font-size:12px">Parts</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Vicent Marí Torres, president del Consell Insular d'Eivissa (en endavant, Consell), per nomenament del Ple de 23 de juny de 2023, actuant en nom i representació d'aquesta institució, de conformitat amb el que disposen l'article 52 del Reglament orgànic del Consell Insular d'Eivissa, l'article 34 de la Llei 7/1985, de 2 de abril, reguladora de les bases del règim local (LBRL), i l'article 20 de la Llei 4/2022, de 28 de juny, de consells insulars (LCI), assistit pel secretari general d'aquesta Corporació, en exercici de les seues funcions de fe pública que li atribueix l'article 92 bis de la LBRL.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Juan Miguel Guasch Serra, president de la Cambra de Comerç, Indústria, Serveis i Navegació d'Eivissa i Formentera (en endavant, Cambra), nomenat en consell insular de la cambra en data 28 de juny de 2022, per raó del seu càrrec, segons les atribucions conferides per l'article 12 de la Llei 4/2014, d'1 d'abril, bàsica de les cambres oficials de comerç, indústria, serveis i navegació (Llei de cambres) i la Llei 1/2017, de 12 de maig, que regula la Cambra Oficial de Comerç, Indústria i Navegació d'Eivissa i Formentera (Llei de cambres IB), i en l'exercici que li atribueix l'article 36 del seu Reglament de règim intern.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Antecedents</span></strong></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.</span></strong> El Consell i la Cambra tenen entre les seues finalitats el desenvolupament d'estratègies de promoció econòmica i desenvolupament local i de foment de l'esperit emprenedor, l'autoocupació i la creació d'empreses en l'àmbit de l'illa d'Eivissa.</p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. </span></strong>El Consell, de conformitat amb l'article 30 de la Llei de cambres IB, modificat per l'article 2 de la Llei 2/2022, de 6 de juny, de mesures urgents en determinats sectors d'activitat administrativa, i per la disposició final 13 de la Llei 12/2023, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per l'any 2024, pot signar convenis per finançar les cambres de comerç, entre altres finalitats, a la fi de coadjuvar al cofinançament de les despeses de funcionament i estructura.</p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.</span></strong> D'altra banda, la Cambra és una corporació de dret públic dependent de la tutela de la conselleria d'Empresa, Ocupació i Energia del Govern de les Illes Balears, que representa els interessos del comerç, la indústria, la navegació i els serveis de la seva demarcació i te l'objecte, les funcions i les atribucions que determina la Llei de cambres i les normes que la despleguen, la Llei de cambres IB i la normativa que la desplega, i les disposicions del Reglament de règim interior de la Cambra Oficial de Comerç, Indústria, Serveis i Navegació d'Eivissa i Formentera (Reglament cambres IB) .</p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.</span></strong> La Cambra gaudeix de la naturalesa d'ens local i té plena capacitat i personalitat jurídica independent per al compliment de les seues finalitats pròpies i es regeix pels principis de cooperació i col·laboració; i en la seua actuació, pels criteris d'eficiència i servei a la ciutadania.</p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A més de l'exercici de les competències de caràcter públic que li atribueix la legislació vigent i de les que li puguin encomanar i delegar les administracions públiques, la Cambra té entre les seves funcions, la de prestar serveis a les empreses que operen les activitats de comerç, indústria, serveis i navegació.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.</span></strong> Que des dels seus inicis, la Cambra ve desenvolupant diverses activitats emparades en la normativa vigent, com, per exemple: emetre diferents certificats; formacions; suport al comerç com a consultoria, comunicació i difusió d'iniciatives; organització de campanyes, concursos, etc.</p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Cambra participa a les diferents entitats i organismes de l'administració dels que forma part, com a òrgan consultiu, acudint puntualment a les seves sessions, amb una participació activa quant a recollida d'opinió i criteris dels sectors empresarials de les nostres illes.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Cambra és membre actiu de l'Institut de Mediació de les Illes Balears (IMIB), integrat pel Col·legi d'Advocats de Balears (ICAIB) i les tres cambres de comerç, impulsant la mediació com a sistema de resolució de conflictes de forma extrajudicial.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.</span></strong> En el Pressupost del Consell de l'any 2026, consta una subvenció nominativa a la Cambra de Comerç, seu Eivissa, per import de 130.000 €, amb càrrec a l'aplicació pressupostària 4220.48966.</p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta subvenció nominativa està prevista en el Pla Estratègic de Subvencions del Consell per als anys 2026-2028, publicat al BOIB núm. 2, de 31 de gener de 2026, amb la finalitat de donar suport a la Cambra finançant l'exercici de les seves funcions publicoadministratives dirigides a les empreses de la seva circumscripció desenvolupades a l'any 2026 i així preservar la seva continuïtat amb la tasca de promoció i defensa dels interessos generals del comerç a l'illa d'Eivissa.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. </span></strong>Que les despeses totals de la Cambra en funcionament i estructura per l'any 2026 a l'illa d'Eivissa objecte de la present subvenció seran de DOS-CENTS NORANTA I SIL MIL AMB SET-CENTS EUROS (296.700,00 €), segons consta a la relació de despeses de l'annex I del present Conveni.</p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.</span></strong> Que és voluntat d'ambdues institucions que tots els ciutadans i ciutadanes de l'Illa d'Eivissa puguin beneficiar-se de l'assessorament i suport proporcionat per la Cambra.</p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les parts es reconeixen mútuament la capacitat legal necessària per formalitzar aquest Conveni, d'acord amb les següents</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Clàusules</span></strong></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- Objecte</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'objecte del present Conveni entre el Consell i la Cambra és establir els termes i condicions per a l'atorgament d'una subvenció nominativa, amb la finalitat d'assegurar la continuïtat de l'entitat beneficiària i contribuir a les despeses derivades del seu funcionament i estructura, així com del desenvolupament de les funcions de caràcter publicoadministratiu durant l'exercici 2026.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Amb aquesta col·laboració publicoprivada es facilita tot un sistema de desenvolupament de l'activitat econòmica i empresarial, posant a disposició de les empreses la informació i els mitjans necessaris per millorar la seva gestió i augmentar la seva competitivitat.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Finançament</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest Conveni instrumenta una subvenció nominativa excepcional i directa, la qual està prevista al Pressupost del Consell de l'any 2026, a la Cambra, de conformitat amb allò establert a l'art. 48 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic (LRJSP), a l'art. 22.2 <em>a </em>de la Llei 38/2003, de 17 de novembre, general de subvencions (LGS), i a l'art. 65 del Reial decret 887/2006, de 21 de juliol, mitjançant el qual s'aprova el Reglament de la llei 38/2003, de 17 de novembre, general de subvencions (RLGS); i tenint en compte el Decret llei 9/2021, de 23 de desembre, que modifica la llei de cambres.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- Obligacions de les parts</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ambdues parts ens comprometem amb caràcter general a executar les activitats objecte d'aquest Conveni de conformitat amb els principis de bona administració, bona fe i presumpció de legalitat.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.1. Obligacions de la Cambra:</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Cambra es compromet a trobar-se en una situació que legitimi la concessió de l'ajuda i a complir amb els requisits i condicions inherents a aquesta. En concret, assumeix les següents obligacions:</span></p> <ul> <li><strong>Estar al corrent de les obligacions tributàries i de la Seguretat Social</strong>, tant davant l'Administració General de l'Estat com davant el Consell, ja sigui mitjançant la presentació de la documentació corresponent o mitjançant una declaració responsable formalitzada davant l'autoritat administrativa competent o notari públic. A aquest efecte, la Cambra podrà autoritzar el Consell per aconseguir aquesta documentació.</li> <li><strong>Sotmetre's a les actuacions de comprovació i control</strong> que pugui dur a terme l'òrgan concedent, així com a les activitats de fiscalització i control financer que corresponguin als òrgans competents, tant de caràcter nacional com europeu, facilitant tota la informació que li sigui requerida en l'exercici d'aquestes funcions.</li> <li><strong>Comunicar a l'òrgan concedent l'obtenció de qualsevol altra subvenció, ajuda, ingrés o recurs</strong> que financin les actuacions subvencionables, provinents de qualsevol administració o entitat pública o privada, nacional o internacional. Aquesta comunicació haurà de realitzar-se tan aviat com es tingui coneixement de la concessió, i en tot cas, abans de la justificació de l'aplicació dels fons rebuts. Així mateix, s'haurà de notificar qualsevol alteració de les condicions tingudes en compte per a la concessió de la subvenció.</li> <li><strong>Disposar dels llibres comptables, registres diligenciats i altres documents degudament auditats en els termes exigits per la legislació mercantil i sectorial aplicable a la persona o entitat beneficiària.</strong></li> <li><strong>Conservar la documentació justificativa de l'aplicació dels fons rebuts</strong>, inclosos els documents electrònics, mentre puguin ser objecte d'actuacions de comprovació i control.</li> <li><strong>Complir amb les obligacions relatives a transparència i subministrament d'informació</strong>, en els termes establerts per la normativa vigent en matèria de transparència.</li> <li><strong>En cas que es produeixin rendiments financers dels fons lliurats, aquests incrementaran l'import de la subvenció concedida.</strong></li> <li><strong>Executar les actuacions subvencionades descrites a l'annex 1, en el marc del suport econòmic atorgat pel Consell.</strong></li> </ul> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Addicionalment, la Cambra haurà de complir amb la resta d'obligacions previstes a l'article 14 de la Llei General de Subvencions (LGS), així com amb les establertes específicament en la corresponent resolució de concessió.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.2. Obligacions del Consell:</span></strong></p> <ul> <li><strong>Destinar la quantitat de cent trenta mil euros (130.0000,00 €) a la Cambra, amb càrrec a la partida pressupostària 4220.48966, existint crèdit adequat i suficient per a fer front a les obligacions de contingut econòmic derivades de la concessió de la subvenció.</strong></li> <li><strong>Tramitar el procediment de concessió de la subvenció</strong>, d'acord amb la normativa vigent que sigui aplicable al cas.</li> <li><strong>Comprovar el compliment de l'adequada justificació de la subvenció, així com de la realització de les funcions publicoadministratives i el compliment de la finalitat que motiva la concessió o el gaudir de l'ajut.</strong></li> <li><strong>Dur a terme les actuacions d'inspecció i control sobre les despeses subvencionables</strong>, sense perjudici de les competències que, d'acord amb la normativa legal o reglamentària, puguin correspondre a altres òrgans o institucions competents.</li> </ul> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Termini d'execució</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La subvenció es destinarà a finançar les depeses objecte del present Conveni que es produeixin des de l'1 de gener de 2026 fins al 31 de desembre de 2026.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- Despeses subvencionables</span></strong></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.1. </span></strong>Es consideren despeses subvencionables aquelles que, de manera indubtable, responguin a la naturalesa de l'activitat subvencionada, siguin estrictament necessàries i s'efectuïn en el termini establert en el present Conveni.</p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Concretament, es consideren despeses subvencionables les de personal, de viatge i desplaçament, assessorament i serveis externs i altres despeses corrents, vinculades a l'exercici de les funcions publicoadministratives de la Cambra. S'entén per:</span></p> <ul> <li>Despeses de personal. Els costos generats per l'abonament de retribucions brutes que inclouen les percepcions salarials de: salari base, complements d'antiguitat, complements derivats de l'activitat (per coneixements especials, per torns de treball, nocturnitat, penositat, etc.), pagues extres, complements personals, incentius a la producció, hores extraordinàries i resta de complements personals i plusos que convencionalment o per sentència judicial corresponguin. Les cotitzacions socials i impostos a càrrec del treballador i la seguretat social a càrrec de la empresa són considerades despeses de personal.</li> <li>Desplaçament, allotjament i manutenció. Les quanties d'aquestes despeses no poden excedir les establertes legalment.</li> <li>Despeses d'assessorament i serveis externs de caràcter corrent necessàries per al desenvolupament de l'activitat publicoadministrativa objecte de la subvenció.</li> </ul> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La raonabilitat del cost s'aplicarà no superant les mitjanes de preus de mercat de la matèria que origina la despesa. Aquest apartat inclou la despesa derivada de la revisió del compte justificatiu per la persona auditora.</span></p> <ul> <li>Despeses relacionades amb les accions i activitats desenvolupades per la Cambra objecte del present Conveni.</li> <li>Altres despeses corrents necessàries per al desenvolupament de les funcions publicoadministratives, com són:</li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Lloguer de la seu, inclosa la comunitat, o altres instal·lacions i/o equips on es desenvolupen aquestes funcions publicoadministratives o de suport per al compliment de les mateixes.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Subministraments d'electricitat, calefacció, aigua, telèfon, fax i internet.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Serveis de neteja.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Manteniment d'edificis, equips d'oficina i equips informàtics.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Material d'oficina, amortització d'equips i altres despeses consumibles d'oficina.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Subscripcions de premsa i de plataformes legislatives.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de dominis corporatius d'internet, de plataformes de reunions i de manteniment de programes informàtics (nòmines, control horari, comptabilitat, etc.).</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Serveis d'assessoria laboral, fiscal i jurídica.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Assegurances dels edificis i/o instal·lacions i les de responsabilitat civil vinculades al desenvolupament de les funcions de la Cambra.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses d'operativa bancària, com ara comissions de comptes o per serveis bancaris (transferències).</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses relacionades amb el Registre Mercantil.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Subministraments d'equips de protecció individual (EPIS).</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses d'amortització, sempre que estiguin vinculades a elements necessaris per a l'exercici de les funcions publicoadministratives per al període subvencionable i es calculin de conformitat amb les normes de comptabilitat generalment acceptades. Per tal motiu, serà necessari presentar les taules d'amortització dels bens objecte de l'amortització.</span></li> </ul> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.2.</span></strong> El cost de les despeses no podrà ser superior al valor de mercat.</p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.3.</span></strong> En cap cas seran despeses subvencionables, i, per tant, no podran formar part de les despeses subvencionables, les següents:</p> <ul> <li>Els interessos deutors dels comptes bancaris.</li> <li>Els interessos, recàrrecs i sancions administratives i penals.</li> <li>Les despeses de procediments judicials.</li> <li>Despeses corresponents a obra o a adquisició de béns i equipaments inventariables.</li> </ul> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els tributs són despeses subvencionables quan la Cambra, beneficiària de la subvenció, els aboni efectivament. En cap cas no es consideren despeses subvencionables els impostos indirectes quan siguin susceptibles de recuperació o compensació.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.4. </span></strong>En els termes establerts a l'article 31.3 de la LGS, quan l'import de la despesa subvencionable superi les quanties establertes en la legislació estatal en matèria de contractes del sector públic per als contractes menors, l'entitat beneficiària ha de sol·licitar com a mínim tres ofertes de proveïdors diferents, amb caràcter previ a la contracció del compromís per a la prestació del servei o el lliurament del bé, llevat que per les característiques especials de les despeses subvencionables no hi hagi en el mercat un nombre suficient d'entitats que el subministrin o el prestin.</p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'elecció de l'oferta presentada es realitzarà d'acord amb criteris d'eficiència i economia, i s'haurà de justificar expressament en una memòria l'elecció quan no recaigui a la proposta econòmica mes avantatjosa.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb el que estableix l'article 29 de la LGS, la Cambra no podrà subcontractar l'activitat subvencionada a tercers. No es considera subcontractació la concertació a tercers quan l'objecte del contracte no s'espera que hagi de ser realitzat personalment pel beneficiari, bé perquè no constitueixi l'objecte de la seva activitat o bé perquè els elements personals del beneficiari no hagin resultat essencials en la valoració de l'activitat subvencionada.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.5.</span></strong> Aquesta subvenció per a les activitats presentades és compatible amb la concessió d'altres ajuts que puguin concedir aquesta o altres administracions o ens públics o privats, nacionals de la Unió Europea o d'organismes internacionals, però en cap cas l'import no pot ser de tal quantia que aïlladament o en concurrència amb altres subvencions superi el cost de l'activitat subvencionada.</p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- Pagament</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consell aportarà com a màxim 130.000,00 euros i aniran a càrrec de la partida pressupostària 4220.48966, segons es preveu al Pressupost del Consell Insular d'Eivissa de l'any 2026.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament de la subvenció nominativa del Consell a la Cambra objecte del present Conveni s'efectuarà en un únic pagament del 100 % de la quantia per un import de 130.000 € a la signatura del Conveni i prèvia fiscalització del reconeixement de l'obligació.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En relació a la presentació de garantia, atès que la beneficiària és un ens instrumental de dret públic vinculada a una administració pública, de conformitat amb allò establert a l'article 42.2 del RLGS, queda exonerada la Cambra de la presentació de garantia.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.- Forma de justificació</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per a la justificació del Conveni, la Cambra haurà de presentar la documentació que a continuació es relaciona entre el 15 i el 28 de febrer de 2027.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La justificació de la subvenció es realitzarà mitjançant la presentació per la seu electrònica del Consell del compte justificatiu que contindrà, com a mínim, la informació següent:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Memòria explicativa de les activitats realitzades, els productes promocionats i els resultats obtinguts.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Memòria econòmica justificativa del cost de l'activitat.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Relació classificada de les despeses corrents de l'activitat, amb indicació del proveïdor, número d'identificació fiscal, concepte, import, data d'emissió de la factura i data de pagament.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) En el cas d'activitats executades per entitats vinculades amb l'entitat beneficiària, s'atendrà el que dictamina la LGS, i a les factures emeses es detallaran els conceptes i imports a les factures.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Justificant de les mesures de publicitat relatives al finançament públic per part del Consell Insular.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La justificació de la despesa s'entendrà efectuada mitjançant la presentació de:</span></p> <ul> <li>Factures pagades o documents de valor probatori equivalent en el tràfic jurídic mercantil o amb eficàcia administrativa que reuneixin els requisits i les formalitats previstos en el Reial decret 1619/2012, de 30 de novembre, pel qual s'aprova el reglament mitjançant el qual es regulen les obligacions de facturació i justificant de pagament.</li> <li><span>Certificat acreditatiu de la prorrata de l'IVA, si correspon.</span></li> <li>Còpies de les nòmines dels treballadors amb contractació laboral com a personal de l'entitat, així com els seus justificants de pagament.</li> <li>Justificants de pagament de la Seguretat Social corresponents al personal contractat.</li> <li><span>Justificant acreditatiu de la retenció de l'IRPF als autònoms, si correspon.</span></li> <li>Justificants de pagament. Es consideraran com a justificants de pagament els següents:</li> </ul> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1r. Extracte bancari en el qual quedi identificat el pagament realitzat mitjançant la indicació de l'import i la identificació del pagador i del destinatari.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2n. Factura que incorpori l'acreditació del cobrament per part del seu emissor o de la persona responsable de l'empresa amb capacitat de cobrament. A aquest efecte, en la factura s'hauran de consignar les dades següents: la data de cobrament; la identificació amb indicació del nom, el NIF i la signatura del declarant del cobrament de la factura, i el segell de l'empresa. Aquest darrer serà facultatiu si l'emissor és una persona física.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3r. Comprovant de transferència bancària en el qual quedi identificat el pagament realitzat mitjançant la indicació de l'import i la identificació del pagador i del destinatari.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4t. Si escau, els tres pressupostos que hagi sol·licitat el beneficiari, quan l'import de la despesa subvencionable superi les quanties establertes en la legislació estatal en matèria de contractes del sector públic per als contractes menors, en aplicació de l'art. 31 de la LGS, així com de l'art. 40 del TRLGS.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5è. Qualsevol altre document de valor probatori equivalent, vàlid en dret, mitjançant el qual s'acrediti la realització efectiva del pagament.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6è. Per a l'acceptació de les justificacions, la despesa haurà d'estar pagada amb anterioritat a l'acabament del període de presentació de justificants.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.- Deficiències en la justificació</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el cas que els documents presentats com a justificació fossin incorrectes o incomplerts, es requerirà a l'entitat beneficiària per tal d'esmenar les deficiències detectades per termini de deu dies hàbils, a comptar des de l'endemà de la recepció d'aquest requeriment, amb l'advertiment que, de no fer-ho, es procedirà a la revocació o a la reducció de l'ajuda segons correspongui, amb la conseqüent obligació de reintegrament de la quantitat percebuda i, si n'és el cas, els corresponents interessos de demora, en les condicions previstes a la LGS i al TRLGS.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si les actuacions o les despeses finalment realitzades i justificades resulten inferiors al pressupost acceptat com a base per a la concessió de la subvenció, es reduirà proporcionalment la quantia de l'ajuda de la següent manera:</span></p> <ul> <li>Si la reducció és de fins al 20 % (inclòs) del pressupost acceptat com a base per a la concessió de la subvenció, es reduirà la subvenció proporcionalment a la reducció del pressupost no justificat.</li> <li>Si la reducció és superior al 20 % i fins el 60 % (inclòs) del pressupost acceptat com a base per a la concessió de la subvenció, es reduirà la subvenció proporcionalment a la reducció del pressupost no justificat i addicionalment es reduirà un 10 % del pressupost no justificat.</li> <li>Si la reducció és de més del 60 % del pressupost acceptat com a base per a la concessió de la subvenció, es considerarà que l'objectiu de l'actuació per a la qual s'ha concedit l'ajuda no s'ha realitzat, la qual cosa donarà lloc al reintegrament de les quantitats percebudes en els termes establerts en la clàusula novena d'aquest Conveni.</li> </ul> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.- Revocació i reintegrament</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pertocarà la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, l'entitat beneficiària incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A més, serà procedent el reintegrament de les quantitats percebudes i l'interès de demora corresponent en les causes i quanties que preveuen els articles 36, 37 i 38 de la LGS, i en la correlativa normativa autonòmica.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'incompliment de l'obligació de justificar la finalitat de l'ajuda econòmica rebuda en la forma i els terminis establerts suposarà, a més de la revocació, la impossibilitat de rebre ajudes del Consell mentre no es faci la devolució de l'import reclamat.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb l'art. 44 del TRLGS, quan el compliment per part del beneficiari s'aproximi de manera significativa al compliment total, d'acord amb la documentació justificativa aportada per l'interessat per a la liquidació de la subvenció, l'eventual reintegrament parcial que resulti de l'aplicació dels criteris a què es refereix la clàusula anterior no caldrà l'exigència d'interessos de demora.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procediment per al reintegrament es regirà pel que es disposa als articles 41 a 43 de la LGS, i al capítol II del títol III del RLGS, i en la correlativa normativa autonòmica.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.- Devolució voluntària</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'entitat beneficiària de la subvenció, segons el que preveu l'art. 90 del RLGS, podrà realitzar voluntàriament la devolució de la totalitat de la quantia rebuda o part d'aquesta mitjançant el seu ingrés, en concepte de «devolució voluntària de subvenció», amb indicació del projecte concret subvencionat, en un compte titularitat del Consell.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.- Infraccions i sancions administratives</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les possibles infraccions en matèria de subvencions que puguin ser comeses per l'entitat beneficiària es graduaran i se sancionaran d'acord amb allò establert al títol V del TRLGS i, amb caràcter supletori, amb el que preveu el títol IV, capítols I i II, de la LGS.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procediment s'adequarà a les previsions establertes en la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (LPAC), i en la LRJSP.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">12.- Tractament de dades de caràcter personal</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pel que fa al tractament de les dades, cadascuna de les parts, dins del marc de les respectives actuacions, haurà de garantir allò disposat en la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Cambra ha de garantir la no recaptació de dades personals de les persones usuàries dels diferents serveis prestats en compliment de l'objecte del present Conveni.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pel que fa a les subcontractacions que pugui realitzar la Cambra per al compliment de les actuacions objecte del Conveni, aquesta es compromet a sol·licitar la firma, per part dels tercers, del corresponent acord de confidencialitat i de protecció de dades.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.- Mecanismes de seguiment</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per garantir el seguiment d'aquest Conveni es podrà crear una comissió de seguiment des del moment de la seua signatura, per tal de donar compliment a l'assenyalat en l'article 49.<em>f</em> de la LRJSP. La comissió estarà integrada per dos representants de cadascuna de les entitats que signen el Conveni.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Correspon a la comissió el seguiment i la valoració de les accions derivades del Conveni, així com la resolució dels problemes d'interpretació i de compliment que poguessin plantejar-se, sense perjudici de les competències que corresponguin al Consell com a entitat que concedeix la subvenció. El funcionament d'aquesta comissió es regirà pel que es disposa en aquest Conveni i per les normes aplicables als òrgans col·legiats de les administracions públiques en la LRJSP.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les controvèrsies que puguin plantejar-se sobre la interpretació i l'execució d'aquest Conveni s'intentaran resoldre per mutu acord de les parts.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.- Modificació del Conveni</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Qualsevol modificació que alteri les condicions establertes en aquest Conveni s'ha de pactar per acord escrit de les parts. En qualsevol cas, el document en què es formalitzi la possible modificació s'ha d'adjuntar a aquest Conveni com una addenda.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">15.- Compatibilitat</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cap cas l'import de l'aportació de l'ajuda pot superar les despeses de les funcions publicoadministratives, segons el pressupost que obra a l'annex I del present Conveni.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">16.- Difusió de la col·laboració del Consell Insular</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En compliment dels articles 11.1 i 34.4 del RLGS, la Cambra es compromet que en els cartells, anuncis, fullets, estands i en tot el material relatiu a les activitats objecte d'aquest Conveni, hi figurarà expressament la col·laboració del Consell i el seu logotip. També farà constar aquesta subvenció en la seva memòria anual.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">17.- Òrgans competents per ordenar, instruir i resoldre el procediment</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Departament de Promoció Econòmica, Cooperació Municipal i Recursos Humans del Consell és el competent per instruir el procediment d'aquest Conveni, de conformitat amb allò establert a l'article tercer, punt 3, del Decret de Presidència núm. 2023000467, de 28 de juny de 2023, d'estructura del govern del Consell Insular d'Eivissa i creació de departaments (BOIB núm. 88, de 29-06-2023).</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dins d'aquest Departament, correspon a la consellera executiva l'ordenació del procediment, en virtut del Decret de Presidència núm. 2023000472, de data 28 de juny de 2023, de nomenament de les persones membres del Consell Executiu i de les vicepresidències del Consell Insular d'Eivissa (BOIB núm. 88, de 29-06-2023), i d'acord amb l'article 33 de la Llei 4/2022, de 28 de juny, de consells insulars, i amb l'article 72 del Reglament orgànic del Consell Insular d'Eivissa (BOIB núm. 136, de 18-09-2020; correcció en BOIB núm. 148, de 14-10-2010; modificació al BOIB núm. 48, de 16-04- 2016), on es recullen les atribucions i competències dels/ de les consellers/eres executius/ives.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pel que fa a la competència per aprovar aquest Conveni, correspon al Consell Executiu, de conformitat amb les atribucions establertes a l'article 28.1 <em>m </em>de la Llei 4/2022, de 28 de juny, de consells insulars (BOIB núm. 88, de 7-07-2022): <em>Aprovar les convocatòries d'ajudes i subvencions, </em>en relació amb l'article 65 del Reglament orgànic del Consell Insular d'Eivissa (BOIB núm. 136, de 18-09-2020; correcció en BOIB núm. 148, de 14- 10-2010; modificació al BOIB núm. 48, de 16-04-2016).</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament d'aquestes ajudes i la seua revocació, en el cas que pertoqui, es farà mitjançant resolució de la consellera executiva del Departament de Promoció Econòmica, Cooperació Municipal i Recursos Humans, de conformitat amb l'article 33.2 <em>l </em>de la Llei 4/2022, de 28 de juny, de consells insulars.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">18.- Vigència del Conveni</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El present Conveni desplegarà els seus efectes des de la seva formalització i tendrà vigència fins el 28 de febrer de 2027.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest Conveni de subvenció no serà susceptible de pròrroga i podrà ser objecte d'addenda manifestada per qualsevol de les parts per escrit i amb una antelació mínima de 3 mesos abans de la seua data de finalització.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">19.- Resolució i extinció del Conveni</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Conveni es podrà resoldre per:</span></p> <ul> <li>Mutu acord, a instància de qualsevol de les parts, que haurà de notificar a l'altra aquesta intenció per escrit i amb una antelació mínima de dos mesos abans de la data de finalització de la vigència d'aquest Conveni.</li> <li>Impossibilitat material o legal de complir les obligacions que deriven de l'objecte del Conveni.</li> <li>Incompliment de les obligacions assumides en el Conveni per part de qualsevol de les parts signants, o d'ambdues.</li> </ul> <p style="margin-left:40px; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En tot cas, serà causa de resolució del Conveni l'incompliment del projecte, que, a més, donarà lloc al reintegrament total o parcial en el termes assenyalats en la clàusula novena d'aquest Conveni.</span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les causes generals previstes a la legislació vigent.</span></li> </ul> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Conveni s'extingirà per esgotament del període de vigència convingut entre les parts.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">20.- Publicitat del Conveni</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El present Conveni es publicarà a la Base de Dades Nacional de Subvencions (BDNS) en els termes expressats a l'article 18 de la LGS, al Butlletí Oficial de les Illes Balears<em> </em>i al Portal de Transparència del Consell (http://transparencia.conselldeivissa.<strong>es</strong>), de conformitat amb allò previst als articles 5.4 i 8.1 de la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació pública i bon govern.</span></p> <p style="text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">21.- Règim jurídic i jurisdicció competent</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El present Conveni no té caràcter contractual sinó que articula una subvenció, i s'ha de regir per les seues clàusules, i en tot allò no previst en el Conveni, per la LRJSP, per la LGS, pel RLGS i pel TRLGS.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la realització de les activitats objecte d'aquest Conveni s'han d'observar les prescripcions contingudes a la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades i garantia dels drets digitals, al Reglament (UE) 2016/679 del Parlament i del Consell, de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals i a la lliure circulació d'aquestes dades i pel qual es deroga la Directiva 95/46/CE (Reglament general de protecció de dades -DOUE 4/5/2016-), i a la resta de legislació vigent en matèria de protecció de dades personals que hi sigui d'aplicació.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les parts que subscrivim aquest Conveni ens comprometem a intentar resoldre en comú les diferències que puguin sorgir en la seua aplicació i la seua interpretació. Però si això no fos possible, les qüestions litigioses que puguin afectar la interpretació i l'execució d'aquest Conveni han de ser de coneixement i de competència de l'ordre jurisdiccional contenciós administratiu.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">I en prova de conformitat, signam aquest Conveni.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pel Consell Insular d'Eivissa&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;Per la Cambra de Comerç, Indústria,</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif;
