&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por no haber podido ser notificado en el domicilio que consta en este Ayuntamiento a la entidad GRUPAYA MANAGEMENT, S.L., y de conformidad con el Art.59.5 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, mediante el presente anuncio se pone en su conocimiento el Decreto de Alcaldía de fecha 09.07.2012, relativo al expediente de Orden de Ejecución núm. 28/11 del tenor literal siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;‘DECRET.- Recibido informe núm. 281/2012 emitido por los Servicios Técnicos Municipales &amp;nbsp;del tenor literal: &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;‘Informe técnico por el trámite del expediente de la Orden de Ejecución núm. 28/11, ordenando el vallado de la obra y la desinstalación de la grua, en el inmueble situado en la calle Jacint Aquenza núm. 18-20&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;I N F O R M E:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por Decreto de fecha 12.04.2011,se ordenó que las obras amparadas por la licencia de obra mayor núm. 41/2007 y que se encontraban paralizadas, en un plazo de 15 días se habían de dejar en las debidas condiciones de seguridad, salubridad o ornamentación pública.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En fecha 20.05.2011, por Decreto, se otorgó un último plazo de quince días para cumplir la orden de ejecución del vallado de la parcela y la retirada de la grúa. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Actualmente, en fecha 9.02.2012, los SSTT inspeccionaron el inmueble y se comprobó que el vallado no se ha realizado y que la grúa está instalada, por tanto la parcela no se encuentra en las condiciones de seguridad correspondientes ya que la obra del edificio está fácilmente accesible para los viandantes y puede ser motivo de multitud de accidentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Según la Ordenanza Municipal sobre conservación de edificaciones, urbanizaciones, terrenos, instalaciones y otros bienes inmuebles, los propietarios tienen la obligación de conservarlos en estado de seguridad, salubridad y ornamento publico.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Según el artículo 45 de dicha Ordenanza, el incumplimiento del deber legal de conservación, cuando afecte de manera grave, inmediata y directa a la seguridad, salubridad o ornamento público, se trata de una infracción grave, no obstante, el incumplimiento reiterado de las ordenes de ejecución o requerimientos específicos formulados por el Ayuntamiento, es un infracción calificada de muy grave.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;C O N C L U S I O N S:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Considerando probados los hechos relacionados, y como resultado que han transcurrido &amp;nbsp;los plazos otorgados y no se ha cumplido con los decretos del Ayuntamiento de fechas 12.04.2011 y 20.05.2011, estos SSTT entienden que se trata de una infracción que puede ser calificada de MUY GRAVE, no obstante, los SSJJ informaran al respecto.’&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En virtud de las atribuciones que me han sido delegadas mediante decreto de fecha 27 de junio de 2011, por el presente RESUELVO:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. De acuerdo con el artículo 19.1 de la Ordenanza del Ayuntamiento de Eivissa sobre conservación de edificaciones, urbanizaciones, terrenos, instalaciones y otros bienes inmuebles, incoar expediente de ejecución subsidiaria por incumplimiento de la orden de ejecución municipal 28/2011, otorgando un último plazo de QUINCE DÍAS para la ejecución del vallado de la parcela y la retirada de la grúa. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.- En caso de incumplimiento de este último plazo, se iniciará la correspondiente ejecución subsidiaria con el cobro de su coste al interesado que según valoración que se anexa, se estima en 27.000,00 €, así como otros gastos que se puedan derivar de la misma.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.- El cómputo de los plazos será contado a partir del día siguiente a la notificación de la presente resolución. &amp;nbsp;&lt;/span&gt;&lt;/p&gt;
