&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Presidència de l&amp;apos;Institut Mallorquí d&amp;apos;Afers Socials (en endavant IMAS) mitjançant Resolució núm. 7035 de 19 d&amp;apos;abril de 2023, va aprovar la convocatòria de la concertació social del servei de centre de dia per a persones amb discapacitat física, inclòs a la xarxa pública de serveis per a persones amb discapacitat de Mallorca (BOIB núm. 54, de 27 d&amp;apos;abril de 2023). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; En data 28 de juny de 2023, la Presidència de l&amp;apos;IMAS va dictar Resolució núm. 12244 d&amp;apos;adjudicació de la concertació social del servei de centre de dia per a persones amb discapacitat física (BOIB núm. 97, de 13 de juliol de 2023), per tres anualitats, a les entitats que s&amp;apos;indiquen a continuació, segons el detall següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;3&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;. &lt;/span&gt;Els dies 29 i 30 de juny, així com el 3 de juliol de 2023 es varen formalitzar els Acords d&amp;apos;acció concertada subscrits entre l&amp;apos;IMAS i les entitats adjudicatàries, per al servei de centre de dia per a persones amb discapacitat física.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La vigència d&amp;apos;aquests Acords, es va establir a la estipulació tercera, en tres anys, amb data d&amp;apos;inici dia 21 de juliol de 2023, i es podrà ampliar i renovar pel mateix termini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Mitjançant Resolució de la Presidència de l&amp;apos;IMAS núm. 16634 de 9 de juliol de 2025, s&amp;apos;acorda l&amp;apos;actualització i fixació de preus dels serveis per a persones amb discapacitat, inclosos a la cartera insular de serveis socials, que poden ser objecte de concertació social per als anys 2025-2027 (BOIB núm. 89, de 12 de juliol de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;5. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;El 30 de juliol de 2025, la Presidència de l&amp;apos;IMAS va dictar Resolució núm. 18592, per a la revisió de preus de la &lt;/span&gt;concertació social del servei de centre de dia per a persones amb discapacitat física, inclòs a la xarxa pública de serveis socials per a persones amb discapacitat de Mallorca (BOIB núm. 105, de 7 d&amp;apos;agost). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;6.&lt;/strong&gt; En data de 27 d&amp;apos;abril i 7 de maig de 2026, el Servei d&amp;apos;Autoritzacions, Registre i Inspecció de Centres i Serveis Socials va emetre informes relatius a les esmentades entitats concertades en el qual s&amp;apos;indiquen les places acreditades existents i&lt;span style="background-color: rgb(255, 255, 255)"&gt; s&amp;apos;informa de la inexistència d&amp;apos;expedient sancionador en matèria de serveis socials per infraccions de les que consten en els articles 128 i 129 de la Llei 4/2009, de Serveis Socials de les Illes Balears durant els darrers 24 mesos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;7. &lt;/strong&gt;Realitzat el preceptiu tràmit d&amp;apos;audiència les entitats concertades amb places disponibles, només l&amp;apos;entitat &lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;ASOCIACIÓN PARA LA REHABILITACIÓN DE ACCIDENTADOS CEREBRALES DE BALEARES REHACER&lt;/span&gt;&lt;/em&gt;, ha manifestat la seva conformitat a l&amp;apos;ampliació de del &lt;span style="background-color: rgb(255, 255, 255)"&gt;servei de centre de dia per a persones amb discapacitat física. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;8. &lt;/strong&gt;En data de 8 de maig de 2026,&amp;nbsp;la cap del Servei de Persones amb Discapacitat, amb el vistiplau de la directora Insular de Persones amb Discapacitat ha emès Informe de necessitat, per el qual es recullen els tràmits preceptius, relacionats als antecedents anteriors i atesa la necessitat existent d&amp;apos;ampliar les places d&amp;apos;aquesta concertació, proposa ampliar per ajustament comptable un total de 4 places , a la entitat REHACER , des de el dia 15 de maig de 2026 fins a la finalització de la concertació social o de les seves pròrrogues. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;9. &lt;/strong&gt;Obra documentació comptable a l&amp;apos;expedient, que preveu una despesa total màxima de 14.857,92€, amb càrrec a la partida pressupostària 40.23140.26000, del pressupost de l&amp;apos;IMAS per a l&amp;apos;any 2026&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;10. &lt;/strong&gt;El Servei Juridicoadministratiu i la Intervenció Delegada han emès sengles informes favorables a l&amp;apos;augment de places del servei esmentat a favor de l&amp;apos;entitat REHACER.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Pel que fa a la competència,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;1. &lt;/strong&gt;Els Estatuts de l&amp;apos;Institut Mallorquí d&amp;apos;Afers Socials (BOIB núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d&amp;apos;abril de 2019, en especial l&amp;apos;establert a l&amp;apos;article 2 d&amp;apos;acord amb el qual l&amp;apos;Institut Mallorquí d&amp;apos;Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Benestar Social del Consell de Mallorca, és l&amp;apos;organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; L&amp;apos;òrgan competent per aprovar aquesta resolució és la Presidència de l&amp;apos;IMAS, d&amp;apos;acord amb l&amp;apos;article 7.2.28 dels Estatuts de l&amp;apos;IMAS (BOIB núm. 67, de 18 de maig de 2019). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; El Decret 48/2017, de 27 d&amp;apos;octubre, pel qual s&amp;apos;estableixen els principis generals als quals s&amp;apos;han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;7. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Els Plecs de prescripcions tècniques que regeixen la concertació social del servei de centre de dia per a persones amb discapacitat física, aprovats per Resolució núm.&amp;nbsp;24234 de 30 de desembre de 2022 (BOIB núm. 2, de 5 de gener de 2023, &amp;nbsp;recullen l&amp;apos;exigència de l&amp;apos;apartat 7.2 de la Llei 12/2018 i del 23 del Decret &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;48&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2017, a l&amp;apos;apartat 19 es preveu el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;8. &lt;/span&gt;&lt;/strong&gt;Acord d&amp;apos;acció concertada ,signat amb l&amp;apos;entitat REHACER en data de 30 de juny de 2023 (Codi CSV: K9AA UV3T ZX3T 3LUH MMMU)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;9. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Resolució de la Presidència de l&amp;apos;IMAS de dial 30 de juliol de 2025, per a la revisió de preus de la &lt;/span&gt;concertació social del servei de centre de dia per a persones amb discapacitat física, inclòs a la xarxa pública de serveis socials per a persones amb discapacitat de Mallorca (BOIB núm. 105, de 7 d&amp;apos;agost de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Pel que fa al procediment, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;10.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; El Decret 48/2017, de 27 d&amp;apos;octubre, pel qual s&amp;apos;estableixen els principis generals als quals s&amp;apos;han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;11. &lt;/strong&gt;L&amp;apos;article 214 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s&amp;apos;aprova el Text refós de la Llei reguladora de les Hisendes Locals, i atès l&amp;apos;acord d&amp;apos;aprovació del règim de fiscalització i intervenció limitada prèvia de requisits bàsics i presa de raó en ingressos del Consell Insular de Mallorca i de les entitats del seu sector públic subjectes a funció interventora de data 12 de desembre de 2019, l&amp;apos;expedient ha estat sotmès a la Intervenció delegada de l&amp;apos;IMAS per a l&amp;apos;emissió del preceptiu informe de fiscalització prèvia ( BOE núm. 59 de 9 de març de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En virtut de la competència atribuïda legalment,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Primer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;APROVAR l&amp;apos;ampliació de 4 places de la concertació social del servei de centre de dia per a persones amb discapacitat física&lt;/span&gt;, a &lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;ASOCIACIÓN PARA LA REHABILITACIÓN DE ACCIDENTADOS CEREBRALES DE BALEARES REHACER&lt;/span&gt;&lt;/em&gt; des de 15 de maig de 2026 fins a la finalització de la concertació social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Se&lt;/span&gt;g&lt;span style="background-color: rgb(255, 255, 255)"&gt;o&lt;/span&gt;n.&lt;/strong&gt; AUTORITZAR I DISPOSAR, a favor de &lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;ASOCIACIÓN PARA LA REHABILITACIÓN DE ACCIDENTADOS CEREBRALES DE BALEARES REHACER&lt;/span&gt;&lt;/em&gt;, amb NIF G07675051 , un import total màxim&lt;strong&gt; &lt;/strong&gt;de &lt;strong&gt;14.857,92€,&lt;/strong&gt; amb càrrec a la partida pressupostària 40.23140.26000, del pressupost de l&amp;apos;IMAS per a l&amp;apos;any 2026. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Cinquè.&lt;/strong&gt; PUBLICAR aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears, &lt;/em&gt;al Tauler d&amp;apos;anuncis de l&amp;apos;IMAS, al Diari Oficial de la Unió Europea i la Seu electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d&amp;apos;acord amb l&amp;apos;article 28.1 dels Estatuts de l&amp;apos;IMAS aprovats per Acord del Ple del Consell de Mallorca d&amp;apos;11 d&amp;apos;abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d&amp;apos;alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d&amp;apos;un mes, comptador a partir del dia següent al de la notificació de la present resolució.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra la desestimació expressa del recurs d&amp;apos;alçada podrà interposar-se recurs contenciós administratiu davant la Secció Contenciosa Administrativa del Tribunal d&amp;apos;Instància, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l&amp;apos;esmentat recurs.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra la desestimació per silenci del recurs d&amp;apos;alçada podrà interposar-se recurs contenciós administratiu davant la Secció Contenciosa Administrativa del Tribunal d&amp;apos;Instància, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s&amp;apos;hagi notificat la resolució).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;No obstant l&amp;apos;anterior, es pot exercitar, si n&amp;apos;és el cas, qualsevol altre recurs que s&amp;apos;estimi pertinent.
