    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Intentada sin efecto la notificación con acuse de recibo al conductor/a o titular del vehículo denunciado, por ignorarse el domicilio o no haber hallado en el mismo a los interesados/as, mediante el presente edicto, el cal se realiza también mediante anuncio en el tablón de edictos del Ayuntamiento de acuerdo con lo establecido en el art. 11 del RD 320/1994, de 25 de febrero, y de acuerdo con lo previsto en los artículos 59.5) y 59.6) y 61 de la Ley 30/1992, de 26 de noviembre, modificada por la Ley 4/1999, de 13 de enero, se notifica que por el Sr. Alcalde, asistido por la Junta de Gobierno Local, se ha acordado la &lt;strong&gt;Resolución imponiendo sanción y de emisión de liquidación de la multa impuesta,&lt;/strong&gt; de los expedientes que a continuación se detallan, incoados por infracciones al RD 1428/2003, de 21 de noviembre, por el que se aprueba el Reglamento General de Circulación para la aplicación y desarrollo del texto articulado de la Ley sobre tráfico, circulación de vehículos a motor y seguridad vial, aprobado por el RDL 339/1990, de 2 de marzo, y modificado por la Ley 18/2009, de 23 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra la presente resoluci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n, que pone fin a la v&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;a administrativa, se podr&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt;n interponer, alternativamente, los siguientes recursos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 18pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Recurso de reposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n, con car&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt;cter POTESTATIVO, a interponer ante el mismo &lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;rgano que ha dictado la presente resoluci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n. Este recurso se podr&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt; interponer en el plazo de un MES, contado a partir del d&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;a siguiente al de la publicaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n de la presente notificaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra la desestimaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n expresa del recurso de reposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n podr&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt; interponerse recurso contencioso administrativo, en el plazo de dos meses a contar desde el d&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;a siguiente a su notificaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra la desestimaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n por silencio del recurso de reposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n podr&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt; interponerse recurso contencioso administrativo en el plazo de seis meses contadores a partir del d&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;a siguiente a su desestimaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n presunta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En ning&lt;/span&gt;&lt;span style="color: black"&gt;ú&lt;/span&gt;&lt;span style="color: black"&gt;n caso no se podr&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt; interponer recurso contencioso administrativo hasta que no se haya resuelto expresamente o no se haya producido la desestimaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n presunta del recurso de reposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n interpuesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 18pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Recurso contencioso administrativo ante el correspondiente juzgado de lo contencioso administrativo, en el plazo de DOS MESES contados desde el d&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;a siguiente a la notificaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n de la resoluci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n, de conformidad con lo que dispone la Ley 29/1998, de 13 de julio, que regula la jurisdicci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Todo lo anterior es sin perjuicio que se puedan utilizar todos cuantos recursos alternativos se estimen procedentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;As&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt; mismo cabe indicar que la interposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n de los recursos pertinentes no suspende la eficacia de la resoluci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n impugnada ni interrumpe los plazos que se puedan derivar, a no ser que as&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt; lo acuerde expresamente la autoridad competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Quedando advertido/a de que como disponen los art&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;culos 113.3) de la Ley 7/85 y 14.2) del Real Decreto Legislativo 2/2004, la interposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n de Recurso de Reposici&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n, no interrumpir&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt; en ning&lt;/span&gt;&lt;span style="color: black"&gt;ú&lt;/span&gt;&lt;span style="color: black"&gt;n caso, la acci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n administrativa para el cobro, a menos que se solicite dentro del plazo para interponer recurso, la suspensi&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n de la ejecuci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n del acto impugnado, para lo cual ser&lt;/span&gt;&lt;span style="color: black"&gt;á&lt;/span&gt;&lt;span style="color: black"&gt; indispensable acompa&lt;/span&gt;&lt;span style="color: black"&gt;ñ&lt;/span&gt;&lt;span style="color: black"&gt;ar alguna de las garant&lt;/span&gt;&lt;span style="color: black"&gt;í&lt;/span&gt;&lt;span style="color: black"&gt;as previstas en el citado art. 14.2), que cubra el total de la deuda tributaria, llevando siempre aparejada la obligaci&lt;/span&gt;&lt;span style="color: black"&gt;ó&lt;/span&gt;&lt;span style="color: black"&gt;n de satisfacer los intereses de demora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
