    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin: 0px"&gt; &lt;br /&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;No habiéndose presentado por los interesados, durante el plazo de exposición al público, ninguna reclamación contra el expediente de modificación de la Ordenanza Fiscal reguladora tasa expedición de documentos aprobada inicialmente por el Ayuntamiento Lleno, en sesión de día 20 de agosto de 2012, ha resultado definitivamente aprobado, y por este motivo, se publica el texto íntegro del mencionado acuerdo, que es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;PRIMERO. Aprobar inicialmente la modificación de la Ordenanza fiscal reguladora de la tasa por la expedición de documentos (BOIB Num. 187 15-12-2011) en el siguiente sentido:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;“Artículo Único. Modificación de la Ordenanza Fiscal reguladora de la tasa por expedición de documentos (BOIB Núm 187 de 15-12-2011).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Uno. Se modifica el artículo 5, que quedará redactado de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;“Artículo 5.- Bonificaciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;1. Los sujetos pasivos de la tasa se podrán beneficiar de las siguientes bonificaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;a. Tendrán una bonificación del 100% si los ingresos de todos los miembros de la unidad familiar sueño inferiores al 50% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;b. Tendrán una bonificación del 90% si los ingresos de todos los miembros de la unidad familiar representan entre el 51% y el 60% del SMI. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;c. Tendrán una bonificación del 50% si los ingresos de todos los miembros de la unidad familiar representan entre el 61% y el 70% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;d. Tendrán una bonificación del 20% si los ingresos de todos los miembros de la unidad familiar representan entre el 71% y el 80% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;e. Tendrán una bonificación del 10% si los ingresos de todos los miembros de la unidad familiar representan entre el 81% y el 90% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;f. Tendrán una bonificación del 5% si los ingresos de todos los miembros de la unidad familiar sueño iguales al SMI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;2. A los efectos de aplicar estas bonificaciones, se computarán los ingresos de todos los miembros de la unidad familiar con independencia de su tipo y concepto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;3. Para aplicar estas bonificaciones es necesario que el interesado acredite que el documento administrativo cuya expedición solicita lo tiene que presentar de forma preceptiva ante alguna otra entidad u organismo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;4. Corresponderá al Batle la concesión de las bonificaciones, previa solicitud del interesado e informe de los Servicios Sociales”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Dos. Se modifica el artículo 7, que quedará redactado de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;“Artículo 7. Tarifa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;La tasa a la cual se refiere esta Ordenanza se regirá por las siguientes tarifas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Las cuotas se satisfarán en las oficinas municipales en el momento de presentación del escrito de solicitud de la tramitación del documento o expediente, o al retirar la certificación o notificación de la resolución si la solicitud no existiera o no fuera expresa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Los documentos recibidos por los conductos de otros registros generales serán admitidos provisionalmente, pero no se los podrá dar curso sin el previo pago de los derechos, para lo cual se requerirá al interesado para que en el plazo de diez días abone las cuotas correspondientes, con la advertencia que transcurrido dicho plazo sin efectuar el abono, se tendrán los escritos o documentos por no presentados y será archivada la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Las certificaciones o documentos que expida la Administración Municipal en virtud de mandamiento judicial emitido a instancia de parte para toda clase de litigios, no se entregarán ni remitirán sin que previamente se haya satisfecho la correspondiente cuota tributaria.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;DISPOSICIÓN FINAL ÚNICA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;La presente Ordenanza fiscal, aprobada por el Pleno de este Ajuntament en sesión celebrada el ____ de _____________ de 20__, entrará en vigor en el momento de su publicación íntegra en el Boletín Oficial de las Islas Baleares y será de aplicación a partir del día siguiente al de su entrada en vigor, permaneciendo en vigor hasta que se acuerde su modificación o su derogación expresa.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;SEGUNDO. Dar al expediente la tramitación y publicidad preceptiva, mediante su exposición al tablón de anuncios de este Ajuntament y en el Boletín Oficial de las Illes Balears, durante un plazo de treinta días hábiles, en los cuales los interesados podrán examinarlo y plantear las reclamaciones que estimen oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;TERCERO. Considerar, en el supuesto que no se presentaran reclamaciones al expediente, en el plazo anteriormente indicado, que el Acuerdo es definitivo, teniendo en cuenta el artículo 17.3 del Real decreto Legislativo 2/2004, del 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;QUART. Facultar al Sr. Batle-Presidente para suscribir los documentos relacionados con este asunto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Contra este Acuerdo, de acuerdo con el artículo 19 del Real decreto Legislativo 2/2004, del 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, los interesados podrán interponer recurso contencioso administrativo, en el plazo de dos meses contados a partir del día siguiente de la publicación de este anuncio al Boletín Oficial de las Islas Baleares, ante el Tribunal Superior de Justicia de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
