    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En relación con el asunto de referencia, y de acuerdo con la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se comunica que el Pleno de la CMAIB, en sesión de 21 de junio de 2012&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;CONSIDERANDO&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Que Avícola Son Perot SL ha solicitado una modificación de la AAI consistente en la ampliación de la granja de gallinas y cambio de titular de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Que la documentación aportada justifica que se trata de una modificación sustancial, en cumplimiento del art. 10.2 de la Ley 16/2002, de 1 de julio y esto obliga a la obtención de una nueva autorización ambiental integrada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Que, para el otorgamiento de esta autorización se tiene que seguir la tramitación prevista en los artículos 12 y siguientes de la Ley 16/2002.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Que en todos aquellos aspectos no regulados en la Ley 16/2002, de 1 de julio (Art. 14) el procedimiento se ajustará a la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y Procedimiento Administrativo Común y la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, así como al resto de disposiciones que le sean de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.Que por otro lado, en relación a la evaluación de impacto ambiental, el presente proyecto está incluido al anexo I de la Ley 11/2006, de 14 de septiembre, de evaluación de impacto ambiental y evaluaciones ambientales estratégicas en las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.Que, por lo tanto, en cumplimiento del art. 12.3 de la Ley 16/2002, se incorporará a la AAI el acuerdo del Pleno de la Comisión de Medio Ambiente de las Illes Balears de fecha 29 de mayo de 2012:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“Informar favorablemente el Proyecto de la modificación de una granja de gallinas ponedoras del T.M. de Manacor, siempre y cuando se cumplan las medidas preventivas y correctoras del estudio de impacto ambiental y de la documentación complementaria así como los condicionantes siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Los residuos de origen animal se tratarán en la forma prevista en la legislación vigente. El tratamiento será el que se establezca en la autorización ambiental integrada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.De acuerdo con el informe del Servicio de Aguas Superficiales de la DG de Recursos Hídricos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los excedentes del movimiento de tierras y del material empleado, se trasladará a vertedero autorizado, evitando realizar acopios de cualquier tipo en las zonas de afección del cauce cercano y, en concreto, sobre la zona APR de inundaciones para evitar la variación de una hipotética lámina de inundación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se recuerda que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.El proyecto de la modificación de una granja de gallinas ponedoras implica una modificación de la autorización ambiental integrada otorgada por el Pleno de la Comisión de Medio Ambiente de las Illes Balears en sesión de fecha 22 de diciembre de 2010 (BOIB núm. 27 de 22/02/2011). Es en la mencionada modificación donde se recogerán la mayoría de los condicionantes ambientales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.De acuerdo con el informe del Servicio de Aguas Superficiales de la DG de Recursos Hídricos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para el uso de la gallinaza como abono, se requerirá previamente autorización y/o concesión de la DG de Recursos Hídricos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Según el informe del Ayuntamiento de Manacor:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La Ordenanza reguladora de la limpieza viaria, recogida de residuos sólidos urbanos y gestión de los parques verdes de Manacor (BOIB núm. 25, 15/02/2007), prohíbe a los generadores singulares calificados hacer uso de los contenedores selectivos de los Parques Verdes. Mientras Avícola Son Perot, S.L. no obtenga la calificación de generador singular cualificado podrá hacer uso del Ecoparc de Manacor para depositar los residuos de papel-cartón, envases ligeros y vidrio que sean asimilables a los generados en los domicilios. En ningún caso podrá depositar residuos industriales, incluidos los embalajes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El presente informe se entiende sin perjuicio de las cuestiones territoriales y urbanísticas, competencia de otras administraciones.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.Que el Ayuntamiento de Manacor emite informe acreditativo de que el proyecto es compatible con el planeamiento urbanístico siempre y cuando se exonere del cumplimiento de aquellos parámetros urbanísticos que el proyecto incumple.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.Que según el artículo 16 de la Ley 16/2002, de 1 de julio, el proyecto y el estudio de impacto ambiental han sido sometidos a información pública durante el plazo de treinta días con publicación en el BOIB núm. 14, de fecha 31 de enero de 2012, no habiéndose presentado alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.Que en fecha 6 de septiembre de 2011, se solicitan informes técnicos a los servicios implicados de las diferentes consejerías, al Consell de Mallorca y al Ayuntamiento de Manacor. Todos los informes presentados son positivos con una serie de condicionantes técnicos que se recogen en la propuesta de acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;10.Que de acuerdo con el anexo V de la Ley 16/2002 (en su última redacción otorgada por la Ley 27/2006 de 18 de julio), se ha efectuado el trámite de consulta previa a la toma de decisión a todas las personas físicas y jurídicas interesadas que cumplen los requisitos establecidos en el artículo 3p, a las cuales se les ha otorgado un plazo de 10 días (Art. 84 de la Ley 30/1992) para hacer las observaciones oportunas. Las personas interesadas no han presentado observaciones en el plazo establecido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ACUERDA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;informar favorablemente la modificación sustancial de la Autorización Ambiental Integrada de la granja de gallinas ponedoras, consistente en la ampliación de la granja de gallinas y cambio de titular de la autorización, con las condiciones de explotación, capacidad y procesos indicados en el proyecto técnico que acompaña la solicitud y con sujeción a las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Respecto a la autorización ambiental integrada en vigor:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Se cambien todas las referencias que se hacían del antiguo titular (Granjas Mallorquinas SL) por el nuevo titular (Avícola Son Perot SL).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b.El condicionante 1 (Objeto) se adapta a las nuevas características de la instalación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c.Se modifican los condicionantes 5 y 6 para definir los nuevos valores de consumos y producción autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d.Se modifica la referencia a la Ley 10/1998 por la nueva Ley de residuos (Ley 22/2011) en su punto 3 del condicionante 7.3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e.Se modifica la referencia al Reglamento (CE) 1774/2002 por el Reglamento (CE) 1069/2009 en el condicionante 7.6.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f.Se añade un condicionante 7.7 para regular el tratamiento de la gallinaza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g.Se modifica el punto 8.1 para adaptarlo a los nuevos consumos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h.Se modifica el punto 8.2 para adaptarlo a la realidad del nuevo proyecto y para regular la reutilización de las aguas pluviales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i.Se modifica el condicionante 9.2.1 para incorporar el grupo electrógeno como foco canalizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;j.Se modifica el condicionante 9.2.3 para igualarlo a otras autorizaciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;k.Se añade el condicionante 10.1 sobre Bienestar Animal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;l.Los condicionantes 9.3 y 9.4 referentes a contaminación lumínica y de ruidos se trasladan al capítulo 10 de requisitos de seguridad y actividades como condicionantes 10.4 y 10.5.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;m.Se modifica el capítulo 11.4 de control documental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.La redacción de la nueva autorización ambiental integral de la granja de gallinas ponedoras a nombre de Avícola Son Perot SL es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1 Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La AAI se concederá a AVÍCOLA SON PEROT, SL, única y exclusivamente para la actividad de explotación ganadera de gallinas ponedoras en sistema de explotación intensivo, así como de recogida y envasado de huevos, con una capacidad de 116.928 gallinas, todo conforme a lo establecido en el proyecto básico de la instalación firmado por el Sr. Gabriel Cañellas Rotger con número de visado 201101182 de 23 de diciembre de 2011 del Colegio oficial de Ingenieros Agrónomos de Levante, con las medidas correctoras que se proponen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La granja está ubicada en el polígono 26, parcelas 830 y 127 del término municipal de Manacor. Las parcelas disponen de una superficie de 35.938 m2 de los cuales 5.058,8 m2 son los destinados a esta actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las coordenadas UTM de la actividad son (Huso UTM: 31):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cada nave tiene capacidad para 58.464 gallinas repartidas en 6 pisos de 6 hileras y 29 jaulas por hilera. Cada jaula tiene dos celdas con una capacidad de 28 gallinas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2 Plazo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La Autorización se concederá por un periodo de 8 años, transcurridos los cuales, a solicitud del interesado, podrá ser renovada y en su caso actualizada para periodos sucesivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3 Desarrollo de las actividades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La actividad se desarrollará según los documentos que obran en el expediente y a lo establecido en la AAI, y en la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;4 Modificaciones de la actividad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cualquier modificación que se produzca en el desarrollo de la actividad tendrá que ser comunicada al órgano ambiental competente el cual valorará el carácter de la modificación y si hace falta modificará la AAI para que se incluya la modificación. A los efectos de la modificación de la AAI se tendrán en cuenta los antecedentes históricos del funcionamiento de las instalaciones y que los valores estimados que se han presentado son nominales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;5 Consumos de materias primas, auxiliares y materias de adición previstos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.3 Condiciones generales de la autorización para producir residuos peligrosos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.La autorización se otorgará para el ámbito territorial de la Comunidad Autónoma de las Illes Balears y se concederá sin perjuicio de las correspondientes a otros organismos o administraciones competentes en la actividad de la cual es objeto, en ningún caso eximirá al titular de la obtención otras licencias y autorizaciones legalmente procedentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.En ningún caso esta autorización podrá invocarse para excluir o disminuir la responsabilidad en que pueda incurrir el titular en el ejercicio de su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.En todo caso, se tienen que cumplir todas las obligaciones que le sean aplicables para dar cumplimiento a la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados, el Real Decreto 833/1988, de 20 de julio, por el cual se aprueba el Reglamento para la ejecución de la Ley 20/1986, de 14 de mayo, de residuos tóxicos y peligrosos (BOE núm. 182, de 20 de julio), el Real decreto 952/1997, de 20 de junio, por el cual se modifica el Reglamento anterior (BOE núm. 160, de 5 de julio de 1997), la Orden del Ministerio de Medio ambiente MAM/304/2002, de 8 de febrero, por la cual se publican las operaciones de valorización y eliminación de residuos y la lista europea de residuos (BOE núm. 43, de 19 de febrero de 2002).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Se llevará un registro que comprenda todas las operaciones generadoras de residuos tóxicos y peligrosos en que intervenga y dónde figurarán, al menos, los datos que aparecen en el artículo 16 del RD 833/1988: cantidad, tipo, fechas de generación y de entrega a gestor autorizado de los residuos producidos. También se tiene que registrar y conservar los justificantes de entrega a gestor autorizado de los mencionados residuos. Este registro se tiene que conservar durante 5 años en las instalaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.En relación a los residuos producidos, se cumplimentarán los documentos de control y seguimiento para cada transporte desde el lugar de producción a gestor autorizado, de acuerdo con lo que dispone el artículo 21 del Real decreto 833/1988. Este documento de control y seguimiento tendrá que cubrir únicamente sustancias que tengan el mismo código de identificación. El envío conjunto de diferentes tipos de residuos requerirá la formalización de tantos documentos como residuos diferentes se envíen (se entienden por diferentes aquellos que tienen un distinto código de identificación). Los documentos tendrán que conservarse, en el lugar donde se realiza la actividad, durante un periodo de cinco años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.En cualquier momento, el órgano competente en materia ambiental podrá realizar una visita de comprobación y certificar la idoneidad de las instalaciones y el mantenimiento de las condiciones iniciales de esta AAI, así como el cumplimiento de las prescripciones técnicas aplicables en virtud de la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.Se tienen que envasar y etiquetar los contenedores de los residuos de acuerdo con lo que disponen los artículos 13 y 14 del vigente Real Decreto 833/1988, y de acuerdo con la reglamentación sobre transporte de mercancías peligrosas. Del mismo modo, el envasado y almacenamiento tienen que seguir las normas de seguridad indicadas al Real Decreto mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.La AAI se concederá única y exclusivamente para la producción de los residuos descritos en este documento y que se generan como resultado del funcionamiento de la granja de gallinas ponedoras y siempre como consecuencia de la actividad desarrollada en conformidad con las condiciones establecidas en el proyecto técnico presentado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.4 Condiciones particulares exigibles a la producción de residuos peligrosos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Almacenamiento de los residuos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Según lo que dispone el artículo 15 del Real decreto 833/1988, se podrá efectuar un almacenamiento temporal de los residuos indicados en las instalaciones, durante un periodo máximo de seis meses en las condiciones y con los medios previstos en la memoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b.Los residuos producidos tendrán que estar siempre dispuestos en contenedores completamente separados unos de los otros y diferenciados en las distintas zonas de almacenamiento, que tendrán que estar cubiertas para evitar el contacto directo de las aguas de lluvia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.5 Condiciones particulares exigibles a la producción de residuos no peligrosos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Siempre que no proceda gestionarlos por sí mismo, los residuos no peligrosos se entregarán a un gestor de residuos, para su valorización o eliminación. En el caso de los residuos urbanos o los asimilables a urbanos serán entregados a la entidad local correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.En todo caso, el poseedor de los residuos está obligado, mientras se encuentren en su poder, a mantenerlos en condiciones adecuadas de higiene y seguridad. Todo residuo potencialmente reciclable o valorizable tiene que ser destinado a estos fines, evitando su eliminación en todos los casos posibles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.6 Condiciones particulares exigibles a la producción de desechos de origen animal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Para la gestión de los desechos de origen animal se tendrá que cumplir lo establecido en el Plan director sectorial para la gestión de residuos urbanos de Mallorca, y en caso de no ser posible, se buscarán soluciones alternativas, que se contemplan en el artículo 13 del Reglamento (CE) 1069/2009 del Parlamento Europeo y del Consejo, del 21 de octubre de 2009. En ningún caso se podrán eliminar mediante enterramiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.En todo caso, los desechos de origen animal, mientras resten en la granja, tendrán que ser mantenidos a temperatura controlada y separados por categorías, y se intentará que sea el mínimo tiempo posible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.En caso de brotes epidémicos que provoquen la muerte generalizada de gallinas, se estará a lo que disponga la autoridad sanitaria competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.7 Condiciones particulares exigibles a la producción de gallinaza&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.La gallinaza se recogerá mediante un sistema de cintas transportadoras. Como norma general se trasladará de forma directa al camión de reparto, el cual la trasladará para su uso como abono a las fincas debidamente autorizadas por la DG de Recursos Hídricos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.En caso de no poder realizarse el reparto por causas meteorológicas o porque no sea época de abonado, la gallinaza se trasladará a la plataforma de gallinaza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Para la utilización de la gallinaza como subproducto, se tendrá que cumplir el artículo 13 del Reglamento (CE) 1069/2009 del Parlamento Europeo y del Consejo, del 21 de octubre de 2009, concretamente los apartados d) y f).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8. Condicionantes hídricos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.1 Consumo de agua&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se prevé un consumo diario de 39,02 m3, que provendrán en su totalidad del pozo de la finca. &lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Limpieza de las naves de ponedoras. Se prevé la limpieza de las naves de ponedoras cada 2 años con un consumo estimado de 24 m3 de agua.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.2 Emisiones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Según la documentación aportada los efluentes generados en las instalaciones y su gestión son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Aguas de las naves de ponedoras. Cada nave contará con su sistema de recogida de las aguas de limpieza. Ésta contará con vías de evacuación laterales y una fosa prefabricada, estanca, con capacidad de 12m3. Las fosas se vaciarán cuando sea necesario para evitar derramamientos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Lixiviados de la plataforma de gallinaza. Se recogerán en una fosa de 38m3 de capacidad. Esta fosa tiene que ser prefabricada y tiene que garantizar su estanqueidad para el almacenamiento de este tipo de producto, para evitar filtraciones en el subsuelo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para evitar la generación de lixiviados por lluvia, esta plataforma se dotará de una cubierta tipo invernadero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Aguas de la planta de envasado: Son aguas de uso doméstico (servicios) y de la limpieza de esta planta. Se recogerán en una fosa estanca prefabricada con capacidad para 10 personas (3m3) y con tres compartimentos. El emanante tratado se almacenará en un depósito de 20 m3 que se vaciará cada 10 días y en todo caso cuando sea necesario para evitar derramamientos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Gallinaza. Una cinta transportadora la recogerá de las naves de ponedoras y la llevará a un elevador de fecales que la depositará en un camión de reparto que o bien la repartirá a las fincas propuestas o bien la llevará a la cubeta de gallinaza, que tendrá 466 m2 de superficie y capacidad para acoger 1.602 m3 (el volumen producido en 4 meses).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La superficie de la cubeta se impermeabilizará como mínimo cada tres años, para evitar infiltraciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se prevé la generación de 4803 m3 de gallinaza, que equivalen a 58.464 Kg de nitrógeno. Se propone la valorización en una superficie de 489.57 ha, superior a la necesaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Aún así antes de la puesta en marcha de la actividad se tiene que contar con la autorización de valorización prevista en el artículo 54.6 del Plan Hidrológico de les Illes Balears vigente, o el equivalente en lo referente a la valorización de deyecciones ganaderas en la próxima revisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.Aguas pluviales. Se estima una producción de unos 2100 m3 anuales. Las pluviales se recogerán de los tejados por canaletas y se aprovecharán para limpieza, bebida de los animales o para refrigeración, éste último uso si es sanitariamente adecuado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Tendrán que contar con un tratamiento mínimo consistente en un filtrado y una cloración u otro tratamiento equivalente; la cloración se puede hacer utilizando el mismo sistema que se utilizará para el agua de pozo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las conducciones de pluviales se tienen que hacer de forma que no entren en contacto con las pistas por donde circularán los camiones ni con la fosa de gallinaza. También se evitará su encharcamiento en los alrededores de las naves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.3 Controles y vigilancia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se llevarán a cabo los siguientes controles, de los cuales, anualmente, se remitirá copia al órgano competente en materia de AAI:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Consumo mensual de agua del pozo (lectura de contador).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Estimación de las aguas pluviales utilizadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Control de calidad del agua de pozo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Análisis cuatrimestrales de, como mínimo, los siguientes parámetros:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Microbiológicos (ufc/100 ml) Salmonelas, Enterococos, Estreptococos y Coliformes totales y fecales&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Químicos (ppm) Amonio, Nitritos, Nitratos, Fósforo total, Carbono Orgánico Total&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los métodos analíticos serán los previstos en la normativa vigente sobre calidad de aguas potables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Volumen de gallinaza. Se llevará un control y contabilidad del volumen de estiércol/gallinaza producido, con periodicidad, como mínimo, mensual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se guardarán los justificantes del vaciado y entrega de las aguas residuales especificando el volumen y el origen de como mínimo los 5 últimos años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Notificaciones al PRTR. Anualmente se notificarán las siguientes emisiones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Emisiones indirectas al agua: se notificarán DQO, Nitrógeno total y Fósforo total de la fosa de las naves de ponedoras y del depósito de la nave de envasado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Emisiones indirectas al suelo: se notificarán los kg de nitrógeno aplicados en función del plan de producción y gestión de deyecciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.4 Aguas Superficiales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las instalaciones de la presente actividad no están afectadas por APR de inundación (la parcela sí lo está parcialmente), pero sí lo está puntualmente por zona de policía del Torrente de na Borges, aunque no supone causa de degradación ni deterioro del Dominio Público Hidráulico, ni la alteración sustancial de la orografía existente que implique cambios de dirección de la escorrentía superficial ni reducción del caudal. Por, tanto:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Los excedentes del movimiento de tierras y de material empleado, se trasladarán a vertedero autorizado el mismo día que se produzcan, quedando prohibido realizar almacenamientos de cualquier tipo en las zonas de afección al lecho del torrente cercano (zona de servidumbre, zona de policía y APR de inundación).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b.Está totalmente prohibido realizar cualquier tipo de vertido en el lecho del torrente (aguas pluviales, residuales, excedentes de tierras, etc.) sin previa autorización por parte de la DG de Recursos Hídricos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c.En caso de realizar un cierre de la parcela con muro, reja, etc. se solicitará autorización previa a la DG de Recursos Hídricos, dada la afección de la parcela a zona de servidumbre, policía y APR de inundación, dejando totalmente libre de obstáculos la mencionada zona de servidumbre (5 metros medidos a cada lado desde la coronación de las fajas laterales o muros de canalización).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9 Condicionantes de atmósfera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.1 Emisiones a la atmósfera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Según el anexo IV de la Ley 34/2007, de 15 de noviembre, de calidad del aire y protección de la atmósfera, la actividad está clasificada como actividad potencialmente contaminadora de la atmósfera del grupo B, punto 2.13.2.a “Instalaciones destinadas a la cría intensiva de aves de corral que dispongan de más de 40.000 emplazamientos si se trata de gallinas ponedoras o del número equivalente para otras orientaciones productivas de aves”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.2 Controles de emisión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.2.1 Control emisiones canalizadas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La instalación dispone de un foco de emisión canalizado, el grupo electrógeno de 240 kVA clasificado según el anexo del RD 100/2011 como:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Actividad Grupo Código&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Motores de combustión interna de potencia térmica inferior a 1 MWt - 02 03 04 04&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Dado que no tiene grupo asociado, no tiene obligación de hacer controles periódicos de sus emisiones. Sin embargo, está sujete a los requisitos generales de la Ley 34/2007 y del RD 100/2011, y, por lo tanto, serán de aplicación los valores límite de emisión establecidos en la normativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.2.2 Control emisiones difusas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Las medidas correctoras y preventivas para reducir la emisión de amoníaco (NH3) serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Controlar la composición del pienso con el objeto de reducir la cantidad de nitrógeno y fósforo de la gallinaza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b.Secar la gallinaza por ventilación forzada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c.Minimizar las pérdidas de los sistemas de abastecimiento de agua que puedan humidificar la gallinaza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d.Retirar la gallinaza al menos 1 vez por semana en caso de cintas transportadoras con secado por ventilación forzada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e.Almacenar la gallinaza en la plataforma de gallinaza cubierta, con cubeta de superficie estanca y sistema de recogida de lixiviados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f.Ubicar la plataforma de gallinaza en una área protegida de vientos dominantes y alejada de posibles fuentes sensibles a olores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Así mismo, para evitar o reducir la emisión de partículas (PM10 o partículas totales) se aplicarán las medidas preventivas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Limitar la velocidad de circulación de vehículos a 20 km/h dentro de las instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b.El suministro de pienso a los animales se hará mediante “tornillo sinfin” u otro sistema para minimizar las emisiones difusas de polvo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c.Minimizar la altura de caída de pienso en operaciones de descarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d.Limpieza periódica de las zonas de carga y descarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e.Pavimentación /compactación del acceso a la granja hasta la zona de carga y descarga de las gallinas y la gallinaza o condicionar los viales de acceso y la zona de maniobras al paso de vehículos pesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Se adoptarán las medidas necesarias para minimizar los olores que puedan generar molestias a la población y viviendas rurales más cercanas. Será necesario disponer de un adecuado aislamiento de los depósitos temporales de estiércol (plataforma de gallinaza).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si se produce algún episodio de olores sobre el entorno, se traerá un registro con la fecha y duración de este, así como la fase del proceso a la cual se encuentra asociada y la propuesta de medidas correctoras o de mejora de gestión con el objetivo de evitar su repetición. Se informará al órgano competente de estos episodios en el momento en que se produzcan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los camiones de transporte de la gallinaza tendrán los remolques cubiertos con lonas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cuando el órgano competente lo considere necesario, podrá requerir al titular de la instalación la realización de una evaluación de la molestia por olores que genera, por medio de la medición de las unidades de olores, de acuerdo con la norma UNE-EN 13725.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.2.3 Otras obligaciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;De acuerdo con lo establecido en el artículo 8.3 de la Ley 16/2002, así como el Reglamento (CE) núm. 166/2006, del Parlamento Europeo y del Consejo, de 18 de enero de 2006, relativa al establecimiento de un registro europeo de emisiones y transferencia de contaminantes y por el cual se modifican las Directivas 91/689/CC y 96/61/CE del Consejo (Registre E-PRTR), el titular de la explotación notificará al menos una vez al año los datos de las emisiones a la atmósfera correspondientes a la instalación de al menos los parámetros siguientes: NH3, N2O, C4 y partículas totales o PM10. Estas emisiones serán enviadas, para su evaluación previa, al departamento competente en materia de contaminación atmosférica adjuntando una memoria explicativa de la metodología empleada para la determinación de los datos notificados antes de ser incorporadas a la base de datos del Ministerio de Medio Ambiente (www.prtr-es.es). Las cantidades de contaminantes serán medidas, calculadas o estimadas, preferentemente por este orden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10 Requisitos de seguridad y actividades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10.1 Bienestar animal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se tendrá que cumplir el Real decreto 348/2000 relativo a la protección de los animales a las explotaciones ganaderas y más específicamente el Real decreto 3/2002, de 11 de enero, por el cual se establecen las normas mínimas de protección de gallinas ponedoras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10.2 Plan de autoprotección&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad dispone del preceptivo Plan de Autoprotección del establecimiento inscrito en el Registro General de Planes de Autoprotección de la Dirección general de Emergencias, con número de inscripción RGPA- 262/09, y lo tendrá que implantar en la totalidad de las instalaciones y procesos que conforman la actividad. En caso de modificación de la instalación se tendrá que actualizar el Plan de Autoprotección.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10.3 Seguridad industrial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad tiene que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Inscribir las instalaciones correspondientes a la Dirección general de Industria, según las normativas vigentes de seguridad industrial (instalación eléctrica de baja tensión, almacenamiento de productos petrolíferos, instalación contraincendios,..). Las instalaciones previstas tienen que cumplir con la legislación vigente en materia de Industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Dar cumplimiento al Reglamento para la supresión de las barreras arquitectónicas (Decreto 20/2003) en todo lo que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Prevenir los riesgos laborales y velar por la salud y seguridad de los trabajadores, y éstos el deber de cumplir las medidas de prevención que se adopten, según lo que se establece en la ley estatal 31/95 de prevención de los riesgos laborales y se dará cumplimiento al RD 486/1997, de 14 de abril, por el cual se establecen las disposiciones de seguridad y salud en los puestos de trabajo. Las condiciones de trabajo se tienen que ajustar a lo que se establece en las disposiciones específicas y reglamentarias en materia de seguridad laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por otro lado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.La instalación eléctrica de baja tensión cumplirá el Reglamento electrotécnico de baja tensión: RD 842/2002, de 2 de agosto, y las instrucciones técnicas que le sean de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Las instalaciones de protección contra incendios y su mantenimiento se tienen que ajustar a lo dispuesto en el Reglamento de instalaciones de protección contra incendios (RD1942/1993) y normas UNE correspondientes, además del Reglamento de protección contra incendios en los establecimientos industriales, según el RD 2267/2004, de 3 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.El almacenamiento de productos petrolíferos se tendrá que adaptar a lo que dispone el RD 2085/1994 por lo que se desarrolla el Reglamento de instalaciones de productos petrolíferos, así como sus posteriores modificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Se tendrá que cumplir el RD 865/2003, de 4 de julio, por el cual se establecen los criterios higiénico-sanitarios para la prevención y control de la legionelosis y el DB HS4 del RD 314/2006, de 17 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10.4 Contaminación Acústica&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se efectuará una campaña anual de caracterización real de los niveles de ruido emitidos al exterior durante las diversas fases típicas de la operación en horario nocturno y diurno, para la comprobación del cumplimiento de los límites establecidos en la normativa autonómica vigente en esta materia, es decir, la disposición adicional quince de la Ley 25/2006, de 27 de diciembre, de medidas tributarias y administrativas, y la Ley 1/2007, contra la contaminación acústica en las Illes Balears, así como los objetivos de calidad acústica indicados en el RD 1367/2007 de 19 de octubre, por el cual se desarrolla la Ley 37/2003, de 17 de noviembre, del ruido, en lo que se refiere a zonificación acústica, objetivos de calidad y emisiones acústicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;10.5 Contaminación lumínica&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se cumplirá con lo que establece la Ley 3/2005 de 20 de abril, de protección del medio nocturno de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11Controles periódicos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.1 Control inicial de las instalaciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular dispondrá de un plazo de 1 año a contar desde la notificación de la AAI, para solicitar a la Consejería de Medio Ambiente, Servicio de Asesoramiento Ambiental, el inicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Esta instalación no podrá iniciar la actividad productiva hasta que no se compruebe el cumplimiento de las condiciones fijadas en la presente AAI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Esta comprobación se podrá realizar por la autoridad competente o mediante una entidad certificada colaboradora de ésta, en el plazo de un mes desde la solicitud de inicio de actividad por el titular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Junto con la mencionada solicitud se aportará toda la documentación necesaria para acreditar el cumplimiento de las condiciones fijadas en la AAI, que como mínimo será:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Certificado de final de obra realizado por el técnico competente y visado por el colegio oficial correspondiente, y que acredite el cumplimiento del condicionado de esta autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b.Documento de aceptación o contratos con los gestores finales autorizados para la gestión de los residuos peligrosos que se generen en la instalacióm.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c.Descripción de las cantidades de residuos no peligrosos producidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d.Solicitud de inscripción en el registro general de explotaciones agrarias prioritarias de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e.La regularización de la situación administrativa de los pozos de la finca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f.La obtención de la autorización administrativa para la valorización de la gallinaza regulada en el Plan Hidrológico de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g.Descripción del sistema de reutilización de las aguas pluviales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h.La aprobación del Plan de producción y gestión de deyecciones aprobado por la administración competente en materia de agricultura y ganadería.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i.Acreditación de la legalidad de todas las edificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.2 Control periódico de las instalaciones&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En cualquier momento, la Consejería de Medio Ambiente y Movilidad podrá realizar visita de comprobación y certificar la idoneidad de las instalaciones y el mantenimiento de las condiciones iniciales que han dado lugar al AAI, así como el cumplimiento de las prescripciones técnicas aplicables en virtud de la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Periódicamente se realizarán visitas de comprobación a las instalaciones por parte de los técnicos de la Consejería de Medio Ambiente y Movilidad, para comprobar el cumplimiento de los requisitos del AAI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.3 Inventario de emisiones en el Registro PRTR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;De acuerdo con lo establecido en el art. 8.3 de la Ley 16/2002, así como el Reglamento (CE) núm. 166/2006, del Parlamento Europeo y del Consejo, de 18 de enero de 2006, relativa al establecimiento de un registro europeo de emisiones y transferencias de contaminantes y por el cual se modifican las Directivas 91/689/CEE y 96/61/CE del Consejo (Registro E-PRTR), y por el RD 508/2007, de 20 de abril, se tendrán que enviar los datos sobre cantidades de contaminantes emitidos, anualmente, al registro informático PRTR-España del Ministerio de Medio Ambiente (www.prtr-es.es).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las cantidades de contaminantes serán medidas, calculadas o estimadas, preferentemente por este orden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se aportará para la evaluación previa de los datos, a la Consejería de Medio Aambiente (Servicio de Asesoramiento Ambiental), una memoria explicativa de la metodología empleada para la determinación de los datos notificados antes de ser incorporadas al registro informático PRTR-España del Ministerio de Medio Ambiente (www.prtr-es.es).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.4 Control documental&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.4.1 Control documental periódico&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Cada 3 años, informe de emisiones de contaminantes a la atmósfera realizado por un Organismo de Control Autorizado (OCA) que serán enviados por parte del OCA al departamento competente en materia de contaminación atmosférica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.4.2 Informe anual&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad enviará, al órgano ambiental encargado de tramitar la AAI, un informe del periodo precedente (año anterior), antes del 1 de marzo de cada año, en el cual se incluirá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A.Residuos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informe anual de los residuos producidos y de su gestión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;B.Emisiones y inmisiones al medio hídrico&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informe anual en el cual se remitirán los resultados de los controles de vigilancia al medio hídrico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;C.Ruidos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informe anual en el cual se remitirán los controles de emisiones de ruidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;D.Industria&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Copia de los certificados que se tengan que realizar en cumplimiento del RD 2085/1994, por el cual se desarrolla el Reglamento de instalaciones de productos petrolíferos, así como sus posteriores modificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;E.En carácter general&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Los datos exigidos por el RD 508/2007 y Reglamento (CE) 166/2006, de 18 de enero, se tendrán que comunicar telemáticamente al Registro informático PRTR-España, dentro de los plazos que correspondan, de forma anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Memoria anual explicativa sobre la metodología empleada para la determinación de los datos notificados al registro PRTR España (en formato papel y formato digital).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Toda la información que sea susceptible de tratamiento informático se aportará en papel y en formato informático estándar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El órgano ambiental encargado de tramitar las AAI enviará a cada Dirección general o administración competente la documentación de la que tenga competencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;12 Obligaciones del titular&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad estará obligado a cumplir con las obligaciones establecidas en el artículo 5 de la Ley 16/2002, de 1 de julio, y en especial:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Asumirá todos los condicionantes recogidos en la AAI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Mantendrá el correcto funcionamiento de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Comunicará al órgano ambiental competente en materia de AAI cualquier incidencia que afecte a la actividad con repercusión ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por otra lado, el titular queda sometido al cumplimiento de la Ley 26/2007, de 23 de octubre, de responsabilidad ambiental, y a sus desarrollos reglamentarios, para prevenir, evitar y reparar los daños medioambientales provocados por su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;13 Carácter de la autorización&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La AAI se otorgará sin perjuicio de terceros y sin perjuicio de las demás autorizaciones y licencias que sean exigibles por el ordenamiento jurídico vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;14 Causas de extinción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Son causas de extinción de la AAI:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La extinción de la personalidad jurídica de AVÍCOLA SON PEROT, SL.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La declaración de quiebra de la empresa AVÍCOLA SON PEROT, SL, cuando la misma determine su disolución expresa como consecuencia de la resolución judicial que la declare.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La no concesión de prórroga de la Autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;15 Modificaciones de las condiciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El órgano ambiental competente, en conformidad con el artículo 26 de la Ley 16/2002, podrá modificar las condiciones de control ambiental de la explotación señaladas en la AAI, o determinar medidas complementarias que se consideren convenientes para la adecuación o mejora de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;16 Renovaciones sucesivas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el supuesto de que AVÍCOLA SON PEROT, SL tuviera implantado un sistema de gestión ambiental EMAS o ISO 14001, a petición de AVÍCOLA SON PEROT, SL se aplicarán los mecanismos que simplifican la comprobación del cumplimiento de las obligaciones derivadas de la AAI, así como la correspondiente solicitud de adaptación, si procede, y de sucesivas renovaciones, previstos a la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se recuerda que, según el informe del Ayuntamiento de Manacor, el proyecto incumple los parámetros urbanísticos fijados por la normativa vigente, por lo cual se tendrá que obtener la exoneración del cumplimiento de estos parámetros tal como sucedía en el proyecto original.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente a haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses a contar desde el día siguiente a haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
