2026-10-09 CAIB text/html 2026-10-13 ca 2026-10-13 ca CAIB ![CDATA[<p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La Llei 5/2008, de 14 de maig, d'actuacions urgents destinades a l'obtenció de sòl per a habitatges de protecció pública (BOIB núm. 68, de 17 de maig de 2008), regula la implantació d'àrees denominades </span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">reserves estratègiques de sòl </em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">(RES).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Cada àmbit té una regulació específica amb les seves normes subsidiàries i complementàries, el seu projecte d'urbanització i el projecte de redistribució de beneficis i càrregues propi de l'àmbit. Així, cada RES s'ha de considerar independent, de manera que l'aplicació de la disposició final cinquena ha de ser particularitzada per a cada RES i garantir la traçabilitat del sector.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">L'àmbit de Son Güells es va declarar Àrea de reserva estratègica de sòl 47/2008, mitjançant l'Acord del Consell de Govern del dia 6 de març de 2009, de resolució de la convocatòria pública d'oferta de sòl per a la creació de reserves estratègiques de sòl.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En la sessió del dia 25 d'octubre de 2013, el Consell de Govern, a proposta del conseller d'Agricultura, Medi Ambient i Territori, aprovà definitivament les normes subsidiàries i complementàries del planejament de la Reserva estratègica de sòl Son Güells, parcel·les M4.1, M4.2, M6.2 i M6.3 de la UE/69-03, de Palma.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La Llei 5/2008 regula a l'article 2.2.</span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">e</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">) dos aspectes bàsics en l'ordenació de les reserves estratègiques de sòl en el municipi de Palma. D'una banda, fixa una densitat màxima de 225 habitants per hectàrea; i de l'altra, una edificabilitat màxima de 0,90&nbsp;m² de sostre per m² de sòl.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Aquests estàndards aplicats a l'àmbit de l'actuació representen els valors següents:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">— Superfície inclosa en l'àmbit de l'actuació: 26.461&nbsp;m²</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— Densitat màxima (225h./ha): 595 habitants</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— Edificabilitat màxima: 9,90 x 26.461&nbsp;m²= 23.814,9&nbsp;m²</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A les mateixes Normes, a l'apartat <em>2.1.1. Densitat d'habitatges</em>, el nombre màxim d'habitatges es va regular en aplicació del Decret 27/1993, d'11 de març, sobre regulació de capacitats de població en els instruments de planejament general i sectorial, que estableix el còmput de tres habitants per habitatge.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tenint en compte que la densitat màxima permesa és de 595 habitants, en l'àmbit de l'actuació es varen preveure 198 habitatges com a màxim.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Així, la situació de partida respecte a la densitat màxima poblacional i l'edificabilitat màxima aprovades per les normes subsidiàries i complementàries per a l'àmbit de la RES 47 Son Güells és la reflectida en el projecte de redistribució de beneficis i càrregues, per donar compliment a l'article 2.2.e) de la Llei 5/2008 i aplicant el còmput de tres habitants per habitatge:</span></span></p> <table border="1" cellspacing="0" class="Table" style="width:100%"> <thead> <tr> <th scope="col" style="vertical-align: top; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La disposició final cinquena de la Llei estableix:</span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Còmput d'intensitat poblacional aplicable a les reserves estratègiques de sòl de la Llei 5/2008, de 14 de maig, d'actuacions urgents destinades a l'obtenció de sòl per a habitatges de protecció pública</strong></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La intensitat poblacional aplicada tant per a habitatges de preu taxat, com per a habitatges de protecció pública i habitatges lliures situats en els àmbits de les reserves estratègiques de sòl de la Llei 5/2008, de 14 de maig, d'actuacions urgents destinades a l'obtenció de sòl per a habitatges de protecció pública, podrà ser de 2,5 habitants per habitatge.</span></span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En cas d'aplicació, s'ha de respectar la densitat màxima poblacional i l'edificabilitat màxima aprovada en les respectives normes subsidiàries i complementàries aprovades per a cada àmbit, i el nou còmput d'habitatges s'ha de distribuir entre els diferents tipus d'habitatges de manera proporcional a l'establerta a les mateixes normes.</span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'estructura general de l'actuació s'ha de mantenir, incloent-hi el sistema viari, el sistema d'espais verds i el sistema d'equipaments.</span></span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">S'han d'aportar els quadres de dades i paràmetres edificables afectats per l'aplicació del nou còmput per incorporar-los com a documentació annexa a les normes subsidiàries i complementàries.</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es justifica expressament que aquesta adaptació <strong>no implica cap modificació del contingut normatiu substantiu</strong> del planejament de la RES de Son Güells per les raons següents:</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— <strong>Inalterabilitat dels paràmetres urbanístics estructurals:</strong> no es modifica ni un sol metre quadrat de l'edificabilitat global del sector (m²st), no s'alteren les altures màximes permeses, ni els coeficients d'ocupació, ni els emplaçaments dels volums edificables aprovats a les NS i CC.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— <strong>Absència de reordenació de l'espai urbà:</strong> el text normatiu, les ordenances gràfiques, els usos globals i detallats, i les tipologies d'ordenació regulades originalment romanen completament immutables.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— <strong>Mecanisme d'eficàcia legal directa:</strong> l'ajust opera com una operació aritmètica derivada d'una ordre legal autonòmica obligatòria. No neix d'una voluntat de redissenyar l'àmbit urbanístic, sinó de reflectir de forma fidel els nous llindars que la llei imposa sobre la realitat física ja consolidada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pel que fa a la justificació tècnica i urbanística, la reducció de la ràtio d'habitabilitat de 3 a 2,5 hab./habitatge representa un <strong>increment del nombre total d'habitatges possibles</strong> dins de la mateixa envolupant edificable.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— <strong>Adequació sociodemogràfica: </strong>el mercat immobiliari actual i les estructures familiars de les Illes Balears demanen habitatges de menor superfície mitjana (d'un i dos dormitoris). El paràmetre anterior forçava superfícies sobredimensionades que encaririen el producte final. El nou estàndard permet optimitzar l'espai edificable sense alterar el volum dels edificis.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>— Suficiència de les infraestructures: </strong>el fet que la densitat màxima d'habitants no es vegi alterada, és a dir, en cap moment s'incrementi el nombre d'habitants màxim, garanteix la suficiència de les xarxes i infraestructures previstes en el projecte d'urbanització.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— <strong>Manteniment de l'equilibri econòmic i dotacional</strong>: atès que no s'incrementa l'edificabilitat lucrativa total (m² de sostre) sinó únicament la divisió interna, no s'altera l'aprofitament urbanístic mitjà del sector. Per tant, no es genera cap plusvàlua que requereixi noves càrregues d'urbanització ni la reobertura del projecte de distribució de beneficis i càrregues ja ferm.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per calcular el nombre d'habitatges màxims resultants en l'aplicació de la disposició final cinquena de la Llei 4/2025, es manté l'edificabilitat i s'aplica a la població establerta a la RES de 594 d'habitants, la intensitat poblacional de 2,5 habitants per habitatge.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Així, el nombre total d'habitatges per bloc es distribueix proporcionalment a la situació de partida del projecte de distribució de beneficis i càrregues, i s'arrodoneix a unitats senceres.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
