![CDATA[<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1. Objecte de la convocatòria</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'objecte d'aquesta convocatòria és fixar els criteris i el procediment de concessió d'ajudes econòmiques destinades a l'organització d'esdeveniments esportius amb projecció turística i repercussió econòmica i social en el municipi de Sant Josep de sa Talaia, que se celebrin en el municipi de Sant Josep de sa Talaia durant l'any 2026, amb la finalitat de promocionar i fomentar la pràctica esportiva, dinamitzar la vida social del municipi i contribuir a la promoció turística del municipi.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els esdeveniments que es presentin a la convocatòria hauran de complir els següents requisits:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Ha de tractar-se d'una activitat de caràcter esportiu.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Ha de tractar-se d'una acció programada, que contribueixi a la promoció turística del municipi de Sant Josep de sa Talaia.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Els esdeveniments hauran de celebrar-se, íntegrament o en part, en el municipi de Sant Josep de sa Talaia, excepte quan, per causa justificada i acreditada, no sigui possible disposar d'instal·lacions o espais municipals adequats.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.</strong> <strong>Despeses subvencionables</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Seran despeses subvencionables aquelles directament relacionats amb l'organització i execució de l'esdeveniment esportiu, realitzats entre <strong>l'1 de gener i el 31 de desembre de 2026</strong>, i referits als següents conceptes:</span></span></span></p>
<ul>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Lloguer d'instal·lacions o equipaments esportius.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Serveis tècnics: arbitratges, cronometratge, jutges, personal auxiliar.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Assegurances vinculades a l'esdeveniment.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Desplaçaments.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Material esportiu fungible.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicitat, comunicació i disseny gràfic.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Serveis sanitaris, ambulàncies i primers auxilis.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Trofeus, medalles i distincions.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Personal tècnic o de suport contractat específicament per a l'esdeveniment.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de logística (muntatge, desmuntatge, senyalització).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses d'administració (papereria, telèfon, internet o altres materials o serveis).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Altres despeses directament relacionades amb l'activitat, que per les característiques especials de l'esport en qüestió, no s'hagin contemplat en els punts anteriors.</span></span></span></li>
</ul>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No seran subvencionables les despeses derivades d'inversions en equipament permanent, ni aquells no vinculats directament a l'esdeveniment</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.</strong> <strong>Règim jurídic</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La present convocatòria se sotmet a la Llei 38/2003, de 17 de novembre, general de subvencions, al Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, a l'Ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep de sa Talaia (BOIB núm. 95, de 17 de juliol de 2021) i al Pla estratègic de subvencions de l'Ajuntament de Sant Josep per als exercicis 2024-2026 (BOIB núm. 36, de 14 de març de 2024).</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta convocatòria s'exposarà al tauler d'anuncis de la seu electrònica de l'Ajuntament i serà publicada en el BOIB i la BDNS.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4. Consignació pressupostària i quantia</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La quantia màxima de les subvencions que es podrà concedir en aquesta convocatòria és de 150.000,00 €, amb càrrec a la partida 341 48056.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La subvenció màxima per beneficiari/esdeveniment no podrà superar els 25.000 €.</span></span></span></p>

<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. Entitats sol·licitants</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Poden ser sol·licitants i/o beneficiaris de les subvencions les persones físiques o jurídiques, els clubs, associacions esportives, federacions esportives i altres entitats que organitzin esdeveniments esportius en el municipi ajustats a la finalitat d'aquestes bases, i que compleixin els requisits següents:</span></span></span></p>
<ul>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estar legalment constituïdes.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estar al corrent de les seves obligacions amb l'Agència Tributària, la Seguretat Social i l'Ajuntament de Sant Josep de sa Talaia.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tenir el seu àmbit d'actuació al municipi de Sant Josep de sa Talaia, i que el seu objecte estigui relacionat amb l'objecte de la convocatòria.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No incórrer en cap de les prohibicions per a ser beneficiari establertes en l'art. 13 de la Llei 38/2003, de 17 de novembre, General de Subvencions.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Trobar-se al corrent en matèria de reintegrament de subvencions amb l'Ajuntament de Sant Josep de sa Talaia (art. 25 RLGS).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En compliment de l'article 11 de la Llei 11/2016, de 28 de juliol, d'Igualtat de Dones i Homes, no estar sancionades o condemnades en els últims tres anys per haver exercit o tolerat pràctiques laborals considerades discriminatòries per raó de sexe o de gènere, sancionades per resolució administrativa ferma o condemnades per sentència judicial ferma.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En compliment de l'article 112 de la Llei 2/2023, de 7 de febrer, de l'activitat física i l'esport de les Illes Balears, no tenir cap patrocini relacionat amb cases d'apostes o entitats vinculades a la venda especialitzada de begudes alcohòliques de graduació superior a vint graus, tabac o similars.</span></span></span></li>
</ul>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Queden expressament exclosos d'aquestes bases i de la convocatòria els Ajuntaments i altres ens públics, així com les entitats que incompleixin algun dels requisits exposats anteriorment.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A la convocatòria es poden presentar un màxim de tres projectes per sol·licitant, però mai més d'una entitat per esdeveniment. A aquest efecte, es tindran en compte les següents regles:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. En cas que un mateix sol·licitant present més de tres projectes, només es valoraran els tres primers, segons l'ordre de presentació per registre d'entrada.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. En cas que dues o més sol·licitants diferents sol·licitin la subvenció per a un mateix esdeveniment, només es valorarà la primera de les propostes presentades, segons el seu registre d'entrada, mentre que l'altra proposta restarà exclosa.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. En cas que un mateix sol·licitant present més d'una sol·licitud per al mateix esdeveniment, només es valorarà la primera sol·licitud d'acord amb l'ordre de presentació per registre d'entrada, i quedaran excloses la resta de sol·licituds.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d. En el cas d'entitats que gestionin diversos esdeveniments, han de presentar una sol·licitud per a cada esdeveniment concret per al qual sol·licitin la subvenció, excepte si aquests esdeveniments conformen un programa únic de diverses actuacions.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6. Règim de les ajudes i compatibilitat</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La convocatòria de subvencions es duu a terme sobre la base dels principis de publicitat, transparència, concurrència, igualtat de gènere, objectivitat i eficiència en el compliment de l'objecte de l'acció subvencionada per l'Ajuntament de Sant Josep de sa Talaia.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El règim per a seleccionar les entitats beneficiàries i per a concedir les ajudes serà el de concurrència competitiva.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'entén per concurrència competitiva el procediment mitjançant el qual la concessió de les subvencions es realitza per comparació de les sol·licituds presentades, amb la finalitat d'establir una prelació entre si d'acord amb els criteris de valoració fixats i adjudicar, amb el límit fixat a les bases, el crèdit disponible segons la valoració obtinguda.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La convocatòria parteix de la premissa que els promotors de l'esdeveniment els qui assumeixen la totalitat del pressupost. Per això, sol·liciten una subvenció pública econòmica per a donar suport a la celebración de l'esdeveniment, ja que consideren que té repercussió turística i que l'aportació pública millora la rendibilitat, en concepte d'imatge i notorietat per al municipi de Sant Josep de sa Talaia. per l'illa d'Eivissa i la seva marca turística.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquestes ajudes són compatibles amb altres ajudes, ingressos o recursos procedents de qualsevol altra administració, ens públic o privat, nacional o de la Unió Europea o d'organismes internacionals. A aquest efecte, el/la beneficiari/ària haurà de comunicar a l'Ajuntament de Sant Josep de sa Talaia la sol·licitud o l'obtenció altres subvencions per al mateix esdeveniment.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cap cas la suma total de les ajudes percebudes podrà ser superior al 50% del cost total de l'activitat subvencionada.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el cas que les entitats que resultin beneficiàries d'aquestes ajudes hagin rebut altres administracions o altres entitats, hauran de tenir en compte si aquelles altres ajudes són compatibles o no amb les d'aquest Ajuntament, en cas que no siguin compatibles, haurien d'optar per l'ajuda que considerin més adequada, i si escau, renunciar a alguna d'aquestes.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7. Presentació de sol·licituds</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds de subvenció es formalitzaran mitjançant el model normalitzat que es pot trobar en la pàgina web de l'Ajuntament. Les instàncies es registraran en la seu electrònica de l'Ajuntament de Sant Josep de sa Talaia o en la forma establerta en l'art. 16 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds aniran acompanyades de la següent documentació:</span></span></span></p>
<ul>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Full de sol·licitud mitjançant model normalitzat (annex 1).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Document nacional d'identitat del/de la representant legal.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Targeta d'identificació fiscal (CIF) de l'entitat.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Document acreditatiu de la inscripció de l'entitat o l'associació en el registre corresponent.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Original o còpia compulsada dels estatuts inscrits en el Registre d'Associacions de les Illes Balears.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declaració del representant legal de l'associació que l'entitat que representa disposa de l'estructura i mitjans necessaris per a dur a terme el projecte o activitats per a les quals sol·licita subvenció; que no està inhabilitada per a contractar amb les administracions públiques o per a obtenir la subvenció; d'estar facultat el sol·licitant per a actuar en nom de l'entitat i de no concórrer en aquesta entitat cap de les causes previstes en els apartats 2 i 3 de l'article 13 de la Llei 38/2003 general de subvencions; que es troba al corrent de les obligacions tributàries, amb la Seguretat Social i amb el mateix Ajuntament de Sant Josep i en matèria de reintegrament de subvencions amb l'Ajuntament de Sant Josep de sa Talaia (annex 2).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declaració de les subvencions sol·licitades/obtingudes per a la mateixa finalitat i compromís de comunicar a l'entitat local les que s'obtinguin en el futur (annex 3).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Autorització per a obtenir informació sobre el compliment de les obligacions tributàries i amb la Seguretat Social (annex 4). No obstant això, la persona sol·licitant podrà denegar expressament el consentiment. En aquest cas, l'entitat haurà d'aportar els certificats acreditatius d'estar al corrent de les obligacions tributàries i amb la Seguretat Social durant l'exposició de la proposta de resolució provisional.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sol·licitud de transferència bancària per al pagament de l'import de la subvenció, en cas que no s'hagi aportat amb anterioritat.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Formulari amb criteris de valoració (annex 5).</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Memòria tècnica descriptiva de les activitats/projectes realitzats o que es tingui previst dur a terme durant l'any 2026. La memòria ha de contenir, almenys, els següents ítems:</span></span></span></li>

<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Mesures de sostenibilitat (si escau)</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El termini de presentació de sol·licituds serà de 15 dies hàbils, comptant a partir de l'endemà de la publicació de l'extracte de la convocatòria en el BOIB.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament pot sol·licitar, a més, tota la documentació complementària que consideri necessària per a avaluar correctament la sol·licitud.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Nota</strong>. Si els documents exigits en la sol·licitud ja s'haguessin presentat a l'Ajuntament en una altra ocasió, el sol·licitant podrà acollir-se al que s'estableix en l'article 53.d) de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques, sempre que es faci constar la data i l'òrgan o dependència on van ser presentats o emesos.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8. Esmena de defectes en la sol·licitud</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la sol·licitud no compleix els requisits establerts en la convocatòria, l'òrgan instructor ha de requerir a la persona/entitat interessada que l'esmeni en el termini màxim i improrrogable de 10 dies hàbils, i li ha d'indicar que, si no ho fa, es considerarà que ha desistit de la sol·licitud, de conformitat amb l'article 23.5 de la LGS.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9.</strong> <strong>Procediment per a determinar l'import de la subvenció</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La quantia individual de la subvenció es determinarà en funció de la puntuació obtinguda per cada projecte conforme als criteris de valoració establerts en aquestes bases, d'acord amb un sistema de trams de puntuació associats a imports màxims d'ajuda.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A aquest efecte, una vegada valorat cada projecte per l'òrgan col·legiat, s'enquadrarà en el tram que li correspongui segons la puntuació total obtinguda, aplicant-se l'import màxim de subvenció previst per a aquest tram, amb subjecció en tot cas a les disponibilitats pressupostàries de la convocatòria i al límit màxim de 25.000 € per esdeveniment.</span></span></span></p>

<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Ajust en cas d'insuficiència de crèdit</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el cas que, una vegada aplicats els imports màxims corresponents a cada tram de puntuació, el crèdit disponible en la convocatòria resulti insuficient per a atendre la totalitat de les subvencions proposades, es procedirà a la reducció proporcional de les quanties inicialment assignades.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A aquest efecte, s'aplicarà un criteri de prorrateig entre les entitats beneficiàries, respectant en tot cas l'ordre de prelació establert segons la puntuació obtinguda.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest prorrateig consistirà en l'aplicació d'un coeficient de reducció comuna sobre les quanties inicialment propostes, de manera que la suma total de les subvencions concedides no superi el crèdit disponible. En qualsevol cas, es respectaran els límits establerts en aquestes bases relatius al percentatge màxim de finançament sobre el cost total de l'esdeveniment, així com els imports màxims per tram de puntuació.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Procediment de concessió</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procediment de concessió de les subvencions es tramitarà en règim de concurrència competitiva, mitjançant la comparació de totes les sol·licituds presentades dins del termini establert en la convocatòria, a fi d'establir una prelació entre les mateixes d'acord amb els criteris de valoració fixats. Finalitzat el termini de presentació de sol·licituds, aquestes seran avaluades de manera conjunta per l'òrgan col·legiat, formulant-se una proposta de resolució que inclourà la relació d'entitats beneficiàries i les quanties assignades, en funció de la puntuació obtinguda i de la disponibilitat pressupostària. La resolució de concessió serà única i comprendrà totes les sol·licituds estimades i desestimades.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10. Criteris d'atorgament de les subvencions</strong></span></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. Examinar les sol·licituds i la documentació presentada i comprovar les dades en virtut de les quals s'haurà d'adoptar la resolució.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. Analitzar i valorar les sol·licituds d'acord amb el barem establert en la base 6 d'aquesta convocatòria.</span></span></span></p>

Requerir als sol·licitants la correcció o millora de les seves sol·licituds.</span></span></span></p>

<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>12. Instrucció i resolució </strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'òrgan instructor del procediment serà el/la tècnic/a d'esports, que durà a terme les actuacions a les quals es refereixen l'art. 24 de la Llei 38/2003, de 17 de novembre, general de subvencions i el Pla Estratègic de Subvencions de l'Ajuntament de Sant Josep de sa Talaia per als anys 2024-2026.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'òrgan instructor, a la vista de l'expedient i l'informe de l'òrgan col·legiat, formularà la proposta de resolució provisional degudament motivada, que haurà de notificar als interessats, concedint-los un termini de 10 dies naturals per a formular al·legacions.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la proposta de resolució provisional, l'Ajuntament de Sant Josep constatarà d'ofici que els beneficiaris estan al corrent de les seves obligacions tributàries, davant la Seguretat Social i amb el mateix Ajuntament de Sant Josep. En cas de no poder-ho acreditar, això serà motiu d'exclusió de la subvenció, i s'emetrà una nova proposta motivada amb possible prorrateig del restant.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Finalitzat aquest termini i examinades les al·legacions que, si fos el cas, haguessin presentat els interessats, l'òrgan instructor, amb l'informe previ de l'òrgan col·legiat, formularà la proposta de resolució definitiva que dirigirà a l'òrgan competent per a resoldre, el qual dictarà la resolució definitiva amb la relació de sol·licitants, la quantia, l'avaluació detallada i els criteris que s'han tingut en compte.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si alguna associació no autoritza l'Ajuntament a poder comprovar d'ofici que estan al corrent de les obligacions tributàries i amb la Seguretat Social, hauran d'aportar en el termini concedit en la proposta de resolució provisional la documentació requerida.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La proposta de resolució provisional i definitiva no crea cap dret a favor del beneficiari davant l'Administració, mentre no se li hagi notificat la resolució de la concessió.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La resolució de concessió, d'acord amb l'article 14 a) de l'ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep de sa Talaia, haurà de contenir la relació d'entitats beneficiàries a les quals s'atorga subvenció amb les quanties individualitzades, especificant els criteris de valoració seguits, així com la desestimació i la no concessió, per desistiment, renúncia al dret o impossibilitat material sobrevinguda de les sol·licituds no ateses.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'òrgan competent per a resoldre aquesta convocatòria de subvencions és l'alcalde de l'Ajuntament de Sant Josep de sa Talaia, sense perjudici que pugui ser assistit per la Junta de Govern Local, segons les atribucions que li confereix l'article 23.2.a) de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local i en relació amb l'article 10.4 de la Llei 38/2003 general de subvencions.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">D'acord amb l'article 25.4 de la Llei 38/2003, de 17 de novembre, general de subvencions, el termini màxim per a resoldre i notificar el procediment no excedirà els sis mesos, comptats a partir de la publicació de l'extracte de la convocatòria en el BOIB. D'acord amb l'article 25.5 de la LGS, el venciment del termini màxim sense haver-se notificat la resolució legitima a les persones interessades per a entendre desestimada la sol·licitud de concessió de la subvenció per silenci administratiu.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La resolució serà pública de conformitat amb el qual preveu l'article 18.2 de la Llei 38/2003 general de subvencions i l'article 17 de l'ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'estableix com a únic mitjà de notificació de tots els actes de tràmit del present procediment, el tauler d'anuncis de la pàgina web de l'Ajuntament (www.santjosep.org).</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>13. Obligacions de les entitats beneficiàries</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les entitats beneficiàries de les subvencions estaran obligades a:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Sotmetre's a les actuacions de comprovació, seguiment i inspecció que pugui efectuar l'Ajuntament de Sant Josep de sa Talaia i aportar tota la informació i documentació que li sigui requerida en l'exercici d'aquestes actuacions.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Comunicar a l'Ajuntament de Sant Josep de sa Talaia la sol·licitud o l'obtenció altres subvencions per a la mateixa finalitat procedent de qualsevol administració o entitat pública o privada, nacional o internacional.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Conservar els documents justificatius de l'aplicació dels fons percebuts, amb inclusió dels documents electrònics, mentre puguin ser objecte d'actuacions de comprovació i control.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Reintegrar els fons percebuts en els supòsits previstos legalment. </span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Qualsevol alteració de les condicions tingudes en compte per a concedir l'ajuda i, en qualsevol cas, l'obtenció de subvencions incompatibles, pot donar lloc a la modificació de la resolució de concessió.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Així mateix, també queden sotmeses a totes aquelles altres obligacions que es derivin de la Llei 38/2003, de 17 de novembre, general de subvencions, i el seu Reglament, aprovat pel Reial decret 887/2006, de 21 de juliol (BOE núm. 176, de 25 de juliol de 2006), en tot allò que sigui aplicable.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>14.</strong> <strong>Pagament i justificació de les despeses</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'execució dels esdeveniments subvencionats es realitzarà conforme al calendari previst per cada entitat beneficiària. La justificació de la subvenció i el pagament de la mateixa s'efectuaran de manera individualitzada per a cada beneficiari, una vegada finalitzat l'esdeveniment corresponent i presentada la documentació justificativa en els termes establerts en aquestes bases.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En conseqüència, encara que la resolució de concessió sigui única, el reconeixement de l'obligació i el pagament de les subvencions es realitzarà de manera progressiva, en funció de la correcta justificació de cada actuació subvencionada.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Pagament anticipat</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb el que es preveu en la normativa vigent en matèria de subvencions, una vegada dictada la resolució de concessió i formalitzada l'acceptació expressa per part de l'entitat beneficiària, podrà efectuar-se un pagament de fins al 30% de la subvenció concedida, amb un límit màxim de 5.000 €, amb la finalitat de facilitar l'adequada execució de l'esdeveniment subvencionat.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest pagament anticipat tindrà la consideració de pagament a compte de la subvenció concedida i quedarà subjecte a les següents condicions:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. El pagament anticipat no requerirà la constitució de garantia, d'acord amb el règim aplicable a entitats sense ànim de lucre i administracions públiques.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. L'import anticipat quedarà condicionat a la justificació posterior de la totalitat de l'activitat subvencionada, en els termes establerts en aquestes bases.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. En el cas que l'import finalment justificat resulti inferior a l'import anticipat, l'entitat beneficiària haurà de reintegrar la diferència que correspongui, conforme al procediment de reintegrament previst en la normativa de subvencions.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d. L'import restant fins a la quantia total concedida s'abonarà una vegada presentada i validada la justificació completa de l'esdeveniment, d'acord amb els requisits i terminis establerts en aquestes bases.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La presentació de la justificació, en la forma i amb els requisits establerts a la present convocatòria, i la comprovació de conformitat en els termes que estableix l'article 84 del RLGS, serà condició indispensable perquè es pugui reconèixer l'obligació a favor de l'entitat beneficiària fer el segon pagament. La justificació de la subvenció per la persona o entitat beneficiària es realitzarà en el termini màxim de dos mesos des de la finalització de l'esdeveniment o projecte per al qual se sol·licita la subvenció, mitjançant l'aportació d'un compte justificatiu, degudament emplenada i acompanyada de la documentació acreditativa de la despesa realitzada. El compte ha de contenir una memòria d'actuació i una memòria econòmica amb el detall previst en l'article 72 del RLGS. No obstant això, quan concorrin circumstàncies degudament justificades que impedeixin el compliment d'aquest termini, l'entitat beneficiària podrà sol·licitar una ampliació d'aquest, amb anterioritat al seu venciment. L'entitat beneficiària haurà de justificar el cost total del projecte subvencionat, mitjançant l'aportació d'un compte justificatiu despesa realitzada.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Criteri de proporcionalitat</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el cas que l'import finalment justificat sigui inferior al pressupost inicialment presentat, la subvenció s'ajustarà de manera proporcional a la despesa efectivament justificada i admès, sempre que s'hagi complert la finalitat per a la qual va ser concedida.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cap cas l'import de la subvenció podrà superar el percentatge màxim de finançament establert en aquestes bases respecte al cost finalment justificat.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cas d'incompliment parcial, s'aplicaran criteris de proporcionalitat per a determinar la quantitat a abonar o, si és el cas, a reintegrar.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El compte justificatiu ha de contenir:</span></span></span></p>

<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una memòria descriptiva de l'esdeveniment o projecte per al qual se sol·licita subvenció i que s'haurà d'haver realitzat durant el període comprès entre l'1 de gener i el 31 de desembre de 2026. Ha de ser un informe detallat de les activitats realitzades que permeti relacionar documentació econòmica justificativa amb les activitats realitzades.</span></span></span></li>
<li><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una memòria econòmica justificativa del projecte presentat, que ha de contenir:</span></span></span></li>
</ul>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Relació dels justificants de despeses imputades i dels ingressos vinculats a l'activitat o projecte</strong>: relació de factures o altres documents justificatius de les despeses realitzades, amb identificació del creditor, el document, l'import, la data d'emissió i la data de pagament (annex 6).</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Documentació justificativa de les despeses realitzades i acreditació del pagament</strong>: les factures originals o els documents de valor probatori equivalent en el tràfic mercantil o amb eficàcia administrativa incorporats a la relació a què fa referència el paràgraf anterior i la documentació acreditativa del pagament. Aquestes factures s'han de presentar ordenades i numerades seguint la numeració atorgada a la relació de justificants imputats al compte justificatiu.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La documentació acreditativa del pagament segons la forma de pagament que hagi utilitzat l'entitat beneficiària ha de ser la següent:</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. Pagament mitjançant transferència bancària o ingressos en un compte bancari:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Còpia del justificant de l'ordre de transferència bancària o del document bancari acreditatiu del pagament en el qual figurin el concepte de la transferència o l'ingrés, la data del document, l'import, a fi que quedi identificat el pagament de la factura, i les dades de l'ordenant i del destinatari, que han de coincidir amb la persona beneficiària i amb l'emissor de la factura, respectivament.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Extracte del compte bancari de la persona beneficiària de l'ajuda en el qual figuri el càrrec d'aquesta transferència.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. Pagament mitjançant xec nominatiu</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Còpia del xec nominatiu emès a nom del proveïdor que expedeix la factura document equivalent, sempre que estigui vençut.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Extracte del compte corrent de la persona beneficiària de l'ajuda en el qual figuri el càrrec d'aquest xec.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. Pagament mitjançant pagarés, lletres de canvi o similars:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Document acreditatiu del càrrec en compte de l'efecte mercantil.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Extracte del compte en què figuri el càrrec de l'efecte mercantil. Aquesta documentació es pot substituir per un certificat o document similar emès per l'entitat bancària que contesa el titular i el número de compte en què s'ha carregat l'efecte mercantil, el lliurador i el deslliurat de la lletra de canvi, la persona beneficiària, el concepte pel qual es fa l'efecte mercantil, l'import de la lletra de canvi i la data d'emissió de la lletra i de l'abonament pel lliurat.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d. Pagament mitjançant targeta de crèdit:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Tiquet de compra en què figuri el pagament amb targeta.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Tiquet de compra i resguard del pagament amb targeta en cas que no figuri en el tiquet de compra.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Extracte del compte en què figuri el càrrec de pagament amb targeta. L'extracte del compte pot substituir-se per un certificat o títol similar de l'entitat bancària en què, com a mínim, consti el titular i el número de compte corrent en què es carrega el pagament de la targeta, la persona beneficiària, el concepte pel qual es fa la transferència, i l'import i la data de l'operació.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e. Pagament mitjançant domiciliació bancària:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Notificació bancària del càrrec.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Extracte bancari en què figuri el càrrec de la domiciliació. </span></span></span></p>

<p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"></span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta documentació es pot substituir per un certificat o títol similar de l'entitat bancària en què consti el titular i el número del compte corrent en què s'ha fet el càrrec i l'ordenant del càrrec, la persona beneficiària, el concepte pel qual es fa el càrrec i l'import i la data de l'operació.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f. Pagament en efectiu: rebut, signat i segellat pel proveïdor, en el qual s'ha d'especificar la despesa al fet que correspon el pagament, la data i l'expressió «rebut en metàl·lic».</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Una liquidació final d'ingressos i despeses</strong> de les actuacions subvencionades signada i segellada pel representant de l'entitat (annex 7).</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Documentació acreditativa d'haver donat adequada publicitat</strong> de la subvenció rebuda de l'Ajuntament. Per al pagament de la subvenció, l'Ajuntament podrà sol·licitar qualsevol altra documentació o informe que consideri adequats.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>15. Reformulació de sol·licituds</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quan la subvenció tingui per objecte el finançament d'activitats que s'hagin de desenvolupar per l'entitat sol·licitant i l'import de la subvenció de la proposta de resolució provisional sigui inferior al que figura a la sol·licitud presentada, es podrà instar l'entitat beneficiària per a la reformulació de la sol·licitud per a ajustar els compromisos i condicions a la subvenció atorgable.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>16. Publicitat dels projectes subvencionats </strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicació de les subvencions concedides s'ha de fer durant el mes següent de cada trimestre natural. Aquesta publicitat es durà a terme segons indica l'article 17 de l'Ordenança General de les Bases Reguladores de les Subvencions que concedeix l'Ajuntament de Sant Josep.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>17. Difusió de la subvenció concedida per l'entitat beneficiària</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les entitats beneficiàries hauran de donar adequada publicitat al caràcter públic del finançament del programa, activitat, inversió o actuació objecte de subvenció. S'haurà de fer constar la col·laboració de l'Ajuntament de Sant Josep de sa Talaia, acompanyat de l'escut de la institució, en materials impresos, mitjans electrònics o audiovisuals, plaques commemoratives, cartells, o bé en esments realitzats en mitjans de comunicació o altres que resultin adequats a l'objecte subvencionat i d'eficàcia equivalent als esmentats.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les ajudes concedides quedaran condicionades a la justificació d'haver donat l'adequada publicitat. Sense aquest requisit no es procedirà al reconeixement de l'obligació i pagament de la subvenció concedida.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>18.</strong> <strong>Reintegrament de les subvencions concedides</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'estarà al que disposa l'article 27 de l'Ordenança General de les Bases Reguladores de Subvencions que concedeix l'Ajuntament de Sant Josep de sa Talaia.</span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>19. Règim de recursos</strong></span></span></span></p>
<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la resolució que recaigui en aquest procediment, la qual posarà fi a la via administrativa, es podran interposar, alternativament, els recursos següents:</span></span></span></p>
<p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- El recurs potestatiu de reposició davant l'òrgan que dictarà la resolució, en el termini d'un mes, comptador a partir de l'endemà de la notificació d'aquesta resolució. Contra la desestimació expressa del recurs de reposició, es podrà interposar el recurs contenciós administratiu, en el termini de dos mesos, comptadors a partir de l'endemà de la notificació de la desestimació del recurs de reposició. Contra la desestimació per silenci del recurs de reposició, es podrà interposar el recurs contenciós administratiu, en el termini de sis mesos, comptadors a partir de l'endemà de la desestimació presumpta. </span></span></span></p>
<p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- O, directament, el recurs contenciós administratiu davant la Jurisdicció Contenciosa Administrativa, en el termini de dos mesos, comptadors a partir de l'endemà de la notificació de l'acord.</span></span></span></p>
