<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">D'una part, Sandra Fernández Herranz, consellera de Famílies, Benestar Social i Atenció a la Dependència del Govern de les Illes Balears en virtut del Decret 7/2025, d'11 de juliol, de la presidenta de les Illes Balears, de modificació del Decret 8/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears i el Decret 8/2025, d'11 de juliol, de la presidenta de les Illes Balears, pel qual es disposa el cessament i el nomenament de membres del Govern de les Illes Balears, en representació de l'Administració de la Comunitat Autònoma de les Illes Balears, amb CIF S0711001H, en l'exercici de les facultats que li atribueix la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">I, de l'altra, María Augusta Mora Chavez, amb document nacional d'identitat número ***9874**, que actua en representació de la Asociación Pitiusa de Familiares Pro Salud Mental de Niños y Niñas con Autismo u Otros Trastornos General del Desarrollo (APFEM), amb NIF G07728751.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Cada una d'elles és reconegut en la respectiva i corresponent representació que exerceix i amb la capacitat legal necessària per a la signatura del present concert.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Exposen</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. Mitjançant Acord del Consell de Govern de 14 de març de 2025, es va aprovar la previsió de les prestacions i els serveis que s'han de concertar durant l'any 2025. Aquesta previsió va ser modificada mitjançant Acord del Consell de Govern de 5 de setembre de 2025.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. El 27 de gener de 2026, la directora general de Famílies, Infància, Joventut, Diversitat i Igualtat va emetre un informe justificatiu relatiu a la necessitat de concertar places del servei d'acompanyament per a joves que han estat sotmesos a mesures administratives, per als anys 2026-2030, modificat en data 10 de febrer, mitjançant informe rectificatiu.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. El 28 de gener de 2026, la consellera de Famílies, Benestar Social i Atenció a la Dependència va resoldre iniciar l'expedient de concertació del servei d'acompanyament per a joves que han estat sotmesos a mesures administratives, per als anys 2026-2030, rectificada, en el mateix sentit, en data 12 de febrer de 2026 mitjançant resolució.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">4. En data 18 de febre de 2026, Intervenció General de la Comunitat Autònoma de les Illes Balears va emetre informe de fiscalització prèvia favorable.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">5. En data 28 de febrer de 2026 es va publicar en el BOIB núm. 27 la Resolució de la consellera de Famílies, Benestar Social i Atenció a la Dependència per la qual es convoca l'acció concertada del servei d'acompanyament per a joves que han estat subjectes a mesures administratives, que establia un termini de 7 dies hàbils per a presentar sol·licituds.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">6. Finalitzat el termini per a presentació de sol·licituds, el 26 de març de 2026, el cap de departament de Menors i Famílies va emetre informe de comprovació del compliment dels requisits establerts a la convocatòria per part de la Asociación Pitiusa de Familiares Pro Salud Mental de Niños y Niñas con Autismo u Otros Trastornos General del Desarrollo (APFEM) i es considera idònia l'entitat per a la ocncertació de 16 places per a la concertació de 16 places per a la prestació del servei d'acompanyament d'emancipació a Eivissa.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">7. En data 29 d'abril de 2026, la consellera de Famílies, Benestar Social i Atenció a la Dependència, va autoritzar la concertació de 16 places del servei d'acompanyament per a joves que han estat subjectes a mesures administratives a Eivissa amb la Asociación Pitiusa de Familiares Pro Salud Mental de Niños y Niñas con Autismo u Otros Trastornos General del Desarrollo (APFEM), amb CIF G07728751 i va autoritzar la despesa màxima estimada a favor d'aquesta entitat per import de 323.456,64 € (tres-cents vint-i-tres mil quatre-cents cinquanta-sius euros i seixanta-quatre cèntims), a distribuir entre 2026 i 2030, període de vigència del concert.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Que, estant ambdues parts conformes amb la concertació, la duen a terme d'acord amb les següents:</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El règim de la concertació és l'establert a les estipulacions contingudes en el document de formalització del concert i al Plec de prescripcions tècniques per a la concertació de places del servei d'acompanyament per a joves que han estat subjectes a mesures administratives.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>3. Persones usuàries</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Les persones usuàries del servei d'acompanyament són les persones joves de 18 a 25 anys en risc d'exclusió que tenen el seu domicili o residència al territori de la comunitat autònoma de les Illes Balears, que han estat objecte d'una mesura de protecció o justícia juvenil, que es troben en procés d'emancipació i necessiten un suport o acompanyament tècnic per ajudar-les en el procés d'autonomia personal per tal d'evitar el risc d'exclusió social.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>4. Designació i accés de les persones usuàries</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Correspon a la persona usuària o, si escau, a la persona tutora o representant legal, presentar la sol·licitud del servei d'acompanyament mitjançant el tràmit electrònic habilitat a la Seu Electrònica del Govern de les Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La tramitació de les sol·licituds d'accés al servei d'acompanyament d'emancipació correspon a la directora general de Famílies, Infància, Joventut, Diversitat i Igualtat.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Correspon a la Direcció General de Famílies, Infància, Joventut, Diversitat i Igualtat tramitar les sol·licituds d'accés al servei d'acompanyament, així com, dictar i notificar la resolució expressa d'aprovació o denegació del servei en el termini de tres mesos comptadors des de la data en què la sol·licitud hagi tingut entrada en el registre de l'òrgan competent per a la seva tramitació. Transcorregut aquest termini sense obtenir resolució, la sol·licitud s'ha d'entendre desestimada.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En cas que no hi hagi places disponibles, la Direcció General de Famílies, Infància, Joventut, Diversitat i Igualtat habilitarà una llista d'espera. Els criteris de prelació que han de regir l'ordre d'aquesta llista d'espera són els que estableix el Decret 40/2017 o la normativa aplicable en cada moment.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">L'entitat prestadora del servei està obligada a acceptar les persones usuàries que designi la Direcció General i, una vegada se li hagi notificat la resolució d'adjudicació de plaça en el servei, ha de dur a terme el començament efectiu de l'acompanyament, d'acord amb la resolució d'adjudicació.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>5. Incidències</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La Conselleria de Famílies, Benestar Social i Atenció a la Dependència ha de conèixer, en tot moment, les places disponibles del servei.</span></span></span></p>
<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">L'entitat concertada ha de comunicar al Servei de Famílies de la Direcció General de Famílies, Infància, Joventut, Diversitat i Igualtat mitjançant el correu electrònic pap@dgmenors.caib.es, el mateix dia que es produeixi, qualsevol tipus de variació i incidència que sorgeixi en relació amb l'atenció a les persones usuàries o amb la seva incorporació al servei, abandonament, incompliment de les condicions d'ús o del Projecte Educatiu Individualitzat, la no personació a entrevistes o recursos a què el jove hagi estat derivat, i qualsevol altra incidència que impliqui un incompliment de les condicions d'ús del servei.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Aquesta comunicació ha de completar-se, al més aviat possible i sempre en el termini de 72 hores des del fet, mitjançant informe d'incidències d'acord amb el model que es facilitarà que s'ha de remetre a la Direcció General perquè es prenguin les decisions oportunes.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Aquesta informació també s'ha d'incloure en l'apartat d'Observacions del llistat de facturació mensual que emet l'entitat juntament amb la factura.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>6. Facturació del servei</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">L'entitat titular del servei no pot facturar, a les persones usuàries cap quantitat addicional per la prestació dels serveis que preveu el Plec de prescripcions tècniques.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Si s'ofereixen serveis o prestacions distints dels que preveu el Plec, seran voluntaris i no tendran caràcter discriminatori ni afany de lucre. En aquest cas, l'entitat ho ha de comunicar per escrit a la Conselleria de Famílies, Benestar Social i Atenció a la Dependència mitjançant una memòria tècnica del servei complementari en què consti una descripció dels mitjans materials i humans que emprarà per prestar-ho i el llistat de persones usuàries que els han ocupat mensualment.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">L'import del servei per mes fixat s'abonarà mensualment a l'entitat gestora del servei d'habitatge d'emancipació per mensualitats vençudes, amb la presentació prèvia de la declaració de places ocupades del servei concertat i la llista de les persones usuàries que les han ocupat mensualment, prèvia revisió de conformitat pel Servei de Famílies.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Només es poden facturar i cobrar els serveis concertats.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Abans de dia 31 de març de cada any de vigència del concert, l'entitat gestora ha de presentar una memòria relativa a la prestació del servei de l'any anterior, amb el resum de l'ocupació mensual del servei concertat, el nombre de persones usuàries ateses i els indicadors que determini la Conselleria de Famílies, Benestar Social i Atenció a la Dependència, juntament amb un informe d'auditoria externa dels comptes del servei i de l'aplicació dels fons rebuts per l'entitat en concepte d'abonament del concert.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En tot cas, el servei concertat queda subjecte al règim de control financer exercit per la Intervenció General de la Comunitat Autònoma de les Illes Balears o, si escau, a altres organismes competents, autonòmics, estatals o europeus.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La facturació del concert es realitzarà de la manera següent:</span></span></span></p>
<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">a) L'entitat concertada ha de presentar una factura en format electrònic a l'aplicació FACe (https://face.gob.es/es), en la qual ha de constar l'import de la liquidació dels serveis concertats corresponent al mes anterior. A aquesta factura s'ha d'adjuntar, degudament signada pel representant legal de l'entitat concertada, una relació detallada de les persones usuàries, en suport paper i també mitjançant arxiu informàtic, segons el model facilitat per la Conselleria.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) La justificació ha de contenir els conceptes següents: nom de les persones usuàries ordenades alfabèticament, DNI/NIE, domicili del servei, data d'inici, data de baixa (si escau), nombre de places concertades, import deduït en concepte de participació econòmica de la persona usuària i cost del servei fraccionat mensualment. Així mateix, cal indicar qualsevol observació i/o incidència relativa a la plaça (absentisme, reserva de plaça, hospitalització, etc.).</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>7. Pagament</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El pagament de les quantitats justificades mensualment s'efectuaran de la forma següent:</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a) La Conselleria de Famílies, Benestar Social i Atenció a la Dependència, mitjançant la Direcció General de Famílies, Infància, Joventut, Diversitat i Igualtat, tramitarà mensualment la proposta de pagament en concepte de cost del servei de les places concertades, amb la presentació prèvia d'una factura mensual, per part de les entitats, dels serveis concertats.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) El pagament de la quantitat que correspongui es durà a terme en el compte corrent que indiqui l'entitat concertada, aquesta no pot cobrar cap quantitat suplementària en concepte de qualsevol altra prestació que s'hagi d'atendre en virtut del concert subscrit.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c) La percepció indeguda de quantitats per part de l'entitat concertada suposa l'obligació de reintegrar-les, per iniciativa pròpia o per requeriment de la Conselleria, amb l'audiència prèvia de l'entitat interessada i amb la tramitació del procediment que correspongui, d'acord amb la legislació de finances aplicable.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">d) Sens perjudici del que disposa l'apartat anterior, els serveis concertats queden subjectes al control de caràcter financer i a les funcions inspectores i sancionadores de les administracions competents en la matèria.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>8. Auditories</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La Conselleria de Famílies, Benestar Social i Atenció a la Dependència pot requerir d'ofici a l'entitat una auditoria tècnica o econòmica per garantir la qualitat i sostenibilitat del servei concertat, així com els drets de les persones usuàries ateses, d'acord amb el previst en l'article 27.2 del Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>9. Durada i vigència del concert</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Els efectes del règim del concert s'iniciaran l'1 de maig de 2026 o data de formalització del concert, si és posterior, per un període de quatre anys.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>10. Condicions tècniques d'execució</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Les condicions tècniques d'execució s'han d'ajustar al Decret 40/2017 i a la normativa vigent en matèria d'emancipació.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El Plec general de condicions tècniques detalla l'objecte, els drets i les obligacions d'ambdues parts, els serveis que s'han de prestar, els criteris d'intervenció amb les persones usuàries, el règim de prestació del servei, els mitjans que ha d'aportar l'entitat concertada i el sistema de coordinació amb l'Administració.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>11. La garantia dels drets de la persona usuària i la informació a la ciutadania dels seus drets i deures</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La garantia dels drets de les persones usuàries és la recollida als articles 7 i 9 del capítol II de la Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Els deures dels usuaris es recullen específicament a les condicions d'ús del servei d'habitatge d'emancipació, els projecte educatiu individual que els usuaris es comprometen a signar i seguir.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>12. Règim de penalitzacions per incompliment de les condicions de l'acord del concert</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El règim de penalitats i incompliments del concert es troba regulat a la clàusula 16 del Plec de prescripcions tècniques que regeix la concertació del servei d'acompanyament per a joves que han estat subjectes a mesures administratives que s'incorpora com a Annex al document de formalització.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>13. Coordinació i seguiment tècnic del servei</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">L'entitat prestadora del servei ha de designar una persona responsable del servei d'acompanyament d'emancipació que ha de coordinar i supervisar la prestació. Aquesta persona responsable ha de rebre i executar les indicacions que la Conselleria de Famílies, Benestar Social i Atenció a la Dependència consideri oportunes en relació amb la prestació del servei, i ha de tenir les atribucions suficients per adoptar, de manera immediata, les decisions necessàries per assegurar-ne el bon funcionament.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Periòdicament, es faran reunions de seguiment entre la persona responsable de l'entitat i el personal tècnic de la Conselleria de Famílies, Benestar Social i Atenció a la Dependència, per valorar el compliment dels objectius fixats en relació amb la prestació del servei.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En qualsevol moment el Servei de Famílies podrà reclamar a l'entitat el registre de les intervencions tècniques realitzades pel personal tècnic amb cada persona jove usuària del programa.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>14. Causes d'extinció i resolució</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Amb caràcter general, seran causes d'extinció i resolució del concert les establertes a la Llei 12/2018, de 15 de novembre, de serveis a les persones a les Illes Balears, i al Decret 48/2017, de 27 d'octubre.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. S'extingirà per compliment i venciment del termini, sempre que no s'hagi renovat d'acord amb el que s'estableixi reglamentàriament i d'acord amb les normes pressupostàries, o per resolució.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Seran causes de resolució les següents:</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a) Incompliment de les normes de caràcter obligatori a les que han de subjectar-se els serveis socials i les obligacions en matèria de seguretat i instal·lacions.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) Prestació defectuosa de les obligacions acordades.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c) Incompliment dels objectius qualitatius i quantitatius establerts, sempre que l'incompliment sigui imputable a l'entitat concertada, així com de les estipulacions essencials de l'acord.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">d) Infracció de caràcter greu de la legislació fiscal, laboral, de Seguretat Social, d'integració social de discapacitats i de prevenció de riscos laborals.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">e) Pèrdua sobrevinguda de les condicions tècniques, econòmiques i financeres que van habilitar l'acord, la revocació o la caducitat de l'autorització d'obertura i funcionament.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">f) Alteració en el control de l'entitat per canvis en la participació de l'accionariat quan aquesta condició hagi estat determinant en la formalització de l'acord d'acció concertada.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">g) Renúncia de l'entitat concertada.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">h) Aquelles altres que s'estableixin reglamentàriament.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. Són causes d'extinció del concert social:</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a. El venciment del termini de durada del concert, excepte que es renovi d'acord amb el que es preveu en el Decret.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b. L'acord mutu de les parts, manifestat amb l'antelació que es determini en el concert a l'efecte de garantir la continuïtat del servei.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c. L'incompliment greu de les obligacions derivades del concert per part de l'Administració o de l'entitat titular del servei, amb el requeriment previ per a exigir el seu compliment.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">d. L'extinció de la persona jurídica a la qual correspon la titularitat, excepte el que preveu l'article següent.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">e. La declaració de concurs de creditors de l'entitat titular del servei.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">f. La revocació de l'acreditació administrativa del servei.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">g. El cessament voluntari, degudament autoritzat, de l'activitat del servei.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">h. La modificació de les condicions tècniques o de les condicions econòmiques per part de l'Administració, quan l'entitat d'iniciativa privada no presti la seva conformitat.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">i. La negativa a atendre les persones usuàries derivades per l'administració competent de conformitat amb l'article 9.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">j. La baixa demanda de les persones amb dret d'accés al servei, les condicions del qual es fixaran, si resulta oportú, en els plecs tècnics.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">k. L'incompliment de les condicions establertes en el document de formalització del concert o de les condicions establertes en els plecs tècnics. Aquests incompliments s'hauran de constatar en el seguiment i control previstos per l'article</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">l. Aquelles altres causes que estableixi el concert.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>15. Jurisdicció competent</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Les qüestions litigioses que puguin derivar-se de la interpretació, execució i, si escau, resolució d'aquest concert seran sotmeses a la jurisdicció contenciosa administrativa.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">I, com a prova de conformitat amb tots els punts, subscriuen aquest concert</span></span></span></p>
