![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Antecedents</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Mitjançant Resolució de la consellera de Presidència i Administracions Públiques de 19 de desembre de 2023 es varen aprovar la convocatòria, les bases, els exercicis i temari, i el barem de mèrits de les proves selectives per a l'ingrés, pel torn lliure, als cossos de l'Administració especial de la Comunitat Autònoma de les Illes Balears (BOIB núm. 172, de 21 de desembre de 2023).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">2. En data 17 de març de 2026 es va publicar en el BOIB núm. 34 la Resolució de la consellera de Treball, Funció Pública i Diàleg Social per la qual s'aprova la llista d'aspirants que han superat les proves selectives per a l'ingrés, pel torn lliure, al cos facultatiu tècnic, escala humanística i ciències socials, especialitat tècnic en ocupació i mercat de treball, per a les illes de Mallorca i Menorca de l'Administració de la Comunitat Autònoma de les Illes Balears i s'ofereixen els llocs de feina.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Una vegada que les persones aspirants que han superat el procés selectiu, han presentat la sol·licitud i s'ha comprovat el compliment dels requisits, han de ser nomenades personal funcionari de carrera </span><span style="color:#000000"><span style="background-color:#ffffff">del cos facultatiu tècnic, escala humanística i ciències socials, especialitat tècnic en ocupació i mercat de treball d</span></span><span style="color:#000000">e l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fonaments de dret</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. La Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.</span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. L'article 5.2 de l'annex del Decret 31/2012, de 13 d'abril, pel qual s'aproven els Estatuts de l'Escola Balear d'Administració Pública.</span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">6. El Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears i posteriors modificacions.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7. La base 16 de la Resolució de la consellera de <span style="color:#000000">Presidència i Administracions Públiques de 19 de desembre de 2023 </span>per la qual s'aproven <span style="color:#000000">aprovar la convocatòria, les bases, els exercicis i temari, i el barem de mèrits de les proves selectives per a l'ingrés, pel torn lliure, als cossos de l'Administració especial de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Per tot això, dict la següent</span></span></p>

Adjudicar els llocs de treball, d'acord amb el que s'indica en l'annex d'aquesta Resolució, a les persones aspirants que han superat les <span style="color:#000000">proves selectives per a l'ingrés, pel torn lliure, al cos facultatiu tècnic, escala humanística i ciències socials, especialitat tècnic en ocupació i mercat de treball de l'Administració de la Comunitat Autònoma de les Illes Balears</span>, després d'haver presentat la documentació pertinent, d'acord amb la petició de destinació efectuada i la puntuació obtinguda en el procés selectiu. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. La presa de possessió s'ha d'efectuar en la conselleria corresponent, en el termini de tres dies hàbils comptadors a partir de l'endemà de la publicació d'aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Abans de prendre possessió del lloc adjudicat, la persona interessada haurà de fer constar que no ocupa cap lloc de treball ni que fa cap activitat en el sector públic de les que es comprenen en l'article 1 de la Llei 53/1984, de 26 de desembre, d'incompatibilitats del personal al servei de les administracions públiques.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Si fa alguna activitat privada, incloses les de caràcter professional, ho haurà de declarar en el termini de deu dies hàbils comptadors des de l'endemà de la presa de possessió, per tal que l'òrgan competent acordi la declaració de compatibilitat o d'incompatibilitat.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. Un cop publicat el nomenament, per adquirir la condició de funcionari de carrera s'ha d'efectuar el jurament o la promesa d'acatar la Constitució, l'Estatut d'Autonomia de la Comunitat Autònoma de les Illes Balears i l'ordenament vigent i prendre possessió en el termini reglamentari.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. Declarar desertes 1 plaça per a l'illa de Mallorca i 2 places per a l'illa d'Eivissa corresponents a l'oferta d'ocupació pública per a l'any 2021, objecte d'aquest procediment, ofertes en la convocatòria de les proves selectives per a l'ingrés, pel torn lliure, als cossos de l'Administració especial de la Comunitat Autònoma de les Illes Balears (BOIB núm. 172, de 21 de desembre de 2023).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En conseqüència, els llocs següents, vinculats a aquesta convocatòria, no s'han pogut cobrir amb persones que hagin superat aquest procés selectiu: </span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera <span style="color:#000000"><span style="background-color:#ffffff">de Treball, Funció Pública i Diàleg Social</span></span> en el termini d'un mes, comptador a partir del següent a la seva publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú, i l'article 57 de la Llei 3/2003, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p>
