&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Ante la imposibilidad de notificar personalmente la resolución del expediente número 290/2011/R, y número de registro R/5030/BAL, relativo al establecimiento de restauración denominado ES DESPATX, situado en la calle &lt;span&gt;Gremi Ferrers, cantonada Gremi Tintorers, número 58, nave 9&lt;/span&gt;, del término municipal de&lt;span&gt; Palma&lt;/span&gt;, y en aplicación de lo que dispone el artículo 59.5 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, se notifica que en fecha 21 de agosto de 2012, se dictó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;span&gt;«&lt;/span&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;span&gt;1. En fecha 6 de mayo de 2012, con número de registro de entrada &lt;/span&gt;12191&lt;span&gt;, &lt;/span&gt;el señor&lt;/span&gt; &lt;span&gt;&lt;span&gt;Louise Adrianne Poore&lt;/span&gt;, presentó una comunicación para inscribir en el Registro Insular de Empresas, Actividades y Establecimientos Turísticos de Mallorca y General, de las Illes Balears el cambio de titular del establecimiento de restauración&lt;/span&gt; &lt;span&gt;denominado ES DESPATX, con número de registro &lt;span&gt;R/5030&lt;/span&gt;/BAL, situado en la calle &lt;span&gt;Gremi Ferrers, cantonada Gremi Tintorers, número 58, nau 9&lt;/span&gt;, terme municipal &lt;span&gt;de Palma&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;span&gt;2. En fecha 21&lt;/span&gt; de agosto de 2012, la jefa de la Sección VII del Servicio de Ordenación y Planificación Turística ha emitido informe favorable sobre la corrección formal de la documentación presentada para la modificación de los datos del establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;br /&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;1. La Ley 8/2012, de 19 de julio del turismo de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;2. El Decreto 13/2011, de 25 de febrero, por el cual se establecen las disposiciones generales necesarias para facilitar la libertad de establecimiento y de prestación de servicios turísticos, la regulación de la declaración responsable y la simplificación de los procedimientos administrativos en materia turística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;3. La Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;4. La Ley 12/2010, de 12 de noviembre, de modificación de diversas leyes para la transposición en las Islas Baleares de la Directiva 200/123/CE, de 12 de diciembre, del Parlamento Europeo i del Consejo, relativa a los servicios en el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;strong&gt;Propuesta de resolución &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Propongo al director general de Turismo que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;br /&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;1. Ordenar la modificación de datos del establecimiento de restauración&lt;/span&gt; &lt;span&gt;situado en la calle &lt;span&gt;Gremi Ferrers, cantonada Gremi Tintorers, número 58, nau 9&lt;/span&gt;, terme municipal &lt;span&gt;de Palma&lt;/span&gt;, que figuran en el Registro Insular de Empresas, Actividades y Establecimientos Turísticos de Mallorca y General, de las Illes Balears y que, con efecto a partir del día 6 de mayo de 2011, son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;span&gt;2. Nombre comercial: &lt;/span&gt;ES DESPATX&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;3. Número de registro: &lt;span&gt;R/5030&lt;/span&gt;/BAL&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Esta inscripción se realiza sin perjuicio de la obtención de todas las autorizaciones o licencias necesarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;br /&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;&lt;span&gt;&lt;strong&gt;Interposició&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;n de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Contra esta Resolución -que pone fin a la vía administrativa- podrá interponerse recurso potestativo de reposición ante el director general de Turismo en el plazo de un mes, a contar desde el día siguiente al de la recepción de la notificación, de conformidad con lo dispuesto en el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de las Islas baleares. También se podrá interponer recurso contencioso-administrativo ante la Sala Contenciosa del Tribunal Superior de Justicia de las Islas baleares en el plazo de dos meses, a contar des del día siguiente al de la recepción de la notificación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
