ca ![CDATA[Resolució de la Presidència de l’Institut Mallorquí d’Afers Socials, de 22 d’abril de 2026, d’aprovació de la previsió i fixació de preus dels serveis a concertar per la Direcció Insular de Persones amb Discapacitat durant l’any 2026 ]] 310122 CAIB 620 ![CDATA[<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Antecedents</strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>1</strong>. <span style="background-color: rgb(255, 255, 255)">Arran de l&apos;aprovació de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l&apos;àmbit social a la comunitat autònoma de les Illes Balears,</span> <span style="background-color: rgb(255, 255, 255)">la fórmula de l&apos;acció concertada es configura com un instrument de col·laboració entre el sector públic i el privat especialment adequat als principis que han de regir el sistema de serveis socials.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">En aquest sentit, l&apos;article 2 de l&apos;esmentada Llei, preveu que les administracions competents de les Illes Balears, per complementar el sistema públic i garantir una adequada equitat i qualitat de les prestacions incloses en la cartera de serveis o del servei d&apos;orientació professional, poden encarregar la prestació d&apos;aquests serveis de la seva competència, mitjançant el sistema d&apos;acció concertada, a entitats sense ànim de lucre del tercer sector social -definides als articles 3 i 4 de la Llei 3/2018, de 29 de maig, del tercer sector d&apos;acció social- o, si escau, a entitats privades, preferentment del tercer sector social, quan concorrin condicions anàlogues d&apos;eficàcia, qualitat i costs, d&apos;acord amb els requisits que estableix l&apos;esmentada Llei i amb respecte als principis de publicitat, transparència i no-discriminació.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>2.</strong> L&apos;article 4.1 de la Llei 12/2018 estableix que, amb una periodicitat anual, les administracions de les Illes Balears competents en matèria social i d&apos;ocupació, en exercici de les seves competències de planificació, han d&apos;elaborar una previsió de les prestacions i els serveis que es pretén sotmetre al règim d&apos;acció concertada.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: rgb(255, 255, 255)">3. </span></strong><span style="background-color: rgb(255, 255, 255)">En data 20 d&apos;abril de 2026</span>, la cap del Servei de Persones amb Discapacitat, amb el vist-i-plau de la directora insular de Persones amb Discapacitat, va emetre proposta d&apos;aprovació de la previsió dels serveis a concertar per la Direcció Insular de Persones amb Discapacitat per l&apos;any 2026 <span style="background-color: rgb(255, 255, 255)">(Codi CSV:</span> K9AADZ9D93AEVCEZ2RPZ<span style="background-color: rgb(255, 255, 255)">).</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Fonaments de dret</strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Pel que fa a la competència,</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>1.</strong> La Llei orgànica 1/2007, de 28 de febrer, de reforma de l&apos;Estatut d&apos;Autonomia de les Illes Balears (BOIB núm. 32 ext., d&apos;1 de març de 2007; correcció d&apos;errades BOIB núm. 29, de 28 de febrer de 2008), en concret l&apos;article 70.4 relatiu a la competència pròpia dels consells insulars en matèria de serveis socials i assistència social.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>2.</strong> La Llei 14/2001, de 29 d&apos;octubre, d&apos;atribució de competències als consells insulars en matèria de serveis socials i seguretat social, estableix a l&apos;article 14 la potestat reglamentària normativa atribuïda als consells insulars en matèria de serveis socials, dins el marc de la regulació bàsica establerta pel Govern de les Illes Balears (BOIB núm. 135, de 10 de novembre de 2001 i BOE núm. 284, de 27 de novembre de 2001).</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: rgb(255, 255, 255)">3. </span></strong>La Llei 4/2009, d&apos;11 de juny, de serveis socials de les Illes Balears (BOIB núm. 89 de 18 de juny de 2009 i BOE núm. 163 de 7 de juliol de 2009) preveu a l&apos;article 27 i a la disposició final quarta, que cada Consell Insular, en el marc de les seves competències, ha de definir les prestacions pròpies de serveis socials, complementant la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears, la qual va ser aprovada mitjançant el Decret 32/2023, de 26 de maig, pel qual s&apos;aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027, s&apos;estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l&apos;àmbit social (BOIB núm. 70, de 27 de maig de 2023).</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>4.</strong> Els Estatuts de l&apos;Institut Mallorquí d&apos;Afers Socials (BOIB núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d&apos;abril de 2019, en especial l&apos;establert a l&apos;article 2 d&apos;acord amb el qual l&apos;Institut Mallorquí d&apos;Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Benestar Social del Consell de Mallorca, és l&apos;organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: rgb(255, 255, 255)">5. </span></strong><span style="background-color: rgb(255, 255, 255)">Decret de la Presidència del Consell de Mallorca pel qual es nomenen els membres del Consell Executiu de 10 de juliol de 2023 (</span><em><span style="background-color: rgb(255, 255, 255)">BOIB</span></em><span style="background-color: rgb(255, 255, 255)"> núm. 95, d&apos;11 de juliol de 2023) pel qual es nomena el Sr. Guillermo Sánchez Cifre conseller executiu de Benestar Social.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>6. </strong>L&apos;òrgan competent per aprovar aquesta resolució és la Presidència de l&apos;IMAS, d&apos;acord amb l&apos;article 7.2 dels Estatuts de l&apos;IMAS (BOIB núm. 67, de 18 de maig de 2019). No obstant això, i d&apos;acord amb l&apos;article 8.2.1 les Vicepresidències de l&apos;IMAS supliran a la Presidència i assumiran les seves atribucions en cas de vacant, absència, malaltia, impossibilitat física o una altre causa legal.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Pel que fa al fons,</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>7. </strong>L&apos;article 37.k) de la Llei 4/2009 atribueix als consells insulars la competència per concertar la gestió de serveis socials dins el seu àmbit territorial amb entitats públiques o privades. Així mateix, l&apos;article 89.1 preveu les diferents fórmules d&apos;organització de la prestació dels serveis socials, entre les quals s&apos;inclou el règim d&apos;acció concertada.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>8</strong>. La Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca aprovada definitivament en Ple del Consell de Mallorca de 13 de juliol de 2017 (BOIB núm. 97, de 18 de juliol de 2017 i correcció d&apos;errades materials publicada BOIB núm. 161, de 30 de desembre de 2017) i prorrogada la seva vigència fins a l&apos;entrada en vigor de la nova Cartera Insular de serveis socials de Mallorca, per Acords del Ple en sessions de 8 de juliol de 2021 (BOIB núm. 95, de 17 de juliol de 2021), de 15 de desembre de 2022 (BOIB núm. 168, de 27 de desembre de 2022), Acord del Ple de 14 de desembre de 2023 (BOIB núm. 176, de 30 desembre de 2023) i Acord del Ple de 12 de desembre de 2024 (BOIB núm. 172, de 31 desembre de 2024).</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>9.</strong> El Reglament pel qual es regula el funcionament dels serveis socials per a persones amb discapacitat inclosos a la Cartera Insular de serveis socials i s&apos;estableixen els requisits d&apos;autorització i acreditació, aprovat al Ple del Consell de Mallorca de data 11 de maig de 2023 (BOIB núm. 83, de 20 de juny de 2023).</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>10. </strong>La Llei 12/2018, de 15 de novembre, de serveis a les persones en l&apos;àmbit social a la comunitat autònoma de les Illes Balears (BOIB núm. 146 de 22 de novembre de 2018), regula al Capítol I el «Règim de col·laboració privada en la gestió de serveis socials per a les persones mitjançant l&apos;acció concertada».</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: rgb(255, 255, 255)">11. </span></strong><span style="background-color: rgb(255, 255, 255)">Resolució de la Presidència de l&apos;IMAS núm. 16634 de dia 9 de juliol de 2025, d&apos;actualització i fixació de preus dels serveis per a persones amb discapacitat, inclosos a la cartera insular de serveis socials, que poden ser objecte de concertació social per als anys 2025-2027 (BOIB núm. 89, de 12 de juliol de 2025).</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En virtut de la competència atribuïda legalment,</span></span></span></p> <p style="text-align: center"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>RESOLC</strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: rgb(255, 255, 255)">Primer.</span></strong><span style="background-color: rgb(255, 255, 255)"> APROVAR la previsió dels serveis a concertar per la Direcció Insular de Persones amb Discapacitat durant l&apos;any 2026, detallats en l&apos;annex I d&apos;aquesta resolució i </span>FIXAR el preu/plaça dels serveis que s&apos;han de concertar.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Segon.</strong> <span style="background-color: rgb(255, 255, 255)">APROVAR el&nbsp;Model d&apos;avaluació de seguiment de l&apos;acció concertada, aplicable als serveis objecte de les noves concertacions socials, així com la&nbsp;Guia&nbsp;d&apos;aplicació al model d&apos;atenció als serveis socials per a persones amb discapacitat de Mallorca. font-size: 12px">Pel que fa als preus de plaça, és d&apos;aplicació, per a cada servei i els seus complements, el que estableix la Resolució de la Presidència de l&apos;IMAS núm. 16634, de 9 de juliol de 2025, d&apos;actualització i fixació de preus dels serveis per a persones amb discapacitat, inclosos a la cartera insular de serveis socials, que poden ser objecte de concertació social per als anys 2025-2027 (BOIB núm. 89, de 12 de juliol de 2025).</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Aquesta previsió té caràcter estimatiu i pot experimentar variacions quant als terminis, la denominació dels serveis, el nombre de places i la seva quantificació econòmica, en funció de les necessitats reals que determini la Direcció Insular de Persones amb Discapacitat.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif;
