&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 30 de juny de 2022, la Comissió Negociadora del Conveni col·lectiu de l'empresa Ajuntament d'Eivissa acordà la&amp;nbsp;modificació de l'article 37 del Conveni Col·lectiu per al personal laboral&amp;nbsp;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 03 de març de 2026, Gema Coronado Asencio en representació de la Comissió Negociadora del Conveni col·lectiu, sol·licità el registre, el dipòsit i la publicació del citat acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. L'article 90.3 del Text Refós de la Llei de l'Estatut dels Treballadors, aprovat pel Reial decret legislatiu 2/2015, de 23 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Reial decret 713/2010, de 28 de maig, sobre registre i dipòsit de convenis col·lectius, acords col·lectius de treball i plans d'igualtat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. L'article 45 de la Llei 39/2015, d'1 d'octubre, de Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dicto la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Inscriure i dipositar l'acord d'aprovació de la modificació de l'article 37 del Conveni Col·lectiu per al personal laboral de l'Ajuntament d'Eivissa de la Comissió Negociadora del Conveni col·lectiu de l'empresa Ajuntament d'Eivissa firmada el 30 de juny de 2022 en el Registre de Convenis col·lectius, Acords col·lectius de treball i Plans d'igualtat de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar l'acord en el &lt;em&gt;Butlletí Oficial dels Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Notificar aquesta Resolució a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; Atès que el conveni col·lectiu per al personal laboral d'aquest Ajuntament va ser aprovat per Ple de la Corporació de data 24 d'octubre de 2019 i es va publicar al Boib núm. 17, de data 15 d'octubre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; Atès que per tal de poder encomanar al Servei d'Ocupació de les Illes Balears (Soib) la tramitació d'ofertes d'ocupació quan es tracti de donar cobertura a contractacions urgents de personal no permanent, es requisit indispensable incloure tal possibilitat en el conveni col·lectiu per al personal laboral de l'Ajuntament d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.&lt;/strong&gt; Atès que l'article 37 dels convenis col·lectius per al personal del Patronat Municipal d'Esports d'Eivissa, del Patronat Municipal del Museu d'Art Contemporani d'Eivissa i del Patronat Municipal de Música d'Eivissa ja inclou la possibilitat d'encomanar al SOIB el procés de difusió de l'oferta genèrica d'ocupació per al cas de selecció de personal no permanent i sempre que no existeixin borses de treball en vigor o aquestes estiguessin esgotades, sense perjudici de garantir durant el procés els principis d'igualtat, mèrit i capacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Vist el certificat de l'acta de la Mesa de Negociació del personal laboral de l'Ajuntament d'Eivissa de la sessió celebrada el dia 9 de març de 2022, mitjançant la qual l'equip de govern i les dues organitzacions sindicals amb representació al Comitè d'empresa de personal laboral; UGT i CSI-F, han aprovat per unanimitat el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. A la vista dels antecedents assenyalats anteriorment es proposa al Ple de la Corporació el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMER.&lt;/strong&gt;- Modificar l'article 37 del conveni col·lectiu per al personal laboral de.l'Ajuntament d'Eivissa en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Allà on diu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;"Artículo 37. Provisión de vacantes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1&lt;/strong&gt;. Cuando se produzca la creación de un nuevo puesto de trabajo o una vacante producida por una jubilación, invalidez o cese del/de la trabajador/a o trabajadores/as, sin perjuicio de las atribuciones de la Alcaldía en la redistribución de efectivos y antes de proceder a su cobertura mediante contratación temporal se tendrán en cuenta las peticiones de movilidad personal, por lo que la dirección de personal tendrá abierto un registro permanente para presentar dichas solicitudes, que se presentarán en el registro general del Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2&lt;/strong&gt;. En el supuesto de existir varias peticiones, se resolverá mediante resolución motivada de Alcaldía, previo conocimiento y audiencia a las partes interesadas y de los representantes del personal laboral, pudiendo la representación legal de los/las trabajadores/as presentar informes al respecto."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ha de dir:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;" Artículo 37. Provisión de vacantes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En el caso de selección de personal no permanente, y siempre que no existan bolsas. de trabajo en vigor o estas estuvieran agotadas, se podrá encomendar al Servicio de Ocupación de las Illes Balears el proceso de difusión de la oferta genérica de ocupación, sin perjuicio de garantizar durante el proceso los principios de igualdad, mérito y capacidad.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGON&lt;/strong&gt;.- Autoritzar a la Sra. Gema Coronado Asencio en qualitat de tècnica de relacions laborals municipal, com a persona encarregada per efectuar les tramitacions administratives necessàries per a la seva inscripció en el registre de convenis davant l'autoritat laboral competent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Eivissa,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
