Mitjançant Resolució de la Presidència de l&amp;apos;IMAS de 5 de febrer de 2026 es va aprovar la llista definitiva de mèrits de les persones aspirants seleccionades del concurs oposició derivat del procés d&amp;apos;estabilització per formar part d&amp;apos;una borsa de treball específica de personal funcionari de l&amp;apos;escala d&amp;apos;Administració especial, subescala de serveis especials, classe personal d&amp;apos;oficis/operari-a, de l&amp;apos;especialitat de personal de serveis de l&amp;apos;Agrupació professional (BOIB núm. 20, de 12 de febrer de 2026).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Atès que en la Resolució de rectificació d&amp;apos;errors de la Resolució de la Presidència de l&amp;apos;IMAS de 3 de març de 2026,(BOIB núm. 31, de 10 de març de 2026) s&amp;apos;ha detectat una errada, en l&amp;apos;Annex amb la llista definitiva de la borsa específica de l&amp;apos;especialitat de Personal de serveis, on apareixen de forma errònia els noms de les persones aspirants Laura González Requena i Manuela Fernández Sánchez, en la llista de persones pel torn lliure, que cal esmenar i, incloure-les en la llista de persones pel torn de reserva per a persones amb discapacitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; L&amp;apos;article 109.2 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden rectificar en qualsevol moment, d&amp;apos;ofici o a instància de les persones interessades, els errors materials, de fet, o aritmètics existents en els seus actes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; L&amp;apos;article 7.2.13 dels Estatuts de l&amp;apos;IMAS, aprovats pel Ple del Consell de Mallorca, de dia 11 d&amp;apos;abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), s&amp;apos;indica que correspon a la Presidència convocar i resoldre els procediments de selecció, establir-ne les bases, els programes i el contingut de les proves i nomenar els membres dels òrgans de selecció. En conseqüència, també correspon a la Presidència resoldre les correccions d&amp;apos;errors de les resolucions sobre aquestes matèries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per tot això, dict la següent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Aquesta resolució no posa fi a la via administrativa i, contra aquesta, es pot interposar, d&amp;apos;acord amb l&amp;apos;article 28.1 dels Estatuts de l&amp;apos;IMAS aprovats per Acord del Ple del Consell de Mallorca d&amp;apos;11 d&amp;apos;abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d&amp;apos;alçada davant el Consell Executiu del Consell Insular de Mallorca, en el termini d&amp;apos;un mes comptador a partir de l&amp;apos;endemà de la notificació de la resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra la desestimació expressa del recurs d&amp;apos;alçada es podrà interposar recurs contenciós administratiu davant el jutjat contenciós administratiu, en el termini de dos mesos comptadors a partir de l&amp;apos;endemà de la notificació de la desestimació de l&amp;apos;esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra la desestimació per silenci del recurs d&amp;apos;alçada es podrà interposar recurs contenciós administratiu davant el jutjat contenciós administratiu, en qualsevol moment a partir de l&amp;apos;endemà de la desestimació presumpta (tres mesos des de la interposició del recurs sense que s&amp;apos;hagi notificat resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;No obstant això, es pot exercir qualsevol altre recurs que es consideri pertinent, d&amp;apos;acord amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
