&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;ORDENANZA MUNICIPAL DE LOS SERVICIOS URBANOS DE TRANSPORTE EN VEHÍCULOS LIGEROS PARA LAS LICENCIAS AUTO TAXI DEL AYUNTAMIENTO DE ESPORLES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;CAPÍTULO PRIMERO: OBJETO DE ESTA ORDENANZA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 1.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La presente Ordenanza tiene por objeto, dentro de las competencias municipales, la regulación del transporte público de viajeros, mediante auto-taxi, dentro del término municipal de Esporles. Para el ejercicio y el uso de la actividad regulada por esta Ordenanza, independientemente y sin perjuicio del cumplimiento de cualquieras otras normas del Estado y de la Comunidad Autónoma de las Islas Baleares, se requiere el cumplimiento de las normas y las prescripciones contenidas en esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 2.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Se entiende por servicio de Auto-Taxi, el que se presta con vehículos dentro o fuera de los cascos urbanos de este término municipal, o incluso fuera de él.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;CAPÍTULO SEGUNDO: DE LOS VEHÍCULOS, DE SU PROPIEDAD Y DE LAS CONDICIONES DE PRESTACIÓN DEL SERVICIO.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;u&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Sección 1ª.- Normas Generales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/u&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 3.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El vehículo adscrito a la licencia municipal que faculta la prestación del servicio al público, tendrá que figurar como propiedad del titular de la misma en el Registro de la Dirección General de Tráfico dependiente de la Consejería de Interior del Gobierno Balear. Se exceptúa de esta obligación en el supuesto de uso temporal de otro automóvil por avería del automóvil adscrito a la licencia, previa autorización de la Alcaldía. Los titulares tendrán que concertar obligatoriamente la correspondiente póliza del seguro que cubra los riesgos &amp;nbsp;determinados&amp;nbsp; por la legislación en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los titulares de la licencia de Auto-taxi podrán sustituir el vehículo adscrito a la misma por otro siempre que se solicite la correspondiente autorización a la Alcaldía de este Ayuntamiento, que la concederá una vez comprobadas las condiciones técnicas necesarias de seguridad, conservación, y características fijadas por esta Ordenanza para la prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 5.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las transmisiones por actos interactivos de los vehículos automóviles que prestan servicios de Auto-Taxi, con independencia de la licencia municipal que los afecte, llevarán implícita la anulación de esta, salvo que, en el plazo de tres meses desde que se haya &amp;nbsp;efectuado la transmisión, el transmitente aplique ésta a otro vehículo de su propiedad, contando siempre con la previa autorización referida en el &amp;nbsp;artículo 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 6.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los vehículos destinados a la prestación de los servicios regulados por esta Ordenanza deberán reunir, como mínimo, las siguientes características: Carrocería cerrada con puertas de fácil acceso y funcionamiento que facilite la maniobra con suavidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las dimensiones mínimas y las características del interior del vehículo y de los asientos serán necesarias para proporcionar al usuario la seguridad y comodidad propias de este tipo de servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Por parte del Ayuntamiento, se podrá autorizar para la prestación del servicio de automóviles adaptados para el transporte de personas con condiciones de movilidad reducida, que tendrán que reunir las características propias de los mismos, de acuerdo con las recomendaciones de los organismos competentes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las puertas tendrán que estar dotadas del mecanismo conveniente para accionar sus vidrios a voluntad del usuario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Tanto las puertas como la parte posterior del vehículo tendrán que llevar el número suficiente de ventanas para conseguir la mayor visibilidad, luminosidad y ventilación posible, mediante vidrios inastillables y transparentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En el interior habrá instalado el alumbrado eléctrico necesario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Tendrán que ir equipados con un extintor contra incendios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Tendrán que estar equipados en su interior con un aparato taxímetro debidamente comprobado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Reunirán las condiciones de seguridad, conservación y funcionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Su capacidad no excederá de siete (7) plazas, incluida la del conductor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 7.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El Ayuntamiento podrá ordenar, cuando lo considere necesario, la instalación de dispositivo de seguridad en los vehículos destinados al servicio de Auto- taxi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;También podrá acordar el establecimiento de sistemas de comunicación para mejorar la prestación del servicio al ciudadano, con la Policía, servicios de auxilio y protección ciudadana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;&amp;nbsp;El funcionamiento de la emisora radio-taxi Esporles, será regulado mediante Decreto de Alcaldia, previa audiencia a la Asociación Taxis de Esporles, si es el caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 8.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;No se autorizará la puesta en servicio de vehículos que no se hayan revisado previamente por la Consejería de Industria del Gobierno Balear y por los servicios técnicos del ayuntamiento o un servicio técnico en quien delegue éste, en cuanto a las condiciones de seguridad, conservación y documentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Se verificará la revisión anual de los vehículos destinados a la prestación del servicio de Auto-taxi por la Consejería de Industria del Gobierno Balear, por los servicios técnicos del ayuntamiento o servicio técnico autorizado en quien delegue este, con el fin de comprobar su buen estado de seguridad, conservación y documentación, de la mencionada revisión si esta fuera efectuada por servicios externos al ayuntamiento, se tendrá que presentar ante el ayuntamiento el comprobante pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En cualquier momento se podrá ordenar, por la Alcaldía, la revisión extraordinaria de un vehículo destinado al servicio regulado por esta Ordenanza, sin que se produzca ninguna liquidación ni cobro de tasas por este concepto, aunque sí puede ocasionar, si se detecta alguna infracción, la sanción correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Todo automóvil que no reúna las condiciones técnicas de comodidad, seguridad o conservación exigidas por esta Ordenanza, no podrá prestar servicio, sin un previo reconocimiento del vehículo por parte de los servicios técnicos del ayuntamiento o servicio técnico autorizado en quien delegue este y el visto bueno del Alcalde, en el cual se acreditará la reparación de las deficiencias observadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;u&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Sección 2ª.- De las licencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/u&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 9.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Para la prestación del servicio al público regulado por la presente Ordenanza, será condición indispensable poseer la correspondiente licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Todos los automóviles amparados por licencias otorgadas tendrán que contar con la correspondiente autorización de la Consejería de Movilidad y Ordenación del Territorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 10.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El otorgamiento de nuevas licencias por el Ayuntamiento vendrá condicionado por la necesidad y conveniencia del servicio a prestar al público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Para acreditar esta necesidad y conveniencia se analizará:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) La situación del servicio en calidad y extensión, antes del otorgamiento de nuevas licencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) El tipo, extensión y aumento de los núcleos de población ubicados en el término municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Las necesidades reales de un mejor servicio y más extenso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) La repercusión de las nuevas licencias a otorgar en el conjunto del transporte y la circulación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En el expediente se dará audiencia a las asociaciones del sector y de usuarios de Esporles, si procede, y se solicitará informe a la Dirección General de Transportes del Gobierno Balear, si procede. El expediente tramitado, junto con el informe y&amp;nbsp; las alegaciones presentadas, en su caso, a la Consejería señalada en el artículo anterior, se evaluará en el Ayuntamiento Pleno para la resolución que proceda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 11.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La concesión de las licencias municipales de Auto-Taxi a que se refiere esta Ordenanza, se otorgarán por la Alcaldía con sujeción al siguiente procedimiento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Acuerdo de iniciación del procedimiento de adjudicación de las licencias disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Publicación de la convocatoria en el Boletín Oficial de las Islas Baleares por el plazo de quince días hábiles, a efectos de presentación de solicitudes para las personas naturales o jurídicas interesadas, así como en el tablón de anuncios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Finalizado el plazo de presentación, la Alcaldía publicará la lista de solicitantes en la forma y plazo señalados en el apartado anterior, para que los interesados y las Asociaciones profesionales, de empresarios y trabajadores, puedan alegar lo que encuentren oportuno en defensa de sus derechos (exclusión o inclusión indebidas, inexactitudes de los datos personales o profesionales de los solicitantes, carencia de condiciones para acudir a la convocatoria, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) La Alcaldía resolverá la concesión de las licencias a favor de los solicitantes con el mayor derecho acreditado, de acuerdo con el orden de prelación previsto en el &amp;nbsp;artículo siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;e) En el supuesto de la inexistencia de solicitudes por parte de los conductores asalariados a que se refiere al artículo 12 de esta Ordenanza, la adjudicación de las licencias se realizará mediante concurso público y libre según el procedimiento establecido por las normas de contratación local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 12.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Podrán solicitar licencias de auto-taxi de nueva creación o las rescatadas por el ayuntamiento, los conductores asalariados de los titulares de licencias de la misma clase que prestan el servicio con plena y exclusiva dedicación a la profesión, acreditada mediante la posesión y vigencia del carnet de conducir, expedido por la Alcaldía y la inscripción y cotización en tal concepto a la Seguridad Social, y las personas naturales jurídicas que las obtengan mediante concurso público y libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La prelación para la adjudicación de las licencias de la clase Auto-Taxi, será siempre a favor de los conductores asalariados, de los titulares de licencias de la misma clase que se hace constar en el anterior párrafo, por rigurosa y continuada antigüedad. En su defecto, las licencias se otorgarán por concurso público y libre entre las personas naturales o jurídicas que las soliciten, con sujeción a lo previsto en el apartado e) del artículo 11 de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 13.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las licencias reguladas en esta Ordenanza se podrán transmitir siempre que el&amp;nbsp; adquiriente cumpla las condiciones exigidas en esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En todos los supuestos de transmisión intervivos de licencia de auto-taxi, a favor de persona que no tenga la condición de cónyuge, hijo político no separado de su cónyuge o heredero forzoso a que se refiere el artículo 807 del Código Civil, se reconocen a favor del Ayuntamiento de Esporles el derecho de tanteo y retracto, que podrá ejercer dentro de los sesenta días siguientes al de la notificación del titular interesado en la transmisión o a partir de la fecha en que tuviera conocimiento que esta se había efectuado en condiciones diferentes de las comunicadas al Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las tasas a abonar por las transmisiones a favor de persona que no tenga la condición de cónyuge, hijo político no separado de su cónyuge, o heredero forzoso a que se refiere el artículo 807 del Código Civil. La autorización de traspaso implica el pago en el Ayuntamiento, sin perjuicio del pago de las exacciones que resulten de las ordenanzas municipales fiscal, de un 10 % del precio fichado para la transmisión&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 14.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las licencias municipales previstas en esta Ordenanza se transcribirán en documento administrativo, siendo cruzadas por una franja de color azul de derecha a izquierda en diagonal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Todas las licencias serán condicionadas, en cuanto a su eficacia, &amp;nbsp;a los vehículos a los cuales afecten y reúnan las condiciones exigidas por esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 15.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Toda persona titular de la licencia de las clases A o B, tendrá la obligación de explotarla personal o conjuntamente, mediante la contratación de conductores asalariados en posesión del permiso local de conductor y afiliación a la Seguridad Social. La explotación de la licencia no será incompatible con otras actividades, siempre que se cumpla con los turnos de actividad mínimos y servicios nocturnos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 16.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En el plazo de ciento veinte días naturales, contados desde la fecha de concesión de la licencia municipal, su titular estará obligado a prestar servicios de forma inmediata y con el vehículo correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 17.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El negociado correspondiente de este Ayuntamiento llevará un registro o fichero de las licencias autorizadas de la clase Auto-Taxi, donde se apuntarán las diferentes incidencias relativas a los titulares o a sus vehículos y conductores, así como a sustituciones, accidentes, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;u&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Sección 3ª.- De las tarifas y de las condiciones de prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/u&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 18.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El régimen de tarifas aplicable a los servicios urbanos prestados por los vehículos adscritos a las licencias reguladas por esta Ordenanza, se fijará por la Junta Local de Gobierno de este Ayuntamiento y los servicios interurbanos que presten, por la Dirección general de Transportes del Gobierno Balear (Comisión de Precios). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En el correspondiente expediente, alegarán, por un plazo de quince (15) días hábiles, las Asociaciones profesionales de empresarios y trabajadores representativos del sector y las de consumidores y usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las tarifas de aplicación serán visibles por el usuario desde el interior del vehículo. En las mismas, se verán las tarifas y los suplementos de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Estas tarifas y suplementos serán de obligado cumplimiento por los titulares de las licencias, los conductores de los vehículos y por los usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 19.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La revisión de las tarifas se realizará también, de acuerdo con el procedimiento establecido en el artículo anterior, para su autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 20.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los vehículos destinados a la prestación del servicio, además de cumplir con lo que disponen los artículos 6, 7 y 8 de la presente Ordenanza, deberán cumplir las siguientes normas y condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Tendrán que llevar un cuentakilómetros y/o aparato taxímetro debidamente comprobado y precintado por la Consellería de Industria del Gobierno Balear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) La pintura exterior será de color blanco. En las dos puertas delanteras llevarán pintada una franja de siete (7) centímetros de anchura colocada oblicuamente y de color ‘azul capri”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) También en las puertas delanteras y centrado encima de la franja determinada en el apartado b) anterior, llevarán el escudo de la ciudad acompañado del número de licencia municipal correspondiente, con cifras de seis (6) centímetros de altura. El modelo del escudo será facilitado por el Ayuntamiento, previo abono de las tasas pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) Cuando los vehículos se encuentren parados, tendrán que llevar la luz verde de la torreta encendida. A criterio del titular podrá llevar un cartel indicando ‘ LIBRE ‘ u ‘ OCUPADO ‘ en el interior pero visible desde el exterior y situado en la parte derecha del parabrisas delantero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 21.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Durante la prestación del servicio de Auto-taxi, los conductores de estos tendrán que ir provistos de la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;A.- En lo referente a los vehículos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Autorización, en su caso, de la DIRECCIÓN GENERAL DE TRANPORTE DEL GOBIERNO BALEAR para realizar servicios de carácter interurbano. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Póliza de seguro&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;B.- En lo referente al conductor:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Carnet de conducir de la clase exigida por la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Permiso municipal de conductor expedido por la Alcaldía&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;C.- En lo referente al servicio:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Libro de reclamaciones, según el modelo oficial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Una copia de la presente Ordenanza del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Direcciones y situación de los lugares de emergencias, centros de salud, comisarías de Policía, Guardia Civil, Bomberos y demás servicios de urgencia, de carácter local, comarcal o insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Plano y listado de calles del término municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Talonario-recibo autorizado por el Ayuntamiento, referido a la cuantía total percibida, de las en concepto de horas de espera y a las salidas del territorio jurisdiccional de este municipio, los cuales podrán ser exigidos por los usuarios y comprobados en las revisiones periódicas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Ejemplar oficial de la tarifa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 22.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La Alcaldía, previa audiencia a las Asociaciones Profesionales, Usuarios y consumidores, regulará las paradas mediante Decreto de Alcaldía, donde se determinará el lugar, número de plazas y forma de estacionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 23.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Tendrá preferencia para recoger a los viajeros y las reservas de prestación de servicios, el vehículo que ocupe el lugar más próximo a la cabecera de la ‘parada’ la cual, para mayor claridad, será señalizada de la forma más conveniente por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El vehículo de siete plazas podrá recoger pasajeros si es requerido y está colocado en segundo lugar de la parada. Los vehículos especiales de transportes de personas de movilidad reducida, podrán ser requeridos por los usuarios, ocupen cualquier lugar de la parada, siempre que sea para desarrollar las tareas específicas por sus características técnicas. Ningún Auto-Taxi podrá recoger pasajeros a una distancia inferior a cincuenta (50) metros de la parada, si en estas hay vehículos libres disponibles por los usuarios. Se exceptúan los vehículos especiales de transportes de personas de movilidad reducida, si es requerido por un usuario con movilidad reducida, siempre que sea para desarrollar las tareas específicas de sus características técnicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El vehículo de siete plazas y los especiales de transportes de personas de movilidad reducida, podrán aceptar reservas a cualquier lugar de la parada, siempre que sea para desarrollar las tareas específicas de sus características técnicas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Para una mayor eficacia del servicio, los vehículos que ocupen los tres primeros lugares, no podrán ser abandonados por sus conductores, exceptuando los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Que se asegure, al menos,&amp;nbsp; la prestación por un número de vehículos igual o superior al cincuenta por ciento de los fijados como máximo por cada parada en el artículo 22 de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Que, en cualquier caso, quede suficientemente justificada la ausencia y aceptada, en su caso, por los conductores de los vehículos que lo sigan por orden de preferencia en la parada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;De cualquier forma, el incumplimiento de la obligación de permanencia en la parada por los conductores que ocupan los primeros lugares, salvo que concurran al unísono las circunstancias indicadas a los apartados a) y b) precedentes, llevará emparejada la pérdida del lugar que ocupe en el orden de preferencia de la parada, pudiendo ser contrapasada por los vehículos que, en aquel momento, ocupen lugares con carencia de derechos a la prestación de servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 24.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Queda prohibido ocupar lugar en la parada antes de acabar totalmente el último servicio realizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 25.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El vehículo que tenga un viaje concertado con antelación, tendrá que comunicarlo a los otros conductores de la parada, no pudiendo aceptar un viaje para la misma hora. La antelación de la comunicación indicada será de treinta minutos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;CAPÍTULO TERCERO: DEL PERSONAL AFECTO AL &amp;nbsp;SERVICIO.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Sección 1ª.- Requisitos generales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 26.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los vehículos adscritos al servicio de Auto-taxi, tendrán que ser conducidos exclusivamente por personas que estén en posesión del permiso municipal de conducir por lo que afecta al transporte urbano. Este permiso será expedido por la alcaldía con la anterior tramitación del correspondiente expediente a petición del interesado, en el que se justifiquen, como mínimo, los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Poseer el carnet de conducir de la clase requerida según la legislación vigente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) No sufrir enfermedad infecto-contagiosa o impedimento físico que imposibilite o dificulte el ejercicio de la profesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Aquellos otros que se dispongan en la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 27.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La Alcaldía, mediante Decreto podrá establecer las medidas necesarias para la Organización y Ordenación del servicio de Auto-Taxi en cuestión de horarios de turnos, calendario, descanso, y vacaciones a propuesta de la Comisión Informativa de Presidencia, y previa ponderación de los expedientes correspondientes, en los cuales necesariamente, tendrán que ser oídos las Asociaciones profesionales de empresarios y trabajadores correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Si por razones justificadas, algún conductor no puede prestar servicio de guardia nocturno, no podrá realizar ningún servicio entre las 22’00 y 6’00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;u&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Sección 2ª.- De la forma de prestar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/u&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 28.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los conductores de vehículos incluidos en esta Ordenanza están obligados a cumplir escrupulosamente las disposiciones de la misma, independientemente de las condiciones laborales reguladas por la legislación pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 29.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El conductor solicitado para realizar un servicio en la forma establecida, personalmente o por radio taxi, no podrá negarse sin una causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Tendrá la consideración de causa justificada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Ser requerido por individuos perseguidos por Agentes de la Autoridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Ser solicitado para transportar un número de personas superior al de las plazas autorizadas por el vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Encontrarse a cualquiera de los viajeros con una embriaguez manifiesta o intoxicación por estupefacientes, excepto en casos de peligro grave o inminente por su vida o integridad física.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) Cuando el equipaje de los viajeros, por su naturaleza o características, bien sean maletas o animales, puedan deteriorar o causar daños en el interior del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;e) Cuando el conductor del vehículo sea requerido para prestar el servicio por vías intransitables que pueda causar peligro para la seguridad e integridad, tanto de los ocupantes cómo del conductor del propio vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;f) Cualquier otra causa similar a las llamadas anteriormente, que justifique la negativa a prestar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;h) Cuando el usuario habitual haya sido denunciado por no haber abonado un servicio anterior, siempre que no lo haya hecho con posterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En cualquier caso, los conductores mantendrán un comportamiento correcto con el público y, en caso de que un usuario lo requiera, tendrán que justificar la negativa ante un Agente de la Autoridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 30.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los conductores no podrán evitar que los viajeros lleven en el vehículo maletas u otros equipajes, siempre que quepan encima de la baca del vehículo, no lo deterioren ni infrinjan el reglamento o disposiciones en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Podrán llevar en el interior del vehículo un cartel que prohíba fumar a los usuarios. Los conductores no fumarán cuando vayan ocupados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 31.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Cuando los viajeros abandonen transitoriamente el vehículo por ellos arrendado y el conductor tenga que esperar que vuelvan, podrá recaudar como garantía el importe del recorrido realizado más media hora de espera en zona urbana y una hora si se trata de un descampado, y una vez agotado el tiempo, se considerará como finalizado el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 32.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Si el conductor tuviera que esperar a sus clientes en lugares donde el estacionamiento sea de duración limitada, podrá reclamar el importe del servicio efectuado, sin obligación por parte suya de continuar con la prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 33.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Los conductores de los vehículos regulados por esta Ordenanza, estarán obligados a proporcionar al cliente cambio de moneda en metálico o billetes hasta la cuantía de cincuenta euros y, si tuvieran que abandonar el vehículo para ir a buscar cambio, no se podrá cobrar ninguna cuantía por el tiempo de espera mientras dure la ausencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 34.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En caso de accidente o avería que provoque la imposibilidad de continuar el servicio, el viajero podrá pedir la intervención de un Agente de la Autoridad que lo compruebe y tendrá que abonar el importe del servicio hasta el instante de la avería o accidente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;u&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Sección 3.- Caducidad y revocación de las licencias y responsabilidades de sus titulares y conductores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/u&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 35.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La licencia caduca por renuncia expresa del titular. La Alcaldía declarará revocadas y retirará las licencias a sus titulares por las siguientes causas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Usar el vehículo para la prestación de servicio diferente al autorizado por la licencia correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Dejar de prestar el servicio al público durante un tiempo superior a sesenta días consecutivos o ciento &amp;nbsp;veinte alternos durante la temporada turística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Cuando el titular de la licencia no tenga concertada la póliza de seguro. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) Reiterado incumplimiento de las disposiciones sobre revisión periódica a la que &amp;nbsp;hace referencia el artículo 8 de la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;e) El arrendamiento, alquiler o apoderamiento de la licencia, que suponga una explotación no autorizada por esta Ordenanza y las transferencias de licencias no autorizadas por la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;f) El incumplimiento de las obligaciones inherentes a la licencia y demás disposiciones que hagan referencia a la propiedad del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;g) La contratación de personal asalariado, sin el necesario permiso municipal de conducir del artículo 27 o sin el alta y cotización a la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La caducidad y retirada de la licencia se acordará por la Junta de Gobierno Local del Ayuntamiento, previa tramitación del correspondiente expediente, el cual podrá incoarse de oficio i/o a instancia de las centrales sindicales, agrupaciones profesionales y asociaciones de consumidores y usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 36.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Tendrán la consideración de falta leve:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Descuido de la limpieza personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Descuido con la limpieza del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Discusiones entre compañeros de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) El incumplimiento del Reglamento y normas de funcionamiento de la emisora de radio base.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;e) El incumplimiento en general de cualquier norma de la presente ordenanza, excepto &amp;nbsp;las ya contempladas expresamente como faltas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 37- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Se considerarán faltas graves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) No cumplir las órdenes concretas del itinerario marcado por el viajero, haciendo el recorrido más largo innecesariamente para poder percibir servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Poner en servicio el vehículo sin estar este en buenas condiciones de funcionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) La utilización de palabras y hechos desagradables y de amenaza en el trato con los usuarios o dirigidos a los peatones o conductores de otros vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) Cometer cuatro faltas leves en un periodo de dos meses, o diez si es en temporada turística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;e) La no asistencia a las paradas, durante la temporada turística, por un espacio de una semana consecutiva sin causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;f) Recoger viajeros en los lugares no autorizados, fuera del Término Municipal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;h) La no prestación del servicio de los turnos de guardia obligatorios establecido por Decreto de Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;i) El incumplimiento del Reglamento y normas de funcionamiento de la emisora de radio taxi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 38.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Se considerarán como faltas muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Abandonar al viajero sin finalizar el servicio para el cual &amp;nbsp;fue requerido, sin causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Cometer cuatro faltas leves en el periodo de duración de una temporada turística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Conducir el vehículo en estado de embriaguez.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;d) Apropiarse de cualquier objeto abandonado sin dar cuenta del hecho a la Autoridad competente dentro de las 72 horas siguientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;e) Las infracciones determinadas como muy graves en la normativa de seguridad vial y la manifiesta desobediencia a las órdenes de esta alcaldía dentro de esta materia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;f) La comisión de delitos, calificados por el Código Penal como dolosos, con ocasión o motivo del ejercicio de la profesión a la cual hace referencia esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;g) El cobro abusivo a los usuarios o cobrar tarifas inferiores a las autorizadas, bien sea concediendo rebajas sobre los precios autorizados o bien, de forma indirecta, dando comisiones a terceros para acaparar servicios en detrimento de los compañeros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;h) El no cumplimiento del Reglamento y normas de funcionamiento de la emisora de radio taxi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 39.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Las sanciones, debidas a las faltas tipificadas en los artículos anteriores serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;a) Por las faltas leves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Amonestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Suspensión de la licencia o del permiso municipal de conducir hasta 15 días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;b) Por las faltas graves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Suspensión de la licencia o del permiso municipal de conducir de 16 días a 6 meses&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-top: 0px; margin-right: 0px; margin-bottom: 0px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;c) Por las faltas muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Suspensión de la licencia o del permiso municipal de conducir hasta 1 año. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;- Retirada definitiva de la licencia o del permiso municipal de conducir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En todo caso se sancionarán con la retirada definitiva del permiso municipal de conducir y si el conductor fuera el titular de la licencia, con su revocación las infracciones definidas en los apartados c), e) y f) del artículo 38 de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 40.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;El procedimiento sancionador se sustanciará de acuerdo con las siguientes instrucciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;1.- El procedimiento tendrá que incoarse por providencia de Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;2.- A tal efecto, la Alcaldía al recibir aquella comunicación o denuncia sobre una supuesta infracción de lo dispuesto en la presente Ordenanza por parte de titulares de licencia o conductores de la misma, &amp;nbsp;podrá acordar la instrucción de una información confidencial y reservada antes de dictar la providencia a la que se refiere el punto primero o, en su caso, al archivo de las actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;3.- En la misma providencia en que la alcaldía acuerde la incoación del expediente sancionador, se nombrará un instructor y secretario, designaciones que se notificarán al sujeto, expedientado, a efectos de posible recusación de los mismos dentro del plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;4.- El instructor ordenará la práctica de cuántas pruebas y actuaciones conduzcan a la aclaración de los hechos y a determinar las responsabilidades susceptibles de sanción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;5.- A la vista de las actuaciones practicadas, el instructor formará un pliego de cargos en el cual se expondrán los hechos imputados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;6.- Este pliego de cargos se notificará a los interesados por vía de Alcaldía, concediendo un plazo de 8 días para que puedan responder.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;7.- Contestado el pliego de cargos o finalizado el plazo para hacerlo, sin haberlo hecho, el instructor formulará propuesta de resolución, que igualmente se notificará a los interesados por vía de Alcaldía, para que en el plazo de 8 días puedan alegar lo que consideren conveniente por su defensa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;8.- La propuesta de resolución, con todo el procedimiento anterior, se remitirá después a la Alcaldía para que lo resuelva. Si la sanción propuesta corresponde a faltas o infracciones tipificadas en la presente Ordenanza como leves y graves, lo resolverá la Alcaldía&amp;nbsp; las infracciones muy graves serán traspasadas a la Junta de Gobierno Local para que decida sobre las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;En contra de la resolución que define al expediente administrativo sancionador podrá acudir a la vía contenciosa-administrativa en la forma prevista a la normativa aplicable al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;CAPÍTULO QUART: MESA DE SEGUIMIENTO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Artículo 41.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Se creará la mesa de seguimiento, cuyo objeto será el cumplimiento de la presente ordenanza, la elevación de propuestas a la misma y el conocimiento de los decretos de alcaldía que la desarrollen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La mesa estará compuesta por el Alcalde o persona que designe, un Técnico Municipal, Un representante de la consejería de Transportes y un regidor de cada partido político.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;La mesa se reunirá una vez el año a propuesta de una de las partes, propuesta que se tendrá que solicitar por escrito en el registro municipal, proponiendo los temas a tratar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Y habiendo transcurrido el plazo de exposición al público de treinta (30) días de duración a contar desde el mencionado anuncio sin que se haya presenta ninguna reclamación o sugerencia, se entiende de conformidad con lo que dispone el art. 17 del RDL 2/2004 de 5 de marzo por el que se aprueba el texto Refundido de la Ley Reguladora de las Haciendas Locales, definitivamente aprobada..&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 8pt"&gt;&lt;span style="font-family: times new roman, serif"&gt;&lt;span style="color: black"&gt;Lo cual se hace público para general conocimiento y a los efectos pertinentes de acuerdo con el art. 17 del mencionado texto legal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
