&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el presente procedimiento jvb 196/11 seguido a instancia de GABRIEL BORRAS BUSQUETS frente a FIATC SEGUROS, IMPORT EXPORT BEDAYA SL se ha dictado Sentencia, cuyo tenor literal es el siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;JDO. PRIMERA INSTANCIA N. 14&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PALMA DE MALLORCA&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SENTENCIA: 00181/2011&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PROCEDIMIENTO: JUICIO VERBAL N° 196/2.011.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SENTENCIA n° 181/2.011&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En Palma, a 22 de septiembre de 2.011.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Vistos por Irene Partida Barreto, Magistrado-Juez del Juzgado de Primera Instancia número 14 de Palma de Mallorca, los presentes autos de juicio verbal seguidos con el número 196/2.011 entre:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Demandante: Don Gabriel Borrás Busquets, representado por la procuradora de los&amp;nbsp; Tribunales Doña María del Romero Gaspar de L’Hotellerie y asistido por el letrado Don Guillermo Caldentey Higueras.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Demandados: La entidad IMPORT EXPORT BEDAYA S.L, declarada en situación de rebeldía procesal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La entidad FIATC SEGUROS, representada por el procurador de los tribunales don Antonio Colom Ferra y asistida por la letrado doña Esther Balaguer Pomar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Objeto: Reclamación de cantidad derivada de accidente de circulación.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;FALLO&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ESTIMO INTEGRAMENTE la demanda presentada por la procuradora de los Tribunales Doña María del Romero Gaspar de L’Hotellerie, en nombre y representación de don Gabriel Borrás Busquets, contra la entidad IMPORT EXPORT BEDAYA S.L y contra la entidad FIATC SEGUROS, y en consecuencia CONDENO SOLIDARIAMENTE a las demandadas a abonar al actor la cantidad de CIENTO NOVENTA Y SIETE EUROS CON TREINTA Y CINCO CENTIMOS (197,35€), más los intereses legales, esto es, respecto del particular condenado, un interés anual equivalente al interés legal del dinero incrementado en dos puntos desde la fecha de la presente resolución y respecto de la compañía aseguradora el interés legal incrementado en un cincuenta por ciento desde la fecha del siniestro y a partir del segundo año el interés no podrá ser inferior al 20%, así como al pago de las costas procesales causadas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Notifíquese esta sentencia a las partes, haciéndoles saber que contra la misma cabe recurso de apelación que, en su caso, deberá prepararse ante este mismo Juzgado dentro de los cinco días siguientes al en que se notifique esta resolución. No se admitirá a trámite el recurso si la parte al tiempo de prepararlo no acredita DOCUMENTALMENTE haber constituido el oportuno depósito para recurrir mediante la consignación del importe de 50 euros en la Cuenta de Depósitos y Consignaciones de este Juzgado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Llévese el original al libro de sentencias.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así por esta mi Sentencia, de la que se expedirá testimonio para incorporarlo a las actuaciones, la PRONUNCIO, MANDO Y FIRMO.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PUBLICACIÓN.- Esta sentencia fue leída y publicada estando S.Sª. celebrando audiencia pública. Doy fe.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y encontrándose dicho demandado, IMPORT EXPORT BEDAYA SL, en paradero desconocido, se expide el presente a fin de que sirva de notificación en forma al mismo.&lt;/span&gt;&lt;/p&gt;
