    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Habiendo transcurrido el plazo de exposición al público del expediente relativo a la &lt;/span&gt;modificación de la Ordenanza Fiscal reguladora de los precios públicos de aplicación a las operaciones de adquisición de plazas turísticas en Formentera&lt;span style="color: black"&gt;, la exposición de la cual fue publicada en el Boletín Oficial de las Islas Baleares núm. 84 de fecha 12 de junio de 2012, y no constando la presentación de reclamación en esta Entidad, en cumplimiento de lo que prevé el artículo 17 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, se hace público que ha quedado definitivamente aprobada la &lt;/span&gt;modificación de la Ordenanza Fiscal reguladora de los precios públicos de aplicación a las operaciones de adquisición de plazas turísticas en Formentera&lt;span style="color: black"&gt;, el texto de la cual es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ORDENANZA FISCAL REGULADORA DE LOS PRECIOS PÚBLICOS DE APLICACIÓN A LAS OPERACIONES DE ADQUISICIÓN DE PLAZAS TURÍSTICAS EN FORMENTERA.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 1&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Concepto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En conformidad con lo previsto en el artículo 127, en relación con el artículo 41, del Real Decreto Legislativo 2/2004, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, este Consell Insular de Formentera establece el precio público de aplicación a las operaciones de adjudicación y gestión de plazas turísticas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 2&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Naturaleza&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La contraprestación económica de las operaciones de adjudicación de las plazas turísticas tiene la naturaleza de precio público, por ser una prestación de servicios y realización de actividades competencia de esta entidad y no concurrir en ella ninguna de las circunstancias especificadas en la letra B) del artículo 20.1 del Real Decreto Legislativo 2/2004, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 3&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estos precios públicos consisten en la contraprestación que tienen que abonar los titulares del establecimientos de alojamientos turísticos por la adquisición de plazas turísticas titularidad del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 4&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Obligados al pago&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Están obligados al pago de estos precios públicos los que soliciten o resulten beneficiados o afectados por las gestiones realizadas por el órgano gestor de plazas de Formentera y que tengan por finalidad la legalización, ampliación o apertura de establecimientos turísticos de alojamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 5&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Tarifas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;a) OPERACIONES DE LEGALIZACIÓN DE PLAZAS (art. 12 Ley 4/2010)&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- 2.800 euros por plaza, hasta las 5 primeras plazas por establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- 3.800 euros a partir de la sexta, aplicando a ésta y a las sucesivas un incremento del 1,5% a partir de la decena según la siguiente fórmula&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;P=S&lt;sup&gt;n=5&lt;/sup&gt;&lt;sub&gt;n=1 &lt;/sub&gt;(2800)+ S&lt;sup&gt;n=N&lt;/sup&gt;&lt;sub&gt;n=6 &lt;/sub&gt;(3800)+ S&lt;sup&gt;n=N+1&lt;/sup&gt;&lt;sub&gt;n=7 &lt;/sub&gt;(0,015*3800)&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;donde&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;P= Valor total en euros de las plazas turísticas objeto de adquisición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;N= Número de plazas turísticas que se adquieren.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los precios de aplicación son los que se derivan del siguiente &lt;strong&gt;CUADRO DE TARIFAS&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 4.200 euros por plaza para los establecimientos clasificados en los grupos de hostales, hostales-residencia, pensiones, fondas y casas de huéspedes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 3.800 euros por plaza para los establecimientos clasificados en los grupos de hoteles, hoteles apartamentos y apartamentos turísticos con categoría igual o inferior a 2 estrellas y/o 2 llaves y viviendas turísticas vacacionales (VTV).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 2.800 euros por plaza para el resto de hoteles, hoteles apartamentos y apartamentos que en el momento de la solicitud tengan su inscripción en el registro de turismo con categoría igual o superior a tres estrellas en el caso de hoteles y tres claves en el caso de apartamentos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si realizada la correspondiente inspección por parte de la Autoridad competente en materia de Turismo se demuestra que no se cumplen los requisitos a que se refiere el párrafo anterior, el establecimiento vendrá obligado al pago de 3.800 euros por plaza adjudicada, lo cual tendrá lugar sin perjuicio de las sanciones que pudieran ser aplicables.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;c) OPERACIONES DE ADQUISICIÓN DE PLAZAS COMO CONSECUENCIA DE LA APERTURA DE NUEVOS ESTABLECIMIENTOS.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En los casos de apertura de nuevos establecimientos de alojamiento en la modalidad de hotel, hotel apartamento y apartamento turístico, se establece el precio unitario de 3.800 euros por plaza, previa presentación de la correspondiente declaración responsable por la cual el titular del nuevo establecimiento se comprometa a:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Cumplir con todos los requisitos exigibles por la normativa turística para iniciar la actividad en la categoría cuya inscripción se solicita.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- No operar con la modalidad del todo incluido.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Mantener las instalaciones abiertas durante al menos 7 meses al año.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se reducirá el precio unitario a 2.800 euros por plaza para el resto de hoteles, hoteles apartamentos y apartamentos que realicen su inscripción en el registro de turismo con categoría igual o superior a cuatro estrellas en el caso de hoteles y tres llaves superior en el caso de apartamentos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El incumplimiento del anterior o la reducción de categoría posteriormente, comportará la obligación por parte del titular del establecimiento a abonar al órgano gestor la cantidad resultante de multiplicar 3.800 euros por plaza adjudicada, sin perjuicio de las sanciones que pudieran ser aplicable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;d) OPERACIONES DE REAPERTURA DE ESTABLECIMIENTOS DADOS DE BAJA DEFINITIVAMENTE.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En los casos de reapertura de establecimientos dados de baja definitivamente, con la consiguiente reactivación de plazas turísticas, se establece el precio unitario de 2.800 euros por plaza, previa presentación de la correspondiente declaración responsable por la cual el titular del establecimiento se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Cumplir con todos los requisitos exigibles por la normativa turística para iniciar la actividad en la categoría la inscripción de la cual se solicita. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- No operar con la modalidad del todo incluido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Mantener las instalaciones abiertas durante al menos 7 meses al año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente Ordenanza entrará en vigor el mismo día de su publicación íntegra en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
