 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;PRIMERA.&lt;/strong&gt;- &lt;strong&gt;Lugar y fecha de la subasta&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La subasta se celebrará a las&lt;strong&gt; 9:30&lt;/strong&gt; horas del día &lt;strong&gt;17 de Diciembre de 2012&lt;/strong&gt; en mi despacho profesional &lt;strong&gt;NOTARIA FCO. JAVIER COMPANY RODRIGUEZ-MONTE, sito en Palma,&amp;nbsp; calle San Miguel, número 28-4º (07002)&lt;/strong&gt;, en única subasta salvo que se interrumpa la tramitación de la misma por mandato judicial o se revoque el requerimiento por el Juzgado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;SEGUNDA&lt;/strong&gt;.-&lt;strong&gt;Bienes objeto de subasta.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;La participación 307 de la serie A, &lt;/strong&gt;de la entidad &lt;strong&gt;“MARINA DE PORTO PI, S.A”&lt;/strong&gt;, titularidad pertenece a la entidad &lt;strong&gt;“LAKEVILLE RESOURCES, S.A”, &lt;/strong&gt;&amp;nbsp;con domicilio a efectos de notificaciones la del Procurador, &lt;strong&gt;DON MIGUEL SOCIAS ROSSELLÓ,&amp;nbsp; Avinguda d&amp;apos;Alexandre Rosselló, 23&amp;nbsp;-5º de Palma de Mallorca. TERCERA&lt;/strong&gt;.- &lt;strong&gt;Tipo de subasta&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La subasta se realizara al mejor postor y el tipo esta fijado en la cantidad de &lt;strong&gt;TREINTA MIL QUINIENTOS NOVENTA Y TRES EUROS Y CINCUENTA Y NUEVE CÉNTIMOS (€ 30.593,59)&lt;/strong&gt;, siendo la enajenación de dicha participación social, sin que puedan realizarse posturas para parte de las mismas.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;CUARTA.&lt;/strong&gt;-&lt;strong&gt; Posturas&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Los licitadores para tomar parte en la subasta, deberán consignar en la &lt;strong&gt;cuenta nº0182.4900.98.0201720270&lt;/strong&gt; abierta a nombre de la Notaria que suscribe en la Entidad &lt;strong&gt;BBVA&lt;/strong&gt;, una cantidad equivalente al veinte por ciento del tipo de licitación. La parte ejecutante podrá tomar parte en la subasta, siempre que existan otros licitadores, sin necesidad de consignar cantidad alguna.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las posturas habrán de realizarse por escrito y en sobre cerrado, en las que se identificará el licitador y se señalara la cantidad fija ofrecida. Los sobres deberán entregarse a la Notario con antelación al acto de la subasta junto con el justificante bancario de haber realizado el depósito a que se refiere el párrafo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El Notario, en su caso, abrirá los sobres y señalara la cantidad que resulte la mejor postura presentada por escrito, &lt;u&gt;incorporando al acta todos los folios de la puja. &lt;/u&gt;A continuación se admitirán posturas verbales de licitadores que, previamente identificados por el Notario, acrediten haber realizado el correspondiente deposito y se adjudicará el remate al mejor postor por la cantidad fija ofrecida, haciéndose constar en acta todas las posturas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;No podrá cederse el remate, a excepción de la ejecutante que si podrá cederlo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El precio del remate se depositara en la Notaria por medio de &lt;em&gt;cheque conformado&lt;/em&gt; de cualquier Entidad bancaria a favor del&lt;strong&gt; Juzgado de Primera Instancia número 13 de Palma de Mallorca, en relación al expediente 748/04&lt;/strong&gt;, relativo al procedimiento de Ejecución de Títulos Judiciales &lt;strong&gt;0001341/2009&lt;/strong&gt;. Si el rematante no deposita el precio del remate en el plazo de diez días naturales desde la fecha de la subasta, perderá la fianza depositada, realizando una nueva adjudicación al favor del siguiente mejor postor y así sucesivamente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
 &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Conforme a lo dispuesto en el articulo &lt;strong&gt;10º&lt;/strong&gt; de los&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;/div&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Estatutos de la sociedad “&lt;strong&gt;MARINA DE PORTI PI, S.A”&lt;/strong&gt;. y en el articulo 125 de la Ley de Sociedades de Capital, celebrada la subasta quedara en suspenso la aprobación del remate y la adjudicación de las participaciones sociales embargadas y se remitirá a la sociedad copia autorizada del acta de subasta a los efectos del ejercicio del derecho de adquisición preferente. Transcurrido cuarenta y cinco días a contar desde la notificación a la sociedad sin que conste el ejercicio del derecho de adquisición preferente, el remate será firme.---&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&amp;nbsp;El señalamiento de la subasta se notificara a los interesados en general &lt;u&gt;mediante publicación&lt;/u&gt; en el &lt;strong&gt;Boletín Oficial de les Illes Balears (BOIB)&lt;/strong&gt;, en &lt;strong&gt;el tablón de anuncios del Juzgado y en el DIARIO EL MUNDO- Dia de Baleares-&lt;/strong&gt;. Asimismo se notificará&amp;nbsp; a la sociedad &lt;strong&gt;“MARINA DE PORTO PI, S.A”, &lt;/strong&gt;a través de su representante, a la sociedad “&lt;strong&gt;AFRECEL, S.L”&lt;/strong&gt;, a través de su abogado Don Miguel Feliu y a la entidad &lt;strong&gt;“LAKEVILLE RESOURCES, S.A”&lt;/strong&gt; por medio de su representante el procurador Don Miguel Socias Rosselló, con despacho profesional en la&amp;nbsp;&amp;nbsp; Avinguda d’Alexandre Rosselló, 23&amp;nbsp;-5º de Palma de Mallorca&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;]]</env:contingut>
