&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;CEDULA DE NOTIFICACION&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el procedimiento de referencia se ha dictado la Sentencia cuyo encabezamiento y fallo son del tenor literal siguiente: &lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SENTENCIA n°: 00212/2012&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En la Ciudad de Palma de Mallorca, a l5 de noviembre de 2012. GUILLERMO ROYO GARCÍA, Magistrado-Juez del Juzgado de Primera Instancia numero 2 de esta Ciudad y su Partido, habiendo visto los autos del juicio verbal con el número 1292/2012 seguidos a instancia de D. JUSTIN JOHN CHRISTOU y DOÑA BRENDA LAURA DAMPHOUSSE, representados por la Procuradora de los Tribunales Dª. MAGADALENA CUART JANER y dirigida por el Letrado D. LUIS MORAGUES CARRATALA, contra DON FRANCISCO PONS NADAL y contra LA HERENCIA YACENTE Y SUS IGNORADOS HEREDEROS Y CAUSAHABIENTES, declarados en rebeldía, sobre prescripción de alodio, se procede a dictar la siguiente resolución, en base a los siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FALLO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;1&lt;/strong&gt;.- &lt;strong&gt;Se estima la demanda&lt;/strong&gt; interpuesta por D. JUSTIN JOHNCHRISTOU y DOÑA BRENDA LAURA DAMPHOUSSE, representados por la Procuradora de los Tribunales Dª. MAGADALENA CUART JANER, contra DON FRANCISCO PONS NADAL y contra LA HERENCIA YACENTE Y SUS IGNORADOS HEREDEROS Y CAUSAHABIENTES, declarados en rebeldía.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2&lt;/strong&gt;.- &lt;strong&gt;Se declara extinguido&lt;/strong&gt; por prescripción el alodio que grava la finca descrita en el Fundamento de Derecho Primero de esta resolución.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3.&lt;/strong&gt;- Se imponen a la parte demandada las costas causadas en esta instancia.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Firme que sea esta resolución, expídase mandamiento al Registro de la Propiedad para que proceda a cancelar la inscripción de dicho alodio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Recurso&lt;/strong&gt;. Contra esta resolución cabe interponer recurso de apelación que deberá INTERPONERSE ante este Juzgado para ante la Audiencia Provincial de Palma de Mallorca en el plazo de VEINTE DLAS a contar desde el siguiente al de su notificación. En la interposición del recurso el apelante deberá exponer las alegaciones en que se base la impugnación, además de citar la resolución apelada y los pronunciamientos que impugna. (Articulo 458 de la Ley de Enjuiciamiento Civil, tras la reforma operada por Ley 37/20ll de l0 de octubre)&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así por esta mi sentencia, de la que se expedirá testimonio para su unión a los autos, la pronuncio, mando y firmo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y como consecuencia del ignorado paradero de FRANCISCO PONS NADAL Y LA HERENCIA YACENTE Y SUS IGNORADOS HEREDEROS Y CASUAHABIENTES, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
