Todo ello de conformidad con el artículo 59.4 y 61 de la Ley 30/92, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común. &lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;INICIO PROCEDIMIENTO SANCIONADOR&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Vista la denuncia de la Policía Local contra la persona arriba referenciada, a la que se le imputan los hechos que igualmente figuran, los cuales pueden ser constitutivos de la infracción que se expresa, a razón de la competencia que me otorga el artículo 48 de la Ordenanza Reguladora de la Tenencia de Animales de Compañía y de conformidad con lo dispuesto en los artículos 6 y 8 del decreto 14/1994, de 10 de febrero, del Reglamento del procedimiento de la Potestad Sancionadora de la CAIB, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;PRIMERO. Incoar expediente sancionador contra MARION KAUFMANN por los hechos a que se refiere el acta de denuncia, consistente en LOS PROPIETARIOS O POSEEDORES DE ANIMALES DE COMPAÑÍA ADOPTARÁN LAS MEDIDAS NECESARIAS PARA QUE ESTOS ANIMALES NO PUEDAN ACUDIR LIBREMENTE A LAS VÍAS Y ESPACIOS LIBRES PÚBLICOS O PROPIEDADES PRIVADAS, POR DONDE CIRCULARÁN SIEMPRE CONDUCIDOS (DEJAR SUELTO UN ANIMAL (PERRO MESTIZO COLOR CANELA)) y tipificada en el artículo 6 de la mencionada ordenanza. Así mismo se hace constar que, según dispone el artículo 47, las mencionadas actuaciones serán sancionadas con multa de 60,10 a 300,51 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;SEGUNDO. Denominar Instructor del procedimiento a CATALINA VALLÉS COMAS, a quien es de aplicación el régimen de recusación previsto en el artículo 29 de la ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común (RJAP).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;TERCERO. El Órgano competente para la resolución del procedimiento será el ALCALDE, conforme disponen los artículos 49 de la mencionada ordenanza y 21.1,k de la ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local (RBRL).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;QUART. Indicar al interesado, el derecho que tiene a conocer, en cualquier momento el procedimiento, su estado de tramitación y a acceder y obtener copia de los documentos constituidos en el mismo y a formular con anterioridad en el trámite de audiencia, alegaciones y aportar los documentos que estime pertinentes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Tiene, igualmente, QUINCE DÍAS para aportar cuantas alegaciones, documentos o informaciones estime convenientes y en su caso, proponer pruebas concretando los medios de los cuales pretenda servirse, los gastos de las pruebas y actuaciones relacionadas con este expediente irán a cargo de la persona interesada, según lo que dispone el artículo 8.3 del decreto 14/1994 de 10 de febrero del Reglamento del Procedimiento de la Potestad Sancionadora de la CAIB. Incluso puede reconocer voluntariamente su responsabilidad y hacer efectiva la sanción correspondiente, lo cual pondrá fin al procedimiento sancionador, sin perjuicio de la posibilidad de interponer los recursos procedentes, según prevé el artículo 10 del mencionado Decreto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;QUINTO. Comunicar esta Resolución al Instructor/a, y darle traslado de las actuaciones existentes al respeto y se notificará a los interesados advirtiéndolos que, de no efectuar alegaciones sobre el contenido de la iniciación del procedimiento sancionador en el plazo de QUINCE DÍAS, contados a partir del día siguiente de la notificación, esta iniciación podrá ser considerada propuesta de resolución, con los efectos previstos en los artículos 13,14 y 15 del mencionado Decreto. A estos efectos la propuesta de la resolución señalaría una multa de CIENTO OCHENTA euros (180,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;SEXTO. Informar que si se paga la sanción en el acto de notificación o en el plazo de 15 días, tendrá una REDUCCIÓN DEL 50% de su importe, con las consecuencias y normas de pago y alegaciones previstas en los artículos 2 y 3 de la Ordenanza Fiscal reguladora de la Bonificación del Pago de las Sanciones por infringir las Ordenanzas Municipales (BOIB 09-06-2012).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Binissalem, 13 de agosto de 2012.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Alcalde. Firmado y sellado.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Lo que le notifico en cumplimiento de lo que preceptúa el artículo 8.2) y 4) del Decreto 14/1994, de 10 de febrero del Reglamento del Procedimiento de la Potestad Sancionadora de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente resolución que es un acto administrativo de trámite, no decisorio, que inicia el procedimiento administrativo, es inimpugnable porque no cabe recurso alguno; sin perjuicio de impugnar en su día la decisión que ponga fin al mismo, si es contraria a sus derechos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Le informo, que aún así, puede formular alegaciones (con los efectos previstos al artículo 3 de la Ordenanza Fiscal reguladora de la Bonificación del Pago de las Sanciones por infringir las Ordenanzas Municipales, BOIB 09-06-2012) y aportar los documentos, proponer pruebas, concretando los medios de que se pueda valer y que estime convenientes, en cualquier momento del procedimiento, anterior al trámite de audiencia; aun así, si estas alegaciones no se presentan dentro del plazo de QUINCE DÍAS, contados a partir del día siguiente al de la notificación, la resolución que inicie el procedimiento y que se le notifica en este acto, podrá ser considerada propuesta de resolución con los efectos previstos en los artículos, 13 14 y 15 del reglamento mencionado. Así mismo, el hecho de formular alegaciones, implica la pérdida del derecho a la reducción, según establece el artículo 3 antes mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;FORMAS DE INGRESO (artículo 4 de la misma Ordenanza Fiscal)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Ingreso directo en la cuenta siguiente: “Banca March” 0061-0018-84-0071890113 “&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Transferencia bancaria a la cuenta de la entidad enunciada en el apartado b).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;FORMAS DE JUSTIFICACIÓN DEL PAGO&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez realizado el ingreso, tiene que presentar el justificante bancario al Departamento de Sanciones de este Ayuntamiento, también se puede remitir vía fax, correo ordinario o correo electrónico haciendo constar el núm. de expediente y el nombre del infractor. De no recibir el mencionado justificante, podrá ser considerado como no pagado, y se continuará la tramitación del procedimiento sancionador, según dispone el artículo 5 de de la Ordenanza Fiscal reguladora de la Bonificación del Pago de las Sanciones por infringir las Ordenanzas Municipales, BOIB 09-06-2012.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
