2026-09-28 715126 CAIB text/html 53176 CAIB ca ca CAIB 53181 500 ![CDATA[Proposta de resolució del director general de Turisme per la qual es concedeixen subvencions en el marc de la convocatòria de subvencions per a millores en eficiència energètica i la innovació en matèria de processos i d’organització en l’àmbit turístic de les Illes Balears]] 2026-10-01 720414 2026-10-01 ![CDATA[<p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Antecedents</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 21 de maig de 2026, es va publicar en el <em>Butlletí Oficial de les Illes Balears</em> la Resolució del conseller de Turisme, Cultura i Esports per la qual s'aprova la convocatòria de subvencions per a millores en eficiència energètica i la innovació en matèria de processos i d'organització en l'àmbit turístic de les Illes Balears.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Aquesta convocatòria de subvencions es considera una ajuda d'estat de les que estan regulades en els articles 107 i 108 del Tractat de Funcionament de la Unió Europea. No obstant l'anterior, les actuacions subvencionables i la quantia o la intensitat de les ajudes previstes en aquesta convocatòria estan limitades pel que disposen els articles 29 (ajudes a la innovació en matèria de processos i d'organització) i 38 (ajudes a la inversió destinades a mesures d'eficiència energètica) del Reglament (UE) núm. 651/2014 de la Comissió, de 17 de juny de 2014, pel qual es declaren determinades categories d'ajudes compatibles amb el mercat interior en aplicació dels articles 107 i 108 del Tractat.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En conseqüència, atès que la convocatòria compleix els requisits que estableixen els esmentats articles 29 i 38 del Reglament, les ajudes previstes són compatibles amb el mercat interior i, alhora, queden exemptes de l'obligació de notificació que es prescriu en l'article 108, apartat 3, del Tractat.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El termini per presentar sol·licituds es va iniciar el 8 de juny de 2026 a les 9.00 hores i finalitza el 30 de setembre de 2026 a les 23.59 hores, d'acord amb el que estableix l'article 18 de la convocatòria.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès que l'objecte de la subvenció és el finançament d'actuacions que no requereixen la valoració comparativa amb altres propostes, es poden dictar les resolucions de concessió una vegada que s'hagi comprovat el compliment dels requisits establerts en la convocatòria, encara que no hagi finalitzat el termini de presentació de les sol·licituds, d'acord amb el que disposa l'article 15.3 de la convocatòria.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">D'altra banda, l'article 15.1 de la convocatòria determina que la selecció de les persones beneficiàries de les subvencions s'ha de fer mitjançant el procediment de concurrència no competitiva. Les persones beneficiàries han de ser seleccionades per rigorós ordre d'entrada de les sol·licituds i fins que s'exhaureixi el crèdit pressupostari assignat a la convocatòria.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El termini per a l'execució de les actuacions subvencionables s'inicià el dia 22 de maig de 2026 i finalitza el 31 de març de 2028. Tot i això, atès el caràcter incentivador de la subvenció, només són actuacions subvencionables les iniciades amb posterioritat a la data de presentació de la sol·licitud de la subvenció.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. L'article 27 de la convocatòria preveu el pagament parcial de la subvenció que resulta d'aplicar un percentatge del 40 % a l'import de l'ajuda concedida, sempre que l'import de l'actuació corresponent quedi justificat, i s'ha de descomptar del pagament final.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest pagament parcial queda condicionat a la presentació de la documentació justificativa detallada en l'article 25 de la convocatòria i a la comprovació del compliment dels requisits establerts en l'article 27 de la convocatòria. El termini per presentar la justificació parcial s'inicia l'1 de maig de 2027 i finalitza el 31 de maig de 2027.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. L'article 28 de la convocatòria preveu el pagament final de la subvenció, descomptant el pagament parcial, si aquest s'ha efectuat.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El termini per a la presentació de la justificació final, d'acord amb l'article 26 de la convocatòria, s'inicia l'1 d'abril de 2028 i finalitza el 2 de maig de 2028. En el cas que la documentació justificativa final de la subvenció es presenti abans que comenci aquest termini, el pagament final s'ha d'efectuar una vegada que s'hagi iniciat l'exercici pressupostari de 2028.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El crèdit assignat inicialment es distribueix entre els diferents programes i tipologies de la manera següent, tenint en compte també el règim i el calendari de pagaments anteriors:</span></span></p> D'acord amb l'article 21.1 de la convocatòria, el director general de Turisme, com a persona instructora, en vista de l'expedient, ha d'avaluar les sol·licituds i formular la proposta de resolució, motivada, de concessió de les subvencions i especificar-ne la quantia. Aquesta proposta de resolució s'ha de notificar mitjançant la publicació en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. En aplicació dels criteris per a l'adjudicació de les subvencions prevists en la convocatòria, es relacionen en l'annex d'aquesta proposta de resolució les persones proposades com a beneficiàries de la subvenció, els noms dels establiments on s'han de dur a terme les actuacions, els pressuposts de les activitats subvencionades, els imports sol·licitats i els imports de la subvenció proposats, desglossats per anualitats pressupostàries.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tot l'anterior es fa d'acord amb el que preveuen els següents articles de la convocatòria: 9 i 10 (programes, tipologies i actuacions subvencionables); 11 i 12 (despeses subvencionables); 13 (intensitat de l'ajuda), i 14 (límits i exclusió).</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. En els expedients administratius corresponents hi consta que les entitats que figuren en l'annex es troben al corrent de les obligacions tributàries i amb la Seguretat Social.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. Hi ha crèdit adequat i suficient per imputar els pagaments de les subvencions previstes en l'annex a les partides pressupostàries</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">12201/G/751C01/77000/00/26064 i 12201/G/751C01/77000/00/26064 dels pressuposts de la Comunitat Autònoma de les Illes Balears per als anys 2027 i 2028, respectivament.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13. Les propostes de resolució no creen cap dret a favor de la persona beneficiària proposada, mentre no es dicti i notifiqui la resolució de concessió.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fonaments de dret</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. L'Ordre del conseller de Turisme de 20 de juny de 2005 per la qual s'estableixen les bases reguladores de les subvencions en matèria de turisme, publicada en el <em>Butlletí Oficial de les Illes Balears</em> de 26 de maig de 2005, amb una correcció d'errades publicada en el <em>Butlletí Oficial de les Illes Balears</em> de 27 d'agost de 2005.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Resolució del conseller de Turisme, Cultura i Esports per la qual s'aprova la convocatòria de subvencions per a millores en eficiència energètica i la innovació en matèria de processos i d'organització en l'àmbit turístic de les Illes Balears, publicada en el <em>Butlletí Oficial de les Illes Balears </em>de 21 de maig de 2026.</span></span></p> <p style="text-align:center"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Proposta de resolució</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propòs al conseller de Turisme, Cultura i Esports que dicti una resolució en els termes següents:</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Concedir una subvenció a les persones sol·licitants per les actuacions indicades en l'annex i pels imports que s'hi assenyalen, en el marc de la convocatòria de subvencions per a millores en eficiència energètica i la innovació en matèria de processos i d'organització en l'àmbit turístic de les Illes Balears.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autoritzar i disposar una despesa global de 405,257,61 €, a favor de les persones sol·licitants que figuren en l'annex, amb càrrec a les partides pressupostàries 12201/G/751C01/77000/00/26064 i 12201/G/751C01/77000/00/26064 dels pressuposts de la Comunitat Autònoma de les Illes Balears per als anys 2027 i 2028, respectivament.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Fer constar que, d'acord amb l'article 24 de la convocatòria, el termini per a l'execució de les actuacions subvencionables s'inicià el 22 de maig de 2026 i finalitza el 31 de març de 2028, sense perjudici del caràcter incentivador de la subvenció, per la qual cosa només són actuacions subvencionables les iniciades amb posterioritat a la data de presentació de la sol·licitud de la subvenció. En conseqüència, no es considera despesa subvencionable qualsevol despesa que hagi estat facturada amb anterioritat.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Fer constar que, d'acord amb l'article 25 de la convocatòria, el termini per a la justificació parcial de la subvenció s'inicia l'1 de maig de 2027 i finalitza el 31 de maig de 2027. No obstant això, s'admet la documentació de la justificació parcial de la subvenció presentada en qualsevol moment anterior a aquest període.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta justificació parcial és optativa i no presentar-la únicament comporta la pèrdua del dret a percebre l'import corresponent al pagament parcial, sense perjudici que es pugui percebre la totalitat de l'import subvencionat una vegada que s'hagi presentat la justificació final.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Fer constar que, d'acord amb l'article 26 de la convocatòria, el termini per a la justificació final de la subvenció s'inicia l'1 d'abril de 2028 i finalitza el 2 de maig de 2028. No obstant això, s'admet la documentació de la justificació final de la subvenció presentada en qualsevol moment del període d'execució.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Fer constar que l'entitat beneficiària de la subvenció ha de complir el règim de publicitat establert en l'article 29 de la convocatòria. L'incompliment de l'obligació de difusió publicitària pot donar lloc al reintegrament de les quantitats percebudes i dels interessos corresponents.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Fer constar que aquesta subvenció ha estat finançada, en la seva totalitat, amb el fons de l'impost del turisme sostenible del Govern de les Illes Balears.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.
