font-size:12px"><strong><span style="color:black">Fets</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.El 3 de juliol de 2025, es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III 2025)<strong><em> </em></strong>mitjançant la Resolució del conseller d'Empresa, Ocupació i Energia d'1 de juliol de 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2.Les persones o entitats que figuren en l'annex d'aquesta Proposta varen presentar una sol·licitud de subvenció en el marc de la convocatòria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.Els tècnics de la Direcció General d'Economia Circular, Transició Energètica i Canvi Climàtic, en aplicació del procediment de concessió que estableix l'apartat novè de la Resolució esmentada, han informat desfavorablement sobre la concessió de les subvencions descrites en l'annex, amb la motivació que també hi figura.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.En data 17 de marzo de 2026 es va emetre la Proposta de resolució provisional del director general d'Economia Circular, Transició Energètica i Canvi Climàtic&nbsp; per la qual es deneguen les subvencions en el marc de la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (programa MOVES III 2025) (BOIB núm. 36, de 21 de marzo de 2026).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.S'ha exhaurit el termini que es concedia per presentar al·legacions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.La Llei 38/2003, de 17 de novembre, general de subvencions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.La Resolució del conseller d'Empresa, Ocupació i Energia d'1 de juliol de 2025 per la qual s'aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (programa MOVES III 2025) (BOIB núm.85, de 3 de juliol de 2025).</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Proposta de resolució definitiva</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propòs al conseller <span style="color:black">d'Empresa, Autònoms i Energia</span> que dicti una resolució en els termes següents:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Denegar la concessió d'una subvenció per actuacions de suport a la mobilitat elèctrica (Programa MOVESIII 2025) als beneficiaris que figuren en l'annex, d'acord amb la motivació que també hi figura.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposició de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Empresa, Autònoms i Energia en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></p> <p>​​​​​​​<span style="font-family:Times New Roman,Times,serif;
