&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Pleno de la Corporación, en sesión ordinaria, día 27 de septiembre de 2012, adoptó el acuerdo que a continuación se transcribe, y que se ha convertido definitivo:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;quot;5.MODIFICACIÓN DE LA ORDENANZA REGULADORA DE LA TASA PARA LA PRESTACIÓN DE LOS SERVICIOS DE ENSEÑANZAS ESPECIALES EN ESTABLECIMIENTOS MUNICIPALES&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se pasa a la votación y el Pleno acuerda, con 9 votos a favor (PP y A + A) y 3 en contra (CpC):&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Aprobar provisionalmente la modificación de la ordenanza reguladora de la tasa para la prestación de los servicios de enseñanzas especiales en establecimientos municipales de la siguiente manera:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El artículo 6 de la ordenanza reguladora de la tasa para la prestación de los servicios de enseñanzas especiales en establecimientos municipales, en el epígrafe 1, Escuela de música, queda redactado de la siguiente manera:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuota por matrícula (incluye todo el curso) € 27,5&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuota por asistencia y mes:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Iniciación al lenguaje musical € 36,3&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Lenguaje Musical (Grado Elemental) € 36,3&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;grupos de 6 o más € 12,1&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Pianista acompañante: a precio de clases&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;de instrumento&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;(*) Los alumnos que sólo se matriculen instrumento y no hagan lenguaje musical deberán pagar un suplemento de 6,6 € mensuales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Someter esta aprobación a información pública mediante anuncio en el BOIB por plazo de treinta días, para que los interesados puedan presentar las alegaciones que estimen oportunas, si no se presentan la aprobación será definitiva y se publicará el texto del ordenanza íntegramente en el BOIB, enviando su copia a la Administración del Estado y el Consell de Mallorca. &amp;quot;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La redacción íntegra de la Ordenanza reguladora de la tasa para la prestación de los servicios de enseñanzas especiales en establecimientos municipales, es la siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;quot;ORDENANZA REGULADORA DE LA TASA POR LA PRESTACIÓN DE LOS SERVICIOS DE ENSEÑANZAS ESPECIALES EN ESTABLECIMIENTOS MUNICIPALES. Aprov. por el Pleno 27092012.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 1. Fundamento y naturaleza.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Al amparo de lo previsto en los artículos 58 y 20.4 v) de la Ley 39/1988, de 28 de diciembre, reguladora de las Haciendas Locales, de conformidad con lo dispuesto en los artículos, 15 a 19 de este texto legal, este Ayuntamiento establece la tasa por la prestación de servicios y la realización de actividades de enseñanza en la escuela de Música y en otros establecimientos docentes municipales, que se regirá por la presente Ordenanza fiscal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 2. Hecho imponible.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Constituye el hecho imponible de la tasa la prestación de servicios y la realización de actividades de enseñanza en la escuela de Música y en otros establecimientos docentes municipales, destinados a impartir enseñanzas especiales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 3. Sujetos pasivos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Son sujetos pasivos de la tasa, en concepto de contribuyentes, las personas físicas que soliciten o se beneficien de la prestación de servicios o realización de las actividades de enseñanza que se detallan en el artículo 6 de esta Ordenanza.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Cuando los alumnos matriculados sean menores de edad, vendrán obligados al pago sus padres o tutores.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 4. Responsables.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Son responsables tributarios las personas físicas o jurídicas determinadas como tales en la legislación general tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La derivación de responsabilidad requerirá que, previa audiencia del interesado, se dicte acto administrativo, en los términos previstos en la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 5. Beneficios fiscales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. No se aplicarán exenciones ni bonificaciones para la determinación de la deuda tributaria que los sujetos pasivos deban satisfacer por esta tasa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. No obstante lo dispuesto en el apartado anterior, en el artículo 6.2. de esta Ordenanza se contienen tarifas reducidas aplicables cuando los sujetos pasivos acrediten escasa capacidad económica.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El artículo 6. Cuota tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Escuela de Música. La cuota tributaria se determinará en función de la tipología de servicios de enseñanzas especiales que se hayan solicitado o que se utilicen, a tal efecto se aplicarán las siguientes tarifas&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuota por matrícula (incluye todo el curso) € 27,5&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuota por asistencia y mes:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Iniciación al lenguaje musical € 36,3&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Otros cursos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuota por matrícula € 50&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuota por cada día de duración de los curso 10 €&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.Reduccions a las cuotas de la Escuela de Música:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Para pertenecer a familia numerosa: 10% de reducción.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Por familia numerosa + 2 miembros de la misma familia en la escuela: 15% de reducción.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Por familia numerosa + 3 miembros de la misma familia en la escuela: 20% de reducción.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Dos miembros de la misma familia en la escuela: 10% de reducción.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De estas reducciones se n&amp;apos;aplicarà una por cada caso, lo más favorable al interesado.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. En situaciones de escasa capacidad económica, que valorará el área de servicios sociales del Ayuntamiento, cuando se impartan clases de música u otros enseñanzas especiales, se aplicarán las tarifas reducidas que aconsejen los mismos servicios sociales para cada caso concreto , atendiendo a las circunstancias concretas.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. En caso de que los usuarios no estén inscritos como residentes en el Padrón municipal en este municipio, las tarifas se incrementarán un 20%.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 7. Acreditación y período impositivo.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La tasa por enseñanza en la Escuela de Música devenga en el momento de formalizar la matrícula en cada curso escolar, independientemente de la recepción efectiva de enseñanza si es que su falta fuera por causas imputables al solicitante.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. En las tasas por enseñanzas diferentes al mencionado en el apartado I, se aplicarán los siguientes criterios.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Cuando se trate de servicios que deben llevarse a cabo en un día, la tasa se devenga cuando se presenta la solicitud del servicio, el cual no se realizará sin que se haya efectual el pago de la tasa .&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) En el caso de que la solicitud del servicio se extienda a varios meses, la tasa se devengará can inicie la prestación del servicio o la realización de la actividad de enseñanzas especiales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Con carácter previo al inicio del servicio deberá depositar el importe correspondiente al pago del primer período trimestral de prestación del servicio.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 8. Régimen de declaración y de ingreso.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La tasa por servicios en la Escuela de Música tendrá que pagar cuando se formaliza la inscripción o matrícula.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. En el caso de tasas por otras enseñanzas especiales, que se extiendan a varios meses, se pagará dentro de los primeros diez días de cada trimestre natural, los comprendidos en el curso escolar, el importe correspondiente a tres meses.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. La tasa se exigirá en régimen de autoliquidación.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Cuando se solicita la prestación del servicio, se presentará debidamente cumplimentado el impreso de autoliquidación de la tasa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. El ingreso de la cuota tributaria se efectuará simultáneamente a la presentación de la autoliquidación.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. El pago de la tasa podrá realizarse mediante domiciliación bancaria, que solicitará el interesado en las oficinas municipales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. Las cuotas liquidadas y no satisfechas se exigirán por la vía de apremio.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 9. Infracciones y sanciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por lo que respecta a las infracciones y sanciones tributarias que, en relación a la tasa regulada en esta Ordenanza, resulten procedentes, se aplicará lo dispuesto en la legislación general tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Disposición Final.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta Ordenanza fiscal entrará en vigor a partir del día 1 de enero de 2013, y deroga cualquier otra que existiera y esté en contradicción con la misma. &amp;quot;---------------------------------------------------&lt;/span&gt;&lt;/p&gt;
