&lt;p&gt; Notificaciones de propuestas de resolución de expedientes sancionadores del ayuntamiento de Inca en materia de infracción de la Ley 22/2011 de residuos y suelo contaminados&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Las notificaciones hechas por correo certificado, con acuso de recibo, no han tenido efecto y no se han podido hacer efectivas por ignorarse el domicilio o no haber encontrado a los interesados que se relacionan, por lo cual se procede, en cumplimiento de lo establecido en el artículo 59.5 de la Ley 30/1992 de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo.&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VISTO que en fecha de 28 de marzo de 2012 se inició, mediante decreto de alcaldía núm. 2012/223, expediente sancionador contra las personas relacionas anteriormente, por la infracción del artículo 43.3 c) de la Ley 22/2011, por abandono y/o vertidos de residuos no peligrosos sin que se haya producido un daño o deterioro grave al medio ambiente o se haya puesto en peligro grave la salud de las personas. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VISTO que no se han presentado alegaciones en tiempo y forma.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dado que el expediente en cuestión se tramita por el procedimiento ordinario que establece el Decreto 14/1994, de 10 de febrero, por el cual se aprueba el Reglamento del procedimiento a seguir por la Administración de la Comunidad Autónoma en el ejercicio de la potestad sancionadora.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dado que los hechos son constitutivos de una infracción grave del artículo 43.3 c) de la Ley 22/2011, de 28 de julio, de residuos y suelo contaminados, que pueden ser sancionados con una multa de 901’- euros hasta 45.000’- euros, de acuerdo con lo establece el artículo 47.1 b) de la mencionada ley, la cual se tendrá que valorar en función del riesgo que comporte para las personas o los bienes, así como la existencia de intencionalidad o reiteración y de la naturaleza de los perjuicios causados.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por todo ello, y de acuerdo con lo que dispone el Decreto 14/1994, de 10 de febrero, y el capítulo II del Título IX de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y procedimiento administrativo común, la instructora dicta la siguiente PROPUESTA DE RESOLUCIÓN, para que si lo considera conveniente el Sr. Alcalde-Presidente lo eleve a resolución definitiva:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.- DECLARAR responsables a las personas relacionadas anteriormente, por una infracción del artículo 43.3 c) de la Ley 22/2011, de 28 de julio, de residuos y suelo contaminados, sin que se haya producido un daño o deterioro grave del medio ambiente o se haya puesto en peligro grave la salud de las personas.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.- CALIFICAR la infracción mencionada como grave.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.- IMPONER la sanción de NOVECIENTOS UN EUROS (901’- €) a las personas relacionadas anteriormente, como responsables de la infracción mencionada, de acuerdo con lo que dispone el artículo 43.3 c) de la Ley 22/2011, de 28 de julio, de residuos y suelo contaminados.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4.- NOTIFICAR la presente propuesta de resolución a los interesados en forma reglamentaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformidad con lo que dispone el artículo 14 del Decreto 14/1994, de 10 de febrero, el interesado dispondrá de un plazo de QUINCE DÍAS hábiles, a contar a partir del día siguiente a la notificación de la presente propuesta de resolución, para formular a alegaciones y para presentar los documentos u otros elementos de juicio que considere pertinentes; así mismo dentro del plazo mencionado el interesado podrá consultar el expediente con la asistencia, si es el caso, de los asesores que necesite.&lt;/span&gt;&lt;/p&gt;
