CAIB 13542 23887 text/html 260 2012-12-15 ![CDATA[Convocatoria pública de subvenciones del Instituto Mallorquín de Asuntos Sociales para la financiación del transporte ordinario y especial de los usuarios con discapacidad de los centros ocupacionales y centros de día, para el año 2012]] 13541 es CAIB es CAIB 2012-12-07 505637 2012-12-15 ![CDATA[<p lang="es-ES" style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;<span lang="es-ES">La presidenta del Instituto Mallorquín de Asuntos Sociales, en fecha 3 de diciembre de 2012, dictó la siguiente resolución:</span></span></p> <p lang="es-ES" style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><b>Resolución de otorgamiento de la convocatoria de las ayudas económicas del Instituto Mallorquín de Asuntos Sociales para la financiación del transporte ordinario y especial de los usuarios con discapacidad de los centros ocupacionales y centros de día, para el año 2012</b></span></p> <p lang="es-ES" style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;<b>Antecedentes:</b></span></p> <p lang="es-ES" style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">1. En fecha 20 de septiembre de 2012, la presidenta del Instituto Mallorquín de Asuntos Sociales (IMAS) aprobó el expediente de la convocatoria pública de subvenciones para la financiación del transporte ordinario y especial de los usuarios con discapacidad de centros ocupacionales y centros de día, para el año 2012, y autorizó el gasto dimanante de este expediente con cargo a la partida presupuestaria 40.23328.48901 (documento RC con núm. de referencia contable 22012014175) por un importe de novecientos mil euros (900.000,00 €).</span></span></p> <p style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">2. En fecha 25 de septiembre de 2012 se publicó en el BOIB núm. 140 la mencionada convocatoria.</span></span></p> <p style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">3. La Comisión Evaluadora de la convocatoria de referencia se reunió el día 23 de noviembre de 2012 y, según consta en el acta de la misma fecha, ha formulado la pertinente propuesta de resolución de acuerdo con las solicitudes presentadas y los criterios de valoración establecidos en las bases.</span></span></p> <p lang="es-ES" style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">4. El Servicio Jurídicoadministratiu y la Intervención Delegada han emitido los pertinentes informes.</span></span></p> <p lang="es-ES" style="margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><b>Consideraciones jurídicas:</b></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;<span lang="es-ES">1. El Pleno del Consejo de Mallorca, en fecha 5 de mayo de 2005, aprobó las bases reguladoras de las ayudas económicas a entidades de la Dirección del Área de Servicios Sociales del Instituto (BOIB núm. 99 de día 30 de junio), de acuerdo con lo que prevé la Ley 38/2003, de 17 de noviembre, general de subvenciones, aplicable en los términos previstos en la disposición final primera, y el Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">2. De acuerdo con el artículo 3 de los Estatutos del IMAS, este organismo tiene personalidad jurídica propia y la capacidad de obrar necesaria para cumplir sus fines. Entre sus facultades, se encuentra la de otorgar subvenciones (apartado m).</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">3. El artículo 7.2 apartado g de los Estatutos del IMAS establece que corresponde a la Presidencia aprobar y resolver los procedimientos de ayudas y subvenciones.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">4. De acuerdo con las bases y con la convocatoria, el procedimiento de concesión de las subvenciones se tiene que hacer mediante concurso, con el límite del crédito presupuestario disponible para esta convocatoria, y el órgano instructor es el Área de Personas con Discapacidad del IMAS, que tiene que llevar a cabo las actuaciones a que se refieren el artículo 23 y siguientes de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y tiene que formular la propuesta de resolución.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">5. La Comisión Evaluadora constituida para esta convocatoria ha estudiado y comprobado todas las solicitudes presentadas, y ha emitido el informe que sirve de base al órgano instructor para elaborar la propuesta de resolución correspondiente.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;<span lang="es-ES">Por todo ello,</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;<b>RESUELVO</b></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;<span lang="es-ES"><b>Primero.</b> EXCLUIR la solicitud presentada por la entidad Asociación de Familiares de Enfermos de Alzheimer de Mallorca (AFAM). En el punto 3 de la convocatoria, expresamente se establece que podrán solicitar la subvención las entidades sin ánimo de lucro que gestionan centros ocupacionales y centros de día, en régimen de concierto o colaboración con la administración pública competente. La entidad AFAM no gestiona ningún centro ocupacional ni centro de día en régimen de concierto ni en colaboración con el IMAS.</span></span></p> <p lang="es-ES" style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES"><b>Tercero.</b> Modificar el párrafo sexto del punto 13 de la convocatoria, que queda redactado así: </span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">El plazo para la presentación de esta primera justificación económica finalizará el quinto día hábil posterior a la notificación de la resolución de la concesión. </span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES"><b>Quart.</b> Notificar esta resolución a la Coordinación del Área de Personas con Discapacidad, al Servicio de Gestión Económica y a la Intervención Delegada, así como a las entidades interesadas, para que, de acuerdo con lo que se prevé en las bases de la convocatoria y en esta resolución, presenten la primera justificación en el plazo, improrrogable, de cinco (5) días hábiles siguientes a la recepción de la notificación de la presente resolución.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 27.1 de los Estatutos del Instituto Mallorquín de Asuntos Sociales, aprobados por el Pleno del Consejo de Mallorca en fecha 9 de febrero de 2012 (BOIB núm. 28 de 21/02/2012), en relación con el artículo 14.4 de la Ley de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, recurso de alzada ante el Consejo Ejecutivo del Consejo de Mallorca, dentro del plazo de un mes, contado a partir del día siguiente al de la notificación de la presente resolución.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contado a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contado a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).</span></span></p> <p lang="es-ES" style="widows: 0; orphans: 0; margin-bottom: 0cm"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span lang="es-ES">No obstante lo anterior, se puede ejercitar, en su caso, cualquiera otro recurso que se estime pertinente.
