Mitjançant, la Resolució de la consellera d'Educació, Cultura i Universitats de 22 de desembre de 2014, es va disposar el canvi de domicili i el trasllat dels alumnes i els professors del CEPA Pitiüses (BOIB núm 7, de 13 de gener). Amb aquesta autorització el centre va quedar configurat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Així mateix, mitjançant la Resolució del conseller d'Educació i Universitats de 18 de juliol de 2024, es va autoritzar el canvi de denominació específica del CEPA Ciutadella per la de CEPA Pilar Benejam i es va autoritzar l'actualització del domicili fiscal i social del centre (BOIB núm. 97, de 23 de juliol). Amb aquesta autorització el centre va quedar configurat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. Posteriorment, mitjançant la Resolució del conseller d'Educació i Universitats de 2 d'agost de 2024, de correcció d'errades advertides en la Resolució del conseller d'Educació i Universitats de 18 de juliol per la qual es va autoritzar el canvi de denominació específica del CEPA Ciutadella per la de CEPA Pilar Benejam i es va autoritzar l'actualització del domicili fiscal i social del centre, es va corregir l'errada advertida en l'adreça del CEPA Pilar Benejam, de manera que el seu domicili va quedar fixat al c/ Mallorca, núm. 67, porta A, 1ª planta, 07760 Ciutadella (BOIB núm. 103, de 6 d'agost).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. En data 24 de març de 2026, el Departament d'Inspecció Educativa va emetre un informe favorable sobre l'autorització de la implantació del pla pilot de batxillerat per a persones adultes, en la modalitat general, en règim presencial i en torn vespertí, al CEPA Pilar Benejam (Ciutadella), per al curs 2026-2027, que s'iniciaria amb el primer curs de batxillerat. Aquesta implantació queda condicionada a l'existència d'un mínim de matrícula d'alumnat que en faci viable l'oferta formativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. En data 1 d'abril de 2026, el Departament d'Inspecció Educativa va emetre un informe favorable sobre l'autorització de la implantació del batxillerat per a persones adultes al CEPA Pitiüses (Eivissa Vila), a partir del curs 2026-2027, en el qual es proposava el trasllat progressiu dels ensenyaments de batxillerat per a persones adultes (BAS) actualment impartits a l'IES Santa Maria, amb l'establiment d'un pla de transició que garanteixi la continuïtat de l'alumnat ja matriculat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. Així mateix, en data 1 d'abril de 2026, la Secció d'Ensenyament per a Persones Adultes de la Direcció General de Planificació i Gestió Educatives, amb el vistiplau de la directora general, va emetre un informe favorable per a l'autorització de la implantació del batxillerat per a persones adultes als centres CEPA Pilar Benejam i CEPA Pitiüses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En aquest informe es disposava que s'elaborarien unes instruccions específiques que regularien la implantació, l'organització i el funcionament d'aquests ensenyaments als centres esmentats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. Amb la finalitat de facilitar que les persones adultes puguin compatibilitzar la seva formació amb les responsabilitats professionals i familiars, i amb l'objectiu de donar resposta a la demanda existent d'aquesta modalitat d'ensenyament, es considera adient la implantació del batxillerat per a persones adultes als CEPA Pilar Benejam i CEPA Pitiüses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La implantació es durà a terme de manera progressiva, així s'iniciarà amb el primer curs de batxillerat en el curs 2026-2027, i s'adaptarà a les característiques i necessitats específiques de cada centre, d'acord amb els informes emesos pels òrgans competents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. El 15 d'abril de 2026, la cap del Departament de Planificació i Centres va emetre un informe favorable sobre l'autorització de la implantació del batxillerat per a persones adultes, en la modalitat general, als centres CEPA Pilar Benejam, de Ciutadella, i CEPA Pitiüses, d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;9. El 15 d'abril de 2026, la directora general de Planificació i Gestió Educatives va emetre una proposta de resolució sobre l'autorització de la implantació del batxillerat en la modalitat general, als centres CEPA Pilar Benejam, de Ciutadella, i CEPA Pitiüses, d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. L'Estatut d'autonomia de les Illes Balears, aprovat per la Llei orgànica 1/2007, de 28 de febrer (BOE núm. 52, d'1 de març), el qual estableix, en l'article 36.2, que, en matèria d'ensenyament, correspon a la Comunitat Autònoma de les Illes Balears la competència de desenvolupament legislatiu i d'execució de l'ensenyament en tota la seva extensió, nivells i graus, modalitats i especialitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. La Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (BOE núm. 159, de 4 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. La Llei orgànica 2/2006, de 3 de maig, d'educació (BOE núm. 106, de 4 de maig), modificada per la Llei orgànica 3/2020, de 29 de desembre (BOE núm. 340, de 30 de desembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. La Llei 1/2022, de 8 de març, d'educació de les Illes Balears, la qual estableix a l'article 102.1, la creació, la supressió i la transformació de centres públics correspon al Govern de les Illes Balears, que ha d'establir els tipus d'ensenyaments que s'hi desenvoluparan. (BOIB núm. 38, de 17 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. La Llei 4/2006, de 30 de març, d'educació i formació permanents de persones adultes de les Illes Balears (BOIB núm. 50, de 6 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. El Reial decret 243/2022, de 5 d'abril, pel qual s'estableixen l'ordenació i els ensenyaments mínims del batxillerat (BOE núm. 82 de 06 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. El Decret 85/2019, de 8 de novembre, d'ordenació dels ensenyaments de l'educació secundària per a les persones adultes (BOIB núm. 153, de 9 de novembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;9. El Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 91, de 14 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per tot això, d'acord amb la proposta formulada per la Direcció General de Planificació i Gestió Educatives, en data 15 d'abril de 2026, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. Autoritzar, amb efectes de l'inici del curs escolar 2026-2027, la implantació del batxillerat per a persones adultes, en la modalitat general, al CEPA Pitiüses (Eivissa Vila), que es durà a terme de manera progressiva, amb una unitat de primer curs el curs 2026-2027 i una unitat de segon curs el curs 2027-2028.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. Disposar que la implantació al CEPA Pitiüses es durà a terme mitjançant el trasllat progressiu dels ensenyaments de batxillerat per a persones adultes (BAS) actualment impartits a l'IES Santa Maria d'Eivissa, amb l'establiment d'un pla de transició que garanteixi la continuïtat de l'alumnat ja matriculat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. &lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;*S'impartiran o no, segons les necessitats d'escolarització del centre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. Inscriure i actualitzar aquestes autoritzacions en el Registre estatal de centres docents no universitaris (RCD) del Ministeri d'Educació, Formació Professional i Esports i en el Registre autonòmic de centres docents de la Conselleria d'Educació i Universitats (Repositori de centres).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. Comunicar aquesta Resolució als centres educatius, a la Direcció General de Personal Docent i Centres Concertats, al Departament de Gestió Econòmica de la Secretaria General de la Conselleria d'Educació i Universitats, al Departament d'Inspecció Educativa (DIE) i a la Secció d'Ensenyaments per a Adults de la Direcció General de Planificació i Gestió Educatives perquè en prenguin coneixement als efectes oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
