&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els nematodes del quist de la patata &lt;em&gt;Globodera pallida&lt;/em&gt; (Stone) Behrens i &lt;em&gt;Globodera rostochiensis&lt;/em&gt; (Wollenweber) Behrens són plagues de quarantena de la Unió Europea que afecten el cultiu de la patata i altres vegetals especificats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el marc de les prospeccions i dels controls oficials efectuats pel Servei d'Agricultura, es va confirmar la presència de &lt;em&gt;Globodera&lt;/em&gt; spp. a determinats llocs de producció de patata de les Illes Balears. En conseqüència, l'any 2021 es va aprovar el manual de procediment de sanitat vegetal al cultiu de la patata a les Illes Balears en què s'establia un pla de vigilància dels nematodes del quist de la patata &lt;em&gt;Globodera rostochiensis&lt;/em&gt; i &lt;em&gt;Globodera pallida&lt;/em&gt;. Aquest manual especificava el programa de prospecció, els procediments d'inspecció i de presa de mostres, les mesures cautelars que s'havien d'adoptar en cas de detectar-se la presència de nematodes del quist de la patata i el programa de control integrat. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En l'àmbit estatal cal destacar l'existència del Pla de Contingència de &lt;em&gt;Globodera pallida&lt;/em&gt; (Stone) Behrens i &lt;em&gt;Globodera rostochiensis&lt;/em&gt; (Wollenweber) Behrens, aprovat pel Ministeri d'Agricultura, Pesca i Alimentació (d'ara endavant, MAPA) el mes de novembre de 2023 i actualitzat el mes de novembre de 2024, el qual s'integra dins el Programa Nacional de Control Oficial del MAPA. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;D'acord amb l'article 5 del Reglament d'execució (UE) 2022/1192 de la Comissió, d'11 de juliol de 2022, quan es detecta i confirma oficialment la presència de &lt;em&gt;Globodera pallida&lt;/em&gt; o &lt;em&gt;Globodera rostochiensis&lt;/em&gt; en un lloc de producció, l'autoritat competent ha de designar aquest lloc com a infestat. Així mateix, els vegetals especificats procedents d'un lloc de producció infestat o que han estat en contacte amb el sòl en què s'ha detectat la plaga s'han de designar com a infestats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El mateix Reglament estableix les mesures que s'han d'aplicar als llocs de producció infestats i als vegetals infestats, amb la finalitat d'erradicar les plagues especificades i impedir-ne la propagació en el territori de la Unió. Aquestes mesures inclouen, entre d'altres, la prohibició de plantar determinats vegetals; l'aplicació de procediments adequats de desinfestació o eliminació de terra; la gestió segura dels residus, i la neteja de maquinària, equips i altres elements que poden actuar com a via de dispersió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Atès el risc de propagació de la plaga mitjançant el sòl adherit als tubercles, a la maquinària, als vehicles, als estris agrícoles i a altres materials, resulta necessari declarar oficialment la presència de la plaga a les Illes Balears i establir les mesures fitosanitàries obligatòries.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El Reglament d'execució (UE) 2022/1192 de la Comissió, d'11 de juliol de 2022, pel qual s'estableixen mesures per erradicar i prevenir la propagació de &lt;em&gt;Globodera pallida&lt;/em&gt; i &lt;em&gt;Globodera rostochiensis&lt;/em&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El Reglament (UE) 2016/2031 del Parlament Europeu i del Consell, de 26 d'octubre de 2016, relatiu a les mesures de protecció contra les plagues dels vegetals. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El Reglament d'execució (UE) 2019/2072 de la Comissió, de 28 de novembre de 2019, pel qual s'estableixen condicions uniformes per a l'execució del Reglament (UE) 2016/2031. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El Reglament (UE) 2017/625 del Parlament Europeu i del Consell, de 15 de març de 2017, relatiu als controls oficials i altres activitats oficials. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. La Llei 43/2002, de 20 de novembre, de sanitat vegetal, que estableix les obligacions dels particulars en matèria de prevenció i lluita contra les plagues i habilita l'adopció de mesures fitosanitàries obligatòries. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. El Reial decret 739/2021, de 24 d'agost, pel qual es dicten disposicions per a l'aplicació a Espanya de la normativa de la Unió Europea relativa a les mesures de protecció contra les plagues dels vegetals i els controls i altres activitats oficials en aquesta matèria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. El Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la Conselleria d'Agricultura, Pesca i Medi Natural exerceix, entre d'altres, la competència en matèria de sanitat vegetal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per tot això, i atesa l'atribució competencial que preveu l'article 20 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 1&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Declarar oficialment la presència de la plaga&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es declara oficialment la presència a les Illes Balears de la plaga de quarantena dels nematodes del quist de la patata &lt;em&gt;Globodera pallida&lt;/em&gt; (Stone) Behrens i &lt;em&gt;Globodera rostochiensis&lt;/em&gt; (Wollenweber) Behrens.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 2&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Designar els municipis infestats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es designen oficialment com a municipis infestats per &lt;em&gt;Globodera&lt;/em&gt; spp. els municipis de les Illes Balears que tenen parcel·les en què el Laboratori Oficial de Sanitat Vegetal de les Illes Balears (LOSVIB) ha confirmat oficialment la presència de la plaga i que figuren en l'annex 1 d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els municipis en què, amb posterioritat a aquesta Resolució, es confirmi oficialment la presència de &lt;em&gt;Globodera&lt;/em&gt; spp. queden igualment designats com a infestats, d'acord amb l'article 5 del Reglament d'execució (UE) 2022/1192, i s'incorporaran al registre oficial corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A l'efecte d'aplicar les mesures fitosanitàries obligatòries previstes en aquesta Resolució, tenen la consideració de llocs de producció infestats les parcel·les situades en els municipis en què el Laboratori Oficial de Sanitat Vegetal de les Illes Balears ha confirmat oficialment la presència de &lt;em&gt;Globodera&lt;/em&gt; spp.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 3&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Designar els vegetals infestats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es designen oficialment com a infestats els vegetals especificats procedents d'un lloc de producció infestat, com també els vegetals que han estat en contacte amb el sòl en què s'ha detectat &lt;em&gt;Globodera&lt;/em&gt; spp., d'acord amb l'article 5.2 del Reglament d'execució (UE) 2022/1192.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Als efectes d'aquesta Resolució, s'entén per &lt;em&gt;vegetals especificats&lt;/em&gt; els vegetals inclosos en l'annex 2, i també els altres que, si escau, s'incorporin posteriorment en l'annex I del Reglament d'execució (UE) 2022/1192 o a la normativa europea que el modifiqui o el substitueixi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 4&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Mesures obligatòries als llocs de producció infestats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Als llocs de producció infestats a què fa referència l'article 2, s'han d'aplicar les mesures següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; No es poden plantar patates destinades a la producció de tubercles de patata per a la plantació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; No es poden plantar ni emmagatzemar els vegetals especificats inclosos en l'annex 2 destinats a la producció de vegetals per a la plantació, excepte els vegetals especificats que figuren en els punts &lt;em&gt;c)&lt;/em&gt; o &lt;em&gt;d)&lt;/em&gt; d'aquest annex, sempre que, després de la collita, se sotmetin a alguna de les següents mesures aprovades oficialment:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— La desinfestació mitjançant els mètodes adequats de manera que no hi hagi cap risc identificable de propagació de la plaga especificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— L'eliminació de la terra mitjançant rentat o raspat fins que els vegetals quedin pràcticament lliures de la plaga, de manera que no hi hagi cap risc identificable de propagació de la plaga especificada, i l'eliminació dels residus de terra seguint un procediment per al qual s'hagi determinat que no hi ha cap risc de propagació de la plaga especificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; S'han de netejar el sòl i les restes vegetals de la maquinària abans o immediatament després de treure-la del lloc de producció infestat i abans d'introduir-la a qualsevol altre lloc de producció no designat com a infestat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; Els llocs de producció destinats a la producció de patates diferents de les destinades a la producció de tubercles de patata per a la plantació s'han de sotmetre a un programa de control oficial destinat a garantir que la plaga no es propagui fora d'aquests espais.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquestes mesures tenen per objecte erradicar la plaga especificada als llocs de producció infestats i impedir-ne la propagació, d'acord amb l'article 8 del Reglament d'execució (UE) 2022/1192.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 5&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Mesures relatives als vegetals infestats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Respecte dels vegetals especificats designats oficialment com a infestats, s'han d'aplicar les mesures següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; No es poden plantar patates destinades a la producció de tubercles de patata per a la plantació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Les patates destinades a transformació industrial o calibratge s'han de sotmetre a procediments adequats i aprovats oficialment per a l'eliminació de residus, inclosos els residus de terra, sempre que s'hagi determinat que aquests procediments no presenten risc de propagació de la plaga especificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:8pt; margin-left:40px; margin-right:0cm; margin-top:0cm"&gt;&lt;span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c) &lt;/em&gt;Els vegetals especificats inclosos en els apartats b) i c) de l'annex 2 s'han de sotmetre a alguna de les mesures següents, aprovades oficialment, de manera que deixin d'estar infestats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La desinfestació mitjançant els mètodes adequats, de manera que no hi hagi cap risc identificable de propagació de la plaga especificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'eliminació de la terra mitjançant procediments com el rentat o el raspat fins que els vegetals quedin pràcticament lliures de terra, de manera que no hi hagi cap risc identificable de propagació de la plaga especificada. En aquest cas, els residus de terra s'han d'eliminar seguint un procediment respecte del qual s'hagi determinat que no comporta cap risc de propagació de la plaga especificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquestes mesures tenen per objecte l'erradicació de la plaga en els vegetals infestats i la prevenció de la seva propagació, d'acord amb l'article 9 i l'annex II del Reglament d'execució (UE) 2022/1192.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El programa de control oficial dels llocs de producció infestats s'ha d'ajustar al que preveu l'article 8.2 del Reglament d'execució (UE) 2022/1192. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquest programa ha de tenir en compte, segons correspongui: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Els sistemes de producció i comercialització dels vegetals hostes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Les característiques de la població de la plaga present.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; L'ús, si escau, de varietats de patata resistents amb els nivells de resistència més elevats disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d) &lt;/em&gt;Altres opcions agronòmiques destinades a suprimir la plaga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e) &lt;/em&gt;Les mesures que permetin, si escau, fer un nou mostreig i, posteriorment, aixecar les restriccions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 7&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Prospeccions, mostrejos i anàlisis&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Amb la finalitat de determinar la distribució de la plaga, el Servei d'Agricultura ha de dur a terme prospeccions oficials de seguiment, anuals i basades en el risc, als llocs de producció de patates diferents dels destinats a la producció de tubercles de patata per a la plantació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les prospeccions de seguiment oficials s'han de dur a terme, com a mínim, sobre el 0,5 % de la superfície utilitzada durant l'any corresponent per a la producció de patates, i se n'ha d'exceptuar la superfície destinada a patates per a la producció de tubercles de patata per a la plantació. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els mostrejos i les proves s'han de dur a terme d'acord amb els mètodes que s'estableixen en el Reglament d'execució (UE) 2022/1192.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 8&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Obligacions dels titulars i operadors&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els titulars dels llocs de producció, productors, magatzems, centres de calibratge, centres de transformació i altres operadors afectats:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Han de permetre l'accés del personal inspector.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Han de facilitar la presa de mostres i les actuacions oficials de control.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Han d'aplicar les mesures fitosanitàries obligatòries que s'estableixen en aquesta Resolució i en el Reglament d'execució (UE) 2022/1192.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;​​​​​​​&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; Han d'evitar la propagació de la plaga mitjançant el moviment de sòl, tubercles, maquinària, vehicles, envasos, eines o altres materials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e)&lt;/em&gt; Han de comunicar al Servei d'Agricultura qualsevol sospita o incidència que pugui implicar la presència o propagació de &lt;em&gt;Globodera&lt;/em&gt; spp.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 9&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Pla de rotació per al control de &lt;em&gt;Globodera&lt;/em&gt; spp. en el cultiu de la patata &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Direcció General d'Agricultura, Ramaderia i Desenvolupament Rural ha d'elaborar un pla de rotació per al control de &lt;em&gt;Globodera &lt;/em&gt;spp. en el cultiu de la patata als municipis declarats infestats, amb la finalitat de reduir la pressió de les poblacions de &lt;em&gt;Globodera&lt;/em&gt; spp. a les parcel·les agrícoles fins a nivells que permetin un cultiu comercial viable i sostenible, i evitar-ne el col·lapse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquest pla de rotació es basarà en l'adopció de mesures fitosanitàries en funció del nivell d'infestació de nematodes de cada parcel·la agrícola. En conseqüència, cada parcel·la disposarà d'una estratègia de control específica, que es basarà en la reducció de la freqüència de sembra de patata, la utilització de cultius trampa (&lt;em&gt;Solanum sisymbriifolium&lt;/em&gt;, entre d'altres), la implantació de cultius no hostes i l'aplicació de bones pràctiques agronòmiques, com ara el volteig de la terra a l'estiu, l'ús de varietats resistents i la racionalització de l'ús de productes fitosanitaris, entre d'altres. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquest pla de rotació pot ser objecte de mesures de foment per part de la Conselleria d'Agricultura, Pesca i Medi Natural.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 10&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Règim sancionador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'incompliment de les mesures previstes en aquesta Resolució pot donar lloc a l'adopció de les mesures cautelars, d'execució i, si escau, sancionadores que pertoquin, d'acord amb la Llei 43/2002, de 20 de novembre, de sanitat vegetal, i la resta de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
