    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Mediante el presente escrito se hace público el contenido del Decreto de la Alcaldía núm. 1550/2012, emitido en fecha 29 de Octubre de 2012, que en su parte expositiva y dispositiva dice:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;“ASUNTO: BAJAS DE OFICIO EN EL PADRÓN MUNICIPAL DE HABITANTES.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto el expediente tramitado por este Ayuntamiento para llevar a cabo la baja de oficio en el Padrón Municipal de Habitantes de este término Municipal, de las personas que a continuación se indican:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sr. Pierre Yves Prioul.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sra. Marion Ingeborg Vogt.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sr. Alessandro Lamira.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sra. Hamida Ben Sbih.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto lo dispuesto en el artículo 72 del Real Decreto 1690/1986, de 11 de julio, por el que se aprueba el Reglamento de Población y Demarcación Territorial de las Entidades Locales, según redacción dada por el Real Decreto 2612/1996, de 26 de diciembre, BOE núm. 14, de 16 de enero, conforme al cual los ayuntamientos darán de baja de oficio, por inscripción indebida, a quienes figuran empadronados incumpliendo los requisitos establecidos en el artículo 54 de este Reglamento, una vez comprobada esta circunstancia en el correspondiente expediente en el que se dará audiencia al interesado. Este deberá comunicar el municipio o país en el que vive habitualmente y solicitar, por escrito, el alta en el padrón municipal o en el Registro de Matrícula de la Oficina o Sección consular correspondiente. Dicha solicitud será tramitada por el Ayuntamiento que acuerde la baja de oficio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si el interesado no manifiesta expresamente su conformidad con la baja, ésta sólo podrá llevarse a cabo con el informe favorable del Consejo de Empadronamiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto que las personas antes relacionadas, NO han expresado su confomidad con la referida baja.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto el informe favorable emitido por el Consejo de Empadronamiento en fecha 21 de Septiembre de 2012.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el ejercicio de las facultades que me confiere la legislación vigente, RESUELVO:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PRIMERO: Dar de baja de oficio en el Padrón Municipal de habitantes de Sant Josep de sa Talaia, de conformidad con lo establecido en el citado artículo 72 RPDT, a las personas que a continuación se detallan:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SEGUNDO: Dar traslado de la presente resolución a las personas interesadas”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Lo que se publica para su conocimiento y a los efectos oportunos, haciendo saber que contra esta resolución se podrán interponer, alternativamente los recursos siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Directamente, el recurso contencioso-administrativo ante el Juzgado Contencioso-Administrativo, en el plazo de dos meses, a contar desde el día siguiente al de la notificación del presente acuerdo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) El recurso de reposición potestativo ante el órgano que ha dictado este acuerdo, en el plazo de un mes, a contar desde el día siguiente al de la notificación de este. Contra la desestimación por silencio del recurso de reposición, que se producirá por el transcurso de un mes desde su presentación sin que se haya resuelto expresamente ni se haya notificado, podrá interponerse el recurso contenciosos-administrativo, en el plazo de seis meses, a contar del día siguiente a la desestimación presunta.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No obstante lo anterior, se puede ejercer, si es el caso, cualquier otro recurso que estime oportuno, todo ello de conformidad con la Ley 29/98, de 13 de julio, reguladora de la jurisdicción contenciosa-administrativa y de la Ley 4/1999, de 13 de enero, de modificación de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común. &lt;/span&gt;&lt;/p&gt;
