    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El 13-12-2012 ha quedado definitivamente aprobada la Ordenanza reguladora de los horarios de establecimientos de la oferta turística complementaria, espectáculos públicos y actividades recreativas, aprobada inicialmente por el Pleno del Ajuntament en sesión ordinaria celebrada el día 11-10-2012, y publicado en el BOIB nº 154 de 20-10-2012, después de que se hayan presentado una serie de alegaciones y que hayan sido resueltas. A continuación se transcribe literalmente el contenido de la Ordenanza tal como ha quedado:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;ORDENANZA REGULADORA DE LOS HORARIOS DE ESTABLECIMIENTOS DE LA OFERTA TURÍSTICA&amp;nbsp; ESPECTÁCULOS &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;COMPLEMENTARIA,&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;PÚBLICOS Y ACTIVIDADES RECREATIVAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;u&gt;Preámbulo&lt;/u&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La disposición adicional séptima de la Ley 16/2006, de 17 de octubre de 2006, &lt;span style="color: black"&gt;sobre&lt;/span&gt; régimen jurídico de licencias de actividades deja sin efectos en las Illes Balears la regulación &lt;span style="color: black"&gt;sobre&lt;/span&gt; los horarios de las actividades catalogadas (denominadas antiguamente espectáculos públicos y actividades recreativas). Es decir, deja sin aplicación la circular 3/1990, de día 11 de abril, sobre el horario de cierre de establecimientos públicos y de actividades recreativas, de la Delegación del Gobierno en las Illes Balears, publicada en el &lt;span style="color: black"&gt;BOCAIB&lt;/span&gt; nº 53 de 1 de mayo del 1990 y la circular 5/1992, de día 5 de agosto, sobre el horario de cierre de establecimientos públicos y actividades recreativas, de la Delegación del Gobierno en las Illes Balears, publicada en el &lt;span style="color: black"&gt;BOCAIB&lt;/span&gt; nº 102 de 25 de agosto de 1992.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El artículo 45 de la mencionada Ley 16/2006 indica que el horario general de apertura y de cierre de las actividades catalogadas se debe determinar por orden de la consejería competente en materia de licencias de actividades del Govern de les Illes Balears. Los plenos de los ayuntamientos respectivos &lt;span style="color: black"&gt;pueden&lt;/span&gt; reducir motivadamente, para una zona o zonas de su municipio, los horarios mencionados.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Lo cierto es que en un futuro próximo no se prevé la regulación de los horarios generales de apertura y de cierre a la que hace referencia el artículo antes mencionado de la Ley 16/2006. Así pues, si tenemos en cuenta la Disposición adicional séptima de este cuerpo legal, nos encontramos con una ausencia de regulación de los horarios de apertura y de cierre, ausencia que puede ser solucionada por parte de los ayuntamientos con la aprobación de una ordenanza con respecto a ello.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Con la regulación de los horarios de aquellos establecimientos que &lt;span style="color: black"&gt;pueden&lt;/span&gt; producir molestias se intenta asegurar la tranquilidad y convivencia entre los vecinos del municipio. Su ordenación y el control debe servir para evitar incomodidades que se &lt;span style="color: black"&gt;puedan&lt;/span&gt; producir por ruidos y a la vez para mejorar los aspectos relacionados con la seguridad ciudadana, el orden público, la limpieza viaria, etc., especialmente en la zona del núcleo del conjunto &lt;span style="color: black"&gt;histórico-artístico&lt;/span&gt; de Ciutadella, en el que, a causa de sus características físicas, se producen problemas de convivencia entre los residentes y la explotación de los establecimientos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es objetivo de esta ordenanza proteger derechos constitucionales, como la calidad de vida, el derecho a la salud y a un medio ambiente adecuado para las personas, y al mismo tiempo facilitar disfrutar de un ocio que &lt;span style="color: black"&gt;sea&lt;/span&gt; respetuoso con la convivencia de todos los ciudadanos. Así mismo, garantizar el derecho de las personas consumidoras y usuarias a la igualdad de trato y a la no discriminación por razón de género en el acceso a bienes y servicios.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 1.- Objeto y ámbito de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Es objeto de esta ordenanza la fijación de unos horarios de cierre y de apertura para los locales o establecimientos del término municipal de Ciutadella de Menorca que a continuación se relacionan:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1.- Discotecas, salas de fiestas, salas de baile, y café-conciertos y similares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;2.- Bares o cafés, restaurantes, cafeterías y análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.- Espectáculos cinematográficos y teatrales, bingos, salones recreativos y similares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 35.45pt"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 2.- Clasificación de los locales o establecimientos.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;2.1 Definiciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;Discoteca: &lt;/span&gt;es el establecimiento autorizado para organizar baile público con participación de los asistentes, amenizado exclusivamente por medios mecánicos o electrónicos, y con servicio de bar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;Sala de fiestas: &lt;/span&gt;es el establecimiento autorizado para ofrecer al público servicios consistentes en la presentación, de forma esporádica o continuada, espectáculos artísticos, de pequeño teatro, folclóricos, eróticos, coreográficos, humorísticos, audiovisuales, variedades y atracciones de cualquier tipo en escena o pista; baile público con participación de los asistentes, amenizados mediante ejecución humana y/o medios mecánicos o electrónicos, y con servicio de bar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Sala de baile: &lt;/span&gt;es el establecimiento autorizado para ofrecer servicios de baile público con participación de los asistentes, amenizados por ejecución humana y/o medios mecánicos o electrónicos, y con servicio de bar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Café-concierto: &lt;/span&gt;es el establecimiento autorizado para ofrecer &lt;span style="color: black"&gt;amenizaciones&lt;/span&gt; musicales mediante ejecución humana y/o medios mecánicos o electrónicos, y con servicio de bar. Entre las actividades que le son propias no se incluye la ejecución de ningún tipo de baile ni de espectáculo, ni con participación de los asistentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;Bar cafetería: es el establecimiento que sirve ininterrumpidamente durante su apertura&amp;nbsp; comidas y bebidas para ser consumidas en la barra o en mesas del mismo establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;Restaurante: es el establecimiento que dispone de cocina y servicio de comedor, con el objeto de ofrecer al público comida y bebida para ser consumidos en el mismo local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Espectáculos cinematográficos y teatrales: exhibiciones de cine y representaciones teatrales en edificios adaptados y autorizados para esta finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Bingo: es el establecimiento adscrito a la práctica del juego de lotería o bingo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;Salón recreativo: es el establecimiento que dispone de máquinas recreativas de juego. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;2.2 De acuerdo con lo previsto en la normativa vigente y a los efectos de esta ordenanza, los locales y establecimientos y actividades se clasifican de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Grupo A: discotecas, salas de fiestas, salas de baile, café-conciertos y similares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Grupo B: bares o cafés, restaurantes, cafeterías y análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Grupo C: espectáculos cinematográficos y teatrales, bingos, salones recreativos y similares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 3.- Horarios de apertura y de cierre.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.1. Los horarios de apertura y de cierre de los locales o establecimientos relacionados en el artículo anterior, así como de las terrazas ubicadas en espacios públicos y/o privados de estos, serán los que a continuación se concretan para las diferentes zonas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) Núcleo central del conjunto histórico-artístico (zona de especial protección) y resto de núcleo urbano&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.2 La apertura se refiere al horario a partir del cual está permitido abrir e iniciar la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.3 El cierre se refiere al horario a partir del cual la actividad del local o establecimiento habrá finalizado completamente, momento en el que se deberá finalizar cualquier tipo de ambientación musical, juego, actuación, etc., y a partir del que no se podrá servir ningún tipo de consumición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Tampoco se permitirá la entrada de más clientes y se deberán encender todas las luces interiores del local para facilitar el desalojo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.4 Los locales o establecimientos donde se desarrollen las actividades deberán quedar completamente vacíos de clientes como máximo media hora después del horario de cierre autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.5 Aquellos locales o establecimientos en los que concurran diversas y diferentes licencias de actividades y siempre que el ejercicio de estas no pueda ser separado físicamente, deberán adoptar como horario de apertura y de cierre el que resulte más restrictivo de todas las actividades que lleven a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3.6 Los locales del grupo B que habitualmente sirven desayunos y no realizan ninguna otra actividad no englobada dentro de este grupo, podrán avanzar su horario de apertura dos horas, con la solicitud previa de los titulares de la actividad al Ajuntament, debiéndose realizar el servicio sin ningún tipo de actividad o ambientación musical.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 4.- Reducción de horario.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Excepcionalmente, por acuerdo de Pleno, el Ajuntament podrá reducir el horario general regulado por esta ordenanza de los locales, de las terrazas, de los recintos, de las instalaciones y de otros establecimientos abiertos al público cuando existan locales o instalaciones de este tipo en zonas en las que haya &lt;/span&gt;alta&lt;span style="color: rgb(35, 31, 32)"&gt; concentración de este tipo de negocios, o que estén calificadas y delimitadas como residenciales o medioambientalmente protegidas, e impidan el derecho al descanso de los vecinos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;A los efectos de la aprobación de esta reducción de horarios, se tramitará el correspondiente expediente, de oficio o a instancia de los interesados, donde deberán figurar los informes técnicos necesarios y la correspondiente información que aporten los vecinos de la zona. Por otro lado, antes de la resolución definitiva, se deberá dar trámite de audiencia a la persona titular de los locales o de los establecimientos afectados, para que puedan formular las alegaciones pertinentes dentro del plazo de quince días.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 5.- Fiestas populares.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Sin perjuicio de lo establecido en el artículo 3, el alcalde podrá autorizar de forma expresa y concreta los horarios especiales de aplicación durante los períodos de celebración de fiestas populares, Navidad y Semana Santa, con las limitaciones y durante el concreto período que se determine en la resolución administrativa correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 6.- Infracciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.1. Cualquier incumplimiento del horario general de apertura y de cierre establecido en esta ordenanza será considerado como infracción administrativa y dará lugar a la incoación de expediente sancionador correspondiente y a la adopción de las medidas cautelares que se consideren oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.2. También se consideran infracciones administrativas las acciones u omisiones que vulneren las disposiciones de esta ordenanza, sin perjuicio de las responsabilidades civiles, penales o de cualquier orden que se puedan derivar de estas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.3 De las infracciones de la presente ordenanza serán responsables solidariamente los titulares de las licencias de actividad de los locales, los explotadores, los organizadores o promotores de espectáculos o actuaciones en directo que se lleven a término en este o que se beneficien directamente o indirectamente de su realización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.4 Graduación de las infracciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.4.1 Para las actividades no catalogadas según la Ley 16/2006, de 17 octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Se consideran infracciones leves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) El adelantamiento o retraso del cierre de los locales en un exceso de tiempo de hasta media hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Se considera infracción grave:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) El adelantamiento de la apertura o el retraso del cierre de los locales o establecimientos públicos en un exceso de media hora a una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b) Las infracciones leves cuando, doce meses antes de cometerlas, la persona responsable de las mismas haya sido objeto de sanción mediante resolución definitiva administrativa, por dos o más infracciones graduadas como leves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Se consideran infracciones muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) El adelantamiento de la apertura o el retraso del cierre de los locales o establecimientos públicos en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b) Las infracciones graves cuando, doce meses antes de cometerlas, la persona responsable de estas haya sido objeto de sanción mediante resolución definitiva administrativa, por dos o más infracciones graduadas como graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.4.2 Para las actividades catalogadas según la Ley 16/2006 de 17 octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Según dispone la Ley 16/2006, de 17 de octubre, en el artículo 116.25, cualquier incumplimiento del horario general de apertura y de cierre de las actividades catalogadas será considerado en todo caso como infracción grave con las sanciones que más adelante se especifican.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 7.- Sanciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.1 Las infracciones podrán ser sancionadas por vía administrativa de acuerdo con las siguientes cuantías:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;ACTIVIDADES NO CATALOGADAS SEGÚN LA LEY 16/2006 de 17 octubre&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) Infracciones leves, con multa de 750,00 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b) Infracciones graves, con multa de 1.500,00 euros y, además, se podrá imponer la sanción de suspensión de la actividad por un período de hasta 6 meses y/o la restricción del horario de apertura y el cierre de la actividad de hasta dos horas y por un periodo de hasta 1 año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;c) Infracciones muy graves, con multa de 3.000,00 euros y, además, se podrá imponer la sanción de suspensión de la actividad por un período de hasta 1 año y/o la restricción del horario de apertura y el cierre de la actividad de hasta dos horas y por un periodo de hasta 2 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;ACTIVIDADES CATALOGADAS SEGÚN LA LEY 16/2006 de 17 octubre&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) Infracciones leves, con multa de 750,00 euros, siempre que no concurra ninguna de las circunstancias agravantes previstas que pueden hacer aumentar la sanción hasta el límite de 1.000,00 euros, y se podrá imponer la sanción de suspensión de la actividad hasta un período de un mes en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a.1. El adelantamiento o el retraso de los espectáculos en un exceso de tiempo de hasta media hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a.2. El adelantamiento de la apertura o el retraso del cierre de los locales o establecimientos públicos en un exceso de hasta media hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;b) Infracciones graves, con multa de 1.500,00 euros, siempre que no concurra ninguna de las circunstancias agravantes previstas que pueden hacer aumentar la sanción hasta el límite de 10.000,00 euros, y se podrá imponer la sanción de suspensión de la actividad por un período de hasta 6 mesos y/o la restricción del horario de apertura y el cierre de la actividad de hasta dos horas y por un periodo de hasta 1 año, en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b.1. El adelantamiento o el retraso de los espectáculos en un exceso de tiempo desde media hora hasta una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b.2. El adelantamiento de la apertura o el retraso del cierre de los locales o establecimientos públicos en un exceso desde media hora hasta una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;&amp;nbsp;c) Infracciones muy graves con multa de 10.001,00 euros siempre que no concurra ninguna de las circunstancias agravantes previstas que pueden hacer aumentar la sanción hasta el límite de 100.000,00 euros, y se podrá imponer la sanción de suspensión de la actividad&amp;nbsp; por un periodo de hasta 1 año y/o restricción del horario de apertura y el cierre de la actividad de hasta dos horas y por un periodo de hasta 2 años, en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;c.1. El adelantamiento o el retraso de los espectáculos en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;c.2. El adelantamiento de la apertura o el retraso del cierre de los locales o establecimientos públicos en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.2 Los procedimientos sancionadores pueden determinar, si procede, el alcance de los daños producidos y la obligación de la reposición o restauración de los bienes afectados por la conducta infractora. Las obligaciones de reposición o restauración serán independientes de las sanciones que puedan imponerse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.3 Para la imposición de las sanciones previstas en esta ordenanza, se tendrán en cuenta, en todo caso para graduarlas, los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a) Existencia de intencionalidad o reiteración.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b) Naturaleza de los perjuicios causados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;c) La reincidencia, por comisión en el plazo de un año de más de una infracción de la misma naturaleza cuando así haya sido declarado por resolución firme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 8.- Prescripción de las infracciones y sanciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.1 Las infracciones muy graves prescriben a los tres años, las graves a los dos años y las leves a los seis meses; las sanciones impuestas por infracciones muy graves prescriben a los tres años, las impuestas por infracciones graves a los dos años y las impuestas por infracciones leves al año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.2 El plazo de prescripción de las infracciones comenzará a partir del día siguiente en el que se haya cometido la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Interrumpirá la prescripción de las infracciones, el inicio, con conocimiento del interesado, del procedimiento sancionador, y se reemprenderá el plazo de prescripción si el expediente sancionador permaneciese paralizado durante más de un mes por causa no imputable a la persona presuntamente responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.3 El plazo de prescripción de las sanciones se inicia a partir del día siguiente en el que sea firme, en vía administrativa, la resolución que imponga la sanción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Interrumpirá la prescripción de las sanciones el inicio, con conocimiento del interesado, de la ejecución de la resolución que imponga la sanción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.4 El procedimiento sancionador ordinario debe ser resuelto, y se debe notificar la resolución que corresponda a la persona interesada en el plazo máximo de un año desde que se haya iniciado; y en el caso del procedimiento sancionador simplificado, en el plazo máximo de tres meses; y la caducidad de procedimiento se producirá de la manera que prevé la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 9.- Reconocimiento de responsabilidad.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Las personas denunciadas pueden reconocer su responsabilidad y conformidad mediante el pago de las sanciones pecuniarias con una reducción del 30% del importe máximo de la sanción si el pago se hace efectivo dentro del plazo de quince días desde la notificación del inicio del procedimiento sancionador. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 10.- Medidas cautelares.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.1 Juntamente, o con posterioridad al inicio del procedimiento sancionador por infracciones graves y muy graves, se podrán acordar, mediante resolución motivada, las medidas provisionales imprescindibles para la normal tramitación del expediente sancionador y para asegurar el cumplimiento de la sanción que pueda imponerse y evitar la comisión de nuevas infracciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.2 Las medidas provisionales que pueden adoptarse consistirán en alguna de las siguientes actuaciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a)&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Restricción del horario de apertura y el cierre de hasta dos horas, respecto del cuadro de horarios prevista en el artículo 3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b)&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;La suspensión o prohibición de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;c) La paralización o la clausura de la actividad, del local, del establecimiento, del recinto o de la instalación, o bien el precinto de sus instalaciones, máquinas o aparatos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;d) Otras medidas que no causen perjuicio de difícil o imposible reparación a las personas interesadas o que impliquen violación de los derechos amparados por las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 11.- Competencia y procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.1 El Órgano competente para iniciar y resolver el procedimiento sancionador será el alcalde o la alcaldesa del Ajuntament de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.2 El procedimiento sancionador se realizará de conformidad con el procedimiento establecido en el Decreto 14/1994, de 10 de febrero, sobre procedimiento sancionador de aplicación en la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Artículo 12.- Normativa ambiental y acústica.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Esta ordenanza se entiende sin perjuicio de las disposiciones legales existentes en materia de contaminación ambiental y acústica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Disposición derogatoria&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Queda derogado el artículo 16.4 de la Ordenanza municipal reguladora de las normas de comportamiento en los espacios públicos del Ajuntament de Ciutadella de Menorca aprobada definitivamente por el Pleno de fecha 21-12-2006.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Disposición final&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;La presente ordenanza entrará en vigor una vez sean cumplimentados los trámites establecidos en la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 14.15pt"&gt; &amp;nbsp;&lt;/p&gt;
