    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Govern del Consell Insular de Formentera, en sessió de caràcter ordinari de 10 d'abril de 2026, &lt;span style="background-color:white"&gt;celebrada en forma presencial&lt;/span&gt;&lt;span style="background-color:white"&gt;,&lt;/span&gt; va adoptar, entre d'altres, el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primer.- APROVAR &lt;/strong&gt;l'atorgament de subvenció nominativa directa per l'import de 45.000,00 € al Club Tennis Illa de Formentera, amb NIF G57285876, per a la contractació del servei de personal tècnic per portar a terme les activitats de l'Escola Municipal de Tennis de Formentera per a l'any 2026, el qual s'adjunta com annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segon.- LA GESTIÓ&lt;/strong&gt; de la subvenció es durà a terme d'acord amb la signatura del conveni annex a la proposta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer.- AUTORITZAR I DISPOSAR LA DESPESA &lt;/strong&gt;amb càrrec a la partida pressupostària 2026.1.341.4800001 dels pressupostos per a l'any 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quart.- RECONÈIXER &lt;/strong&gt;l'obligació del 80% de l' import concedit, ordenar el pagament i pagar l'import del 80% de 45.000,00 € de la subvenció (36.000 €) i registrar l'operació com a pendent de justificar fins que el beneficiari no procedeixi a la justificació de la mateixa d'acord amb les normes de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cinquè.- FACULTAR &lt;/strong&gt;al Sr. President del Consell Insular de Formentera perquè, una vegada estigui aprovada aquesta subvenció de concessió nominativa directa, pugui signar el conveni annex, segons l'estipulat a l'article 21 de la Llei 4/2022, de 28 de juny, de consell insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Sisè.- GUARDAR&lt;/strong&gt; còpia d'aquest conveni en el Registre de Convenis que es troba ubicat a la secretaria de la corporació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Setè.- NOTIFICAR&lt;/strong&gt; aquest acord al Club Tennis Illa de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Vuitè.- PUBLICAR&lt;/strong&gt; el conveni en el BOIB, al tauler d'anuncis i a la pàgina web del Consell Insular de Formentera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'una part, el Sr. Óscar Portas Juan, major d'edat, veí de Formentera, domiciliat a la plaça de la Constitució núm. 1, Formentera, amb DNI (...).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Sr. Jorge Jiménez Martínez-Pantoja, major d'edat, amb DNI (...), i domicili a efectes de notificacions a (...), Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;INTERVENEN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Sr. Óscar Portas Juan, com a president del Consell Insular de Formentera, que actua en nom i representació d'aquesta corporació, amb NIF P0702400C i amb domicili a la plaça de la Constitució núm. 1, Sant Francesc (Formentera), en virtut del Decret de Presidència de 27 de desembre de 2024, d'atribucions competencials als membres de l'equip de Govern, publicat al BOIB núm. 19, de 11 de febrer de 2025, d'acord amb l'article 136 del Reglament Orgànic del Consell Insular de Formentera (ROC) i en virtut de l'article 21.1.b de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, de la Llei Orgànica 5/1985, de 19 de juny, de règim electoral general i de l'article 21 de la Llei 4/2022, de 28 de juny, de consells insulars en relació al Títol IX d'aquesta Llei sobre Règim especial de Formentera, assistit pel secretari de la corporació, el Sr. Ángel Custodio Navarro Sánchez, de conformitat amb l'article 161 del ROC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Sr. Jorge Jiménez Martínez-Pantoja, president del Club Tennis Illa de Formentera, qui actua en representació del citat club, el qual disposa de NIF G57285876, segons l'Acta de l'Assemblea General ordinària del Club Tennis Illa de Formentera, de data 17 de novembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Ambdues parts actuen en representació de les seves respectives entitats, es reconeixen mútuament plena capacitat jurídica per obrar i,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;MANIFESTEN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;PRIMER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;Que les pistes de tennis i pàdel, situades al Camí de Porto Saler, Formentera, són de titularitat del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;SEGON.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;Que les esmentades instal·lacions esportives són béns de domini públic segons l'establert en l'article 125 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears i a l'article 6 de la Llei 6/2001, d'11 d'abril, de patrimoni de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;TERCER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;Que als efectes de donar ús a les instal·lacions muntades per el Consell Insular de Formentera per aquest any 2026, per tal d'exercir els interessos del Consell Insular de Formentera, aquest es troba habilitat per promoure tota classe d'activitats esportives i donar serveis públics que contribueixin a satisfer les necessitats i aspiracions del municipi de Formentera, donada la competència establerta per l'article 70.9 de la Llei Orgànica 1/2007, de 28 de febrer, que modifica l'Estatut d'Autonomia de les Illes Balears. A més, de forma específica, la Llei 2/2023, de 7 de febrer, de l'activitat física i l'esport a les Illes Balears, estableix al seu article 9, entre d'altres, la competència del Consell Insular de Formentera per col·laborar, en el seu àmbit territorial, amb les entitats en el desenvolupament de l'esport.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En virtut de l'exposat anteriorment, ambdues parts acorden formalitzar aquest conveni, d'acord amb les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÀUSULES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;1. Objecte del conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;L'objecte d'aquest conveni és la subvenció directa per a la contractació del serveis del personal tècnic per portar a terme les activitats de l'Escola Municipal de Tennis del Consell Insular de Formentera al Club Tennis Illa de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;2. Obligacions de les parts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La contractació del personal tècnic per portar les activitats esportives de l'escola de tennis queda subjecte a les següents condicions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per part del Club de Tennis Illa de Formentera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Club Tennis Illa de Formentera aportarà els monitors per al desenvolupament de l'Escola Municipal de Tennis, coberta plenament pels entrenadors que el club designi. Aquests estaran correctament contractats i dependran laboralment del club sense que hi hagi cap vincle laboral amb el Consell Insular de Formentera, de manera que la retribució i l'assignació de les seves tasques correspondran al Club de Tennis Illa de Formentera, que serà el responsable d'aplicar el conveni col·lectiu que correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Els entrenadors del Club Tennis Illa de Formentera que siguin designats, han de portar a terme les activitats segons la programació establerta per la direcció de la pròpia Escola Municipal de Tennis conjuntament amb l'Àrea d'Esports del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Club Tennis Illa de Formentera es compromet a tenir regularitzades les relacions laborals en tot moment de tots els seus monitors/entrenadors des de l'inici de l'activitat. A més, ha de garantir igualment que estan en possessió d'una assegurança de responsabilitat civil. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Facilitar la uniformitat dels monitors/entrenadors, adequadament serigrafiada, segons allò acordat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Presentar una relació de monitors que seran contractats al llarg de la temporada. Es permetrà qualsevol nova alta o baixa al llarg de la temporada. Aquestes noves situacions, hauran de ser comunicades a l'Àrea d'Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Tenir a tots els seus treballadors correctament contractats segons marca la normativa laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Comunicar a l'Àrea d'Esports tots els esdeveniments organitzats al llarg de la temporada per facilitar la seva difusió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;LOPD – Intercanvi entre el CIF i el CTIF d'informació dels alumnes de l'Escola Municipal de Tennis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per part del Consell Insular de Formentera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Realitzar les actuacions d'informació, difusió i inscripció de l'alumnat a l'Escola Municipal de Tennis amb caràcter previ a l'inici de cada curs, així com gestionar, si escau, la incorporació d'alumnes que ho poguessin sol·licitar un cop iniciada l'activitat, sempre que això no suposi l'alteració dels grups ja existents. Aquestes actuacions i gestions hauran de ser en coordinació amb el Club de Tennis Illa de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Pagar el Club de Tennis Illa de Formentera els imports corresponents a la contractació dels monitors/entrenadors de l'escola en el marc d'aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

Forma de pagament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Consell Insular de Formentera realitzarà una aportació màxima de &lt;strong&gt;45.000€,&lt;/strong&gt; &lt;strong&gt;IVA inclòs,&lt;/strong&gt; per a la contractació del serveis del personal tècnic per portar les activitats de l'Escola Municipal de Tennis del Consell Insular de Formentera esmentada al manifest primer d'aquest conveni, amb càrrega a la partida pressupostària 2026.1.1341.4800001 del Pressupostos General del Consell Insular de Formentera per l'any 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La forma de pagament per part del Consell Insular de Formentera, serà la següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;S'abonarà al Club Tennis Illa de Formentera un primer pagament del 80% (36.000€) en el moment de la signatura del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;S'abonarà un segon pagament del 20% (9.000€) restant, quan es presenti una memòria justificativa del primer 80%, aportant una memòria responsable amb el contingut que determinen l'Àrea d'Esports i la d'Intervenció. La memòria justificativa del primer 80% s'haurà de presentar abans del 31 d'octubre de 2026. Per motius excepcionals es podrà atorgar una pròrroga, prèvia comunicació i autorització. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El tècnic de l'Àrea d'Esports emetrà un informe favorable on digui que la contractació conveniada es duu a terme amb normalitat, dins els objectius marcats en aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Durant el mes de gener de 2027 el club haurà de justificar el 100% de la seua actuació. Aquest serà requisit indispensable per poder signar un nou conveni amb el Consell. Això no exempta de retornar la quantitat corresponent en el cas de no poder justificar el 100% de les quantitats rebudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El beneficiari està eximit de presentar garanties atenent la naturalesa de les activitats subvencionades i les seves característiques com beneficiari, de conformitat amb l'article 42 i següents del Real Decret 88/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En compliment del què disposa l'article 11 del decret legislatiu 2/2005, de 25 de desembre, text refós de la llei de subvencions de les Illes Balears, el Club de Tennis Illa de Formentera queda sotmès, entre d'altres, a les obligacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Dur a terme les activitats o la inversió o adoptar el comportament que fomenta la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Presentar durant el mes de gener de 2027 els documents acreditatius de la justificació de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Sotmetre's a les actuacions de comprovació que duguin a terme els òrgans competents en qualsevol moment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Notificar al CIF qualsevol modificació que es pretengui realitzar en la contractació dels treballadors, inicialment presentat, en relació a les actuacions subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Deixar constància de la percepció i l'aplicació de la subvenció en els llibres de comptabilitat o en els llibres de registre que hagi de dur el beneficiari d'acord amb la legislació mercantil o fiscal que sigui aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Conservar els documents justificatius de l'aplicació dels fons percebuts mentre puguin ser objecte d'actuacions de comprovació i control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Reintegrar els fons percebuts en els supòsits prevists en l'article 44 d'aquesta Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;4. Justificació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Club Tennis Illa de Formentera presentarà al Registre General d'Entrada del CIF, ubicat a l'OAC, o de forma telemàtica mitjançant la OVAC, la següent documentació durant el mes de gener de 2027, dirigida a l'Àrea d'Esports d'aquest Consell:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Organigrama del club (tant de la directiva com de l'àrea tècnica).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Memòria d'Activitat Anual amb: grups, horaris, monitors/es, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Memòria de RH: personal contractat, tipus de contracte, funcions, horari que duu a terme, salari, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Memòria Justificativa Simplificada Anual del 100% de la despesa realitzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Programa de Desenvolupament (formació per als monitors/res, cursos, xerrades per a usuaris, pares, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Programa d'Esdeveniments (esdeveniments duts a terme al llarg de l'any, breu descripció).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Mitjans de Promoció: cartells, pòsters, tríptics, uniformitat del personal, etc., amb la imatge del Consell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Acreditació d'estar al corrent de pagament de totes les obligacions tributàries i davant de la Seguretat Social, o autorització en favor del CIF, perquè pugui sol·licitar els certificats necessaris davant el Ministeri d'Economia i Hisenda i el Departament d'Economia i Hisenda de la Comunitat Balear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Pressupost d'ingressos i despeses realitzades, en el que s'haurà d'incloure el compte justificatiu de despeses, de conformitat amb el que estableix l'article 72 del Reial Decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El tècnic de l'Àrea d'Esports del Consell de Formentera haurà d'emetre un informe el qual corrobori que efectivament s'ha realitzat aquesta despesa i que tot és correcte per tancar l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas que la documentació no es presenti dintre del termini establert, el Consell Insular de Formentera farà un requeriment al Club de Patinatge Artístic perquè en el &lt;strong&gt;termini de 15 dies&lt;/strong&gt; presenti la documentació corresponent a la justificació del conveni. En cas que no s'atengui aquest requeriment, el Consell portarà a terme els tràmits necessaris per al reintegrament de la subvenció atorgada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;5. Reintegrament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;S'estableix l'obligació per part del Club Tennis Illa de Formentera de reintegrar els fons en el supòsit d'incompliment dels requisits i obligacions establertes per a la concessió, i en tot cas, en els supòsits regulats en l'article 44 del decret legislatiu 2/2005, de 28 de desembre, text refós de la Llei de subvencions de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;A més, el CIF es reserva el dret a disminuir proporcionalment la seva aportació, en el supòsit d'incompliment parcial del conveni, o bé en el cas que les despeses justificades no arribin al total de les despeses pressupostades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;6. Vigència del conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Aquest conveni és vigent des del dia de la seva signatura fins al dia 31 de desembre de 2026, tenint efectes retroactius quant a les activitats objecte d'aquest conveni, des de l'1 de gener de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Aquest conveni es podrà resoldre, amb audiència prèvia de les parts, entre d'altres, per les causes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El mutu acord entre les parts, que s'ha de formalitzar per escrit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;L'incompliment de les normatives d'aplicació i/o dels pactes establerts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;No dur a terme la prestació de les activitats objecte del present conveni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el cas que la resolució del conveni fos per incompliment per part del Club de Tennis Illa de Formentera, aquest haurà de reintegrar la totalitat les quantitats econòmiques percebudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;7. Procediment d'atorgament de la subvenció i naturalesa del present conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El present conveni té &lt;em&gt;naturalesa administrativa&lt;/em&gt; i constitueix l'instrument a través del qual es canalitza una subvenció pel procediment de concessió directa previst a l'article 7.1 c) del decret legislatiu 2/2005, de 28 de desembre, text refós de la Llei de subvencions de les Illes Balears, i en l'article 22.2 c) de la Llei 38/2003, de 17 de novembre, general de subvencions, perquè s'acrediten raons d'interès públic, social, econòmic o humanitari que dificulten la seva convocatòria pública, d'acord amb els informes que consten a l'Àrea d'Esports del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;8. Normativa d'aplicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el no previst en el conveni present caldrà ajustar-se al que disposen les bases d'execució del Pressupost General del Consell Insular de Formentera per al 2026, aprovat per acord del Ple de 20 de gener de 2026 (acord d'aprovació inicial elevat a definitiu, segons allò publicat al BOIB núm. 23, de 19 febrer de 2026; amb rectificació d'errors pel que fa a la plantilla orgànica, segons allò que es deriva del que apareix publicat al BOIB núm. 25, de 24 de febrer de 2026), a l'esmentada Llei de consells insulars, article 96.2 de i disposició addicional 9a sobre Normativa en matèria de subvencions; al Decret legislatiu 2/2005, de 28 de desembre, text refós de la llei de subvencions de les Illes Balears; a la Llei 38/2003, de 17 de novembre, general de subvencions i al Reial decret 887/2006, de 21 de juliol, pel que s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, d'acord amb el que estableix l'article 8 de l'esmentada Llei 38/2003 i els articles 10 i següents del Reglament abans mencionat així com l'establert a l'article 6 i concordants del citat Decret legislatiu 2/2005.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es deixa palès que s'actua en sintonia amb les Bases generals reguladores de les subvencions del Consell Insular de Formentera per al 2026, aprovades per acord del Ple de 20 de gener de 2026, en el marc de les Bases d'execució del Pressupost general de la corporació (acord d'aprovació inicial elevat a definitiu, segons allò que es deriva del que apareix publicat al BOIB núm. 31, de 10 de març de 2026) i&amp;nbsp; amb el Pla estratègic de subvencions per als anys 2026 i 2027, aprovat per acord del Ple de 20 de gener de 2026 (segons allò que es deriva del que apareix publicat al BOIB núm. 31, de 10 de març de 2026), en el sentit que la convocatòria i les bases especifiques presents es consideren una actuació simultània, segons permet la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I en prova de conformitat, ambdues parts signen aquest conveni de col·laboració per duplicat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
