En el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; núm. 53, de 25 d&amp;apos;abril de 2026, es va publicar la Resolució del conseller d&amp;apos;Educació i Universitats per la qual s&amp;apos;autoritza la implantació del batxillerat en la modalitat general al CEPA Pilar Benejam, del municipi de Ciutadella i al CEPA Pitiüses, del municipi d&amp;apos;Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. S&amp;apos;ha comprovat que hi va haver una errada de transcripció en el punt&amp;nbsp; 3 de la Resolució, a l&amp;apos;hora d&amp;apos;especificar els ensenyaments autoritzats del CEPA Pitiüses i és necessari corregir-lo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. En data 7 de maig de 2026, la cap del Servei de Planificació Educativa va emetre un informe favorable sobre la correcció de l&amp;apos;errada detectada en la Resolució del conseller d&amp;apos;Educació i Universitats de dia 20 d&amp;apos;abril de 2026, per la qual s&amp;apos;autoritza la implantació del batxillerat en la modalitat general al CEPA Pilar Benejam, del municipi de Ciutadella i al CEPA Pitiüses, del municipi d&amp;apos;Eivissa (BOIB núm. 53, de 25 d&amp;apos;abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. En data 7 de maig de 2026, la directora general de Planificació i Gestió Educatives va proposar l&amp;apos;autorització de la correcció de l&amp;apos;errada detectada en la Resolució del conseller d&amp;apos;Educació i Universitats de dia 20 d&amp;apos;abril de 2026, per la qual s&amp;apos;autoritza la implantació del batxillerat en la modalitat general al CEPA Pilar Benejam, del municipi de Ciutadella i al CEPA Pitiüses, del municipi d&amp;apos;Eivissa (BOIB núm. 53, de 25 d&amp;apos;abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. L&amp;apos;article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears estableix que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l&amp;apos;òrgan que hagi dictat l&amp;apos;acte o la disposició; la rectificació d&amp;apos;errors ha d&amp;apos;especificar, si escau, els efectes jurídics que se&amp;apos;n deriven, i s&amp;apos;ha de notificar o publicar preceptivament quan faci referència a actes que hagin estat notificats o publicats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. L&amp;apos;article 109.2 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden, així mateix, rectificar en qualsevol moment, d&amp;apos;ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per tot això, i d&amp;apos;acord amb la proposta formulada per la Direcció General de Planificació i Gestió Educatives en data 7 de maig de 2026, dict la següent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d&amp;apos;Educació i Universitats en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb l&amp;apos;article 124 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;També s&amp;apos;hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb l&amp;apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
