    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No habiéndose presentado por los interesados, durante el plazo de exposición al público, ninguna reclamación contra la Ordenanza reguladora del precio público por la prestación del servicio de l’Escola d’Adults i de l’Escola Viva, aprobada inicialmente por el Ajuntament Pleno, en sesión de día 20 de agosto de 2012, ha resultado definitivamente aprobado, y por este motivo, se publica el texto íntegro del mencionado acuerdo, que es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“PRIMERO.- Aprobar inicialmente la modificación de la ordenanza reguladora del precio público por la prestación del servicio de la l’Escola d’Adults i de l’Escola Viva (BOIB Num. 186 de 13-12-2011), en el sentido siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“Artículo Único. Modificación de la Ordenanza reguladora del precio público por la prestación del servicio de l’Escola d’Adults i de l’Escola Viva (BOIB Núm 186 de 13-12-2011).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Uno. Se modifica el artículo 4, que quedará redactado de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“Artículo 4. Cuantía. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. La cuantía a abonar por la prestación del servicio de la l’Escola Municipal d’Adults será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. La cuantía a abonar por la prestación del servicio de l’Escola Viva será de 15,00.-€ mensuales por usuario.” &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Dos. Se modifica el artículo 5, que quedará redactado de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“Artículo 5. Bonificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Al servicio de l’Escola Municipal d’Adults se aplicarán las siguientes bonificaciones: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a. Tendrán una bonificación de un 10% de la cuota total los alumnos menores de edad, los alumnos de familias numerosas y los residentes al núcleo de Son Serra de Marina previa presentación de la documentación que acredite estas circunstancias. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b. Disfrutarán de una bonificación de un 25% de la cuota total los alumnos matriculados a l’Escola Municipal d’Adults afectados por una minusvalía de grado igual o superior a un 33%. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c. Las bonificaciones anteriormente citadas no se podrán acumular y en el supuesto de que fuera posible la aplicación de más de una, el obligado tendrá que optar por una de ellas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. A los usuarios del servicio de l’Escola Viva se los podrá aplicar las siguientes bonificaciones: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a. Una bonificación del 100% si los ingresos de todos los miembros de la unidad familiar sueño inferiores al 50% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b. Una bonificación del 90% si los ingresos de todos los miembros de la unidad familiar representan entre el 51% y el 60% del SMI. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c. Una bonificación del 50% si los ingresos de todos los miembros de la unidad familiar representan entre el 61% y el 70% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d. Una bonificación del 20% si los ingresos de todos los miembros de la unidad familiar representan entre el 71% y el 80% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e. Una bonificación del 10% si los ingresos de todos los miembros de la unidad familiar representan entre el 81% y el 90% del SMI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f. Una bonificación del 5% si los ingresos de todos los miembros de la unidad familiar sueño iguales al SMI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A los efectos de aplicar estas bonificaciones, se computarán los ingresos de todos los miembros de la unidad familiar con independencia de su tipo y concepto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Corresponderá al Batle la concesión de las bonificaciones, previa solicitud del interesado y, en el caso de l’Escola Viva, la concesión se hará, de oficio, previa propuesta formulada por la Jefa de Servicios Sociales, que será quienes propondrá a las personas a las que se le tiene que conceder la bonificación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. Serán otorgadas por curso escolar. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5. No se concederá ninguna más exención ni bonificación, salvo las especificadas en el presente precepto.” &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Tres. Se modifica el artículo 6, que quedará redactado de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“Artículo 6. Normas de gestión. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. El pago de las tarifas se hará anticipadamente en el momento de solicitar la prestación del servicio tanto de l’Escola d’Adults como de l’Escola Viva y serán irreducibles. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. No obstante el anterior, y en cuanto a las tarifas fijadas por la enseñanza reglada, se podrá solicitar el fraccionamiento de la deuda tributaria. No se exigirá garantía ni interés de demora si el vencimiento del último pago se produzca dentro del año corriente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La tarifa prevista por l’Escola Viva, en el supuesto de que el servicio se preste por plazo superior a un mes, se abonará de forma bimensual. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Los pagos se harán mediante la domiciliación bancaria a entidades designadas por el Ajuntament como colaboradores. A estos efecto, las personas obligadas al pago rellenarán hoja de domiciliación según el modelo aprobado por el Ajuntament. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. Las deudas por el precio público regulado en la presente Ordenanza se podrán exigir por el procedimiento administrativo de apremio” &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;DISPOSICIÓN FINAL ÚNICA&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente Ordenanza, aprobada por el Pleno de este Ayuntamiento en sesión celebrada el ____ de _____________ de 20__, entrará en vigor en el momento de su publicación íntegra en el Boletín Oficial de las Islas Baleares y será de aplicación a partir del día siguiente a su entrada en vigor, permaneciendo en vigor hasta que se acuerde su modificación o su derogación expresa.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;SEGUNDO.- Dar al expediente la tramitación y publicidad preceptiva, mediante exposición del mismo en el tablón de anuncios del Ajuntament y en el Boletín Oficial de la Comunitat Autónoma de las Islas Baleares por un plazo de 30 días, dentro de los cuales los interesados podrán examinarlo y plantear las reclamaciones que estimen oportunas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;TERCERO.- Considerar definitivamente adoptado el Acuerdo, en el supuesto de que no se presenten reclamaciones al expediente en el plazo anteriormente indicado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;QUARTO.- Facultar al Sr. Batle-Presidente para suscribir los documentos relacionados con este asunto.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra el presente acuerdo, en aplicación del artículo 107.3 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y dado que aprueba una disposición de carácter general, se puede interponer recurso contencioso administrativo, ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la presente notificación, en conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la jurisdicción contenciosa administrativa. Todo esto sin perjuicio de que pueda interponer cualquiera otro recurso que pudiera estimar más conveniente a su derecho.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
