&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span lang="es-ES"&gt;Intentada sin efecto la notificación por correo certificado con acuse de recibo, o no habiéndose podido efectuar po ignorarse el domicilio o no haberse encontrado en el mismo a los interesados que se relacionan, se procede, en cumplimiento de lo que establece el artículo 59.5 de la Ley 30/1992 de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, a la publicación en el Boletín Oficial de las Islas Baleares,así como en los tablones de anuncios del Ayuntamiento de Alaró y de Badajoz del siguiente requerimiento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;‘De acuerdo con lo que establece la Ley 11/99, que modifica el Real decreto Legislativo 339/90, de 2 de marzo, modificado por la Ley 5/97, de 24 de marzo, en aquello que hace referencia a la determinación del estado de abandono de los vehículos, se establece que se presumirá racionalmente su abandono en el siguiente caso: cuando permanezca estacionado por un periodo superior a un mes en el mismo lugar y presente desperfectos que hagan imposible su desplazamiento por sus propios medios o le falten las placas de matriculación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Resultando que en base a lo establecido en el art. 3.b) de la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados, se entiende que el vehículo abandonado es un residuo sólido urbano, otorgando el art. 49.3, de la misma Ley, competencias a las entidades locales para la gestión de éstos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Considerando que dichos vehículos se encuentran en el supuesto anteriormente mencionado, el Regidor Delegado de Mantenimiento de Servicios, comunica :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1.- El tratamiento como residuo sólido urbano de los vehículos que a continuación se relacionan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2.- Notificar el requerimiento a los titulares de los vehículos, de los cuales sean conocidas los datos, otorgando a los titulares de los mismos, basándose con lo establecido en el art. 53.3 de la Ley 22/2011 de residuos, un plazo de 48 horas desde la fecha de recepción de la notificación, para que pueda aportar cuantas alegaciones, documentos o informaciones crea convenientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3.- Considerar abandonados y no identificados a los vehículos contenidos en la siguiente relación sin matrícula o que no figuren en el registro central de vehículos de la Jefatura provincial de tráfico y, por lo tanto, residuo sólido urbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Si no estáis de acuerdo con el contenido de este escrito disponéis de un plazo de 15 días, contando desde el día siguiente a la recepción de esta notificación , para alegar todo aquello que consideráis conveniente para vuestra defensa y para proponer las pruebas que creais oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Si en el plazo de 48 horas no procedéis a la retirada o no recibimos noticias vuestras, de acuerdo con lo establecido en la Ley 11/99, de 21 d’abril, de modificación de la Ley reguladora de las bases de régimen local, y otras medidas para el desarrollo local en materia de tráfico, circulación de vehículos a motor y seguridad vial, en su art.2, se procederá a su tratamiento como residuo sólido urbano, iniciándose el correspondiente expediente sancionador en base al art.46.4.b de la Ley 22/2011 de residuos y suelos contaminados, con sanción de multa hasta 900 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las alegaciones tienen que presentarse al Registro General del Ayuntamiento, dirigidos a la Alcaldía e indicando sus datos personales, domicilio, fecha y matrícula del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Todo esto sin perjuicio de las deudas que se hayan generado con la Hacienda Municipal o de otros organismos oficiales a los cuales tendrá que hacer frente el titular del vehículo.’&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
