&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el presente procedimiento&amp;nbsp; seguido a instancia de MIGUEL ARENAS GOU,&amp;nbsp; LOS ALMENDROS DE IBIZA CONSTRUCCIONES Y PROMOCIONES, S.L. frente a MANUEL PRIETO OLMEDO,&amp;nbsp; NORDAKER INTERNATIONAL SL , RAIMUNDO GOMEZ REVILLA, MARIO MORALES RODES , INGENIERIA Y GEOTECNIA &amp;amp; PROYECTOS Y SERVICIOS SL , LUIS GASCON FOLQUÉ , CONSTRUCCIONES TURRENTAS SL , SERGI CRUZ I ROVIRA , ARENAS Y ASOCIADOS SL , H20 GEOFÍSICA BALEAR SL , GEOTECNIA IBIZA SL , GREAT NIVELON CONSTRUCCIONES Y PROMOCIONES SL , PROCORSAN, S.L. se ha dictado sentencia, cuyo tenor literal es el siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“&lt;strong&gt;Se estima&lt;/strong&gt; el recurso de apelación interpuesto por la procuradora de los tribunales doña María Montserrat Montané Ponce, en nombre y representación de don Miguel Arenas Gou, contra la sentencia dictada el día 11 de abril de 2011 por la Ilma. Sra. Magistrado del Juzgado de Primera Instancia número 4 de Palma de Mallorca, en el juicio ordinario del que el presente rollo dimana.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Se estima&lt;/strong&gt; igualmente el recurso de apelación interpuesto contra la misma resolución por el procurador de los tribunales don José Luis Nicolau Rullan, en nombre y representación de la entidad ‘los Almendros de Ibiza Construcciones y Promociones S.L.’.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En consecuencia, se revoca y deja sin efecto dicha resolución, y en su lugar:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Se desestima&lt;/strong&gt; la demanda interpuesta por el procurador de los tribunales don Gabriel Buades Salom, en nombre y representación de ‘Procorsan S.L.’, contra don Miguel Arenas Gou, dom Mario Morales Rodes, ‘Los Almendros de Ibiza Construcciones y Promociones S.L.’ y contra ‘Norkader Internacional S.L.’, a quienes se absuelve de todas las peticiones formuladas en su contra, con imposición a la actora de las costas de la primera instancia.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No se hace pronunciamiento sobre las costas de esta alzada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Devuélvanse los depósitos constituidos para recurrir’.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y encontrándose dichos demandados,&amp;nbsp; H20 GEOFÍSICA BALEAR SL,&amp;nbsp; GEOTECNIA IBIZA SL, GREAT NIVELON CONSTRUCCIONES Y PROMOCIONES SL, en paradero desconocido, se expide el presente a fin que sirva de notificación al mismo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PALMA DE MALLORCA a dieciocho de Septiembre de dos mil doce.&lt;/span&gt;&lt;/p&gt;
