    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;La Ley 56/2003, de 16 de diciembre, de &lt;/span&gt;&lt;span lang="es-ES"&gt;Empleo (BOE nº. 301, de 17 de diciembre) incluye las políticas activas de empleo de las cuales forma parte el programa de la promoción del empleo autónomo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;La regulación de este programa se hizo por primera vez en el año 1986, atendiendo los importantes cambios producidos en la economía española, principalmente en el mercado de trabajo. Después de aquella primera regulación, se aprobó la Orden TAS/1622/2007, de 5 de junio, por la que se regula la concesión de subvenciones al programa de promoción del empleo autónomo (BOE nº. 136, de 7 de junio), que deroga expresamente la normativa que regulaba estas subvenciones y se adapta a las directrices de la Ley 56/2003, antes mencionada. La nueva regulación del programa mantiene la financiación de los proyectos en las primeras fases de implantación con la finalidad de hacer más atractiva la opción del trabajo por cuenta propia entre las personas en demanda de empleo. &lt;/span&gt;&lt;span lang="es-ES"&gt;Por otra parte, la nueva regulación nace con la intención de paliar las dificultades de incorporación al empleo de determinados colectivos como las mujeres, los jóvenes y las personas con discapacidad, en coherencia con el programa nacional de reformas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;En cuanto al procedimiento de concesión, se mantiene el régimen de concesión directa que prevé el artículo 2.1, letras b) y d), del Real Decreto 357/2006, de 24 de marzo, por el que se regula la concesión directa de determinadas subvenciones en los ámbitos del empleo y de la formación profesional ocupacional (BOE nº. 83, de 7 de abril), según prevé el artículo 2.2 de la Orden TAS/1622/2007 antes mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Las acciones subvencionables que prevé esta Resolución se financian con cargo a los fondos recibidos del Servicio Público de Empleo Estatal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Visto el proceso de traspaso de gestión a las comunidades autónomas de las políticas activas de empleo, la Orden TAS/1622/2007 prevé unos contenidos comunes, incluidos en el capítulo I, que son aplicables en todo el territorio nacional, partiendo de la competencia del Estado en materia de legislación laboral, sin perjuicio de que los ejecuten las comunidades autónomas, mientras que deja a estas últimas los aspectos procedimentales y la adecuación a sus peculiaridades organizativas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;De acuerdo con es&lt;/span&gt;&lt;span lang="es-ES"&gt;to, vista la situación de crisis económica y el interés por mantener la actividad empresarial y la estacionalidad propia de la actividad turística de esta comunidad autónoma, que ha dado lugar a una regulación específica en la contratación del personal mediante la figura del fijo discontinuo, se considera necesario prever también esta estacionalidad en el caso de los trabajadores por cuenta propia, ya que se trata de una realidad económica que no se puede obviar. Y, por lo tanto, la obligación del beneficiario de mantener la actividad económica durante un periodo de tres años (36 meses) puede ser de forma continuada o por fracciones de seis meses durante un periodo superior hasta el cumplimiento de los treinta y seis meses dentro de un máximo de 6 años consecutivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;El artículo segundo del Decreto 1&lt;/span&gt;&lt;span lang="es-ES"&gt;2/2011, de 18 de junio, del presidente de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB nº. 91 ext., de 20 de junio), atribuye a la Dirección General de Comercio y Empresa las competencias relativas al fomento y los registros públicos de la economía social y el trabajo autónomo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;La Orden del consejero de Trabajo y Formación de 4 de mayo de 2005 establece las bases reguladoras de las subvenciones en materia de trabajo (BOIB nº. 73, de 12 de mayo). El artículo 1.2, apartado 28, prevé que puede ser objeto de subvención la promoción del empleo autónomo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-weight: normal"&gt;El artículo 3 de la Orden mencionada establece que las convocatorias de subvenciones se tienen que aprobar &lt;/span&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-weight: normal"&gt;mediante una resolución del consejero o consejera competente en materia de trabajo y formación y se tienen que publicar en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Por todo ello, de conformidad con el artículo 15 del Texto Refundido de la Ley de Subvenciones, aprobado mediante el Decreto Legislativo 2/2005, de 28 de diciembre (BOIB nº. 196, de 31 de diciembre), y el artículo 3 de la Orden de bases reguladoras antes mencionada, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal; text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Primero&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;El objeto de esta Resolución es aprobar y regular &lt;/span&gt;&lt;span lang="es-ES"&gt;la convocatoria de ayudas para fomentar la creación de empleo autónomo con la finalidad de convertir personas desempleadas en trabajadores autónomos o por cuenta propia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Segundo&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Personas b&lt;/span&gt;&lt;span lang="es-ES"&gt;eneficiarias&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;1. &lt;/span&gt;&lt;span lang="es-ES"&gt;Pueden ser beneficiarias de las ayudas que establece esta convocatoria las personas desempleadas e inscritas como demandantes de empleo en la oficina del servicio público de empleo correspondiente que se den de alta en el régimen especial de trabajadores autónomos o régimen especial por cuenta propia que corresponda o mutualidad del colegio profesional, y que estén incluidas en alguno de los colectivos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;span lang="es-ES"&gt;a) mujeres víctimas de violencia de género &lt;/span&gt;&lt;span lang="es-ES"&gt;desempleadas y personas con discapacidad desempleadas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;span lang="es-ES"&gt;b)&lt;/span&gt;&lt;span lang="es-ES"&gt; mujeres desempleadas y jóvenes desempleados de 30 o menos años&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;span lang="es-ES"&gt;c) desempleados no incluidos en los colectivos anteriores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;En todo caso, la persona solicitan&lt;/span&gt;&lt;span lang="es-ES"&gt;te tiene que estar domiciliada en la comunidad autónoma de las Illes Balears y la actividad se tiene que llevar a cabo en el mismo ámbito territorial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Igualmente, h&lt;/span&gt;&lt;span lang="es-ES"&gt;an de estar dados de alta en el censo de obligados tributarios y en el impuesto sobre actividades económicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;La fecha de a&lt;/span&gt;&lt;span lang="es-ES"&gt;lta en el Régimen Especial de Trabajadores Autónomos, en el régimen especial por cuenta propia que corresponda o mutualidad del colegio profesional, se considerará fecha de inicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;2.&lt;/span&gt;&lt;span lang="es-ES"&gt; Los &lt;/span&gt;&lt;span lang="es-ES"&gt;trabajadores autónomos o por cuenta propia que formen parte de comunidades de bienes o de sociedades civiles pueden ser beneficiarios siempre que soliciten las subvenciones a título particular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;3.&lt;/span&gt;&lt;span lang="es-ES"&gt; &lt;/span&gt;&lt;span lang="es-ES"&gt;Quedan excluidos de las ayudas que establece esta convocatoria los socios de sociedades mercantiles de capital, cooperativas y sociedades laborales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;También se excluyen los autónomos colaboradores: se considera así a las personas que colaboran en una actividad de naturaleza autónoma sin ser sus titulares, aunque sea de manera personal, habitual y directa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Igualmente, quedan excluidos de las ayudas los trabajadores que hayan ejercido la misma o similar actividad como autónomos o por cuenta propia (en el mismo o similar epígrafe del impuesto de actividades empresariales o de la declaración censal para el que se solicita la ayuda) durante el año anterior a la fecha de inicio de la actividad para la que se solicita la subvención, y los que ya hayan percibido la ayuda para el establecimiento como trabajadora o trabajador autónomo con anterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tercero&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Importe económico&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;El crédito inicialmente asignado a esta convocatoria para el ejercicio de 201&lt;/span&gt;&lt;span lang="es-ES"&gt;2 es de 700.000,00 € con cargo en la partida presupuestaria 14701 315C01 47000.00 19202 FF del presupuesto vigente de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cuarto&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Solicitudes y documentación&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;1. Las solicitudes, di&lt;/span&gt;&lt;span lang="es-ES"&gt;rigidas a la Dirección General de Comercio y Empresa de la Vicepresidencia Económica, de Promoción Empresarial y de Empleo, según el modelo normalizado del anexo 1 de esta Resolución, se tienen que presentar en el Registro de la Vicepresidencia Económica, en sus delegaciones o en cualquier otro lugar de los que establece el artículo 38.4 de la Ley 30/1992.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Los solicitantes tienen que presentar la documentación siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;a&lt;/span&gt;&lt;span lang="es-ES"&gt;)&lt;/span&gt;&lt;span lang="es-ES"&gt; &lt;/span&gt;&lt;span lang="es-ES"&gt;Anexo 1 de solicitud de subvención de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;b&lt;/span&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;) Alta de la persona solicitante en el régimen especial de la seguridad social de trabajadores autónomos o régimen especial que corresponda o mutualidad del colegio profesional correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;c&lt;/span&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;) Alta de la persona solicitante en el censo de obligados tributarios, en la cual conste la fecha de inicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;d&lt;/span&gt;&lt;span lang="es-ES"&gt;) &lt;/span&gt;&lt;span lang="es-ES"&gt;Fotocopia del DNI/NIE (sólo en el caso de no figurar en la base de datos de la Dirección General de Comercio y Empresa) y certificado de empadronamiento, en caso de que la residencia en las Illes Balears no figure en el DNI/NIE.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;e&lt;/span&gt;&lt;span lang="es-ES"&gt;)&lt;/span&gt;&lt;span lang="es-ES"&gt; Documento bancario acreditativo de la titularidad de la cuenta o modelo TG-002 de solicitud de transferencia bancaria para pagos de la Comunidad Autónoma de las Illes Balears, rellenado adecuadamente, si procede.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;f) Memoria justificativa del proyecto empresarial completa, de acuerdo con el anexo 2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;3&lt;/span&gt;&lt;span lang="es-ES"&gt;. Además, si procede, la persona interesada tiene que aportar la documentación siguiente, en original o copia compulsada, junto con la solicitud:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;a) Acreditación de la condición de persona con discapacidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;En los supuestos de subvenciones para personas con discapacidad, tienen esta consideración las que tengan reconocido un grado de minusvalidez igual o superior al 33 %, de acuerdo con la Ley 51/2003, de 2 de diciembre (BOE nº. 300, de 16 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;b)&lt;/span&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt; Acreditación de la condición de víctima de violencia de género.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;4. En el supuesto &lt;/span&gt;&lt;span lang="es-ES"&gt;de que alguno de los documentos mencionados, con ocasión de la tramitación de otros expedientes a la Dirección General de Comercio y Empresa, ya se haya presentado, no es necesario aportarlo de nuevo, siempre que se hagan constar la fecha y el órgano o dependencia en que se presentó o, en su caso, en qué se emitió, que no hayan transcurrido más de cinco años desde la finalización del procedimiento correspondiente y que no haya sufrido modificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;5. La Dirección General de Comercio y Empresa, en cualquier momento, puede solicitar a&lt;/span&gt;&lt;span lang="es-ES"&gt; las personas interesadas la documentación y la información complementaria que considere necesaria para resolver el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Quinto&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Periodo subvencionable y p&lt;/span&gt;&lt;span lang="es-ES"&gt;resentación de solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;1. &lt;/span&gt;&lt;span lang="es-ES"&gt;El plazo para iniciar las actividades que se pueden subvencionar tiene que comprender desde el 1 de mayo de 2011 hasta la finalización del plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;2.&lt;/span&gt;&lt;span lang="es-ES"&gt; El plazo para presentar las solicitudes es de 15 días hábiles a contar a partir del día siguiente de la publicación de esta Resolución en el &lt;/span&gt;&lt;span lang="es-ES"&gt;Boletín Oficial de las Illes Balears &lt;/span&gt;&lt;span lang="es-ES"&gt;o hasta que se agote la cuantía económica asignada a esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;3.&lt;/span&gt;&lt;span lang="es-ES"&gt; &lt;/span&gt;&lt;span lang="es-ES"&gt;Si la cuantía asignada a esta convocatoria se agota con anterioridad a la finalización del plazo para la presentación, se tiene que suspender la concesión de las ayudas mediante la publicación correspondiente en el &lt;/span&gt;&lt;span lang="es-ES"&gt;Boletín Oficial de las Illes Balears &lt;/span&gt;&lt;span lang="es-ES"&gt;de la resolución del vicepresidente económico, de Promoción Empresarial y de Empleo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Sexto&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Procedimiento para resolver las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;1&lt;/span&gt;&lt;span lang="es-ES"&gt;. Las solicitudes de subvención se tienen que resolver por orden de entrada de los expedientes completos, hasta que se agoten los créditos destinados a la convocatoria o a la finalización del plazo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;2. Una vez resueltos los expedientes completos, si no se ha agotado el crédito previsto, se tramitarán los expedientes con deficiencias y, en este caso, la fecha de presentación de la subsanación establecerá el orden para resolver el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Sépti&lt;/span&gt;&lt;span lang="es-ES"&gt;mo&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Competencia y resoluci&lt;/span&gt;&lt;span lang="es-ES"&gt;ón&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;1. &lt;/span&gt;&lt;span lang="es-ES"&gt;La Dirección General de Comercio y Empresa es el órgano competente para tramitar las solicitudes de ayudas de esta convocatoria. El director general de Comercio y Empresa tiene que emitir las propuestas de concesión o denegación de las ayudas, las cuales tienen que contener la lista de los beneficiarios propuestos para otorgar la subvención, así como las solicitudes excluidas con el motivo de la exclusión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;De acuerdo con el artículo 59.6 de la Ley 30/1992, los actos a que se refieren el apartado sexto, punto 2, y el párrafo anterior se tienen que notificar a las personas interesadas mediante la publicación, durante el periodo de vigencia de esta convocatoria, en la página web de la Dirección General de Comercio y Empresa y en el tablón de anuncios de la Vicepresidencia Económica, de Promoción Empresarial y de Empleo de la sede de Son Castelló (plaza de Son Castelló, 1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;2. La resolución expresa del vicepresidente económico, de Promoción Empresarial y de Empleo finaliza el procedimiento de concesión de la subvención y tiene que motivar y fijar, con carácter definitivo, la cuantía individual de la subvención concedida. Esta resolución se tiene que notificar a las personas interesadas de acuerdo con el artículo 59 de la Ley 30/1992, mediante la publicación en el BOIB. Además, la resolución se tiene que dictar y notificar dentro del periodo de seis meses a contar desde la fecha de finalización del plazo para presentar las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;3. La resolución de concesión tiene que especificar los aspectos siguientes: beneficiario, &lt;/span&gt;&lt;span lang="es-ES"&gt;periodo durante el cual tienen que mantener la actividad, cuantía, partida presupuestaria a la cual se aplica y forma de pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;4&lt;/span&gt;&lt;span lang="es-ES"&gt;. En caso de que el beneficiario reciba otras subvenciones o ayudas para la misma actividad o tipo de actuación, el importe de las subvenciones que establece esta Resolución no puede ser en ningún caso de tal cuantía que, de forma aislada o en concurrencia con otras subvenciones o ayudas, supere el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Octa&lt;/span&gt;&lt;span lang="es-ES"&gt;vo&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Cuantía de las ayudas&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Las cuantías tienen que ser las siguientes, en función del colectivo de que se trate:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;a)&lt;/span&gt;&lt;span lang="es-ES"&gt; 8.000 € para mujeres víctimas de violencia de género y personas con discapacidad desempleadas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;b) 7.000 € para mujeres desempleadas y jóvenes de 30 o menos años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;c) 5.000 € para desempleados no incluidos en los colectivos anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Noveno&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Pago y justificación de actividades&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Una vez presentada toda la documentación conforme y completa, y dictada la resoluc&lt;/span&gt;&lt;span lang="es-ES"&gt;ión de otorgamiento, se tiene que continuar la tramitación para el pago de la ayuda al beneficiario, dado que con la documentación aportada con la solicitud se entiende acreditada la justificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Décimo&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;1. &lt;/span&gt;&lt;span lang="es-ES"&gt;Los beneficiarios quedan obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;a) &lt;/span&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;Mantener su actividad empresarial y su alta en la seguridad social o equivalente durante al menos tres años a contar desde la fecha de alta en la seguridad social o equivalente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;No obstante, el cómputo de este periodo de 36 meses se puede contabilizar de forma no continuada siempre que en el proyecto empresarial presentado se justifique la estacionalidad para ejecutarlo y siempre que el alta en la seguridad social o equivalente sea por periodos de 6 meses, dentro de un máximo de 6 años consecutivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En caso de incumplimiento, la persona beneficiaria tiene que reintegrar las subvenciones percibidas de manera proporcional al tiempo que falte para el cumplimiento del preceptivo plazo, excepto en caso de que se acrediten causas ajenas a la voluntad de la persona beneficiaria y siempre que el cumplimiento se aproxime de manera significativa al cumplimiento total.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;b)&lt;/span&gt;&lt;span lang="es-ES"&gt; Informar a la Dirección General de Comercio y Empresa sobre cualquier alteración de las condiciones que se han tenido en cuenta para conceder la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;c)&lt;/span&gt;&lt;span lang="es-ES"&gt; Someterse a las actuaciones de comprobación que haga la Dirección General de Comercio y Empresa, y a las actuaciones de control financiero de la Intervención General de la Comunidad Autónoma de las Illes Balears y de la Sindicatura de Cuentas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;A estos efectos, la Dirección General de Comercio y Empresa hará las comprobaciones de mantenimiento de la actividad empresarial por medio de informes de vida laboral emitidos por la Tesorería General de la Seguridad Social, excepto en el supuesto de que la persona beneficiaria no la haya autorizado a obtenerlos, o esté inscrita en un régimen especial o mutualidad del colegio profesional correspondiente, caso en que el beneficiario tendrá que presentar, antes del día 30 de junio de cada año, un informe acreditativo del mantenimiento de la actividad empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;d)&lt;/span&gt;&lt;span lang="es-ES"&gt; Comunicar la obtención de otras subvenciones o ayudas para la misma finalidad procedentes de cualquier administración o entidad pública o privada, nacional o internacional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;e)&lt;/span&gt;&lt;span lang="es-ES"&gt; Conservar los documentos justificativos de la aplicación de los fondos percibidos, mientras puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;f)&lt;/span&gt;&lt;span lang="es-ES"&gt; Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 del Decreto Legislativo 2/2005.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Undé&lt;/span&gt;&lt;span lang="es-ES"&gt;cimo&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Normativa de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-weight: normal"&gt;1. La convocatoria se rige por&lt;/span&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-weight: normal"&gt; la Orden del consejero de Trabajo y Formación de 4 de mayo de 2005 por la que se establecen las bases reguladoras de las subvenciones en materia de trabajo (BOIB nº. 73, de 12 de mayo); por el Real Decreto 357/2006, de 24 de marzo, por el que se regula la concesión directa de determinadas subvenciones en los ámbitos del empleo y de la formación profesional ocupacional (BOE nº. 83, de 7 de abril); por la Orden TAS/1622/2007, de 5 de junio, por la que se regula la concesión de subvenciones al programa de promoción del empleo autónomo (BOE nº. 136, de 7 de junio), y por esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;2. En todo &lt;/span&gt;&lt;span lang="es-ES"&gt;aquello que no establecen esta Resolución ni la Orden mencionada se tiene que aplicar el Decreto Legislativo 2/2005.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Duo&lt;/span&gt;&lt;span lang="es-ES"&gt;décimo&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Régimen de minimis&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Estas ayudas están sometidas al régimen de minimis, en los términos establecidos en el Reglamento (CE) &lt;/span&gt;&lt;span lang="es-ES"&gt;nº. 1998/2006 de la Comisión, de 15 de diciembre, relativo a la aplicación de los artículos 87 y 88 del tratado CE a las ayudas de minimis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Decimotercer&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tramitación telemática&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;En caso de que durante la tramitación de las subvenciones de&lt;/span&gt;&lt;span lang="es-ES"&gt; esta convocatoria la Dirección General de Comercio y Empresa implante cualquier procedimiento o actuación de tramitación telemática, los beneficiarios podrán tener acceso por medios electrónicos a la información y al procedimiento administrativo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Decimocu&lt;/span&gt;&lt;span lang="es-ES"&gt;arto&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Todas las denominaciones de órganos y cargos que en esta Resolución aparecen en género masculino, se tienen que entender referidas indistintamente al género masculino y al femenino.&lt;/span&gt;&lt;/p&gt;
