ayuntamiento, a que se refiere el artículo anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Artículo 3.-&lt;/b&gt; Cuantía.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La cuantía del precio regulado en esta ordenanza será la fijada en las tarifas contenidas en el apartado siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Las tarifas de esta precio público serán las siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;TARIFA 1.&lt;/b&gt;&lt;span style="font-weight: normal"&gt; Suministro de agua.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a.- Cuota fija:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por beneficiarios del servicio ............................................. 24 euros&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Normas de aplicación:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se entiende por beneficiario el propietario o poseedor del inmueble afectado o el titular de la industria o comercio.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La cuota se liquidará por trimestres, que vencerán el primer día del mes de cada trimestre natural.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b.- Cuota variable: ....................................................... 0&amp;apos;46 euros/m3&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Normas de aplicación:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuando en el trimestre anterior la persona beneficiaria hubiera consumido menos de 10 m3, el precio anterior se reduciría en un sesenta por ciento.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuando en el trimestre anterior la persona beneficiaria hubiera consumido más de 45 m3, el precio se incrementará en un treinta por ciento.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La liquidación se efectuará por trimestres naturales vencidos.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;TARIFA 2.&lt;/b&gt;&lt;span style="font-weight: normal"&gt; Conservación de contadores:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a. Contadores de media pulgada ..................................... 2&amp;apos;4 euros&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b. Contadores de 0&amp;apos;75 pulgadas ...................................... 6 euros&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El precio anterior se meritará por trimestre, día primero de cada uno de los naturales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;br /&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;b&gt;Artículo 4.-&lt;/b&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt; Obligación de pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;La obligación de pago del precio regulado en esta ordenanza nace desde que se inicia la prestación del servicio, con periodicidad trimestral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Artículo 5.-&lt;/b&gt; El Ayuntamiento suministrará los contadores de agua, con pago previo del precio correspondiente que será el de su coste.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los cambios de titular de los contratos de suministro, se resolverán por Decreto de Alcaldía de forma gratuita siempre que no se tenga ninguna deuda pendiente. En caso contrario, el solicitante podrá optar entre pagar la cantidad pendiente o pagar el precio fijado por un contador nuevo.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No se permitirán los cambios de titularidad de contadores entre miembros de una misma unidad familiar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;DISPOSICIÓN FINAL&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Esta ordenanza fiscal, aprobada por el Pleno de la Corporación en sesión ordinaria de 27.09.2012, entrará en vigor el mismo día que se publique en el Boletín Oficial de las Islas Baleares, y será vigente hasta que se modifique o derogue expresamente.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
