&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;1. Mitjançant Resolució del conseller d'Educació i Universitats d'11 de juny de 2026, es va regularitzar la configuració autoritzada de determinats centres privats concertats d'educació especial de les Illes Balears i es va suprimir la referència a la tipologia de les unitats autoritzades. Amb aquesta autorització el CCEE Mater Misericordiae va quedar configurat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Ensenyaments autoritzats:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Educació especial infantil (EEI):&lt;/strong&gt; 4 unitats i una ràtio de 4/6 alumnes per unitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Educació especial bàsica obligatòria (EEB):&lt;/strong&gt; 25 unitats, distribuïdes de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 23 unitats al centre específic Mater Misericordiae (c/ de Francesc Julià, 54) i un màxim de 140 places escolars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 2 unitats ASCE (aules substitutòries de centre específic), distribuïdes de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 1 unitat al CC Sant Agustí, Palma, (codi 07003328) i una ràtio de 4/6 alumnes per unitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 1 unitat al CC Sant Francesc d'Assís, Palma, (codi 07003444) i una ràtio de 4/6 alumnes per unitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Programes de transició a la vida adulta (TVA):&lt;/strong&gt; 8 unitats i una ràtio de 4/6 alumnes per unitat, distribuïdes de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 5 unitats al centre Mater Misericordiae (c/ de Francesc Julià, 54).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 2 unitats a les aules externes del centre a s'Aranjassa (c/ de s'Aranjassa, 9, 07199 Palma).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;- 1 unitat a l'aula externa del centre a Sineu (c/ de Ponent, 1, 07510 Sineu)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;*Les ràtios de les unitats autoritzades aniran vinculades al perfil de l'alumnat escolaritzat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:12.0pt"&gt;2. En data 25 de juny de 2026, (GOIBE470225/2026), la representant del centre va presentar una sol·licitud de modificació de la configuració del centre amb l'augment de 2 unitats d'educació especial bàsica (EEB) a unes instal·lacions ubicades a la Plaça Verge del Miracle núm. 4 de Palma. Amb la sol·licitud va presentar plànols i una memòria explicativa i justificativa de les noves aules.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;3. En data 10 d'abril de 2026, el cap de Departament del Servei d'Inclusió per a la Comunitat Educativa va emetre un informe favorable referent a la sol·licitud d'augment de dues unitats d'educació especial bàsica (EEB) del CCEE Mater Misericordiae atès que eren necessàries per donar resposta a les sol·licituds d'admissió d'alumnat amb necessitats educatives especials que requereix una intervenció educativa d'alta intensitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;4. Finalment, en data 31 d'agost de 2026, l'arquitecte del Servei d'Infraestructures Educatives va emetre un informe favorable de la visita realitzada el mateix dia per a l'autorització del centre amb la configuració sol·licitada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;5. El 31 d'agost de 2026, la cap del Servei de Planificació Educativa va emetre un informe favorable sobre la modificació de la configuració del centre privat concertat d'educació especial Mater Misericordiae, de Palma, amb&amp;nbsp; l'augment de 2 unitats d'educació especial bàsica (EBB) a les instal·lacions de la Plaça Verge del Miracle, núm. 4, de Palma&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;6. L'1 de setembre de 2026, la directora general de Planificació i Gestió Educatives va proposar l'autorització de la modificació de la configuració del centre privat concertat d'educació especial Mater Misericordiae, de Palma, amb&amp;nbsp; l'augment de 2 unitats d'educació especial bàsica (EBB) a les instal·lacions de la Plaça Verge del Miracle, núm. 4, de Palma&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

L'Estatut d'autonomia de les Illes Balears, aprovat per la Llei orgànica 1/2007, de 28 de febrer (BOE núm. 52, d'1 de març), el qual estableix, en l'article 36.2, que, en matèria d'ensenyament, correspon a la Comunitat Autònoma de les Illes Balears la competència de desenvolupament legislatiu i d'execució de l'ensenyament en tota la seva extensió, nivells i graus, modalitats i especialitats&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;2. La Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (BOE núm. 159, de 4 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;3. La Llei orgànica 2/2006, de 3 de maig, d'educació, (BOE núm. 106, de 4 de maig), modificada per la Llei orgànica 3/2020, de 29 de desembre, (BOE núm. 340, de 30 de desembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;4. La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;5. La Llei 1/2022, de 8 de març, d'educació de les Illes Balears, la qual estableix a l'article 102, punt 2, de Creació de centres que la creació, la supressió i la transformació de centres privats s'ha de sotmetre a l'autorització administrativa corresponent, (BOIB núm. 38, de 17 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;6. El Decret 39/2011, de 29 d'abril, pel qual es regula l'atenció a la diversitat i l'orientació educativa als centres educatius no universitaris sostinguts amb fons públics (BOIB núm. 67, de 5 de maig). En l'article 40, en el capítol X, assenyala que s'han d'establir les directrius d'intervenció adients per fomentar models de suport inclusius que afavoreixin una atenció educativa de qualitat per a tots els alumnes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;7. La Resolució del conseller d'Educació i Universitat de 2 de maig de 2018 per la qual es modifica la Resolució de la consellera d'Educació, Cultura i Universitats, de 25 de març de 2015 per la qual es regulen les ràtios als centres específics d'educació especial, i s'estableixen les ràtios dels programes de formació per a la transició de la vida adulta (TVA) per als alumnes escolaritzats als centres específics d'educació especial (CEE) i a les aules ASCE (aules substitutòries de centre especial) (BOIB núm. 61, de 17 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;8. La Resolució del conseller d'Educació i Universitat de 5 de juliol de 2018 per la qual es modifica la Resolució de la consellera d'Educació, Cultura i Universitats de 13 de maig de 2015, per la qual s'estableixen amb caràcter provisional els requisits mínims d'espai als centres específics d'educació especial (CEE) i a les aules substitutòries de centre específic (ASCE) ubicades a centres ordinaris (BOIB núm. 95, de 2 d'agost).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;9. La Resolució del conseller d'Educació i Universitat de 19 d'octubre de 2017 per la qual s'estableixen els tipus d'unitats de cada una de les etapes de l'educació especial per als centres sostinguts totalment o parcialment amb fons públics al nivell de l'educació especial (BOIB núm. 133, de 31 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;10. El Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 91, de 14 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;Per tot això, i d'acord amb la proposta formulada per la Direcció General de Planificació i Gestió Educatives en data 1 de setembre de 2026, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;3. Inscriure i actualitzar aquesta modificació en el Registre estatal de centres docents (RCD) del Ministeri d'Educació, Formació Professional i Esports i en el Registre autonòmic de la Conselleria d'Educació i Universitats. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;4. Fer avinent al centre que resta obligat a complir la legislació vigent i a sol·licitar la revisió oportuna de la seva configuració quan s'hagi de modificar qualsevol de les dades que figuren en aquesta Resolució. En cas contrari, es revocarà l'autorització atorgada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;5. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:normal"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
