&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Es fa públic que el Ple del Consell Insular de Formentera en la sessió de dia 30 se març&amp;nbsp;de 2026, ha adoptat el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;3.3.- PRP2026/194. PROPOSTA DE LIMITACIÓ ACCÉS AS CALÓ DES MORT I ES RAM PER A L&amp;apos;ANY 2026&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;......&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Sotmès a votació de 16 (dels 17 membres que formen el Ple de la corporació), per més de la MAJORIA ABSOLUTA, amb la següent composició i votació: el vot a favor del president i dels 7 representants presents del grup polític Sa Unió de Formentera PP-Compromís (que formen l&amp;apos;equip de Govern); dels 4 representants presents del grup polític Gent x Formentera; dels 3 representants presents del grup polític PSIB-PSOE; i l&amp;apos;abstenció del Sr. Córdoba Marí, conseller no adscrit, adopta, sobre la base de la proposta transcrita, el següent&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;ACORD&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;JUSTIFICACIÓ (PART EXPOSITIVA)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PROPOSTA DE LIMITACIÓ ACCÉS AS CALÓ DES MORT I ES RAM PER A L&amp;apos;ANY 2026&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Vist el Pla de Mobilitat Sostenible de Formentera (BOIB núm. 65 de 14 de maig de 2019) que inclou com a les seves propostes (propostes 9.1.1 i 9.1.1.2.) la reorganització del disseny dels actuals i futurs estacionaments a les zones de platja i la delimitació dels límits dels camins i accessos a zones de platja.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Vista la Llei 7/2019, esmentada anteriorment, autoritza el Consell Insular a limitar temporalment l&amp;apos;afluència de vehicles a zones de valor natural, patrimonial o paisatgístic per evitar aglomeracions i danys ambientals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Vist els acords de regulació d&amp;apos;accés a les vies d&amp;apos;accés des Caló des Mort i es Ram que s&amp;apos;han aprovat durant els anys 2022-2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Informe&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;I. Descripció de l&amp;apos;entorn&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Es Caló des Mort és una petita cala situada al vessant de llebeig del massís de la Mola, entre l&amp;apos;embarcador de Es Ram i la platja de Es Copinar. Aquest indret es localitza a l&amp;apos;extrem oriental de la platja de Migjorn, en el punt on comencen els penya-segats característics de la zona de la Mola. Es tracta d&amp;apos;un espai de difícil accés, format per un talús rocós, una petita franja d&amp;apos;arena i aigües de gran transparència, amb un fons marí de composició mixta de roca i sorra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L&amp;apos;entorn es caracteritza per la presència d&amp;apos;escars —varadors artesanals tradicionals— i una pineda litoral que aporta un valor paisatgístic i ambiental rellevant. Les vistes panoràmiques que ofereix aquest indret contribueixen a la seva gran afluència de visitants, especialment durant els mesos d&amp;apos;estiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;II. Pressió turística i problemàtiques derivades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En els darrers anys, l&amp;apos;increment sostingut del nombre de visitants a aquesta zona ha derivat en una pressió turística significativa, amb conseqüències directes sobre la conservació del medi natural i la qualitat de l&amp;apos;experiència dels usuaris. Entre les principals problemàtiques detectades destaquen:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El deteriorament dels camins d&amp;apos;accés, especialment el camí d&amp;apos;arena utilitzat de manera intensiva durant l&amp;apos;estiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L&amp;apos;estacionament incontrolat de vehicles als marges del camí, afectant greument la vegetació i provocant danys irreversibles a l&amp;apos;entorn.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L&amp;apos;alteració dels valors ambientals i paisatgístics propis de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L&amp;apos;augment del risc en matèria de seguretat, dificultant l&amp;apos;accés de serveis d&amp;apos;emergència i la mobilitat dels residents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Amb l&amp;apos;objectiu d&amp;apos;afrontar aquesta situació, l&amp;apos;any 2017 el Consell Insular de Formentera va encarregar un informe tècnic per analitzar la viabilitat de limitar l&amp;apos;accés de vehicles a motor a la zona. El document resultant posava de manifest els efectes negatius derivats de la massificació i de l&amp;apos;ús inadequat del camí d&amp;apos;accés, assenyalant especialment el perjudici causat a la vegetació adjacent a causa de l&amp;apos;estacionament descontrolat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Així mateix, es constatava que l&amp;apos;estretor del camí i el volum de trànsit generaven conflictes de circulació, agreujats per la manca d&amp;apos;espais per a la maniobra o l&amp;apos;encreuament de vehicles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;III. Mesures adoptades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En base als informes i a les necessitats detectades, es varen implementar una sèrie de mesures orientades a regular la circulació i l&amp;apos;estacionament a la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Es permet l&amp;apos;accés de vehicles amb persones amb mobilitat reduïda fins a la zona immediata a la cala, per garantir-ne l&amp;apos;accessibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Es reserva l&amp;apos;accés i estacionament prioritari als vehicles d&amp;apos;emergències, protecció civil i cossos de seguretat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Els residents amb parcel·la privada poden continuar utilitzant els camins d&amp;apos;accés i estacionar-hi, en tot moment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Els titulars d&amp;apos;establiments comercials poden accedir-hi exclusivament per a operacions de càrrega i descàrrega.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Els vehicles de visitants únicament poden aturar-se per pujar o baixar passatgers, havent d&amp;apos;estacionar posteriorment en les zones habilitades a tal efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;D&amp;apos;acord amb el que estableix la normativa de trànsit, es defineix com a parada la immobilització del vehicle durant menys de dos minuts, sense que el conductor en descendeixi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;A fi de garantir el compliment d&amp;apos;aquestes mesures, es van dur a terme les següents actuacions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Instal·lació de senyalització que indica la prohibició d&amp;apos;estacionament i l&amp;apos;absència de sortida del camí d&amp;apos;accés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Senyalització dels punts de sobreample amb prohibició d&amp;apos;estacionar, per permetre l&amp;apos;encreuament de vehicles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Senyalització específica a les entrades de les finques particulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Instal·lació de sistemes de pal-corda per delimitar el perímetre i protegir la vegetació de les zones sensibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;A nivell normatiu, cal destacar que el Pla de Mobilitat Sostenible de Formentera, aprovat en sessió plenària de 21 de desembre de 2018 (BOIB núm. 65 de 14 de maig de 2019), preveu actuacions específiques per a la reorganització dels estacionaments i la delimitació dels camins d&amp;apos;accés a platges. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Igualment, la Llei 7/2019, esmentada anteriorment, autoritza el Consell Insular a limitar temporalment l&amp;apos;afluència de vehicles a zones de valor natural, patrimonial o paisatgístic per evitar aglomeracions i danys ambientals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Els Serveis Tècnics de Mobilitat constaten que, malgrat les mesures de senyalització i abalisament, segueixen produeixen incompliments reiterats per part dels visitants, arribant a trencar les proteccions instal·lades i estacionar sobre àrees naturals protegides. Aquesta situació va motivar l&amp;apos;acord del Ple del Consell Insular de l&amp;apos;any 2022, pel qual es varen establir restriccions específiques d&amp;apos;accés, estacionament i control per al període comprès entre l&amp;apos;1 de juny i el 20 de setembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L&amp;apos;informe de la Policia Local de data 19 d&amp;apos;abril de 2022 evidencia que, durant la temporada alta, continuen produint-se problemes de col·lapse viari a causa de l&amp;apos;estacionament indegut i de l&amp;apos;estretor dels camins. Aquests fets comprometen greument l&amp;apos;accés dels serveis d&amp;apos;emergència i afecten la mobilitat dels residents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Donada l&amp;apos;eficàcia d&amp;apos;aquestes mesures, i davant l&amp;apos;evidència que l&amp;apos;afluència de visitants continua sent elevada més enllà del període indicat, el Consell va acordar la seva ampliació temporal del 15 de maig al 15 d&amp;apos;octubre durant els anys 2023-2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;IV. Mesures per a l&amp;apos;any 2026&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En base a l&amp;apos;experiència acumulada, al present informe i l&amp;apos;informe de la Policia Local de 15 d&amp;apos;abril de 2024, es considera necessari mantenir i ampliar les mesures establertes en exercicis anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Permetre l&amp;apos;accés i estacionament als residents amb parcel·la privada dins la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Autoritzar únicament la parada per a la pujada o baixada de passatgers en el cas dels vehicles de visitants, els quals hauran d&amp;apos;estacionar fora del camí, a les zones habilitades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Mesures de senyalització i abalisament:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

 &lt;li&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Mantenir i, si cal, ampliar els sistemes de pal-corda per evitar la invasió de les zones naturals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Manteniment de zones d&amp;apos;estacionament:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Control i vigilància:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Conclusió&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Les problemàtiques persistents i els riscos associats a l&amp;apos;accés descontrolat a les zones de Es Caló des Mort i Es Ram justifiquen plenament el manteniment i ampliació de les mesures adoptades en exercicis anteriors. Per tot això, s&amp;apos;informa favorablement la proposta de manteniment i reforç de les restriccions d&amp;apos;accés i estacionament durant el període comprès entre el 15 de maig i el 15 d&amp;apos;octubre de 2026, així com la continuïtat de les mesures de control, senyalització i vigilància descrites anteriorment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;ANTECEDENTS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;I. Atès el Pla de Mobilitat Sostenible de Formentera (BOIB núm. 65 de 14 de maig de 2019) que inclou com a les seves propostes (propostes 9.1.1 i 9.1.1.2.) la reorganització del disseny dels actuals i futurs estacionaments a les zones de platja i la delimitació dels límits dels camins i accessos a zones de platja.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;II. Vists els acords de regulació d&amp;apos;accés a les vies d&amp;apos;accés des Caló des Mort i es Ram que s&amp;apos;han aprovat durant els anys 2022-2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;III. Vista la disposició d&amp;apos;inici de la vicepresidenta primera i Consellera de Mobilitat i Medi Ambient de 12 de març de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;IV. Atès l&amp;apos;informe de la tècnica de l&amp;apos;àrea de Mobilitat del Consell de Formentera de data 13 de març de 2026 on es proposa les següents mesures:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“En base a l&amp;apos;experiència acumulada, al present informe i l&amp;apos;informe de la Policia Local de 15 d&amp;apos;abril de 2024, es considera necessari mantenir i ampliar les mesures establertes en exercicis anteriors. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PRIMER.- Sobre la competència per regular l&amp;apos;accés i la publicitat de l&amp;apos;acord que s&amp;apos;aprovi.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Segons preveu l&amp;apos;article 9 de la Llei 7/2019, de 8 de febrer, per a la sostenibilitat mediambiental i econòmica de l&amp;apos; illa de Formentera, en endavant, LSMEIF, el Ple és competent per adoptar l&amp;apos;acord de regulació de les vies d&amp;apos;accés a es Caló des Mort i es Ram i l&amp;apos;acord que s&amp;apos;aprovi es publicarà al BOIB i es difondrà als mitjans de comunicació als efectes de publicitat: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“Article 9 Accés restringit a determinats espais &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. El Ple del consell insular, per tal d&amp;apos;evitar que es produeixin danys o aglomeracions en vies públiques o espais determinats amb valors naturals, patrimonials o paisatgístics, pot acordar limitar-hi temporalment l&amp;apos;afluència de vehicles de motor. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. L&amp;apos;acord corresponent s&amp;apos;ha de publicar en el Butlletí Oficial de les Illes Balears i ha de tenir una difusió adequada en els mitjans de comunicació.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;SEGON.- Sobre el contingut de la regulació.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La limitació prevista a l&amp;apos;article 9 de la LSMEIF, ha de ser, en tot cas, proporcional i necessària en relació al bé jurídic que es vol protegir. En aquest cas, la finalitat perseguida, que és la protecció de l&amp;apos;espai queda degudament fonamentada per el que exposa l&amp;apos;informe tècnic ja que fa referència a la saturació del terrenys afectats, situació aquesta acreditada segons els comptatges i observacions realitzades des de la pròpia àrea de Mobilitat del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Tenint en consideració també que el Pla de Mobilitat Sostenible de Formentera (BOIB núm. 65 de 14 de maig de 2019) inclou com a les propostes (propostes 9.1.1 i 9.1.1.2) la regulació de l&amp;apos;accés a les vies d&amp;apos;accés des Caló des Mort i es Ram tal com s&amp;apos;ha realitzat des de l&amp;apos;any 2017, es consideren correctes les mesures proposades pels serveis tècnics. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per l&amp;apos;anterior, s&amp;apos;informa favorablement a que el Ple del Consell Insular de Formentera reguli l&amp;apos;accés a les vies establertes, amb l&amp;apos;adopció de les actuacions que es recullen a l&amp;apos;informe tècnic de l&amp;apos;àrea de Mobilitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Tot això segons el meu lleial saber i entendre sense perjudici de superior criteri fonamentat en dret.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;(....)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Examinada la documentació que conforma l&amp;apos;expedient, atès l&amp;apos;article 82 del Reglament Orgànic del Consell Insular de Formentera (ROC) així com&amp;nbsp; l´article de 9.1 la Llei 7/2019, de 8 de febrer, per a la sostenibilitat mediambiental i econòmica de l&amp;apos;illa de Formentera, norma que disposa la competència del Ple, es proposa l&amp;apos;adopció del següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PART RESOLUTIVA&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PRIMER&lt;/strong&gt;.- Prendre, entre el 15 de maig i el 15 d&amp;apos;octubre de 2026, les següents determinacions en quant a les vies d&amp;apos;accés a les zones d&amp;apos;es Caló des Mort i es Ram:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Admetre l&amp;apos;accés de vehicles de o amb persones amb mobilitat reduïda per apropar-les a la zona d&amp;apos;accés directe a la cala. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Proporcionar als vehicles d&amp;apos;emergències, protecció civil i cossos de seguretat un accés ràpid a la zona d&amp;apos;accés directe a la cala. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Els veïns amb parcel·la privada per a l&amp;apos;estacionament podran seguir fent ús dels camins d&amp;apos;accés i estacionar en tot moment a la seva parcel·la. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Pels vehicles a motor de visitants autoritzar únicament l&amp;apos;aturada per baixar o pujar la resta de passatgers diferents del conductor, havent d&amp;apos;abandonar el vehicle els camins d&amp;apos;accés per estacionar en les zones habilitades a tal efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;SEGON&lt;/strong&gt;.- Adoptar o reforçar, entre el 15 de maig i el 15 d&amp;apos;octubre de 2026, les següents mesures de senyalització i abalisament:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Senyalitzar la prohibició d&amp;apos;estacionament i que el camí des Caló des Mort no té sortida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Senyalitzar la prohibició d&amp;apos;estacionament al camí des Ram.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- En ambdós camins, senyalitzar la prohibició d&amp;apos;estacionament en els sobreamples.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- En ambdós camins, senyalitzar la prohibició d&amp;apos;estacionament als accessos a les finques particulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Abalisament amb pal-corda del perímetre dels punts de sobreample o altres per protegir les zones vegetals de l&amp;apos;estacionament de vehicles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;TERCER&lt;/strong&gt;.- Mantenir les zones d&amp;apos;estacionament de turismes i motocicletes de l&amp;apos;àrea urbana des Copinar annexes al camí d&amp;apos;accés a es Caló des Mort.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;QUART&lt;/strong&gt;.- Facultar la policia local i els controladors d&amp;apos;estacionament regulat, en les vies d&amp;apos;accés a les zones d&amp;apos;es Caló des Mort i es Ram, pel control del compliment de les limitacions d&amp;apos;accés i estacionament, denuncia de les infraccions i la retirada del vehicle de la via i el seu dipòsit en el lloc que es designi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;CINQUÈ&lt;/strong&gt;.- Donar trasllat als organismes que poguessin veure&amp;apos;s afectats pel contingut del present acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;SISÈ.-&lt;/strong&gt; Publicar el present acord al BOIB i en el web del Consell Insular, per a general coneixement.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Formentera, amb la data de la signatura electrònica &lt;em&gt;(20 d&amp;apos;abril de 2026)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
