&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Habiendo resultado infructuosa la notificación de Resoluciones de revisión de oficio, por carta certificada con acuse de recibo, a los sujetos responsables, se procede en forma y efectos previstos en el Artº 59.5 de la Ley de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común de 26 de Noviembre de 1.992 (BOE 27.11.92) a publicar la relación de subsidiados, a las que se les notifica las cantidades que deberán reintegrar a este Organismo, por los hechos que a continuación se detallan, advirtiéndoles que disponen de un plazo de 10 días contados a partir de la fecha de la presente publicación para reintegrar dicha cantidad indebidamente percibida en la cuenta núm.0049-5103- 71- 2516550943 de el Banco Santander Central Hispano (BSCH) a nombre de este Organismo debiendo devolver copia del justificante en su Oficina de Empleo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1º-Que le fue reconocida una reanudación de prestación por desempleo con fecha de inicio 27/03/10, y un posterior subsidio por agotamiento con fecha de inicio 01/08/10, que no le correspondían puesto que tenía la prestación extinguida al haber permanecido en autónomos más de dos años, por lo que no cabía la reanudación de la prestación ni el posterior subsidio por agotamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Igualmente se le comunicaba que la percepción indebida de la mencionada prestación ascendía a 3.906,92 euros correspondientes al periodo 27/03/10 a 18/04/10, 08/07/10 a 30/08/10, 01/11/10 a 14/11/10, 03/12/10 a 15/03/11y 27/05/11 a 20/07/11, que inició la compensación con la tramitación de la nueva solicitud presentada el 02/02/12, quedando en fla actualidad como percepción indebida la cantidad de 494,60 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2º-Con fecha 23/05/12, se le comunicó la propuesta de revocación del derecho que tiene Vd, reconocido, por el motivo indicado, concediéndole un plazo de 10 días para que alegara cuanto considerara que conviene a su derecho.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3º- NO ha formulado alegaciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;FUNDAMENTOS DE DERECHO&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1º- El Servicio Público de Empleo Estatal es competente para resolver por razón de la materia, de acuerdo con lo dispuesto en los arts. 226 y 229 del Texto Refundido de la Ley General de la Seguridad Social, aprobado por Real Decreto Legislativo 1/1994, de 20 de junio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2º- Que a los hechos expuestos les son de aplicación lo dispuesto en el artº 213 del R.D.Legislativo 1/1994 de 20 de junio, por el que se aprueba el Texto Refundido de la Ley General de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Visto todo lo actuado, preceptos legales citados y demás de general aplicación, esta Dirección Provincial&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;RESUELVE&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Revocar la resolución de fecha 28/05/10, y declarar la percepción indebida de la misma en la cantidad de 494,60 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;De acuerdo con el nº 2 del artº 33 del Real Decreto 625/1985, de 2 de abril , de desarrollo de la Ley de protección por desempleo, dispone de 30 días para reintegrar dicha cantidad en el Banco Santander CC nº 00495103-71-2516550943, devolviendo a su Oficina del Servicio Público de Empleo una copia del boletín de ingreso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;También podrá solicitar el pago aplazado o fraccionamiento de la cantidad requerida, cuya concesión conllevará el correspondiente devengo del interés legal del dinero, establecido anualmente en la Ley de Presupuestos Generales del Estado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En el supuesto de que no realizase el reintegro y, fuese en algún momento beneficiario de prestaciones, se procederá a realizar su compensación con la prestación, según se establece en el artº 34 del Real Decreto 625/1985, independientemente de que se le haya concedido el aplazamiento o fraccionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Transcurridos los 30 días sin que se haya producido el reintegro, siempre que no se haya iniciado la compensación o se haya solicitado el aplazamiento o fraccionamiento se emitirá la correspondiente certificación de descubierto por la que se iniciará la vía del apremio, según lo dispuesto en el artº 33.2 del Real Decreto 625/1985.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Si el reintegro, la compensación o la solicitud de fraccionamiento o aplazamiento, se realizase antes de la apertura de la mencionada vía de apremio, pero con posterioridad a la finalización del plazo de 30 días reglamentarios, la cantidad adeudada se incrementará de acerito con lo establecido en el artº 27.2 del Texto Refundido de la Ley General de la Seguridad Social con los siguientes recargos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Durante el primer mes posterior al periodo de pago reglamentario el 3%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Durante el segundo mes posterior al periodo de pago reglamentario, el 5%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Durante el tercer mes posterior al periodo de pago reglamentario, el 10%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;A partir del cuarto mes posterior al periodo de pago reglamentario, el 20%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Contra la presente resolución, conforme a lo previsto en el artº. 71 del Texto Refundido de la Ley de Procedimiento Laboral, aprobado por el Real Decreto Legislativo 2/1995, de 7 de abril, podrá interponer ante esta Dirección Provincial, reclamación previa a la vía jurisdiccional social, dentro del plazo de 30 días hábiles siguientes a la fecha de comunicación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt;
